el artículo 45 de la Ley Nº 7384 de 16 de marzo de 1994, se establece el beneficio\npara el Sector Pesquero Nacional, de adquirir de RECOPE el combustible (gasolina y diesel), para la\nactividad de pesca no deportiva, a un precio competitivo con el precio internacional.\n\n2º-Que a pesar de que en el artículo supracitado, se establecen los parámetros o metodología para\nconsiderar la fijación del precio de dichos combustibles, la norma no es lo suficientemente clara y\nsu interpretación para efectos de su aplicación podría generar dudas, en razón de que no ha sido\ndesglosado o reglamentado.\n\n3º-Que en atención a lo indicado y por razones de oportunidad, conveniencia y razonabilidad, se hace\nnecesario establecer dicha regulación.\n\n4º-Que el artículo 49 de la citada Ley Nº 7384, del 16 de marzo de 1994, reafirma la potestad\nreglamentaria que en general le compete al Poder Ejecutivo, lo mismo que para esta Ley en\nparticular. Por tanto:\n\nDecretan:\n\nEl siguiente:\n\nReglamento al Artículo 45 de la Ley Número 7384\n\nSobre el Otorgamiento de Combustible para el\n\nSector Pesquero no Deportivo\n\nArtículo 1º-En cumplimiento a lo dispuesto en el artículo 45 de la Ley Nº 7384 de 16 de marzo de\n1994, RECOPE venderá el combustible (gasolina regular y diesel), a la Flota Pesquera Nacional,\nexcepto la actividad de pesca deportiva, a un precio competitivo con el precio internacional.\n\nArtículo 2º—Para los efectos de la aplicación del presente\nReglamento, se establecen las siguientes definiciones:\n\na) PCFPi = Es el Precio de Venta en Plantel por Litro de Combustible\n(gasolina regular o diesel), que consume la Flota Pesquera Nacional No Deportiva.\n\nb) CIFRi = Es el costo mensual CIF Refinería, por Litro de\nCombustible, el cual incluye los costos F.O.B. (libre a bordo), así como el seguro y el\ntransporte del combustible (gasolina regular y diesel), colocado en el Puerto de\nDesembarque Nacional. Se deberá interpretar que dentro de este concepto, su componente\nF.O.B., sea igual al que utilizó RECOPE como promedio en su último ajuste\nextraordinario, para cada uno de los combustibles antes citados.\n\nc) COif = Costo anual por litro trasegado por Oleoducto calculado con\nbase en la información existente en el cierre contable del período fiscal inmediato\nanterior, de conformidad con la información existente en el último Estado Financiero\nDisponible, considerando como denominador, el volumen proporcional de combustibles\ntrasegados por Oleoducto, destinado al consumo de la Flota Pesquera Nacional no Deportiva.\nEl monto obtenido se actualizará con la inflación estimada para el período siguiente.\n\nd) CPif = Costo anual por litro vendido en Planteles calculado con base\nen la información existente en el cierre contable del Período Fiscal inmediato anterior,\nde conformidad con la información existente en el último Estado Financiero Disponible,\nconsiderando como denominador, el volumen proporcional de combustible vendido en\nPlanteles, durante el período que corresponda, destinado al consumo de la Flota Pesquera\nNacional No Deportiva. Therefore:\n\nThey Decree:\n\nThe following:\n\nRegulation to Article 45 of Law Number 7384\n\non the Granting of Fuel for the\n\nNon-Sport Fishing Sector\n\nArticle 1º-In compliance with the provisions of Article 45 of Law No. 7384 of March 16,\n1994, RECOPE shall sell fuel (regular gasoline and diesel) to the National Fishing Fleet,\nexcept for sport fishing activity, at a price competitive with the international price.\n\nArticle 2º—For the purposes of applying this\nRegulation, the following definitions are established:\n\na) PCFPi = This is the Plant Sale Price per Liter of Fuel\n(regular gasoline or diesel) consumed by the National Non-Sport Fishing Fleet.\n\nb) CIFRi = This is the monthly CIF Refinery cost per Liter of\nFuel, which includes the F.O.B. (free on board) costs, as well as the insurance and\ntransport of the fuel (regular gasoline and diesel), placed at the National\nPort of Landing. It shall be interpreted that within this concept, its F.O.B.\ncomponent is equal to the average used by RECOPE in its last extraordinary\nadjustment for each of the aforementioned fuels.\n\nc) COif = Annual cost per liter transferred by Pipeline calculated based\non the information existing in the accounting closing of the immediately preceding\nfiscal period, in accordance with the information existing in the last Available\nFinancial Statement, considering as the denominator the proportional volume of fuels\ntransferred by Pipeline destined for the consumption of the National Non-Sport Fishing Fleet.\nThe amount obtained shall be updated with the estimated inflation for the following period.\n\nd) CPif = Annual cost per liter sold at Plants calculated based\non the information existing in the accounting closing of the immediately preceding\nFiscal Period, in accordance with the information existing in the last Available\nFinancial Statement, considering as the denominator the proportional volume of fuel sold at\nPlants during the corresponding period, destined for the consumption of the National\nNon-Sport Fishing Fleet. The amount obtained shall be updated by the estimated inflation for\nthe following period.\n\ne) International Fuel Price: This shall be determined based on the\naverage of the price that RECOPE uses as a reference for the fuels (gasoline,\ndiesel) it imports.\n\nf) Fuel for Fishing: This covers only the regular gasoline\nand diesel varieties.\n\nArticle 3º-The setting of the price of fuels consumed by the National Non-Sport Fishing Fleet\nshall be established taking into account only the following cost structure:\n\nPCFPi = CIFRi + COif + CPif\n\nFor:\t i = Regular Gasoline, Diesel\n\n f = Fixed until the conclusion of the next review\n\nArticle 4º-In determining the price of fuels destined for consumption by the National\nNon-Sport Fishing Fleet, the amounts corresponding to administrative\nexpenses, asset depreciation, port charges, investment, marketing margins,\nor others of a similar nature shall not be considered, such that the objective is met that the set price\nis competitive with the international prices of the markets that RECOPE uses as a reference\nin the acquisition of fuels.\n\nArticle 5º-Price requests may be made by RECOPE or INCOPESCA or by the Regulatory\nentity ex officio, since the price variations for the National Non-Sport Fishing Fleet\nshall be made following the same Ordinary and Extraordinary variations requested by\nRECOPE.\n\nArticle 6º-Shall become effective upon its publication.\n\nGiven at the Presidency of the Republic.-San José, on the first day of July, two thousand three." }
