  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30988\n\n                        Reglamento de creación del Programa de voluntariado para las áreas\nsilvestres protegidas.\n\nTexto Completo acta: 90A57\nNº 30988-MINAE\n\nNº 30988-MINAE\n\n(Este Decreto fue Derogado por\nel artículo 22 del decreto ejecutivo N° 32443 del 1 de marzo del 2005)\n\n \n\nLA PRIMERA VICEPRESIDENTA EN EJERCICIO DE LA PRESIDENCIA DE LA\nREPÚBLICA Y EL MINISTRO DEL AMBIENTE Y ENERGIA\n\nEn uso de las facultades que les confieren los incisos 3) y 18) del\nartículo 140 de la Constitución Política; los artículos 1º, 2º, 4º, 6º, 34 y 35 de\nla Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995; y las leyes Nº 7575 Ley\nForestal del 16 de abril de 1996, Nº 6084 Ley de Parques Nacionales del 17 de agosto de\n1977, Nº 7317 Ley de Conservación de Vida Silvestre de 7 de diciembre de 1992 y sus\nrespectivos reglamentos; y\n\nConsiderando:\n\n1º—Que es deber del Estado procurar, dotar y realizar las\nacciones necesarias para garantizar a los costarricenses un ambiente sano y\necológicamente equilibrado. Y además debe defender y preservar el bienestar de todos los\nhabitantes de la Nación, lo que requiere entre otras cosas la protección del medio\nambiente.\n\n2º—Que el Estado debe fomentar la participación activa y\norganizada de los habitantes de la República, en las acciones tendientes a proteger y\nmejorar de manera sostenible el ambiente. Siendo responsabilidad del Sistema Nacional de\nÁreas de Conservación la administración, manejo y desarrollo de las Áreas Silvestres\nProtegidas, los servicios voluntarios para la conservación representan para el Sistema\nuna fuente importante e indispensable de apoyo para fortalecer la protección de los\nrecursos existentes en la áreas silvestres.\n\n3º—Que las acciones que se desarrollan por medio del voluntariado\nrequieren de una adecuada organización y estrecha coordinación con diferentes\ninstancias, instituciones u organizaciones, nacionales o internacionales. Por\ntanto,\n\nDECRETAN:\n\nReglamento de creación del Programa\nde Voluntariado para las Áreas Silvestres Protegidas\n\nCAPÍTULO I\n\nDel programa de voluntariado para las\náreas silvestres protegidas propiedad estatal\n\nArtículo 1º—Se crea el programa de\nvoluntariado para las Áreas Silvestres Protegidas auspiciado por el Ministerio de\nAmbiente y Energía, a través del Sistema Nacional de Áreas de Conservación, creado\npara apoyar las acciones de educación ambiental, protección, mantenimiento y\nconservación de los recursos existentes dentro de las Áreas.\n\nArtículo 2º-Existirá dentro de la Dirección del SINAC un Coordinador, responsable de la Ejecución\ndel Programa y será el enlace con las Organizaciones o Instituciones dedicadas a esta actividad,\nquien vigilará el correcto cumplimiento y aplicación del presente reglamento.\n\nCAPÍTULO II\n\nDe los y las integrantes del programa de voluntariado para las áreas silvestres protegidas propiedad\nestatal\n\nArtículo 3º-Este programa estará integrado por dos categorías de miembros:\n\na)   Ciudadanos y ciudadanas costarricenses.\n\nb)   Extranjeros y extranjeras que cumplan con todos los requisitos que las leyes costarricenses\nexigen para poder ingresar legalmente al país.\n\nArtículo 4º-Sus integrantes serán personas de probada solvencia moral y de reconocida honradez,\ndisciplina y compromiso con la causa conservacionista y ambientalista y con los principios de\ndesarrollo sostenible. Prestarán sus servicios ad-honoren, motivados (as) por el único interés de\ncoadyuvar en la protección y manejo de los recursos existentes en las áreas silvestres.\n\nArtículo 5º-Podrán ser nombrados (as) miembros de este programa las personas que cumplan con los\nrequisitos establecidos en el presente Reglamento y que sean mayores de edad. Una vez nombrados la\norganización que se encargue del reclutamiento de los voluntarios (as) deberá coordinar con la\nDirección del SINAC la elaboración de las identificaciones respectivas, adquiriendo así los\nrespectivos derechos y obligaciones inherentes a su condición. La vigencia del carnet de\nidentificación será de un año para los nacionales y residentes en el país; en caso de ciudadanos\n(as) extranjeros (as) será de acuerdo con el permiso de permanencia en el país otorgado por las\nAutoridades de Migración. No obstante, el mismo no podrá exceder de tres meses.\n\nLa Dirección del Área de Conservación respectiva se reserva el derecho de revocatoria del carnet de\ncomprobarse alguna de las causales contempladas en este Reglamento.\n\nArtículo 6º-A los efectos del inciso a), del artículo 3º, son requisitos para optar por la condición\nde miembro del Programa de Voluntariado para las Áreas Silvestres Protegidas, los siguientes:\n\na)   Ser costarricense o tener la condición de residente. o turista, en cuyo caso se deberá\naportarse el permiso de permanencia emitido por la Dirección de Migración y Extranjería.\n\nb)   Ser mayor de edad.\n\nc)   Llenar el formulario de solicitud que al efecto facilitará la Dirección de cada Área de\nConservación.\n\nd)   Concluir satisfactoriamente los aspectos de instrucción y prácticas que el Sistema Nacional de\nÁreas de Conservación determine.\n\ne)   Demostrar conocimiento de las disposiciones de este Reglamento.\n\nf)    Incorporarse al programa de voluntariado existente en cada Área de Conservación.\n\ng)   Costear de su propio patrimonio los gastos de traslado, alimentación o cualquier otro gasto\ndurante el tiempo que permanezca en el programa.\n\nh)   Contar con una póliza de riesgos del trabajo, que cubra como mínimo el tiempo que estará\nprestando los servicios dentro del programa.\n\nArtículo 7º-A los efectos del inciso b), del artículo 3º, son requisitos para optar por la condición\nde miembro del Programa de Voluntariado para las Áreas Silvestres Protegidas, los siguientes:\n\na)   Tener permiso de permanencia  en Costa Rica por un plazo mayor al de la vigencia del carné.\n\nb)   Haber cumplido con todos los requisitos migratorios que la legislación costarricense establece.\n\nc)   Contar con el respaldo de alguna institución extranjera: Universidad, ONG, o Estado, de\nreconocida solvencia moral, ética, social y económica.\n\nd)   Costear de su propio patrimonio los gastos de traslado, alimentación o cualquier otro gasto\ndurante el tiempo que permanezca en el programa.\n\ne)   Ser mayor de edad de conformidad con la legislación costarricense.\n\nf)    Llenar el formulario de solicitud que al efecto facilitará la Dirección de cada área de\nconservación.\n\ng)   Concluir satisfactoriamente los aspectos de instrucción y prácticas que el Sistema Nacional de\nÁreas de Conservación determine.\n\nh)   Demostrar conocimiento de las disposiciones de este Reglamento.\n\ni)    Incorporarse al programa de voluntariado existente en cada Área de Conservación.\n\nj)    Aportarse el permiso de Migración indicado en el artículo anterior.\n\nk)   Contar con una póliza de riesgos del trabajo, que cubra como mínimo el tiempo que estará\nprestando los servicios dentro del programa.\n\nArtículo 8º-Son deberes de los miembros del Programa de Voluntariado para las Áreas Silvestres\nProtegidas:\n\na)     Cumplir con las disposiciones legales vigentes, así como con las directrices que al efecto\ndicte el Sistema Nacional de Áreas de Conservación.\n\nb)     Colaborar con los funcionarios públicos competentes, en las labores de supervisión, aseo,\nornato, mantenimiento, cuidado y vigilancia de los recursos existentes dentro de las áreas\nsilvestres protegidas estatales.\n\nc)     Acatar las ordenes que le gire el Administrador del Área silvestre protegida correspondiente,\nsiempre y cuando se ajusten al ordenamiento jurídico y a este Reglamento.\n\nd)     Efectuar un informe semanal de las labores efectuadas, el cual deberá ser entregado al final\nde la semana al jefe de la respectiva Área Silvestre o a quién este en su lugar, para que sea este\nquién lo haga llegar al Director del Área de Conservación.\n\ne)     Notificar al respectivo jefe del Área Silvestre protegida de cualquier irregularidad cometida\npor funcionarios o particulares dentro de estas áreas.\n\nf)      Mantener en el ejercicio de la labor de miembro del programa, una actitud permanente de\nseriedad, prudencia y atención, así como de cortesía y amabilidad con sus compañeros de programa,\nlos funcionarios públicos y el público en general.\n\ng)     En caso de requerirse, deberá brindar testimonio fiel de todo cuanto hubiere visto, oído y\nactuado durante el tiempo que estuvo dentro del programa.\n\nh)     Cumplir fielmente las disposiciones de este Reglamento.\n\ni)      Tener hábitos de vida y una conducta personal acordes con los que el Estado exige a los\nfuncionarios públicos, así como tener principios acordes con la conservación y protección de los\nrecursos naturales y del ambiente.\n\nj)      Cooperar con las instituciones y organizaciones de la sociedad civil aledañas al Área\nSilvestre protegida, en la realización de actividades de concientización y de educación ambiental\nque permitan aumentar el apoyo de los y las ciudadanas al trabajo que realiza el programa.\n\nk)     Portar la debida identificación cuando se encuentre prestando servicio.\n\nl)      Solicitar quince días antes a su vencimiento la renovación del carné que lo acredita como\nmiembro del programa.\n\nArtículo 9º-Son derechos de los miembros del Programa de Voluntariado para las Áreas Silvestres\nProtegidas:\n\na)     Recibir capacitación y asesoría sobre las funciones en que coadyuvarán con los funcionarios\npúblicos, así como en protección de los recursos naturales existentes dentro del Área Silvestre\nProtegida.\n\nb)     Pedir informes de como realizar mejor su función al respectivo jefe del Área Silvestre\nProtegida.\n\nc)     Solicitar apoyo y colaboración a los funcionarios públicos del Área Silvestre Protegida para\npoder desempeñar eficazmente su función.\n\nd)     Recibir la debida identificación antes de ingresar a las Áreas.\n\nArtículo 10.-Queda prohibido a los miembros del Programa de Voluntariado para las Áreas Silvestres\nProtegidas:\n\na)   Actuar en contra de la legislación costarricense o las directrices que dicte el Sistema\nNacional de Áreas de Conservación, o del presente reglamento.\n\nb)   Asumir funciones propias de los funcionarios públicos.\n\nc)   Asumir funciones de autoridad de policía.\n\nCAPÍTULO III\n\nDe las organizaciones\n\nArtículo 11.-Toda organización nacional o internacional que pretenda realizar acciones, actividades\no proyectos relacionados con voluntariado en la Áreas Silvestres Protegidas bajo la administración\ndel Estado, deberá ser previamente autorizada por el SINAC, y desarrollarán sus acciones bajo el\nprincipio de igualdad de condiciones. Por lo tanto, ninguna organización o institución podrá\ndesarrollar sus acciones o utilizar los logos, nombres u otras identificaciones del MINAE o SINAC si\nno cuenta con convenido firmado con el MINAE y refrendado por la Contraloría General de la\nRepública.\n\nArtículo 12.-Toda Organización o institución que se dedique al reclutamiento de voluntarios, deberá\ncumplir con las siguientes obligaciones:\n\na)   Presentar al SINAC de previo a que sus miembros sean aceptados en el programa, la respectiva\ncopia de la solicitud de reclutamiento incluyendo foto, así como la evaluación de los rasgos de la\npersonalidad de los concursantes tanto nacionales como extranjeros.\n\nb)   b-Elaborar las identificaciones respectivas de cada miembro con los logotipos oficiales, a\nefecto de que las mismas sean firmadas por la Dirección del SINAC o la persona designada por ésta.\n\nc)   Deberán presentar un plan anual de trabajo a la Dirección del SINAC el primer día hábil del mes\nde Diciembre de cada año. Asimismo tendrán que presentar tres informes cuatrimestrales de avances y\nde labores en los meses de Abril, Agosto y Diciembre.\n\nd)   Cada Organización o Institución deberá contar con una póliza básica del Instituto Nacional de\nSeguros, que cubriría cualquier accidente que pudieran sufrir sus miembros.\n\ne)   Deberán cubrir los gastos de alimentación, transporte, en caso de que se requieran así como\ncualquier otra situación que se presente.\n\nf)    Mantener un registro actualizado de la nomina de todos los voluntarios (as) a nivel nacional\ncomo internacional, el cual será presentado al coordinador mensualmente.\n\ng)   Comunicar a la Dirección del SINAC la cancelación o suspensión de cualquier persona que integre\nla nomina de voluntarios inscritos.\n\nh)   Cancelar la membresía ante la organización cuando el SINAC lo solicite según los motivos\ndisciplinarios o de otra índole.\n\ni)    Capacitar a los voluntarios de cada organización sobre los objetivos y labores en que\ncoadyuvarán en las ASP, así como en lo relativo a sus derechos.\n\nj)    Acatar las disposiciones legales que rigen en materia legal y administrativa las Áreas\nSilvestres Protegidas, así como cualquier otra directriz que dicten en esta materia las Autoridades\nrespectivas.\n\nCAPÍTULO IV\n\nDe los bienes del Ministerio\n\nArtículo 13.-Para el uso de las instalaciones, equipo, propiedad del Ministerio, los voluntarios\npertenecientes a organizaciones o instituciones, deberán de previo contar con  un Convenio de\nCooperación suscrito al efecto con el Ministerio.\n\nArtículo 14.-Asimismo deberán de responder por el daño, pérdida, o extravío que ocasionen a dichos\nbienes.  En caso de reposición se contará de previo con un avalúo emitido por la oficina de\nPatrimonio del Ministerio.\n\nCAPÍTULO V\n\nDe la estructura del Programa de Voluntariado para las Áreas Silvestres Protegidas\n\n \n\nArtículo 15.-El Programa de Voluntariado para las Áreas Silvestres Protegidas, tendrá la siguiente\nestructura jerárquica:\n\na)   La Dirección del Sistema Nacional de Áreas de Conservación, será quién dicte las directrices a\naplicar en el programa, además de observar, implementar y aplicar este reglamento, para lo que podrá\nnombrar un coordinador nacional.\n\nb)   En cada Área de Conservación habrá un programa de voluntariado que se encargará de implementar\ny aplicar las directrices emanadas del SINAC, en cada una de las Áreas Silvestres Protegidas\nEstatales en donde existan miembros del programa. Estará a cargo del Director del Área o quién este\ndesigne.\n\nc)   En cada Área Silvestre Protegida Estatal donde exista uno o más miembro de este programa, el\nresponsable de la aplicación y observancia de este reglamento y las directrices dictadas por el\nSINAC a través de la dirección de Área de Conservación será el Administrador del Área Silvestre\nrespectiva.\n\nCAPÍTULO VII\n\nDe las faltas y sanciones\n\n \n\nArtículo 16.-Los y las integrantes del programa serán responsables por sus actos, respondiendo tanto\ncivil como penalmente por sus acciones o excesos en su trabajo.\n\nArtículo 17.-Son faltas que ameritan la exclusión del voluntario:\n\na)   Incumplimiento reiterado a los deberes y responsabilidades asumidas como miembro del programa.\n\nb)   Excederse en las atribuciones o potestades contempladas en este Reglamento.\n\nc)   Violar las disposiciones legales de cualquier naturaleza dentro del tiempo que permanezca como\nmiembro del programa.\n\nd)   Recibir dádivas, recompensas, favores o pagos de cualquier tipo, durante el tiempo que\npermanezca dentro del programa, y que pretendan que no asuma sus deberes y obligaciones como miembro\ndel programa.\n\ne)   Actuar bajo los efectos del licor u otras drogas ilegales durante la realización de sus\nfunciones dentro del programa.\n\nf)    Agredir verbal o físicamente a cualquier persona.\n\ng)   Retener ilegalmente o no reportar a la jefatura del Área Silvestre correspondiente, artículos u\nobjetos pertenecientes a los visitantes, a los funcionarios o a terceras personas y que hayan\nquedado perdidos u olvidados.\n\nArtículo 18.-En caso de expulsión, la misma será decretada por el Director del Sistema Nacional de\nÁrea s de Conservación, previo informe correspondiente del Director del Área de Conservación o del\nAdministrador del Área Silvestre Protegida.\n\nArtículo 19.-Además de lo dicho en el artículo anterior para aplicar la sanción respectiva, el\nórgano competente deberá tomar en consideración las circunstancias en que se dieron los hechos, las\nposibles reiteraciones a faltas anteriores y el tipo de falta que se cometió y con los principios de\nprudencia, proporcionalidad y racionalidad establezca la sanción que corresponda al hecho cometido.\n\nArtículo 20.-Se deroga el Decreto Ejecutivo Nº 19177-MIRENEM del 1 de agosto de 1989.\n\nArtículo 21.-Rige a partir de su publicación.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 30988\n\n                        Regulation creating the Volunteer Program for protected wild areas.\n\nFull Text acta: 90A57\nNº 30988-MINAE\n\nNº 30988-MINAE\n\n(This Decree was Derogated by\narticle 22 of executive decree N° 32443 of March 1, 2005)\n\n \n\nTHE FIRST VICE PRESIDENT IN EXERCISE OF THE PRESIDENCY OF THE\nREPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn use of the powers conferred by subsections 3) and 18) of\narticle 140 of the Political Constitution; articles 1, 2, 4, 6, 34 and 35 of\nthe Organic Environmental Law Nº 7554 of October 4, 1995; and laws Nº 7575 Forest Law\n(Ley Forestal) of April 16, 1996, Nº 6084 National Parks Law (Ley de Parques Nacionales) of August 17,\n1977, Nº 7317 Wildlife Conservation Law (Ley de Conservación de Vida Silvestre) of December 7, 1992 and their\nrespective regulations; and\n\nConsidering:\n\n1.—That it is the duty of the State to procure, provide and carry out the\nnecessary actions to guarantee Costa Ricans a healthy and\necologically balanced environment. And it must also defend and preserve the well-being of all\ninhabitants of the Nation, which requires, among other things, the protection of the environment.\n\n2.—That the State must encourage the active and organized\nparticipation of the inhabitants of the Republic, in actions aimed at protecting and\nimproving the environment in a sustainable manner. Being the responsibility of the National System of\nConservation Areas the administration, management and development of Protected Wild Areas,\nvoluntary services for conservation represent for the System\nan important and indispensable source of support to strengthen the protection of\nexisting resources in wild areas.\n\n3.—That the actions carried out through volunteering\nrequire adequate organization and close coordination with different\nbodies, institutions or organizations, national or international. Therefore,\n\nTHEY DECREE:\n\nRegulation creating the Volunteer\nProgram for Protected Wild Areas\n\nCHAPTER I\n\nOf the volunteer program for\nstate-owned protected wild areas\n\nArticle 1.—The volunteer\nprogram for Protected Wild Areas is created, sponsored by the Ministry of\nEnvironment and Energy, through the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), created\nto support environmental education, protection, maintenance and\nconservation actions of the resources existing within the Areas.\n\nArticle 2.—There shall exist within the Directorate of SINAC a Coordinator, responsible for the Execution\nof the Program and who shall be the liaison with the Organizations or Institutions dedicated to this activity,\nwho shall oversee the correct compliance and application of this regulation.\n\nCHAPTER II\n\nOf the members of the volunteer program for state-owned protected wild\nareas\n\nArticle 3.—This program shall be composed of two categories of members:\n\na)   Costa Rican citizens.\n\nb)   Foreigners who meet all the requirements that Costa Rican laws\ndemand to legally enter the country.\n\nArticle 4.—Its members shall be persons of proven moral standing and recognized honesty,\ndiscipline and commitment to the conservationist and environmental cause and to the principles of\nsustainable development. They shall provide their services on an honorary basis (ad-honorem), motivated solely by the interest of\ncontributing to the protection and management of resources existing in wild areas.\n\nArticle 5.—Persons who meet the\nrequirements established in this Regulation and who are of legal age may be appointed as members of this program. Once appointed, the\norganization responsible for recruiting volunteers must coordinate with the\nDirectorate of SINAC the preparation of the respective identifications, thus acquiring the\nrespective rights and obligations inherent to their condition. The validity of the identification card\nshall be one year for nationals and residents in the country; in the case of foreign\ncitizens, it shall be according to the permit to remain in the country granted by the\nImmigration Authorities. However, it may not exceed three months.\n\nThe Directorate of the respective Conservation Area reserves the right to revoke the card if\nany of the grounds contemplated in this Regulation are proven.\n\nArticle 6.—For the purposes of subsection a), of article 3, the requirements to be eligible for the condition\nof member of the Volunteer Program for Protected Wild Areas are the following:\n\na)   Be Costa Rican or have the condition of resident or tourist, in which case the\npermit of stay issued by the Directorate of Immigration and Foreign Affairs must be provided.\n\nb)   Be of legal age.\n\nc)   Complete the application form that the Directorate of each Conservation\nArea will provide for this purpose.\n\nd)   Satisfactorily conclude the instruction and practical aspects that the National System of\nConservation Areas determines.\n\ne)   Demonstrate knowledge of the provisions of this Regulation.\n\nf)    Join the existing volunteer program in each Conservation Area.\n\ng)   Cover from their own funds the costs of transportation, food or any other expense\nduring the time they remain in the program.\n\nh)   Have an occupational risk insurance policy that covers at least the time they will be\nproviding services within the program.\n\nArticle 7.—For the purposes of subsection b), of article 3, the requirements to be eligible for the condition\nof member of the Volunteer Program for Protected Wild Areas are the following:\n\na)   Have a permit to remain in Costa Rica for a period longer than the validity of the card.\n\nb)   Have fulfilled all the migratory requirements that Costa Rican legislation establishes.\n\nc)   Have the endorsement of some foreign institution: University, NGO, or State, of\nrecognized moral, ethical, social and economic standing.\n\nd)   Cover from their own funds the costs of transportation, food or any other expense\nduring the time they remain in the program.\n\ne)   Be of legal age in accordance with Costa Rican legislation.\n\nf)    Complete the application form that the Directorate of each conservation\narea will provide for this purpose.\n\ng)   Satisfactorily conclude the instruction and practical aspects that the National System of\nConservation Areas determines.\n\nh)   Demonstrate knowledge of the provisions of this Regulation.\n\ni)    Join the existing volunteer program in each Conservation Area.\n\nj)    Provide the Immigration permit indicated in the previous article.\n\nk)   Have an occupational risk insurance policy that covers at least the time they will be\nproviding services within the program.\n\nArticle 8.—The duties of the members of the Volunteer Program for Protected Wild\nAreas are:\n\na)     Comply with the legal provisions in force, as well as with the guidelines that for this purpose\nare issued by the National System of Conservation Areas.\n\nb)     Collaborate with competent public officials in the tasks of supervision, cleaning,\nornamentation, maintenance, care and surveillance of the resources existing within the\nstate-owned protected wild areas.\n\nc)     Obey the orders given by the Administrator of the corresponding protected wild area,\nprovided they conform to the legal system and this Regulation.\n\nd)     Prepare a weekly report of the work carried out, which must be delivered at the end\nof the week to the head of the respective Wild Area or to whoever acts in their place, so that the latter\nmay forward it to the Director of the Conservation Area.\n\ne)     Notify the respective head of the protected Wild Area of any irregularity committed\nby officials or private individuals within these areas.\n\nf)      Maintain, in the exercise of the work as a member of the program, a permanent attitude of\nseriousness, prudence and attentiveness, as well as courtesy and kindness with their program colleagues,\npublic officials and the general public.\n\ng)     If required, must provide faithful testimony of everything they may have seen, heard and\ndone during the time they were in the program.\n\nh)     Faithfully comply with the provisions of this Regulation.\n\ni)      Have life habits and personal conduct consistent with those that the State demands of\npublic officials, as well as have principles consistent with the conservation and protection of\nnatural resources and the environment.\n\nj)      Cooperate with the civil society institutions and organizations adjacent to the protected Wild\nArea, in carrying out awareness-raising and environmental education activities\nthat allow increasing the support of citizens for the work carried out by the program.\n\nk)     Carry the proper identification when providing service.\n\nl)      Request, fifteen days before its expiration, the renewal of the card that accredits them as a\nmember of the program.\n\nArticle 9.—The rights of the members of the Volunteer Program for Protected Wild\nAreas are:\n\na)     Receive training and advice on the functions in which they will assist public\nofficials, as well as on the protection of the natural resources existing within the Protected Wild\nArea.\n\nb)     Request reports on how to better perform their function from the respective head of the Protected Wild\nArea.\n\nc)     Request support and collaboration from the public officials of the Protected Wild Area in order\nto effectively perform their function.\n\nd)     Receive the proper identification before entering the Areas.\n\nArticle 10.—The members of the Volunteer Program for Protected Wild\nAreas are prohibited from:\n\na)   Acting against Costa Rican legislation or the guidelines issued by the National\nSystem of Conservation Areas, or against this regulation.\n\nb)   Assuming functions specific to public officials.\n\nc)   Assuming police authority functions.\n\nCHAPTER III\n\nOf the organizations\n\nArticle 11.—Any national or international organization that intends to carry out actions, activities\nor projects related to volunteering in the Protected Wild Areas under the administration\nof the State must be previously authorized by SINAC, and shall develop their actions under the\nprinciple of equal conditions. Therefore, no organization or institution may\ncarry out its actions or use the logos, names or other identifications of MINAE or SINAC if\nit does not have an agreement signed with MINAE and countersigned by the General Comptroller of the\nRepublic (Contraloría General de la República).\n\nArticle 12.—Any Organization or institution dedicated to the recruitment of volunteers must\ncomply with the following obligations:\n\na)   Submit to SINAC, before its members are accepted into the program, the respective\ncopy of the recruitment application including a photo, as well as the evaluation of the personality\ntraits of the candidates, both national and foreign.\n\nb)   Elaborate the respective identifications of each member with the official logos, so\nthat the same may be signed by the Directorate of SINAC or the person designated by it.\n\nc)   Must present an annual work plan to the Directorate of SINAC on the first business day of the month\nof December each year. Likewise, they must present three quadrimestrial progress and\nwork reports in the months of April, August and December.\n\nd)   Each Organization or Institution must have a basic insurance policy from the National Insurance\nInstitute (Instituto Nacional de Seguros), which would cover any accident that its members might suffer.\n\ne)   Must cover the costs of food, transportation, if required, as well as\nany other situation that may arise.\n\nf)    Maintain an updated record of the roster of all volunteers both nationally\nand internationally, which will be presented to the coordinator monthly.\n\ng)   Notify the Directorate of SINAC of the cancellation or suspension of any person on\nthe roster of registered volunteers.\n\nh)   Cancel the membership before the organization when SINAC so requests for disciplinary reasons\nor of another nature.\n\ni)    Train the volunteers of each organization on the objectives and tasks in which\nthey will assist in the Protected Wild Areas (ASP), as well as regarding their rights.\n\nj)    Comply with the legal provisions governing Protected\nWild Areas in legal and administrative matters, as well as any other guideline issued in this matter by the respective\nAuthorities.\n\nCHAPTER IV\n\nOf the Ministry's property\n\nArticle 13.—For the use of facilities, equipment, property of the Ministry, volunteers\nbelonging to organizations or institutions must previously have a Cooperation\nAgreement signed for this purpose with the Ministry.\n\nArticle 14.—Likewise, they must be liable for any damage, loss, or misplacement caused to said\nproperty. In the event of replacement, there must be a prior appraisal issued by the\nPatrimony office of the Ministry.\n\nCHAPTER V\n\nOf the structure of the Volunteer Program for Protected Wild Areas\n\n \n\nArticle 15.—The Volunteer Program for Protected Wild Areas shall have the following\nhierarchical structure:\n\na)   The Directorate of the National System of Conservation Areas shall be responsible for issuing the guidelines to\nbe applied in the program, in addition to observing, implementing and applying this regulation, for which it may\nappoint a national coordinator.\n\nb)   In each Conservation Area there shall be a volunteer program that shall be responsible for implementing\nand applying the guidelines issued by SINAC, in each of the State Protected\nWild Areas where there are members of the program. It shall be in charge of the Director of the Area or whoever they\ndesignate.\n\nc)   In each State Protected Wild Area where there is one or more members of this program, the\nperson responsible for the application and observance of this regulation and the guidelines issued by\nSINAC through the Conservation Area directorate shall be the Administrator of the respective Wild\nArea.\n\nCHAPTER VII\n\nOf offenses and sanctions\n\n \n\nArticle 16.—The members of the program shall be responsible for their acts, being liable both\ncivilly and criminally for their actions or excesses in their work.\n\nArticle 17.—Offenses warranting the exclusion of the volunteer are:\n\na)   Repeated non-compliance with the duties and responsibilities assumed as a member of the program.\n\nb)   Exceeding the attributions or powers contemplated in this Regulation.\n\nc)   Violating legal provisions of any nature during the time they remain as a\nmember of the program.\n\nd)   Receiving gifts, rewards, favors or payments of any kind, during the time they\nremain within the program, which intend that they not assume their duties and obligations as a member\nof the program.\n\ne)   Acting under the influence of liquor or other illegal drugs while carrying out their\nfunctions within the program.\n\nf)    Verbally or physically assaulting any person.\n\ng)   Illegally retaining or not reporting to the leadership of the corresponding Wild Area, articles or\nobjects belonging to visitors, officials or third parties that may have been\nlost or forgotten.\n\nArticle 18.—In the event of expulsion, it shall be decreed by the Director of the National System of\nConservation Areas, after the corresponding report from the Director of the Conservation Area or the\nAdministrator of the Protected Wild Area.\n\nArticle 19.—In addition to what is stated in the previous article, to apply the respective sanction, the\ncompetent body must take into consideration the circumstances in which the events occurred, the\npossible reiterations of previous offenses, the type of offense committed and, with the principles of\nprudence, proportionality and reasonableness, establish the sanction that corresponds to the act committed.\n\nArticle 20.—Executive Decree Nº 19177-MIRENEM of August 1, 1989, is repealed.\n\nArticle 21.—It takes effect upon its publication."
