(\"La tala ilegal en Costa Rica, un análisis\npara la discusión\", elaborado por el Centro Agro Económico Tropical de\nInvestigación y Enseñanza, CATIE).\n\n3º-Que la doctrina del derecho público,\nreconoce que el uso de una vía pública, al igual que sucede con el uso de los\ndemás bienes públicos, debe ser regulado sobre la base de requisitos derivados\nde la seguridad y sanidades públicas, así como por razones que conciernen al\nbuen régimen de la cosa pública o a su conservación.\n\n4º-Que la\nAdministración tiene la facultad general de reglamentación del uso de las vías\npúblicas.\n\n5º-Que se requiere un\ntiempo prudencial para que la Administración Forestal del Estado, ante el grave\nproblema de la tala ilegal, documentado por el estudio del CATIE antes\nreferido, diseñe y establezca un sistema institucional de control de la tala\nilegal.\n\n6º-Que la normativa\nlegal forestal vigente reconoce que la madera proveniente de plantaciones, por\nsus características de cultivo no requiere autorización para su transporte\nexcepto en lo que se refiere al Certificado de Origen o distintivos otorgados\npor el Ministerio de Ambiente y Energía por medio del Sistema Nacional de Áreas\nde Conservación.\n\n7º-Que existe un\ncomercio de madera aserrada entre los centros de abastecimiento y los sitios de\nuso, para diferentes fines como construcciones, reparaciones y remodelaciones\nque requieren que la madera pueda transitar durante toda la semana.\n\n8º-Que mediante Decreto\nEjecutivo Nº 30494-MINAE-MOPT-SP publicado en La Gaceta Nº 119 del 21 de junio\ndel 2002, el Poder Ejecutivo ha regulado el transporte de productos forestales\npor vías públicas terrestres, no obstante, se ha determinado la necesidad de\nmodificar parcialmente su contenido, para dar una mejor claridad en la\naplicación de esta norma. Para ese fin formará\nbrigadas de control a nivel central y regional. Éstas brigadas contarán con el\napoyo de todas las instituciones del Estado para el cumplimiento de los fines\nprevistos en esta norma.\n\nArtículo 4º-La madera\nproveniente del bosque sea escuadrada, en block o en troza y los medios de\ntransporte utilizados que circulen fuera de las horas autorizadas en esta\nnorma, quedarán a la orden de la autoridad competente instruida para este fin,\nhasta tanto no se verifiquen los documentos respectivos y la procedencia de la\nmadera, verificación que será llevada a cabo por las autoridades\nadministrativas competentes.\n\nArtículo 5º-La madera\nque no cuente con la respectiva documentación será decomisada por las\nautoridades correspondientes. También se decomisará el medio de transporte\nusado. Ambos serán puestos a la orden de las autoridades del Ministerio del\nAmbiente y Energía, quienes contarán con un plazo de hasta tres días para\nrealizar la respectiva investigación y si es del caso, ponerlos a la orden de\nla autoridad judicial competente.\n\nArtículo 6º-Las guías\nde transporte que emita la Administración Forestal del Estado para el\ntransporte de madera en troza o aserrada, no podrán tener una vigencia mayor de\ntres meses. Dichas guías no podrán ser renovadas, lo cual implicará realizar\nuna nueva solicitud, siendo esta debidamente justificada por parte del regente\ny del criterio razonado producto de una inspección al lugar, por parte de los\nfuncionarios de la Administración Forestal del Estado. Los regentes deberán\naportar copia de los documentos que autoricen o expidan ante la correspondiente\noficina subregional de la Administración Forestal del Estado.\n\nArtículo 7º-La\nAdministración Forestal del Estado deberá sistematizar la información\nproveniente de las actas elaboradas en estos casos, y de los demás documentos\npertinentes para elaborar un estudio general y determinar el impacto jurídico\nde la normativa vigente para fundamentar los cambios legislativos necesarios.\n\nArtículo 8º-El\nMinisterio del Ministerio del Ambiente y Energía evaluará el problema de la\ntala ilegal, en el territorio nacional y establecerá las medidas\nadministrativas para reducirla, así como recomendar los cambios en la\nlegislación vigente.\n\nArtículo 9º-La\nResolución N° R-SINAC-DG-010-2000 del Ministerio del Ambiente y Energía,\nSistema Nacional de Áreas de conservación, publicada en el Diario Oficial La\nGaceta Nº 143 del miércoles 26 de julio del 2000, continuará aplicándose en lo\nque no se regule en este decreto para el transporte de madera, indistintamente\ncual sea su procedencia.\n\nArtículo 10.-Rige a\npartir de su publicación.\n\nPubliquese.\n\nDado en la Presidencia\nde la República.-San José, a los cuatro días del mes de diciembre del dos mil\ndos.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 30918\n\n Reform Determines the necessary documents for the transportation of timber\non public land routes in the national territory\n\nComplete Text of act: 5F547\nDECREES\n\nNo.\n30918-MINAE-MOPT-SP\n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTERS OF THE\nENVIRONMENT AND ENERGY,\n\nAND OF PUBLIC WORKS AND\nTRANSPORTATION\n\nAND OF PUBLIC SECURITY\n\nBased on the\nprinciples and objectives established in articles 50, 140, subsections 3) and 18)\nand 146 of the Political Constitution, the Forestry Law (Ley Forestal) No. 7575 of February 13,\n1996; the provisions of the Organic Environmental Law No. 7554 of October 4,\n1995; the Biodiversity Law No. 7788 of April 30, 1998; the provisions\nof articles 100, 101 and related articles of the Law of Transit on Public Land\nRoutes No. 7331; and the provisions of the General Public Administration\nLaw No. 6227 of May 2, 1978.\n\nConsidering:\n\n1.-That it is an essential\nand priority function of the State to ensure the conservation, protection and\nadministration of natural forests and the production,\nharvesting, industrialization and promotion of the country's forest resources\ndestined for that purpose, in accordance with the principle of adequate and\nsustainable use of renewable natural resources.\n\n2.-That technical\nstudies indicate that 34% of the timber commercialized in the country\ncomes from illegal logging. (\"Illegal Logging in Costa Rica, an analysis\nfor discussion\", prepared by the Tropical Agricultural Research and Higher\nEducation Center, CATIE).\n\n3.-That the doctrine of public law\nrecognizes that the use of a public road, as with the use of\nother public goods, must be regulated based on requirements derived\nfrom public safety and health, as well as for reasons concerning the\ngood management of public property or its conservation.\n\n4.-That the\nAdministration has the general power to regulate the use of public\nroads.\n\n5.-That a\nprudent period of time is required for the State Forestry Administration (Administración Forestal del Estado), faced with the serious\nproblem of illegal logging, documented by the aforementioned CATIE study,\nto design and establish an institutional system for the control of illegal\nlogging.\n\n6.-That the current\nforestry legal regulations recognize that timber from plantations, due to\nits cultivation characteristics, does not require authorization for its transportation\nexcept with regard to the Certificate of Origin (Certificado de Origen) or distinctive marks granted\nby the Ministry of Environment and Energy through the National System of Conservation\nAreas.\n\n7.-That there is\ntrade in sawn timber between supply centers and sites of\nuse, for different purposes such as constructions, repairs and remodels,\nwhich require that timber can be in transit throughout the week.\n\n8.-That through Executive\nDecree No. 30494-MINAE-MOPT-SP published in La Gaceta No. 119 of June 21,\n2002, the Executive Branch has regulated the transportation of forest products\non public land routes; however, the need to\npartially modify its content has been determined, in order to provide greater clarity in the\napplication of this norm. For this end, they shall form\ncontrol brigades at the central and regional levels. These brigades shall have the\nsupport of all State institutions for the fulfillment of the purposes\nestablished in this norm.\n\nArticle 4.-Timber\nfrom the forest, whether squared, in block, or in log form, and the means of\ntransport used that circulate outside the hours authorized in this\nnorm shall be placed at the disposal of the competent authority appointed for this purpose,\nuntil the respective documents and the origin of the\ntimber are verified, verification that shall be carried out by the competent\nadministrative authorities.\n\nArticle 5.-Timber\nthat does not have the respective documentation shall be seized by the\ncorresponding authorities. The means of transport\nused shall also be seized. Both shall be placed at the disposal of the authorities of the Ministry of\nEnvironment and Energy, who shall have a period of up to three days to\ncarry out the respective investigation and, if applicable, place them at the disposal of\nthe competent judicial authority.\n\nArticle 6.-The transport guides\nissued by the State Forestry Administration for the\ntransportation of log or sawn timber may not have a validity period greater than\nthree months. Said guides may not be renewed, which shall entail making\na new request, with this being duly justified by the regent\nand by the reasoned criterion resulting from an on-site inspection by\nofficials of the State Forestry Administration. The regents must\nprovide a copy of the documents authorizing or issuing them before the corresponding\nsubregional office of the State Forestry Administration.\n\nArticle 7.-The\nState Forestry Administration must systematize the information\ncoming from the official reports prepared in these cases, and from the other pertinent\ndocuments, to prepare a general study and determine the legal impact\nof the current regulations to support the necessary legislative changes.\n\nArticle 8.-The\nMinistry of the Environment and Energy shall evaluate the problem of\nillegal logging in the national territory and shall establish the administrative\nmeasures to reduce it, as well as recommend changes in the\ncurrent legislation.\n\nArticle 9.-The\nResolution No. R-SINAC-DG-010-2000 of the Ministry of Environment and Energy,\nSistema Nacional de Áreas de Conservación, published in the Official Newspaper La\nGaceta No. 143 of Wednesday, July 26, 2000, shall continue to be applied in what\nis not regulated in this decree for the transportation of timber, regardless\nof its origin.\n\nArticle 10.-Effective\nupon its publication.\n\nLet it be published.\n\nGiven at the Presidency\nof the Republic.-San José, on the fourth day of December, two thousand\ntwo." }
