  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31344\n\n                        Declara de Interés Público el Desarrollo del Sistema de Información del\nSector Agropecuario Costarricense -INFOAGRO-.\n\nTexto Completo acta: 1811A7\nNº 31344-MAG\n\nNº 31344-MAG\n\n(Este decreto ejecutivo fue derogado por el 3° del decreto ejecutivo\nN° 45693 del 16 de marzo de 2026)\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nDe\nconformidad con las atribuciones que les confieren los artículos 140, incisos\n3), 8), 18), y 20), y 146 de la Constitución Política, los artículos 25, 27.1,\n28.2b de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de Administración\nPública y la Ley Nº 7064 del 29 de abril de 1987, Ley de Fomento a la\nProducción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de\nAgricultura y Ganadería.\n\nConsiderando:\n\n1º-Que\nel establecimiento de Sistemas de Información constituye una acción prioritaria\ndel Gobierno de Costa Rica como mecanismo para la prestación de servicios\npúblicos eficientes a los ciudadanos.\n\n2º-Que\nlas acciones dirigidas a disminuir la brecha digital y con ello facilitar el\nacceso a la información y el conocimiento, son fundamentales para el\nmejoramiento del nivel de vida de los costarricenses.\n\n3º-Que\nla estructura productiva agropecuaria se encuentra en un proceso de\nmodernización acelerado en el cual la tecnología de información juega un papel\nfundamental para su mejoramiento.\n\n4º-Que\nel Sector Agropecuario Costarricense ha establecido el Sistema de Información\nINFOAGRO como un medio para facilitar el acceso y uso de la información a los\nproductores costarricenses, como alternativa para fortalecer los procesos de\ntoma de decisiones y la modernización de las cadenas agro productivas\nnacionales.\n\n5º-Que\nINFOAGRO es un sistema de información congruente con los esfuerzos nacionales\nseñalados en los considerandos 1° y 2°.\n\n6º-Que\nel desarrollo de INFOAGRO demanda un compromiso institucional, especialmente de\nlas organizaciones públicas agropecuarias, para el logro de sus objetivos en\nlos niveles nacional, regional y local.\n\n7º-Que\nmediante Ley Nº 7064 del 29 de abril de 1987, se creó el Consejo Sectorial\nNacional Agropecuario (CAN), integrado por los Jerarcas Superiores de las\nInstituciones Públicas del Sector Agropecuario, el cual debe constituirse\nentonces como la instancia superior del INFOAGRO. Por tanto:\n\nDecretan:\n\nArtículo\n1º-Se declara de interés público el desarrollo del Sistema de Información del\nSector Agropecuario Costarricense -INFOAGRO-.\n\nArtículo 2º-La estructura organizacional de INFOAGRO, para su desarrollo y operación en los niveles\nnacional, regional y local, estará conformada por el Consejo Sectorial Nacional Agropecuario (CAN),\nel Comité Directivo Sectorial (CDS), la Secretaría Ejecutiva de Planificación Sectorial Agropecuaria\n(SEPSA), los Comités Sectoriales Regionales Agropecuarios (CSRA), los equipos regionales de INFOAGRO\ny los Centros de Información.\n\nArtículo 3º-El Consejo Sectorial Nacional Agropecuario (CAN), en concordancia con la jerarquía\nsuperior que le asigna la ley y las funciones que le establece, se constituye en la instancia\nsuperior jerárquica de INFOAGRO y su competencia y responsabilidad será la de establecer la política\nde desarrollo del sistema de acuerdo con el Plan Nacional de Desarrollo y el Plan de Desarrollo\nAgropecuario, así como dar el seguimiento general al sistema. Para el seguimiento a los aspectos\nespecíficos del desarrollo de INFOAGRO se reunirá al menos una vez cada cuatro meses.\n\nArtículo 4º—El Comité Directivo Sectorial (CDS) será la\ninstancia de carácter sectorial encargada de conducir los procesos de desarrollo y\nconsolidación del sistema en el nivel nacional, así como de asegurar la vinculación de\nlas instituciones del Sector Agropecuario en las distintas acciones y responsabilidades\nque les correspondan, para lo cual ejecutara las siguientes funciones:\n\n1- Proponer al Consejo Sectorial Nacional Agropecuario (CAN), y al\nMinistro de Agricultura y Ganadería, Rector del Sector Agropecuario, las políticas de\ndesarrollo de INFOAGRO.\n\n2- Determinar la estrategia de operación del sistema, en concordancia\ncon sus objetivos y las políticas definidas.\n\n3- Aprobar los planes anuales de trabajo de INFOAGRO.\n\n4- Articular las acciones de INFOAGRO en el contexto de las\ninstituciones del Sector Agropecuario, procurando que ello se manifieste en sus planes\noperativos - presupuestarios, de tal forma que se asignen los recursos necesarios para el\ndesarrollo de INFOAGRO en los niveles nacional, regional y local.\n\n5- Dar seguimiento y evaluar periódicamente los avances del sistema y\nproponer al Ministro y a las autoridades institucionales las medidas correctivas\npertinentes.\n\n6- Cualesquiera otra acorde con las funciones que le competen.\n\nArtículo 5º—El Comité Directivo Sectorial de INFOAGRO (CDS)\nestará conformado por:\n\n1- La jefatura del Sistema Unificado de Información Institucional\n(SUNII) del Ministerio de Agricultura y Ganadería.\n\n2- La jefatura del Sistema de Información de Mercados (SIM) del\nConsejo Nacional de Producción.\n\n3- La jefatura del Sistema de Información de Mercados Mayoristas del\nPrograma Integral de Mercadeo Agropecuario.\n\n4- El Director de Planificación del Servicio Nacional de Riego y\nAvenamiento.\n\n5- El Director de Planificación del Instituto de Desarrollo Agrario.\n\n6- El encargado del Área de Información del Instituto Nacional en\nTransferencia e Investigación de Tecnología Agropecuaria (INTA).\n\n7- El encargado del Área de Información del Instituto Costarricense\nde Pesca y Acuacultura.\n\n8- El Coordinador del Área de Estudios Económicos e Información de\nSEPSA, quien lo presidirá.\n\n    Artículo 6°—La\nrepresentación institucional en el Comité Directivo Sectorial recaerá en las personas\nque ocupen los cargos indicados en el artículo anterior, los cuales contarán con su\nrespectivo suplente, el cual será de la misma área institucional en que se desempeña el\ntitular. Serán funcionarios de los representantes institucionales en el Comité Directivo\nSectorial.\n\n(Así reformado por el artículo 1°\ndel decreto ejecutivo N° 32182 del 23 de noviembre del 2004)\n\n    1- Representar a su institución, con poder decisorio, ante INFOAGRO.\n    2- Vigilar por la coherencia del desarrollo de la información en su organización en\n      relación con las pautas determinadas en el desarrollo de INFOAGRO.\n    3- Canalizar y coordinar, al interior de su representada, todos los aspectos en que\n      ésta tenga relación con los diferentes componentes de INFOAGRO, así como promover que\n      estos alcancen los resultados deseados en el marco del sistema.\n\nArtículo 7º—Corresponderá a la Secretaría Ejecutiva de\nPlanificación Sectorial Agropecuaria (SEPSA), actuar como órgano ejecutivo del Comité\nDirectivo Sectorial, específicamente a través del Área de Estudios Económicos e\nInformación. La SEPSA integrará un equipo con al menos dos funcionarios profesionales y\nun técnico profesional, todos a tiempo completo y a cargo del Coordinador del Área\nseñalada. Entre las principales funciones de SEPSA estarán:\n\n1- Coordinar, promover y ejecutar acciones del sistema en el nivel\nnacional y la articulación de éstas en las regiones y localidades del país, mediante\nlas estructuras correspondientes en esos niveles.\n\n2- Informar periódicamente al Ministro Rector y a las autoridades del\nSector Agropecuario sobre el avance nacional de INFOAGRO y recomendar las medidas\ncorrespondientes.\n\n3- Ejecutar, en concordancia con las disposiciones del Comité\nDirectivo Sectorial (CDS), los lineamientos técnicos para el buen funcionamiento de\nINFOAGRO.\n\n4- Coordinar con los entes que se requiera para disponibilizar\ninformación considerada de interés para los usuarios.\n\n5- Promover la capacitación de los usuarios de INFOAGRO en cuanto al\nuso de la información, así como del manejo de las herramientas del sistema.\n\n6- Generar acciones y estrategias tendientes a la promoción y\ndifusión de los alcances y objetivos de INFOAGRO en procura de una incorporación\ncreciente de usuarios al sistema.\n\nArtículo 8º—Los Comités Sectoriales Regionales Agropecuarios\n(CSRA), estarán integrados por los directores regionales de las instituciones públicas\nagropecuarias en cada región, y serán las instancias responsables, en ese ámbito, del\ndesarrollo de INFOAGRO, en concordancia con las políticas definidas por el CAN y el\nMinistro Rector del Sector. Serán funciones de los Comités Sectoriales Regionales\nAgropecuarios:\n\n1- Orientar las acciones regionales de INFOAGRO en concordancia con los\nlineamientos de política nacional, el Plan Regional de Desarrollo y las necesidades y\ncaracterísticas de la región.\n\n2- Constituir formalmente los equipos regionales de INFOAGRO que\ngaranticen el adecuado funcionamiento de las actividades del sistema en la región, según\nuna planificación anual operativa y presupuestaria.\n\n3- Implementar las tareas de seguimiento y evaluación que permitan el\ncontrol y desarrollo eficiente de INFOAGRO en los niveles regional y local.\n\n4- Informar periódicamente a las autoridades del Sector Agropecuario\nsobre los resultados de la operación de INFOAGRO en la región.\n\nArtículo 9º—Los Equipos Regionales de INFOAGRO estarán\nintegrados, en cada región, por al menos dos funcionarios designados por el respectivo\nComité Sectorial Regional Agropecuario. Por lo tanto, desde el punto de vista\njerárquico, dependerán de éste y mantendrán una vinculación de carácter técnico con\nel equipo nacional de INFOAGRO en SEPSA. Sus principales funciones serán:\n\n1- Planificar, ejecutar y coordinar las acciones de los diferentes\ncomponentes de INFOAGRO en los niveles regional y local, en coherencia con los\nlineamientos establecidos por el Comité Sectorial Regional Agropecuario y el Comité\nDirectivo Sectorial.\n\n2- Capacitar, o promover la capacitación, de los distintos actores que\nintervienen en el proceso de desarrollo de INFOAGRO, en el manejo de las herramientas del\nsistema y/o en el uso de la información que se disponibiliza.\n\n3- Dar seguimiento permanente a las acciones del sistema en la región\ne informar permanentemente al Comité Sectorial Regional Agropecuario sobre los avances\nobtenidos y, de ser necesario, recomendar las medidas requeridas para su mejoramiento.\n\n4- Desarrollar y coordinar estrategias de divulgación de los\nbeneficios de INFOAGRO entre los usuarios, procurando una participación creciente en el\nacceso y uso de la información del sistema.\n\nArtículo 10.—Los Centros de Información constituirán la unidad\nbásica del sistema y podrán constituirse bajo dos modalidades distintas:\n\n1- Por oficinas locales y/o subregionales de las instituciones\npúblicas del Sector Agropecuario, cumpliendo funciones de usuarios de información, pero\na la vez prestando servicios de información a otros usuarios, especialmente a pequeños y\nmedianos productores.\n\n2- Por organizaciones de productores agropecuarios que demandan\nservicios de información para fortalecer sus procesos de toma de decisiones y la\nmodernización de su gestión empresarial. Sus principales funciones serán:\n\na- Planificar y promover el acceso, uso y generación de valor a la\ninformación puesta a disposición a través de INFOAGRO.\n\nb- Desarrollar estrategias tendientes a la generación de información\ncorrespondiente a su ámbito espacial para el desarrollo del sistema y la\nretroalimentación de la red.\n\nc- Fortalecer el uso y acceso de la información por parte de sus\nusuarios, brindando facilidades para acceder y utilizar la información que sea de su\ninterés.\n\nArtículo 11.-Se autoriza a las instituciones públicas del Sector Agropecuario para que incluyan en\nsus planes, presupuesto, actividades y contenidos presupuestarios, dirigidos a sustentar técnica y\nfinancieramente, gastos e inversiones de INFOAGRO, relacionadas con el suministro, acceso, difusión\ny uso de información, particularmente en partidas como equipo de cómputo, accesorios y repuestos\npara equipo de cómputo, financiamiento de actividades de capacitación y publicación de documentos,\nde conformidad con las disposiciones legales aplicables en la materia y en concordancia con lo\nestablecido en el Decreto Ejecutivo No. 26117-MAG del 3 de junio de 1997 sobre la Integración de\nServicios en el Sector Agropecuario.\n\nArtículo 12.-Se deroga el Decreto Ejecutivo Nº 26978-MAG del 20 de abril de 1998, publicado en La\nGaceta Nº 100 del 26 de mayo de 1998.\n\nArtículo 13.-Rige a partir de su publicación.\n\nDado en la Presidencia de la República.-San José, a los veintiún días del mes de julio del dos mil\ntres.",

For the oversight of the\nspecific aspects of INFOAGRO's development, it shall meet at least once every four months.\n\nArticle 4º—The Sectoral Steering Committee (CDS) shall be the\nbody of a sectoral nature responsible for directing the development and\nconsolidation processes of the system at the national level, as well as for ensuring the linkage of\nthe institutions of the Agricultural Sector in the various actions and responsibilities\ncorresponding to them, for which it shall carry out the following functions:\n\n1- Propose to the National Agricultural Sectoral Council (CAN), and to the\nMinister of Agriculture and Livestock, Rector of the Agricultural Sector, the development\npolicies for INFOAGRO.\n\n2- Determine the system's operating strategy, in accordance\nwith its objectives and the defined policies.\n\n3- Approve the annual work plans of INFOAGRO.\n\n4- Articulate the actions of INFOAGRO within the context of the\ninstitutions of the Agricultural Sector, ensuring that this is manifested in their operational\nand budgetary plans, in such a way that the necessary resources are allocated for the\ndevelopment of INFOAGRO at the national, regional, and local levels.\n\n5- Provide oversight to and periodically evaluate the system's progress and\npropose the pertinent corrective measures to the Minister and the institutional authorities.\n\n6- Any other function consistent with the duties within its competence.\n\nArticle 5º—The Sectoral Steering Committee of INFOAGRO (CDS)\nshall be composed of:\n\n1- The head of the Unified Institutional Information System\n(Sistema Unificado de Información Institucional, SUNII) of the Ministry of Agriculture and Livestock.\n\n2- The head of the Market Information System (Sistema de Información de Mercados, SIM) of the\nNational Production Council.\n\n3- The head of the Wholesale Market Information System of the\nIntegrated Agricultural Marketing Program.\n\n4- The Director of Planning of the National Irrigation and Drainage\nService.\n\n5- The Director of Planning of the Agrarian Development Institute.\n\n6- The person in charge of the Information Area of the National Institute for\nAgricultural Technology Transfer and Research (Instituto Nacional en\nTransferencia e Investigación de Tecnología Agropecuaria, INTA).\n\n7- The person in charge of the Information Area of the Costa Rican Institute\nof Fishing and Aquaculture.\n\n8- The Coordinator of the Economic Studies and Information Area of\nSEPSA, who shall preside over it.\n\n    Article 6°—The\ninstitutional representation on the Sectoral Steering Committee shall fall upon the persons\nholding the positions indicated in the previous article, who shall have their\nrespective alternate (suplente), who shall be from the same institutional area in which the\nprincipal operates. The institutional representatives on the Sectoral Steering Committee shall serve as officials.\n\n(Thus reformed by article 1°\nof executive decree N° 32182 of November 23, 2004)\n\n    1- Represent their institution, with decision-making power, before INFOAGRO.\n    2- Monitor the consistency of information development within their organization in\n      relation to the guidelines established in the development of INFOAGRO.\n    3- Channel and coordinate, within their represented institution, all aspects in which\n      it relates to the different components of INFOAGRO, as well as promote that\n      these achieve the desired results within the system framework.\n\nArticle 7º—It shall be the responsibility of the Executive Secretariat for\nAgricultural Sectoral Planning (SEPSA) to act as the executive body of the Sectoral Steering Committee, specifically through the Economic Studies and\nInformation Area. SEPSA shall integrate a team with at least two professional officials and\none professional technician, all full-time and under the charge of the Coordinator of the aforementioned\nArea. Among the main functions of SEPSA shall be:\n\n1- Coordinate, promote, and execute system actions at the national\nlevel and the articulation of these in the country's regions and localities, through\nthe corresponding structures at those levels.\n\n2- Periodically inform the Rector Minister and the authorities of the\nAgricultural Sector about the national progress of INFOAGRO and recommend the\ncorresponding measures.\n\n3- Execute, in accordance with the provisions of the Sectoral Steering Committee (CDS), the technical guidelines for the proper functioning of\nINFOAGRO.\n\n4- Coordinate with the entities required to make available\ninformation considered of interest to users.\n\n5- Promote the training of INFOAGRO users regarding the\nuse of information, as well as the management of the system's tools.\n\n6- Generate actions and strategies aimed at the promotion and\ndissemination of the scope and objectives of INFOAGRO in pursuit of a\ngrowing incorporation of users into the system.\n\nArticle 8º—The Regional Agricultural Sectoral Committees\n(CSRA) shall be composed of the regional directors of the public agricultural institutions in each region, and shall be the responsible bodies, in that sphere, for the\ndevelopment of INFOAGRO, in accordance with the policies defined by the CAN and the\nRector Minister of the Sector. The functions of the Regional Agricultural Sectoral Committees shall be:\n\n1- Guide the regional actions of INFOAGRO in accordance with the\nnational policy guidelines, the Regional Development Plan, and the needs and\ncharacteristics of the region.\n\n2- Formally establish the regional teams of INFOAGRO that\nguarantee the adequate functioning of the system's activities in the region, according\nto an annual operational and budget plan.\n\n3- Implement oversight and evaluation tasks that allow for the\ncontrol and efficient development of INFOAGRO at the regional and local levels.\n\n4- Periodically inform the authorities of the Agricultural Sector\nabout the results of INFOAGRO's operation in the region.\n\nArticle 9º—The Regional Teams of INFOAGRO shall be composed,\nin each region, of at least two officials designated by the respective\nRegional Agricultural Sectoral Committee. Therefore, from the hierarchical point\nof view, they shall report to it and shall maintain a technical linkage with\nthe national team of INFOAGRO in SEPSA. Their main functions shall be:\n\n1- Plan, execute, and coordinate the actions of the different\ncomponents of INFOAGRO at the regional and local levels, in coherence with the\nguidelines established by the Regional Agricultural Sectoral Committee and the Sectoral Steering Committee.\n\n2- Train, or promote the training of, the different actors that\nintervene in the INFOAGRO development process, in the management of the system's tools\nand/or in the use of the information made available.\n\n3- Provide permanent oversight of the system's actions in the region\nand permanently inform the Regional Agricultural Sectoral Committee about the progress\nachieved and, if necessary, recommend the measures required for its improvement.\n\n4- Develop and coordinate strategies for disseminating the\nbenefits of INFOAGRO among users, seeking growing participation in the\naccess to and use of the system's information.\n\nArticle 10.—The Information Centers shall constitute the basic\nunit of the system and may be established under two different modalities:\n\n1- Through local and/or subregional offices of the public\ninstitutions of the Agricultural Sector, fulfilling functions as information users, but\nat the same time providing information services to other users, especially to small and\nmedium-scale producers.\n\n2- Through agricultural producer organizations that demand\ninformation services to strengthen their decision-making processes and\nthe modernization of their business management. Their main functions shall be:\n\na- Plan and promote access, use, and generation of value from the\ninformation made available through INFOAGRO.\n\nb- Develop strategies aimed at generating information\ncorresponding to their spatial scope for the development of the system and the\nfeedback of the network.\n\nc- Strengthen the use and access of information by its\nusers, providing facilities to access and use the information that is of\ninterest to them.\n\nArticle 11.-The public institutions of the Agricultural Sector are authorized to include in\ntheir plans, budgets, activities, and budgetary items, directed at technically and\nfinancially supporting, expenses and investments of INFOAGRO, related to the supply, access, dissemination,\nand use of information, particularly in line items such as computer equipment, accessories and spare parts\nfor computer equipment, financing of training activities and publication of documents,\nin accordance with the legal provisions applicable in the matter and in agreement with what is\nestablished in Executive Decree No. 26117-MAG of June 3, 1997, regarding the Integration of\nServices in the Agricultural Sector.\n\nArticle 12.-Executive Decree Nº 26978-MAG of April 20, 1998, published in La\nGaceta Nº 100 of May 26, 1998, is hereby repealed.\n\nArticle 13.-It shall be effective as of its publication.\n\nIssued at the Presidency of the Republic.-San José, on the twenty-first day of July, two thousand\nthree."
