a los cinco\ndías del mes de setiembre del dos mil tres.\n\nConsiderando:\n\n1- Con base a la resolución C-03-03 de la\nCIAT, resolución sobre la Conservación del Atún en el Océano Pacífico, que dice:\n\n\" La Comisión Interamericana del\nAtún Tropical (CIAT): Teniendo presente la Resolución sobre la conservación de los\natunes aleta amarilla y patudo en el Océano Pacifico Oriental aprobada por la CIAT en su\n69ª reunión en Manzanillo (México), alienta a los estados y entidades pesqueras con\nbuques palangreros a gran escala (LSTLV) a emprender iniciativas similares a la de Japón,\no sea, una reducción de 20% de su flota, de conformidad con el Plan Internacional de\nAcción de la FAO.\n\nConsciente con seria preocupación de que,\na pesar de la citada Resolución, la captura de patudo por LSTLV y su capacidad de pesca\nsiguen creciendo en el Océano Pacífico Oriental (OPO), definido para los propósitos de\nesta Resolución como la zona comprendida entre el litoral de las Américas y el meridiano\n150°0 desde el paralelo 40° N hasta el paralelo 40° S.\n\nResponsables del estudio científico de los\natunes y especies afines del OPO, y de formular recomendaciones a las Partes con respecto\na dichos recursos, y habiendo mantenido desde 1950 un programa científico ininterrumpido\ndedicado al estudio de dichos recursos.\n\nObserva que el recurso atunero en el OPO\nsostiene a una de las pesquerías de atunes con artes de superficie más importantes del\nmundo.\n\nReconoce, con base en la experiencia previa\nen estas pesquerías, que existe la posibilidad de reducir la producción potencial del\nrecurso si el esfuerzo de pesca es excesivo.\n\nNota que en los años entre 1980 y 2002,\ncon la excepción de 1987, el Director recomendó medidas de conservación a los\nComisionados, quienes a su vez aprobaron dichas medidas para recomendación a sus\ngobiernos respectivos.\n\nCreyendo que es importante seguir un\nenfoque precautorio al tratar medidas de conservación y ordenación para el recurso\natunero en el OPO, y\n\nConsiderando que los estudios de los atunes\naleta amarilla y patudo presentados en esta reunión demuestran que el esfuerzo de pesca\nactual (promedio de 2000-2001) estaría por encima del nivel\n\nde rendimiento máximo sostenible promedio\npara ambas especies si el reclutamiento depende fuertemente del nivel de desove;\n\nRESUELVE:\n\n1. Que esta resolución es aplicable para\n2003, excepto el párrafo 6, que es aplicable para 2004 también;\n\n2. Los buques cañeros y de pesca deportiva\nno quedan sujetos a estas medidas.\n\n3. Que se vedará la pesca por buques\natuneros cerqueros en el OPO a partir de las 0000 horas del 1° de diciembre hasta las\n24:00 horas del 31 de diciembre;\n\n4. Desalentar descargas y transacciones\ncomerciales de atún o productos derivados provenientes de actividades de pesca prohibidas\npor esta resolución. El Director podrá proporcionar información pertinente a las Partes\npara apoyarles en este respecto.\n\n5. Cada Parte de la CIAT, parte no\ncontratante cooperante, entidad pesquera u organización regional de integración\neconómica (colectivamente \"CPC), para las pesquerías de cerco:\n\n5.1. A más tardar el 1º de octubre de\n2003, informará a todos los interesados de su industria atunera nacional de la veda, y\nenviará copia del aviso al Director.\n\n5.2. Asegurará que en el momento de\niniciar la veda, y durante toda la duración de la misma, todos los buques atuneros\ncerqueros que enarbolan su pabellón en el OPO estén en puerto, excepto que buques que\nlleven un observador del programa de Observadores a Bordo del APICD podrán estar en el\nmar, siempre que no pesquen.\n\n5.3. Tomará las medidas del caso e\ninformará al Director de las mismas antes del 1º de octubre de 2003.\n\n6. Que cada CPC tomará las medidas\nnecesarias para asegurar que su captura palangrera anual total de patudo en el OPO durante\n2003 y 2004 no supere la captura en 2001. Cada CPC con LSTLFV proveerá informes mensuales\nde captura al Director.\n\n7. No se considerará que esta resolución\nprejuzgue cualquier arreglo futuro por la Comisión para la conservación del atún\npatudo.\n\n8. Que la Comisión desarrollará, en su\n71ª Reunión, un programa a largo plazo para la conservación de los atunes patudo y\naleta amarilla en el OPO.\"\n\n2- Que Costa Rica como país actualmente\ndescarga normalmente más de 40.000 TM de atún proveniente de barcos atuneros con bandera\nextranjera que faenan en el OPO, todos incluidos en el Registro General de Buques de la\nCIAT.\n\nPor tanto:\n\nSE ACUERDA:\n\n1. No otorgar licencias de pesca de atún\ncon red de cerco durante el mes de diciembre del 2003.\n\n2. Aquellas embarcaciones que cuenten con\nlicencia de pesca nacional vigente en el mes de diciembre del 2003, les queda prohibida la\nrealización de actividades de pesca en las aguas patrimoniales de Costa Rica.\n\n3. Las plantas procesadoras de atún,\nestablecidas en Costa Rica, para realizar un desembarque de atún durante el período de\nveda, quedan obligadas a solicitar una autorización previa a la autoridad nacional del\nINCOPESCA ante la CIAT. La autoridad nacional vía correo electrónico, a la mayor\nbrevedad posible, enviará la solicitud al Director de la CIAT en la cual se anotará el\nnombre del barco atunero, bandera, tonelaje de atún que se estima descargar y fecha\nprogramada para la descarga, a fin de verificar que el atún en cuestión fue capturado\nsin violar la veda del mes de diciembre del 2003. En caso de que el Director de la\nSecretaría de la CIAT comunique que el embarque consultado no cumple con la veda o\nexisten dudas fundamentadas sobre el cumplimiento, la autoridad nacional comunicará a la\nindustria atunera y a la Agencia de Vapores representante del barco, la negativa de\ndesembarcar el atún en territorio costarricense y la denegatoria también de que se\nrealice ninguna operación de trasbordo en aguas patrimoniales costarricenses. Se insta a\nla autoridad nacional y a la Secretaría de la CIAT a evacuar a la mayor brevedad posible,\nlas consultas sobre la verificación del cumplimiento con la veda, a fin de no dificultar\nen tiempo, las operaciones de las industrias atuneras costarricenses.\n\n4. El presente acuerdo debe de comunicarse\noficialmente a las empresas procesadoras de atún y a las Agencias de vapores\nrepresentantes de barcos atuneros de bandera extranjera.\n\n5. ACUERDO FIRME, PUBLÍQUESE.\n\nNota de SINALEVI:  Mediante\nAcuerdo N° 496 del 21 de noviembre de 2003,  se modifica la presente\nresolución en lo concerniente al Artículo 2°,  sin embargo,  por no\nexistir el mismo en el acuerdo citado se incluye en forma total el texto del\nartículo del Acuerdo indicado supra. \n\n\"Artículo\n2º-Se autoriza la pesca en el mar patrimonial de Costa Rica, excepto dentro\ndel mar territorial y en aquella área incluida en la zona vedada en la resolución\nde la CIAT C-03-12, establecida y definida de la siguiente manera: \"Desde la\nintersección del Meridiano de 95°O, con el litoral occidental del continente\namericano hacia el sur hasta el paralelo 10° N, luego hacia el oeste hasta el\nmeridiano de 120°O , luego hacia el sur hasta el paralelo de 5° S, luego\nhacia el este hasta el meridiano de 100° O, luego hacia el norte hasta el\nparalelo de 5° N, luego hacia el este hasta el meridiano de 85° O y finalmente\nhacia el norte hasta su intersección con el litoral occidental americano\n\nPuntarenas, 17 de setiembre del 2003.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Regulation 365\n\n Resolution on the Conservation of Tuna in the Pacific Ocean.\n\nFull Text of record: 70048\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nNo. AJDIP/365.—Puntarenas, on the fifth\nday of September, two thousand three.\n\nConsidering:\n\n1- Based on IATTC Resolution C-03-03,\nresolution on the Conservation of Tuna in the Pacific Ocean, which states:\n\n\" The Inter-American Tropical Tuna\nCommission (IATTC): Bearing in mind the Resolution on the conservation of\nyellowfin and bigeye tunas in the Eastern Pacific Ocean approved by the IATTC at its\n69th meeting in Manzanillo (Mexico), encourages states and fishing entities with\nlarge-scale tuna longline vessels (LSTLV) to undertake initiatives similar to that of Japan,\nthat is, a 20% reduction of its fleet, in accordance with the FAO International Plan\nof Action.\n\nAware with serious concern that,\ndespite the aforementioned Resolution, the catch of bigeye by LSTLVs and their fishing capacity\ncontinue to grow in the Eastern Pacific Ocean (EPO), defined for the purposes of\nthis Resolution as the area between the coast of the Americas and the meridian 150°W from the parallel 40° N to the parallel 40° S.\n\nResponsible for the scientific study of the\ntunas and related species of the EPO, and for formulating recommendations to the Parties with respect\nto said resources, and having maintained since 1950 an uninterrupted scientific program\ndedicated to the study of said resources.\n\nObserves that the tuna resource in the EPO\nsupports one of the most important surface-gear tuna fisheries in the\nworld.\n\nRecognizes, based on previous experience\nin these fisheries, that the potential production of the\nresource could be reduced if the fishing effort is excessive.\n\nNotes that in the years between 1980 and 2002,\nwith the exception of 1987, the Director recommended conservation measures to the\nCommissioners, who in turn approved said measures for recommendation to their\nrespective governments.\n\nBelieving that it is important to follow a\nprecautionary approach when dealing with conservation and management measures for the tuna\nresource in the EPO, and\n\nConsidering that the studies of yellowfin and bigeye tunas\npresented at this meeting demonstrate that the current fishing\neffort (average of 2000-2001) would be above the level\n\nof average maximum sustainable yield\nfor both species if recruitment depends strongly on the spawning level;\n\nRESOLVES:\n\n1. That this resolution is applicable for\n2003, except paragraph 6, which is applicable for 2004 as well;\n\n2. Pole-and-line and sport-fishing vessels\nare not subject to these measures.\n\n3. That fishing by purse-seine tuna vessels\nshall be closed in the EPO from 0000 hours on December 1st until\n2400 hours on December 31st;\n\n4. Discourage landings and commercial\ntransactions of tuna or derived products stemming from fishing activities prohibited\nby this resolution. The Director may provide pertinent information to the Parties\nto support them in this regard.\n\n5. Each IATTC Party, cooperating non-party,\nfishing entity, or regional economic integration organization\n(collectively \"CPC\"), for purse-seine fisheries:\n\n5.1. No later than October 1, 2003,\nshall inform all stakeholders of its national tuna industry of the closure, and\nshall send a copy of the notice to the Director.\n\n5.2. Shall ensure that at the time of\ninitiating the closure, and throughout the duration of the same, all purse-seine tuna\nvessels flying its flag in the EPO are in port, except that vessels\ncarrying an observer from the APICD On-Board Observer Program may be at\nsea, provided they do not fish.\n\n5.3. Shall take the appropriate measures and\ninform the Director thereof before October 1, 2003.\n\n6. That each CPC shall take the necessary\nmeasures to ensure that its total annual longline catch of bigeye in the EPO during\n2003 and 2004 does not exceed the catch in 2001. Each CPC with LSTLFV shall provide monthly\ncatch reports to the Director.\n\n7. This resolution shall not be considered to\nprejudge any future arrangement by the Commission for the conservation of bigeye\ntuna.\n\n8. That the Commission shall develop, at its\n71st Meeting, a long-term program for the conservation of bigeye and\nyellowfin tunas in the EPO.\"\n\n2- That Costa Rica, as a country, currently\nnormally lands more than 40,000 MT of tuna from tuna vessels flying a foreign\nflag that operate in the EPO, all included in the IATTC Regional Vessel Register.\n\nTherefore:\n\nIT IS AGREED:\n\n1. Not to grant tuna fishing licenses\nwith purse-seine nets during the month of December 2003.\n\n2. Those vessels that hold a valid\nnational fishing license in the month of December 2003 are prohibited from\ncarrying out fishing activities in the patrimonial waters of Costa Rica.\n\n3. Tuna processing plants\nestablished in Costa Rica, in order to land tuna during the closure\nperiod, are obligated to request prior authorization from the national authority of\nINCOPESCA before the IATTC. The national authority, via email, as promptly\nas possible, shall send the request to the IATTC Director in which the\nname of the tuna vessel, flag, tonnage of tuna estimated to be landed, and\nscheduled date for the landing shall be noted, in order to verify that the tuna in question was caught\nwithout violating the closure of December 2003. In the event that the Director of the\nIATTC Secretariat communicates that the shipment consulted does not comply with the closure or\nthere are substantiated doubts about compliance, the national authority shall communicate to the\ntuna industry and to the Shipping Agency representing the vessel, the denial of\nlanding the tuna in Costa Rican territory and also the refusal to\ncarry out any transshipment operation in Costa Rican patrimonial waters. The\nnational authority and the IATTC Secretariat are urged to process\nthe consultations on the verification of compliance with the closure as promptly as possible, in order not to complicate,\nin terms of time, the operations of the Costa Rican tuna industries.\n\n4. This agreement must be communicated\nofficially to the tuna processing companies and to the shipping agencies\nrepresenting foreign-flag tuna vessels.\n\n5.
