serán liberados\".\n\n2°—Que el articulo 52 de la Ley No 7317, establece que: para el\nejercicio de la extracción de recolecta de la flora, se requiere de una licencia, que\nserá otorgada previa consulta con las autoridades y entidades científicas\ncorrespondientes.\n\n3°—Que el articulo 75 de la Ley No. 7317 establece que: \"no\nse permitirá la importación o la exportación de la fauna o la flora comprendida en los\napéndices I, II y III de la Convención sobre el Comercio Internacional de Especies\nAmenazadas de Fauna y Flora Silvestres, cuando la autoridad científica compruebe que esa\nimportación o exportación se efectúa en detrimento de la flora y de la fauna silvestre\nnacionales\".\n\n4°—Que el articulo 74 de la Ley NO. 7317 establece que:\n\"Poder Ejecutivo nombrará una o varias autoridades científicas, cuya función será\nla de suministrar la información científica, necesaria para el otorgamiento de los\npermisos o de los certificados de importación y exportación de la flora y la fauna\nsilvestres\".\n\n5°—Que se requiere incorporar modificaciones en las funciones y\nla estructura del Consejo de Representantes de las Autoridades Científicas de la\nConvención sobre el Comercio Internacional de Especies Amenazadas de Flora y Fauna\nSilvestres con el fin de cumplir con los citeriores mandatos.\n\nDECRETAN:\n\nArticulo 1°—Modifíquese el articulo 2° del Decreto la\nAutoridad Científica.\n\nb) Emitir dictámenes requeridos o formular recomendaciones a la Autoridad Administrativa, antes de\nque ésta emita su dictamen y expida los permisos o certificados, sobre la capacidad del destinatario\npara albergar y cuidar adecuadamente especímenes, vivos importados de especies incluidas en el\napéndice I y los introducidos procedentes del mar.\n\nc) Vigilar el estado de las poblaciones y recopilar información biológica de las especies nativas\nafectadas por el comercio y los datos sobre exportación a fin de recomendar medidas correctivas\neficaces, que limiten la exportación de especímenes a fin de mantenerlas en toda su área de\ndistribución en un nivel consistente\n\ncon la función que se desempeña en el ecosistema o bien por encima del nivel a partir del cual\npodrían reunir los requisitos de inclusión en el apéndice I.\n\nd) Informar a la autoridad administrativa, si las instituciones científicas que solicitan su\ninscripción en el Registro para obtener etiquetas de intercambio científico, cumplen o no los\ncriterios enunciados en la resolución 2,14 de la Conferencia de las Partes y en otras normas o\nprescripciones nacionales más estrictas.\n\ne) Que los dictámenes y asesoramientos para permisos de exportación de especies, que se encuentran\nincluidos en los apéndices se basen en análisis científicos de la información disponible sobre el\nestado, la distribución y las tendencias de la población, la recolección y otros factores biológicos\ny ecológicos según proceda y en la información sobre el comercio de las especies de que se trate.\n\nf) Examinar todas las solicitudes presentadas en virtud de los párrafos 4 y 5 del articulo VIl de la\nconvención, e informar a la autoridad administrativa si el establecimiento solicitante cumple los\ncriterios para producir especímenes que se consideren criados en cautividad o reproducidos\nartificialmente con arreglo a la convención y las resoluciones pertinentes.\n\ng) Compilar y analizar información sobre la situación biológica de las especies afectadas por el\ncomercio a fin de facilitar la preparación de las propuestas necesarias para enmendar los apéndices.\n\nh) Analizar las propuestas de enmienda a los apéndices presentadas por otras partes y formular\nrecomendaciones acerca de la posición que la delegación nacional deba asumir al 2003.\n\nNo 28522-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn the exercise of the powers contained in article 140 subsections\n3) and 18) of the Political Constitution; articles 3°, 4°, 13, 17 and 74 of the Wildlife Conservation Law (Ley de Conservación de Vida Silvestre) No 7317 and Law No. 5605, Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES),\n\nConsidering:\n\n1°—That Law No. 7317, Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre)\nestablishes in article 47 that: \"The release of fauna that: for the\nexercise of extraction through the collection of flora, a license is required, which\nshall be granted after prior consultation with the corresponding authorities and scientific\nentities.\n\n3°—That article 75 of Law No. 7317 establishes that: \"the\nimport or export of fauna or flora included in\nAppendices I, II and III of the Convention on International Trade in Endangered\nSpecies of Wild Fauna and Flora shall not be permitted when the Scientific Authority verifies that said\nimport or export is carried out to the detriment of national wild flora and fauna\".\n\n4°—That article 74 of Law NO. 7317 establishes that:\n\"The Executive Branch shall appoint one or several Scientific Authorities, whose function shall\nbe to supply the scientific information necessary for the granting of\npermits or certificates for the import and export of wild flora and fauna\".\n\n5°—That it is necessary to incorporate modifications in the functions and\nthe structure of the Council of Representatives of the Scientific Authorities of the\nConvention on International Trade in Endangered Species of Flora and Fauna\nWildlife (Convención sobre el Comercio Internacional de Especies Amenazadas de Flora y Fauna Silvestres) in order to comply with the aforementioned mandates.\n\nDECREE:\n\nArticle 1°—Amend article 2° of Executive Decree\nNo. reads as follows:\n\nThe functions of the Council of Representatives of the Scientific Authorities shall be the following:\n\na) To recommend that the import, export, and introduction from the sea of\nspecimens of wild flora and fauna that are included in the CITES appendices does\nnot pose any danger to national populations or will not harm their\nsurvival, and to exempt re-export certificates that do not require the advice of the\nScientific Authority.\n\nb) To issue required opinions or formulate recommendations to the Administrative Authority, before\nit issues its opinion and issues permits or certificates, on the capacity of the recipient\nto house and properly care for live imported specimens of species included in\nAppendix I and those introduced from the sea.\n\nc) To monitor the status of populations and compile biological information on native species\naffected by trade and export data in order to recommend effective corrective\nmeasures, which limit the export of specimens in order to maintain them throughout their entire\ndistribution area at a level consistent\n\nwith the function they perform in the ecosystem or well above the level from which\nthey could meet the requirements for inclusion in Appendix I.\n\nd) To inform the administrative authority whether or not the scientific institutions that request their\nregistration in the Registry to obtain scientific exchange labels meet the\ncriteria stated in Resolution 2.14 of the Conference of the Parties and in other more stringent national standards or\nrequirements.\n\ne) That the opinions and advice for export permits for species that are\nincluded in the appendices be based on scientific analyses of the available information on the\nstatus, distribution, and population trends, the collection, and other biological\nand ecological factors as appropriate, and on the information on the trade of the species in question.\n\nf) To examine all applications submitted under paragraphs 4 and 5 of Article VII of the\nconvention, and to inform the administrative authority whether the applicant establishment meets the\ncriteria to produce specimens considered to be bred in captivity or artificially\nreproduced in accordance with the convention and the relevant resolutions.\n\ng) To compile and analyze information on the biological status of species affected by\ntrade in order to facilitate the preparation of the necessary proposals to amend the appendices.\n\nh) To analyze the proposals for amending the appendices submitted by other parties and to formulate\nrecommendations on the position that the national delegation should take on the matter.\n\ni) To issue a criterion regarding the proposals and projects for the reintroduction of wild flora and\nfauna species that are or are not included in the CITES appendices.\n\nj) To issue a criterion regarding the release throughout the national territory of animals from\ncaptive breeding, plants reproduced in nurseries,
