  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30894\n\n                        Excepciona la aplicación de suspensión de recibir solicitudes para trámites\nmineros contenidos el el decreto  que Crea la Comisión de Evaluación y Diagnóstico de las\nActividades Geológicas y Mineras,  a solicitud del Ministerio Seguridad Pública\n\nTexto Completo acta: 5E8E8\nN° 30894-MINAE\n\nN° 30894-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\nCon fundamento en las atribuciones\nconferidas por los artículos 140 incisos 3) y 18) y 50 de la Constitución Política; el\nartículo 11 de la Ley de Biodiversidad, Nº 7788 del 27 de mayo de 1998; la Ley Orgánica\ndel Ambiente, Nº 7554 del 4 de octubre de 1995, el Código de Minería, Ley Nº 6797 del\n4 de octubre de 1982, el Decreto Ejecutivo Nº 30477-MINAE del 12 de junio del 2002 y la\nLey General de la Administración Pública, Nº 6227 de 2 de mayo de 1978.\n\nConsiderando:\n\n1°—Que el artículo 50 de la Constitución Política establece la\nobligación para el Estado de velar porque los ciudadanos disfruten de un ambiente sano y\necológicamente equilibrado.\n\n2°—Que el Código Minero dispone el dominio absoluto, inalienable\ne imprescriptible por parte del Estado, de todos los recursos minerales que se encuentren\nen el territorio nacional y en su mar patrimonial, cualquiera que sea su origen, estado\nfísico o naturaleza de las sustancias que contengan. Asimismo dispone que el Estado\nprocurará explotar las riquezas mineras por sí mismo o por medio de organismos que\ndependan de él, correspondiendo a la Dirección de Geología y Minas velar por la\ncorrecta aplicación de la legislación minera en las fases de tramitación de permisos o\nconcesiones, en su ejercicio o extinción, además de brindar un servicio geológico de\nestudio e investigación.\n\n3°—Que el Ministerio del Ambiente y Energía, por medio del\nDecreto Ejecutivo Nº 30646-MINAE publicado en el Diario Oficial La Gaceta Nº 166 del 30\nde agosto del 2002, con el interés de poner en ejecución un Plan de Modernización de la\nDirección de Geología y Minas, dar agilidad al servicio público y elevar la calidad de\nlos servicios, creó la Comisión de Evaluación y Diagnóstico de las Actividades\nGeológicas y Mineras de la Dirección de Geología y Minas del Ministerio del Ambiente y\nEnergía, compuesta por personal técnico, administrativo y legal de la Institución y de\notras organizaciones gubernamentales y no gubernamentales para que realicen la tarea de\nanálisis, diagnóstico y evaluación de las diferentes etapas que se desarrollan en esa\nDirección. Asimismo, se suspendió por un plazo de 4 meses a partir de la promulgación\nde ese Decreto, toda recepción de solicitudes de permisos y concesiones mineras ante la\nDirección de Geología y Minas. Se exceptuó de la aplicación del citado Decreto\nEjecutivo, las solicitudes de autorización que presenten la Comisión Nacional de\nEmergencias, las Municipalidades y el Ministerio de Obras Públicas y Transportes, por\ntratarse de interés público.\n\n4°—Que el día 25 de setiembre del 2002, el Ministerio de\nSeguridad Pública presenta ante la Dirección de Geología y Minas, una solicitud de\nextracción minera en el cauce del Río Sapoá y otros sitios de cantera, en el Cantón de\nLa Cruz, Provincia de Guanacaste, con el fin de abastecer de materiales la construcción\ndel proyecto \"Estación de Inspección para el control de drogas Peñas\nBlancas\", que es una obra pública, pagada por el Gobierno de los Estados Unidos de\nAmérica para ese Ministerio y aprobada por el Ministerio de Relaciones Exteriores, cuyas\nobras son de suma importancia y urgencia para combatir y controlar las actividades\nilícitas que se derivan por el trasiego, consumo y tenencia de drogas en la Frontera\nNorte. Siendo esta actividad que se promueve de interés público por tener repercusiones\ninmediatas en la sociedad costarricense y a nivel internacional, el Estado costarricense\ndebe abocarse a dar prioridad y agilidad a este tipo de solicitudes por las implicaciones\nsociales, económicas y de salud pública que conllevan. It also establishes that the State\nwill endeavor to exploit mineral wealth by itself or through organisms that\ndepend on it, with the Directorate of Geology and Mines (Dirección de Geología y Minas) being responsible for ensuring the\ncorrect application of mining legislation in the phases of processing permits or\nconcessions, in their exercise or extinction, in addition to providing a geological service of\nstudy and research.\n\n3.—That the Ministry of Environment and Energy (Ministerio del Ambiente y Energía), through\nExecutive Decree No. 30646-MINAE published in the Official Gazette La Gaceta No. 166 of August\n30, 2002, with the interest of implementing a Modernization Plan for the\nDirectorate of Geology and Mines, to provide agility to the public service and raise the quality of\nthe services, created the Commission for Evaluation and Diagnosis of Geological\nand Mining Activities of the Directorate of Geology and Mines of the Ministry of Environment and\nEnergy, composed of technical, administrative, and legal personnel from the Institution and\nother governmental and non-governmental organizations to carry out the task of\nanalysis, diagnosis, and evaluation of the different stages developed in that\nDirectorate. Likewise, all receipt of applications for mining permits and concessions before the\nDirectorate of Geology and Mines was suspended for a period of 4 months from the promulgation\nof that Decree. Exempted from the application of the cited Executive\nDecree were the authorization requests submitted by the National Emergency\nCommission (Comisión Nacional de Emergencias), the Municipalities, and the Ministry of Public Works and Transport (Ministerio de Obras Públicas y Transportes), as\nthey are matters of public interest.\n\n4.—That on September 25, 2002, the Ministry of\nPublic Security (Ministerio de Seguridad Pública) submitted to the Directorate of Geology and Mines an application for\nmining extraction in the channel of the Sapoá River and other quarry sites, in the Canton of\nLa Cruz, Province of Guanacaste, in order to supply materials for the construction\nof the project \"Peñas Blancas Drug Control Inspection Station\" (Estación de Inspección para el control de drogas Peñas Blancas),\nwhich is a public work, paid for by the Government of the United States of\nAmerica for that Ministry and approved by the Ministry of Foreign Affairs, whose\nworks are of utmost importance and urgency to combat and control the illicit\nactivities derived from the trafficking, consumption, and possession of drugs on the Northern\nBorder. As this activity being promoted is of public interest for having immediate\nrepercussions on Costa Rican society and internationally, the Costa Rican State\nmust address giving priority and agility to this type of request due to the social,\neconomic, and public health implications they entail. Therefore,\n\nDECREE:\n\nArticle 1.—To exempt from the application of the suspension of\nreceiving applications for mining procedures contained in Executive Decree No.\n30646-MINAE, published in the Official Gazette La Gaceta No. 166 of August 30, 2002,\nthe request submitted by the Ministry of Public Security on September 25,\n2002, for the construction of the project \"Peñas Blancas Drug Control Inspection Station,\" so that it may be processed and resolved by the\nadministrative authorities of the Directorate of Geology and Mines and the National\nEnvironmental Technical Secretariat (Secretaría Técnica Nacional Ambiental), due to the existence of a public interest and reasons of opportunity and\nconvenience for the Costa Rican State.\n\nArticle 2.—It shall be effective from its publication."
