34, 35, 36 y 37; Ley de Biodiversidad, artículos 58 y 60; en aplicación de\nlo dispuesto en los artículos 6º, 9º, 11 y 27 de la Ley General de la Administración Pública.\n\nConsiderando:\n\n1º-Que la sociedad denominada Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima, cédula\njurídica número tres-ciento uno-cero diez mil ochocientos ochenta y dos, representada por el señor\nRodrigo Jiménez Rímolo, portador de la cédula de identidad Nº 1-504-185, Vicepresidente con\nfacultades de apoderado generalísimo sin límite de suma de la citada sociedad, cuya personería está\nvigente e inscrita en la Sección Mercantil del Registro Público al tomo mil trescientos sesenta y\nuno, folio noventa y nueve, asiento ciento veintiuno, solicitó al Área de Conservación La Amistad\nPacífico, Oficina Subregional de Buenos Aires, el sometimiento voluntario al Régimen de Refugios\nPrivados de Vida Silvestre, un inmueble de su propiedad el cual se encuentra inscrito en el Registro\nNacional, Folio Real matrícula número ciento quince mil setecientos cincuenta y siete-cero cero\ncero, sito en el distrito segundo Volcán, cantón tercero Buenos Aires, provincia de Puntarenas, con\nuna superficie de doscientas setenta y tres hectáreas, dos mil ochocientos cincuenta y ocho metros\ncuadrados con cuarenta y tres decímetros cuadrados, plano catastrado número P-seiscientos siete mil\nsetecientos treinta y uno-dos mil, el cual se somete en su totalidad. La sociedad Corporación de\nDesarrollo Agrícola Del Monte Sociedad Anónima, aceptó someter voluntariamente al régimen de Refugio\nde Vida Silvestre Privado, el inmueble dicho por un periodo de diez años, según lo establece el\nartículo 102, inciso f), del Reglamento a la Ley de Conservación de Vida Silvestre, prorrogables en\nforma automática salvo su previa manifestación o de la administración que exprese lo contrario.\n\n2º-Que dentro del área objeto de la solicitud existe un gran número de recursos faunísticos\n(insectos, mamíferos, anfibios, aves y reptiles) así como recursos florísticos que merecen ser\nconservados racional y sosteniblemente, para garantizar su permanencia dentro de los ecosistemas en\nque actualmente se encuentran.\n\n3º-Que de conformidad con el artículo 87 de la Ley de Conservación de la Vida Silvestre, el\nprincipal efecto ambiental que genera la declaratoria de un inmueble bajo este régimen jurídico lo\nes, que para los efectos de la conservación de los recursos naturales la administración general del\nrefugio corresponde a los propietarios del inmueble, supervisada por el Sistema Nacional de Áreas de\nConservación del Ministerio del Ambiente y Energía, a través del Área de Conservación La Amistad\nPacífico, Oficina Subregional de Buenos Aires, dependencia que dará la aprobación previa para\nejecutar todas aquellas actividades que deseen realizar en lo sucesivo dentro del área declarada y\nsometida al Refugio de Vida Silvestre.\n\n4º-Que por medio de la resolución Nº ACLA-P-D-454 de las diez horas, treinta minutos del siete de\noctubre del dos mil dos, la Directora del Área de Conservación La Amistad Pacífico, licenciada\nGladys De Marco González, aceptó la solicitud de sometimiento voluntario que realizó el Presidente\nde la sociedad Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima para someterse\nvoluntariamente al Refugio de Vida Silvestre Privado.\n\n5º-Que con la protección oficial de estos ecosistemas, se logrará la protección y conservación de\nespecies de vida silvestre propias de estos hábitats, los cuales tienen gran importancia biológica y\nsocioeconómica, ya que algunas se encuentran en peligro de extinción y que debido al estado actual\nde los recursos naturales en la zona y la apertura nacional hacia la conservación de la\nbiodiversidad por medio de las Áreas Silvestres Protegidas, lo que es necesaria su preservación.\n6º-Que el manejo racional integrado de los recursos naturales, contribuye a satisfacer las\nnecesidades regionales para la investigación, recreación, educación ambiental, así como el\naprovechamiento de los recursos naturales renovables explotados racionalmente.\n\n7º-Que la administración de la vida silvestre y la recomendación de medidas que aseguren la\nperpetuidad de las especies es función de la Dirección General de Vida Silvestre del Ministerio del\nAmbiente y Energía. The company Corporación de\nDesarrollo Agrícola Del Monte Sociedad Anónima, agreed to voluntarily submit to the Private\nWildlife Refuge regime, the said property for a period of ten years, as established in\narticle 102, subsection f), of the Regulation to the Wildlife Conservation Law, automatically\nrenewable unless its prior manifestation or that of the administration expresses otherwise.\n\n2º-That within the area subject to the request there exists a large number of faunal resources\n(insects, mammals, amphibians, birds and reptiles) as well as floristic resources that deserve to be\nconserved rationally and sustainably, to guarantee their permanence within the ecosystems in\nwhich they are currently found.\n\n3º-That in accordance with article 87 of the Wildlife Conservation Law, the\nmain environmental effect generated by the declaration of a property under this legal regime\nis that, for the purposes of natural resource conservation, the general administration of\nthe refuge corresponds to the property owners, supervised by the National System of\nConservation Areas of the Ministry of Environment and Energy, through the Área de Conservación La Amistad\nPacífico, Oficina Subregional de Buenos Aires, the office that will grant prior approval to\ncarry out all those activities that may be desired to be undertaken henceforth within the declared area\nsubmitted to the Wildlife Refuge.\n\n4º-That by means of resolution Nº ACLA-P-D-454 of ten hours, thirty minutes of the seventh of\nOctober of two thousand two, the Director of the Área de Conservación La Amistad Pacífico, licensed\nGladys De Marco González, accepted the request for voluntary submission made by the President\nof the company Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima to voluntarily\nsubmit to the Private Wildlife Refuge.\n\n5º-That with the official protection of these ecosystems, the protection and conservation of\nwildlife species characteristic of these habitats will be achieved, which have great biological and\nsocioeconomic importance, since some are in danger of extinction and due to the current state\nof natural resources in the area and the national opening towards biodiversity\nconservation through Protected Wild Areas, their preservation is necessary.\n6º-That the rational integrated management of natural resources contributes to satisfying\nregional needs for research, recreation, environmental education, as well as the\nutilization of rationally exploited renewable natural resources.\n\n7º-That the administration of wildlife and the recommendation of measures that ensure the\nperpetuity of species is a function of the Dirección General de Vida Silvestre of the Ministry of\nEnvironment and Energy. Therefore:\n\nTHEY DECREE:\n\nArticle 1º-Declare \"Montaña El Tigre Private National Wildlife Refuge\", the property\nregistered in the Public Property Registry, Puntarenas section, under the Folio Real System with\nthe registration number one hundred fifteen thousand seven hundred fifty-seven-zero zero zero, located in the\nsecond district Volcán, third canton Buenos Aires, province of Puntarenas, farm owned by the\ncompany Corporación de Desarrollo Agrícola Del Monte Sociedad Anónima, legal identification number three-\nzero one-zero ten thousand eight hundred eighty-two.\n\nArticle 2º-The owner of said properties undertakes not to develop any activity that\nin any way hinders or impedes the existence of the flora and fauna present on the\nreferred properties without prior authorization from the Ministry of Environment and Energy and shall provide all\nnecessary collaboration to MINAE officials, researchers, natural resource\ninspectors who sporadically visit said area for the fulfillment of the functions inherent to\ntheir respective positions.\n\nArticle 3º-Said property shall be subject to the Wildlife Refuge category during a\nperiod of ten years, renewable for equal periods automatically if the owner\ndoes not express, within the term of three months prior to the expiration of the term, its desire to not\nsubmit its property to the Private National Wildlife Refuge regime.\n\nArticle 4º-The activities developed by the owner within this Refuge must comply with\nthe legal, regulatory and technical standards established by the Ministry of Environment and Energy and\nthose approved in the corresponding management plan (plan de manejo).\n\nArticle 5º-The vigilance of this refuge and the fulfillment of the technical provisions that to\nthis effect recommends the National System of Conservation Areas, through the Área de Conservación La\nAmistad Pacífico, shall be the responsibility of the property owner, the company Corporación\nde Desarrollo Agrícola Del Monte Sociedad Anónima.\n\nArticle 6º-The owner must send to the Área de Conservación La Amistad Pacífico, an annual\nreport on the following aspects: development and infrastructure within the property, achievements\nobtained, activities for the next period and the state of the natural resources on the property.\nSaid report must be approved by the State, as long as the activities conform to the\nproposed management plan (plan de manejo) and current legislation.\n\nArticle 7º-The owner of the indicated farm shall enjoy the benefits and incentives established\nin the Wildlife Conservation Law, for which the distinct involved\nministerial offices shall issue the necessary documents.\n\nArticle 8º-It becomes effective upon its publication.\n\nGiven at the Presidency of the Republic.-San José, on the twenty-eighth day of October of two thousand\nthree." }
