  "body_en_text": "in the entirety of the text\n\n                    -\n\nComplete Text of Regulation 15\n\n                        Exempts the Ministry of Environment and Energy from the application of Article\n3 of Presidential Directive No. 1, so that it may request from the Budgetary Authority the\ncreation of the position corresponding to the post of Environmental Controller\n\nComplete Text of Record: 5F260\n\nEXECUTIVE BRANCH\n\nI\nNo. 015\n\nTHE FIRST VICE PRESIDENT\nEXERCISING THE PRESIDENCY OF THE REPUBLIC\nAND THE MINISTER OF FINANCE\n\nIn exercise of the powers conferred upon them by Articles 140, subsections 3), 7), 8), 18) and 20) and 146 of the Political Constitution; 4, 26, 27, 98, 100 and 113, subsection 2) of the General Law of Public Administration, the first paragraph of Article 21 of Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets, and Article 102 of Law No. 7554 of November 13, 1995.\n\nConsidering:\n\n1º—That the Organic Law of the Environment No. 7554, published in La Gaceta No. 215 of Monday, November 13, 1995, aims to provide Costa Ricans and the State with the necessary instruments to achieve a healthy and ecologically balanced environment.\n\n2º—That Article 102 of Law No. 7554 establishes the creation of the post of Environmental Controller, assigned to the Office of the Minister of Environment and Energy.\n\n3º—That as a result of the aforementioned Law, the Ministry of Environment and Energy is requesting the creation of the Environmental Controller position.\n\n4º—That Article 46 of Chapter X of the General Regulation of the Ministry of Environment and Energy, Executive Decree No. 30077-MINAE, published in La Gaceta No. 11 of Wednesday, January 16, 2002, establishes the functions corresponding to the post of Environmental Controller.\n\n5º—That Article 3 of Presidential Directive No. 1, published in La Gaceta No. 99 of May 24, 2002, establishes that the Budgetary Authority will not consider requests for the creation of positions during the 2002 budget period.\n\n6º—That the Ministry of Environment and Energy, in accordance with Article 102 of the Organic Law of the Environment No. 7554, requires the Environmental Controller position, which is why it is necessary to exempt it from the prior Presidential Directive, in order to request from the Budgetary Authority the creation of said position.
