A., cédula\njurídica 3-101130624. Que por continuar\ndesapareciendo de nuestro medio y por ende de nuestro planeta los bosques y las especies\nde vida silvestre esta categoría de manejo permite conservarlas y manejarlas, dentro de\nun desarrollo sostenible sirviendo a la vez como regulador ambiental, mediante la\nimplementación de un plan de manejo.\n\n4°—Que el propietario de dicho\ninmueble accede voluntariamente a incorporarse a este régimen de protección de Vida\nSilvestre, por un mínimo de diez años, comprometiéndose a no desarrollar ninguna\nactividad que comprometa la fragilidad de los diferentes ecosistemas existentes en la\nzona, sin contar con la correspondiente autorización del área de conservación Osa, del\nsistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía.\nAsimismo dará toda la colaboración necesaria para que los investigadores, inspectores de\nrecursos naturales y otros funcionarios del MINAE, visiten dichas áreas en cumplimiento\nde sus funciones.\n\n5°—El Área propuesta para Refugio está cubierta por\nbosque secundario en recuperación. Es un bosque rico en especies representativas del\nbosque tropical húmedo. Además limita en la mayor parte con la laguna Pejeperrito,\nhumedal de gran importancia ecológica en la zona.\n\n6°—Entre las especies de fauna de la zona se pueden\nencontrar algunos insectos importantes como son las mariposas (Heliconius sp), mariposa\nbuho (Caligo sp), hormigas azteca (Azteca sp), termitas (Nasutitermes sp), araña dorada\n(Nephila clavipes). La representación herpetológica se puede resumir en ranitas de\nvidrio (Centrolenella valeria y C. colymbaphylum) y el sapo venenoso (Dendrobatos\ngranuliferus), endémica de Costa Rica). Las aves más representativas son la lapa roja\n(Ara macao), el zopilote rey (Sarcoramphus papa), el gavilán blanco (Leucopternis\nalbicollis), paloma morada (Columba nigrirostris), tucán pico bicolor (Ramphastus\nswainsonii), cacique piccplata (Ambiycercus holosericeuis), sargento (Ramphocelus\npasserinii), gallina de monte (Tinamus major), martín peña (Tigrisoma mexicanum),\ngallito de agua (Jacana spinosa). También se aprecian el pechoamarillo o cristofue\n(Pitangus sulphuratus), y el gavilán cangrejero (B. Anthracinus). Entre los mamíferos se\nconoce la existencia de armadillos (Dasypus novemcinctus), los tepezcuintles (Agouti\npaca).\n\n7°—Que dicha área constituye un núcleo muy\nimportante para el manejo de los recursos naturales especialmente para la protección y\nconservación de especies de vida típicas de este tipo de ecosistema, formando un\ncorredor biológico entre el Parque Nacional Corcovado con otras Áreas Protegidas.\n\n8°—Que debido al estado actual de los Recursos\nNaturales de la Región y a la apertura nacional hacia la protección de las áreas\nsilvestres y a la biodiversidad de dicha región y debido a que es una zona de frecuentes\ny muy fuertes aguaceros, así como también el alto grado de erosión de suelos y aptos\nprincipales para la protección forestal, resulta ser un área muy frágil lo que hace\nnecesaria la preservación de la misma.\n\n9°—Que el manejo racional integrado de los Recursos\nNaturales, contribuye a satisfacer las necesidades Regionales para la investigación,\nrecreación, educación ambiental, así como el aprovechamiento de los recursos Naturales\nRenovables racionalmente.\n\n10°—Que la administración de Vida Silvestre y la\nrecomendación de medidas que aseguren la perpetuidad de las especies es función de la\nDirección General de Vida Silvestre del Ministerio del Ambiente y Energía.\n\n11°—Que en los estudios preliminares efectuados en la\nzona se ha recomendado la creación de un área silvestre protegida, para la protección\nde la biodiversidad, para brindar oportunidades para la investigación científica y la\nrecreación.\n\nPor tanto,\n\nDecretan:\n\nArtículo 1°—Se declara \"Refugio de Vida\nSilvestre Lagunazul Categoría Privado. That because forests and wildlife species\ncontinue disappearing from our environment and therefore from our planet,\nthis management category allows them to be conserved and managed, within\nsustainable development, serving at the same time as an environmental regulator, through\nthe implementation of a management plan (plan de manejo).\n\n4—That the owner of said\nproperty voluntarily agrees to be incorporated into this wildlife protection regime\nfor a minimum of ten years, committing not to develop any\nactivity that compromises the fragility of the different ecosystems existing in the\nzone, without the corresponding authorization from the Osa Conservation Area (Área de Conservación Osa), of the\nNational System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry of Environment and Energy (Ministerio del Ambiente y Energía).\nLikewise, it will provide all necessary collaboration so that researchers, inspectors of\nnatural resources, and other MINAE officials may visit said areas in fulfillment\nof their duties.\n\n5—The Area proposed for the Refuge is covered by\nsecondary forest in recovery. It is a forest rich in representative species of the\ntropical rainforest (bosque tropical húmedo). Furthermore, it borders for the most part on the Pejeperrito lagoon,\na wetland of great ecological importance in the zone.\n\n6—Among the fauna species of the zone, one can\nfind some important insects such as butterflies (Heliconius sp), owl butterfly\n(Caligo sp), Azteca ants (Azteca sp), termites (Nasutitermes sp), golden orb-weaver spider\n(Nephila clavipes). The herpetological representation can be summarized as glass frogs\n(Centrolenella valeria and C. colymbaphylum) and the venomous toad (Dendrobatos\ngranuliferus), endemic to Costa Rica). The most representative birds are the scarlet macaw\n(Ara macao), the king vulture (Sarcoramphus papa), the white hawk (Leucopternis\nalbicollis), the short-billed pigeon (Columba nigrirostris), the chestnut-mandibled toucan (Ramphastus\nswainsonii), the yellow-billed cacique (Ambiycercus holosericeuis), the scarlet-rumped tanager (Ramphocelus\npasserinii), the great tinamou (Tinamus major), the bare-throated tiger-heron (Tigrisoma mexicanum),\nthe northern jacana (Jacana spinosa). Also observed are the great kiskadee or \"cristofue\"\n(Pitangus sulphuratus), and the crab hawk (B. Anthracinus). Among mammals, the existence is known\nof armadillos (Dasypus novemcinctus) and pacas (Agouti\npaca).\n\n7—That said area constitutes a very important\nnucleus for natural resource management, especially for the protection and\nconservation of wildlife species typical of this type of ecosystem, forming a\nbiological corridor between Corcovado National Park and other Protected Areas.\n\n8—That due to the current state of the Natural\nResources of the Region and the national opening towards the protection of wild\nareas and the biodiversity of said region, and because it is a zone of frequent\nand very heavy downpours, as well as having a high degree of soil erosion and primary suitability\nfor forest protection, it turns out to be a very fragile area, which makes\nits preservation necessary.\n\n9—That the rational integrated management of Natural\nResources contributes to satisfying Regional needs for research,\nrecreation, environmental education, as well as the rationally managed use of Renewable Natural\nResources.\n\n10—That wildlife management and the\nrecommendation of measures that ensure the perpetuity of species is a function of the\nGeneral Directorate of Wildlife (Dirección General de Vida Silvestre) of the Ministry of Environment and Energy.\n\n11—That in the preliminary studies carried out in the\nzone, the creation of a protected wild area has been recommended for the protection\nof biodiversity, to provide opportunities for scientific research and\nrecreation.\n\nTherefore,\n\nThey decree:\n\nArticle 1—The \"Lagunazul Wildlife Refuge, Private Category\" (Refugio de Vida Silvestre Lagunazul Categoría Privado) is declared.
