  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31286\n\n                        Impone Servidumbre de Acueducto sobre el Inmueble ubicado en la Provincia de\nCartago, Cantón El Guarco, Distrito Tobosi.\n\nTexto Completo acta: 69126\nNº 31286-G\n\nNº 31286-G\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE GOBERNACIÓN Y POLICÍA\n\nCon fundamento en el artículo 146 de la Constitución Política, los artículos 99 y siguientes de la\nLey de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas y el artículo 383 y siguientes del\nCódigo Civil y,\n\nConsiderando:\n\n1º-Que el Ministerio del Ambiente y Energía, mediante resolución Nº R-347-Aguas-MINAE, de las trece\nhoras y treinta minutos del veinticinco de setiembre del dos mil uno, otorgó concesión de\naprovechamiento de aguas a la Municipalidad de El Guarco, a partir de esa fecha, y por el plazo de\nquince años para el aprovechamiento de aguas de uso doméstico durante todo el año, las veinticuatro\nhoras del día, en una cantidad de 20 litros por segundo, que se tomarán de una naciente, efectuando\nla captación en propiedad de los señores Arnulfo y Gilberto ambos de apellidos Navarro Cordero,\nconduciéndola por medio de tubería hasta el sitio del aprovechamiento.\n\n2º-Que la Municipalidad de El Guarco presentó solicitud de imposición de servidumbre de acueducto\nante el Ministerio de Gobernación y Policía de conformidad con la Ley de Aguas Nº 276 del 27 de\nagosto de 1942 y sus reformas.\n\n3º-Que mediante resolución 759-2002 ALG de las 9:00 horas del 5 de mayo del 2003, dictada por la\nDirección de Asesoría Jurídica del Ministerio de Gobernación y Policía procedió a poner en\nconocimiento de las partes interesadas, el informe rendido por el perito valuador del Ministerio de\nHacienda, sobre el monto de la indemnización correspondiente a los propietarios del fundo sirviente\nseñores Arnulfo y Gilberto ambos de apellidos Navarro Cordero, el cual fue cancelado mediante\ndepósitos judiciales en la cuenta corriente del Juzgado Civil de Mayor Cuantía de Cartago Nº\n001-23614-4 del Banco de Costa Rica, boletas Nos. 0436579 B y 0436580 B por un monto exacto de\ncuatrocientos treinta y tres mil setecientos tres colones sin céntimos, cada uno de los depósitos,\nsiendo el monto total de la suma de ochocientos sesenta y siete mil cuatrocientos seis colones\nexactos a favor de los copropietarios.\n\n4º-Que de conformidad con los estudios realizados por este Ministerio y la concesión de\naprovechamiento de aguas otorgada mediante resolución Nº R-347-Aguas-MINAE de las 13:30 horas del 25\nde setiembre del 2001, leyes precitadas y artículo 383 y siguientes del Código Civil, procede\ndecretar la constitución de la correspondiente servidumbre de acueducto.\n\nDecretan:\n\nArtículo 1º-Imponer servidumbre de acueducto por el término de quince años según los términos de la\nconcesión sobre el inmueble inscrito en el Registro de la Propiedad, partido de Cartago, Folio Real\nmatrícula veintinueve mil setecientos cincuenta cero, cero, cero, naturaleza: terreno de pastos y\nmontaña, ubicada en la provincia de Cartago, cantón El Guarco, distrito Tobosi. Linderos actuales:\nnorte, Marvin y Javier ambos Cordero Navarro; sur, Germán Ceciliano Navarro y en parte camino\npúblico con un frente de ciento treinta y cinco metros con cincuenta y ocho decímetros; este, camino\npúblico con un frente de quinientos veintitrés metros con treinta y un decímetros, y oeste, camino\npúblico con un frente de ciento diecinueve metros diecisiete decímetros. Mide noventa mil\nochocientos metros cuadrados. La finca anteriormente descrita pertenece por partes iguales a Arnulfo\ny Gilberto ambos de apellidos Navarro Cordero, el primero con cédula de identidad número tres-\ndoscientos ochenta y cuatro-setecientos treinta y siete, y el segundo con cédula de identidad número\ntres-doscientos cuarenta y ocho-cuatrocientos cincuenta y uno.\n\nArtículo 2º-Descripción de la servidumbre: se localiza a 60 metros vértice sureste, inicia desde el\ncamino público y se extiende hasta el sitio de captación de la Quebrada Guaba y cercana a la\ncolindancia norte de la finca sirviente, tal como lo indica el plano catastrado Nº 3-0833080-2002 y\nverificado en la inspección de campo, atraviesa parte de la finca de este a oeste. De acuerdo al\nplano catastrado de referencia, tiene una longitud de 273,00 metros y ancho de 4 metros, lo cual\nrepresenta un área total de 1.096,00 metros cuadrados. La tubería utilizada será de conducción de agua potable que deberá ir\nenterrada, de manera que no cause ningún problema a la agricultura y ganado, para efectos de\naprovechar las características topográficas del terreno y la pendiente natural del mismo. La\nMunicipalidad de El Guarco deberá construir obra calibradora por medio de llave de paso, según las\nnormas, diseños y reglamentos del Ministerio del Ambiente y Energía para estos casos.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 31286\n\n                        Imposes an aqueduct easement (servidumbre de acueducto) on the Property located in the Province of\nCartago, Canton El Guarco, District Tobosi.\n\nFull Text record: 69126\nNº 31286-G\n\nNº 31286-G\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF GOVERNANCE AND POLICE\n\nBased on Article 146 of the Political Constitution, Articles 99 and following of\nLey de Aguas Nº 276 of August 27, 1942 and its amendments, and Article 383 and following of the\nCivil Code, and,\n\nConsidering:\n\n1º-That the Ministry of Environment and Energy, through resolution Nº R-347-Aguas-MINAE, at thirteen\nhours and thirty minutes on September twenty-fifth, two thousand one, granted a water use concession (aprovechamiento de aguas) to the Municipality of El Guarco, as of that date, and for a term of\nfifteen years for the use of water for domestic use throughout the year, twenty-four\nhours a day, in a quantity of 20 liters per second, to be taken from a spring (naciente), with the\nintake (captación) on property belonging to Messrs. Arnulfo and Gilberto, both with the surnames Navarro Cordero,\nconveying it by pipeline to the site of use.\n\n2º-That the Municipality of El Guarco filed a petition for imposition of an aqueduct easement (servidumbre de acueducto)\nwith the Ministry of Governance and Police in accordance with Ley de Aguas Nº 276 of August\n27, 1942 and its amendments.\n\n3º-That through resolution 759-2002 ALG at 9:00 hours on May 5, 2003, issued by the\nLegal Advisory Directorate of the Ministry of Governance and Police, it proceeded to make known\nto the interested parties the report rendered by the expert appraiser of the Ministry of\nFinance, regarding the amount of compensation corresponding to the owners of the servient tenement (fundo sirviente),\nMessrs. Arnulfo and Gilberto, both with the surnames Navarro Cordero, which was paid through\njudicial deposits in the checking account of the Civil Court of Greater Amount of Cartago Nº\n001-23614-4 of Banco de Costa Rica, slips Nos. 0436579 B and 0436580 B for the exact amount of\nfour hundred thirty-three thousand seven hundred three colones and zero céntimos, for each deposit,\nthe total amount being the sum of eight hundred sixty-seven thousand four hundred six colones\nexact in favor of the co-owners.\n\n4º-That in accordance with the studies conducted by this Ministry and the water use concession (concesión de\naprovechamiento de aguas) granted through resolution Nº R-347-Aguas-MINAE at 13:30 hours on September\n25, 2001, the aforementioned laws, and Article 383 and following of the Civil Code, it is appropriate\nto decree the constitution of the corresponding aqueduct easement (servidumbre de acueducto).\n\nDecree:\n\nArticle 1º-To impose an aqueduct easement (servidumbre de acueducto) for the term of fifteen years according to the terms of the\nconcession on the property registered in the Property Registry, Cartago district, Folio Real\nnumber twenty-nine thousand seven hundred fifty-zero, zero, zero, nature: pasture and mountain land,\nlocated in the province of Cartago, canton El Guarco, district Tobosi. Current boundaries:\nnorth, Marvin and Javier, both Cordero Navarro; south, Germán Ceciliano Navarro and in part a public\nroad with a frontage of one hundred thirty-five meters and fifty-eight decimeters; east, public\nroad with a frontage of five hundred twenty-three meters and thirty-one decimeters; and west, public\nroad with a frontage of one hundred nineteen meters and seventeen decimeters. It measures ninety thousand\neight hundred square meters. The farm previously described belongs in equal parts to Arnulfo\nand Gilberto, both with the surnames Navarro Cordero, the first with identity card number three-\ntwo hundred eighty-four-seven hundred thirty-seven, and the second with identity card number\nthree-two hundred forty-eight-four hundred fifty-one.\n\nArticle 2º-Description of the easement (servidumbre): it is located 60 meters from the southeast vertex, starting from the\npublic road and extending to the intake (captación) site on the Quebrada Guaba and near the\nnorthern boundary of the servient tenement (fundo sirviente), as indicated on cadastral map Nº 3-0833080-2002 and\nverified in the field inspection. It crosses part of the farm from east to west. According to the\nreferenced cadastral map, it has a length of 273.00 meters and a width of 4 meters, which\nrepresents a total area of 1,096.00 square meters. It is located on the existing internal road,\nproperly formed and compacted, which at the time served as access to the intake (captación)\nsite. It is ballast and earth in fair condition, and it also constitutes the only road\nof the servient tenement (inmueble sirviente). The pipeline used will be for drinking water conveyance and must be\nburied, so as not to cause any problem to agriculture and livestock, in order to\ntake advantage of the topographic characteristics of the land and its natural slope. The\nMunicipality of El Guarco must build a measuring device by means of a shut-off valve, according to the\nnorms, designs, and regulations of the Ministry of Environment and Energy for these cases. The easement (servidumbre)\nshall be exercised on foot or by means of transport, including heavy machinery.\n\nArticle 3º-The compensation is set at the sum of eight hundred sixty-seven thousand four hundred\nsix colones exact (¢867,406.00), which has already been paid by the Municipality of El Guarco, through\njudicial deposit in the checking account of the Civil Court of Greater Amount of Cartago, Nº\n001-23614-4, slips Nos. 0436579 B and 0436580 B, in favor of Messrs. Arnulfo and Gilberto, both\nwith the surnames Navarro Cordero, owners of the servient tenement (fundo sirviente), according to the registration citations already\nindicated.\n\nArticle 4º-This Executive Decree becomes effective upon its publication.\n\nGiven at the Presidency of the Republic.-San José, on the thirteenth day of June of two thousand\nthree."
