  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31567\n\n                        Declara oficialmente como libre de la Mosca del Mediterráneo (Ceratitis\ncapitata, Wied) el área de Los Inocentes y Zonas Circunvecinas ubicadas en el Cantón La Cruz\n\nTexto Completo acta: 70553\nNº 31567\n\nNº 31567\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE\nAGRICULTURA Y GANADERÍA\n\n \n\nEn\nejercicio de las facultades conferidas en los artículos 140, incisos 3), 8),\n18) y 20) y 146 de la Constitución Política, los artículos 25, 27.1, 28.2b de\nla Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública,\nla Ley Nº 7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria, la Ley\nNº 1970 del 26 de octubre de 1955, Convención Internacional de Protección\nFitosanitaria y la Ley Nº 7475 del 20 de diciembre de 1994, Ley Aprobatoria del\nAcuerdo sobre Agricultura del Acta Final en que se incorporan los Resultados de\nla Ronda Uruguay de Negociaciones Comerciales Multilaterales.\n\n \n\nConsiderando:\n\n \n\n1º-Que\nla mosca del Mediterráneo (Ceratitis capitata, Wied) constituye una plaga de\ngran importancia económica que afecta un amplio rango de frutales y hortalizas,\ngenerando fuertes perjuicios económicos a la agricultura y limitando también\nlas posibilidades de los productos, de accesar a mercados internacionales, dado\nque se trata de una plaga clasificada como cuarentenaria.\n\n \n\n2º-Que\nla mosca del Mediterráneo fue detectada por primera vez en Costa Rica en la\nRegión Central en 1955, fecha y lugar a partir de las cuales se ha diseminado,\npor lo que es de amplia distribución en el país. \n\n \n\n3º-Que\nel Servicio Fitosanitario del Estado, mediante sistemas de detección, control y\nmonitoreo, aceptados internacionalmente, ha confirmado la ausencia de esta\nplaga del área circundante a la Hacienda Los Inocentes y zonas circunvecinas\nubicadas en el distrito de Santa Cecilia, cantón de La Cruz, provincia de\nGuanacaste. \n\n \n\n4º-Que\nlas partes contratantes de la Convención Internacional de Protección\nFitosanitaria aceptan el reconocimiento de áreas libres y de escasa prevalencia\nde plagas.\n\n \n\n5º-Que\nlas normas de la Convención establecen los requisitos para el establecimiento y\nuso de áreas libres de plagas (ALP) como una opción del manejo del riesgo para\nla Certificación Fitosanitaria de productos vegetales exportados del ALP .\n\n \n\n6º-Que\nse hace necesario adoptar las medidas técnicas y jurídicas que permitan evitar\nla reinfestación de la plaga a efecto de disminuir el riesgo fitosanitario para\nla explotación de frutales y hortalizas con fines de exportación, coadyuvando\nasí al mejoramiento de la calidad de vida de los productores y de la economía\nnacional. Por tanto:\n\nDECRETAN:\n\nArtículo\n1º-Se declara oficialmente como libre de la mosca del Mediterráneo (Ceratitis\ncapitata, Wied.) el área de Los Inocentes y zonas circunvecinas, ubicadas en el\ncantón La Cruz, incluyendo los distritos de La Cruz, Santa Cecilia y La Garita,\nProvincia de Guanacaste, Región Chorotega, área localizada en el polígono\ncomprendido entre las coordenadas:85.62655, 11.05197; -85.55231, 11.08611;\n-85.37728, 11.11538; -85.37891, 11.04710 y -85.47285, 10.97394. \n\nArtículo\n2º-Como efecto inmediato del reconocimiento de área libre de la plaga, la zona\nliberada quedará bajo control oficial manteniendo un sistema de monitoreo\nusando dispositivos para trampeo de moscas de la fruta.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 31567\n\n                        Officially declares the area of Los Inocentes and Surrounding Zones located in the Canton of La Cruz as free of the Mediterranean Fruit Fly (Ceratitis\ncapitata, Wied)\n\nComplete Text record: 70553\nNº 31567\n\nNº 31567\n\n \n\nTHE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF\nAGRICULTURE AND LIVESTOCK\n\n \n\nIn\nexercise of the powers conferred by articles 140, subsections 3), 8),\n18) and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.2b\nof Law Nº 6227 of May 2, 1978, General Law of Public Administration,\nLaw Nº 7664 of April 8, 1997, Law of Phytosanitary Protection, Law\nNº 1970 of October 26, 1955, International Plant Protection\nConvention, and Law Nº 7475 of December 20, 1994, Law Approving the\nAgreement on Agriculture of the Final Act Embodying the Results of the\nUruguay Round of Multilateral Trade Negotiations.\n\n \n\nConsidering:\n\n \n\n1º-That\nthe Mediterranean fruit fly (Ceratitis capitata, Wied) constitutes a pest of\ngreat economic importance that affects a wide range of fruit trees and vegetables,\ngenerating heavy economic losses to agriculture and also limiting\nthe possibilities of the products to access international markets, given\nthat it is a pest classified as quarantine.\n\n \n\n2º-That\nthe Mediterranean fruit fly was detected for the first time in Costa Rica in the\nCentral Region in 1955, date and place from which it has spread,\nand is therefore widely distributed in the country. \n\n \n\n3º-That\nthe State Phytosanitary Service, through internationally accepted detection, control, and\nmonitoring systems, has confirmed the absence of this\npest from the area surrounding Hacienda Los Inocentes and surrounding zones\nlocated in the district of Santa Cecilia, canton of La Cruz, province of\nGuanacaste. \n\n \n\n4º-That\nthe contracting parties to the International Plant Protection\nConvention accept the recognition of pest-free areas and areas of low pest\nprevalence.\n\n \n\n5º-That\nthe Convention's standards establish the requirements for the establishment and\nuse of pest-free areas (PFAs) as a risk management option for\nthe Phytosanitary Certification of plant products exported from the PFA.\n\n \n\n6º-That\nit is necessary to adopt the technical and legal measures to prevent\nreinfestation of the pest in order to reduce the phytosanitary risk for\nthe exploitation of fruit trees and vegetables for export purposes, thereby contributing\nto the improvement of the quality of life of producers and of the national\neconomy. Therefore:\n\nTHEY DECREE:\n\nArticle\n1º-The area of Los Inocentes and surrounding zones, located in the\ncanton of La Cruz, including the districts of La Cruz, Santa Cecilia, and La Garita,\nProvince of Guanacaste, Chorotega Region, an area located in the polygon\ncomprised between the coordinates: -85.62655, 11.05197; -85.55231, 11.08611;\n-85.37728, 11.11538; -85.37891, 11.04710, and -85.47285, 10.97394, is officially declared as free of the Mediterranean fruit fly (Ceratitis\ncapitata, Wied.). \n\nArticle\n2º-As an immediate effect of the recognition of a pest-free area, the\nliberated zone shall remain under official control, maintaining a monitoring system\nusing devices for trapping fruit flies. For the purpose of reducing\nthe risk of reinfestation, the State Phytosanitary Service shall proceed to\nestablish the phytosanitary measures required as appropriate.\n\nArticle\n3º-It is declared that to maintain the area free of said pest, the phytosanitary protection\nmeasures that proceed to prevent its reintroduction are of mandatory particular interest, and all phytosanitary measures issued by the\nState Phytosanitary Service are matters of public order and mandatory compliance.\n\nArticle\n4º-All persons, natural or legal, public or private, in particular\nthe agents related, directly or indirectly, to the production,\ncommercialization, and movement of fruits and vegetables into this area, who\nhave knowledge of the pest must report it to the State Phytosanitary Service.\n\nArticle\n5º-In the event of an outbreak of the Mediterranean fruit fly within the pest-free area, the\nowners or occupants by any title of the fruit and vegetable\nplantations within the free zone must execute all phytosanitary\nmeasures ordered to them by the State Phytosanitary\nService. Otherwise, proceedings shall be in accordance with the provisions of article 15\nof the Law of Phytosanitary Protection, without prejudice to the criminal\nliabilities they may incur, in accordance with the provisions of\nclauses 17 and 68 of the Law of Phytosanitary Protection.\n\nArticle\n6º-For the use of the funds contemplated in article 66 of the Law\nof Phytosanitary Protection, any outbreak of the pest in the area recognized as free shall be declared a state of emergency in this Executive Decree.\nThe State Phytosanitary Service shall arrange the use of those resources\nfor the control and combat of the pest and shall carry out the corresponding\nliquidation, a posteriori, in accordance with the administrative procedures\nthat regulate the matter. \n\nArticle\n7º-Public or private, autonomous or semi-autonomous institutions are\nempowered to make donations and economic contributions, within the legal\nframework of reference that governs each of them, as well as to provide all types\nof collaboration to the State Phytosanitary Service to address this\nphytosanitary emergency. \n\nArticle\n8º-It shall be effective upon its publication.\n\n \n\nGiven\nat the Presidency of the Republic.-San José, on the twenty-fifth day of the month of\nJuly of two thousand three."
