  "body_en_text": "throughout the text\n\n                    -\n\n                        Full Text of Norm 509\n\n                        Amendment to the Regulation for the Regulation and Control of the Efficient Use of\nFuel destined for the National Non-Sport Fishing Fleet in Jurisdictional Waters or Outside\nThem\n\nFull Text of record: 7003D\nAJDIP/509\n\nAJDIP/509.-Puntarenas, on the twenty-first day of November of the year\ntwo thousand three.\n\n \n\nConsidering:\n\n \n\n1º-That by agreement\nAJDIP/258-2002, dated September 12, 2002, this board of directors, in\naccordance with the provisions of Law No. 7384 of March 16, 1994,\npublished in the Official Gazette La Gaceta No.\n62, of March 29, 1994, Law Creating the Costa Rican Institute of\nFisheries and Aquaculture (INCOPESCA), issued the Regulation for the Regulation and\nControl of the Efficient Use of Fuel destined for the National Non-Sport Fishing Fleet\nin Jurisdictional Waters or Outside Them.\n\n \n\n2º-That said Regulation stipulates\nin its Article No. 10: \"The Purchase Order shall be valid for sixty calendar\ndays, once the term of its validity has expired without having been executed, the\nsame shall expire by operation of law and under no circumstance may it be\nrevalidated.\" 3º-That the Members of the Board consider it advisable that in exceptional\ncases of force majeure or fortuitous event, duly justified, the Administration\nmay assess the possibility of revalidating the exempted fuel purchase order.\n\nTherefore:\n\n \n\nIT IS AGREED:\n\n1º-To amend Article 10 of the\nFuel Regulation, so that it reads as follows:\n\n \n\n\"Article 10.-The Purchase Order\nshall be valid for sixty calendar days, once the term of its validity has expired\nwithout having been executed, the same shall expire by operation of law and only under\ncircumstances highly qualified as force majeure or fortuitous events in the judgment of the\nExecutive Presidency of INCOPESCA may it be revalidated.\n\nFor these purposes, the interested party,\nno later than within the 10 business days following its expiration, must\naddress a petition to your Office attaching the strict proofs that demonstrate\nthat the alleged circumstances of force majeure or fortuitous event are\ntrue. Under any circumstance, the interested\nparty must additionally present certification from RECOPE indicating\nthat said order has not been executed.\"\n\n2º-It takes effect upon its\npublication."
