  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31591\n\n                        Redefine límites del Parque Nacional Palo Verde\n\nTexto Completo acta: 70A7A\nDECRETOS\n\nNº 31591-MINAE\n\n    EL PRESIDENTE DE LA REPÚBLICA\n\n    Y EL MINISTRO DE AMBIENTE Y ENERGÍA\n\nDe conformidad\ncon las facultades establecidas en el artículo 140 inciso 3) y 18) y 146, de la\nConstitución Política, los artículos 13 a 18 de la Ley Forestal N° 7575 publicada el\n16 de abril de 1996, 32 a 38 de la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de\n1995 y 13 de la Ley Nº 6084 del 24 de agosto de 1977 de Creación del Servicio de Parques\nNacionales.\n\nConsiderando:\n\n1º—Que es\npolítica del Gobierno y del Ministerio de Ambiente y Energía la conservación de los\nrecursos naturales y el desarrollo sostenible.\n\n2º—Que\npor Decreto Ejecutivo Nº 8492-A del 1º de junio de 1978 se creó la Reserva Biológica\nPalo Verde.\n\n3º—Que\nmediante Decreto Ejecutivo Nº 10535 del 17 de setiembre de 1979, Nº 12586-A del 24 de\nabril de 1981 y Nº 15119-MAG del 4 de enero de 1984, se cambió la categoría de manejo a\nla Reserva Biológica Palo Verde por Refugio de Vida Silvestre Rafael Lucas Rodríguez\nCaballero y se ampliaron sus límites.\n\n4º—Que\npor decreto ejecutivo No. 11541-A del 30 de mayo de 1980 publicado en La Gaceta Nº\n112 del 13 de junio de 1980 se creó el Parque Nacional Palo Verde, segregado después\nmediante Decreto Ejecutivo Nº 12765-A de 16 de julio de 1981, publicado en La Gaceta 134\nde 16 de julio de 1981 excepto en cuanto a la finca número 34388 inscrita al tomo 2327,\nfolio 525, asiento 5.\n\n5º—Que la\nLey 6794 del 25 de agosto de 1982 publicada en La Gaceta Nº 248 del 27 de\ndiciembre de 1982 ratificó en su artículo 1°, inciso k) el Parque Nacional Palo Verde\ncreado por DE. 11541-A.\n\n6º—Que\npor decreto ejecutivo N° 20082 del 9 de noviembre de 1990 publicado en La Gaceta Nº\n234 Alcance 46 de 10 de diciembre de 1990 se adicionaron los terrenos del Refugio Rafael\nLucas Rodríguez Caballero al Parque Nacional Palo Verde, perdiendo por tanto la\nnomenclatura que ostentaba esa área silvestre.\n\n7º—Que\nmediante Decreto Ejecutivo Nº 24426 publicado en La Gaceta Nº 139 de 21 de julio\nde 1995 se amplió el Parque Nacional Palo Verde incorporándole el corredor biológico\ndel bosque La Mula.\n\n8º—Que\ncon la emisión de los decretos relacionados se incluyeron algunos sectores al Parque\nNacional Palo Verde en que el Instituto de Desarrollo Agrario (IDA) había adjudicado\nparcelas para fines agropecuarios, principalmente en el Asentamiento Bagatzí.\n\n9º—Que\ncomo medida para diagnóstico y propuesta de soluciones al problema socioeconómico de\nBagatzí el IDA procedió al levantamiento catastral en dos planos con los catastrados\nG-738420-2001 con una extensión de 8879Ha.7637.12 m² y Nº G-714022-2001 con una\nextensión de 42 Ha. 4977.50 m² dentro del Parque Nacional Palo Verde. 10.—Que con\nel estudio catastral aportado por IDA se definieron los límites reales del Parque\nNacional Palo Verde en el Sector Norte revelando al Área de Conservación\nArenal-Tempisque la necesidad de redefinición de los límites de esta área silvestre\nprotegida. Por tanto:\n\nDECRETAN:\n\nArtículo\n1º—Redefinir los límites del Parque Nacional Palo Verde, de la siguiente manera.\n\nSegún los\nmapas básicos del Instituto Geográfico Nacional, Hojas cartográficas Cañas, Tempisque,\nTalolinga, Abangares, a escala 1:50.000. Continúa hasta un punto ubicado en el camino público de coordenadas N\n263233.48 E 393481.04, prosiguiendo por el camino público, pasando por los puntos de\ncoordenadas N 263526.75 E 393244.93 y N 264079.04 E 393342.95, hasta un punto de\ncoordenadas N 264449.86 E 393725.48. Del punto anterior se continúa sobre el camino\npúblico hasta la intersección de camino a Falconeana y Bagatzi de coordenadas N\n265934.70 E 394008.12, continúa por el camino hasta intersección del camino viejo a San\nRamón, de coordenadas N 267166.30 E 394251.30, se continúa sobre el lindero de la finca\nInversiones Campos Bastos S. A. hasta interceptarse con el Canal Oeste Tramo 2, de\ncoordenadas N 267294.82 E 394276.73. El límite continúa a partir de la coordenadas N\n267354.86 E 394285.06, ubicado en la margen derecha del Canal Oeste Tramo 2, prosiguiendo\nen línea recta hasta interceptar con el límite de la Reserva Biológica Lomas Barbudal\nen el punto de coordenadas N 267670.41, E 394350.61, ubicado en la curva de 60 metros\nsobre el nivel del mar. A partir de ese punto, dicha curva delimita el parque por el norte\nhasta el vértice de coordenadas N 267598.69 E 393.547.12 que también se encuentra en la\ncota de nivel de los 60 metros sobre el nivel del mar, en el límite con la Reserva\nBiológica Lomas Barbudal. Continúa el límite hasta el punto de coordenadas N 267392.85\nE 393191.37, ubicado en la margen derecha del Canal Oeste Tramo 2. El límite continúa\ndel punto de coordenadas N 267371.32 E 393132.59 ubicado en el derecho de vía del Canal\nOeste, correspondiente al punto donde intercepta con el camino a Aguas Frías, continua\nsobre ese mismo camino con rumbo Sureste hasta la intersección del camino a Parcelas\nBagatzi de coordenadas N 267268.23 E 393129.78, el límite prosigue por el camino público\nhasta la intersección del camino público , en la Parcela 33 del Anillo de Protección\nBagatzi de coordenadas N 267141.47 E 393547.12, continúa sobre el camino público a\nParcelas Bagatzi hasta la intersección con el camino frente a la Parcela 28 y Parcela 33,\nde coordenadas N 266994.63 E 393413.45 , se continúa sobre el camino hasta un punto de\ncoordenadas N 266903.42 E 393686.42, se prosigue por el camino hasta un punto en el Anillo\nde Protección Bagatzi, de coordenadas N 266560.27 E 393406.31.   "body_en_text": "DECREES\n\nNo. 31591-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn accordance with the powers established in Article 140, subsections 3) and 18), and Article 146 of the Political Constitution, Articles 13 to 18 of the Forest Law (Ley Forestal) No. 7575 published on April 16, 1996, Articles 32 to 38 of the Organic Law of the Environment No. 7554 of October 4, 1995, and Article 13 of Law No. 6084 of August 24, 1977, creating the National Parks Service.\n\nConsidering:\n\n1º—That the conservation of natural resources and sustainable development are policies of the Government and the Ministry of Environment and Energy.\n\n2º—That by Executive Decree (Decreto Ejecutivo) No. 8492-A of June 1, 1978, the Palo Verde Biological Reserve was created.\n\n3º—That through Executive Decree No. 10535 of September 17, 1979, No. 12586-A of April 24, 1981, and No. 15119-MAG of January 4, 1984, the management category of the Palo Verde Biological Reserve was changed to Rafael Lucas Rodríguez Caballero Wildlife Refuge and its boundaries were expanded.\n\n4º—That by Executive Decree No. 11541-A of May 30, 1980, published in La Gaceta No. 112 of June 13, 1980, the Palo Verde National Park was created, later segregated by Executive Decree No. 12765-A of July 16, 1981, published in La Gaceta 134 of July 16, 1981, except regarding farm number 34388 registered in volume 2327, folio 525, entry 5.\n\n5º—That Law 6794 of August 25, 1982, published in La Gaceta No. 248 of December 27, 1982, ratified in its Article 1, subsection k) the Palo Verde National Park created by DE. 11541-A.\n\n6º—That by Executive Decree No. 20082 of November 9, 1990, published in La Gaceta No. 234, Supplement 46, of December 10, 1990, the lands of the Rafael Lucas Rodríguez Caballero Wildlife Refuge were added to the Palo Verde National Park, therefore losing the nomenclature that this wild area held.\n\n7º—That through Executive Decree No. 24426 published in La Gaceta No. 139 of July 21, 1995, the Palo Verde National Park was expanded by incorporating the La Mula forest biological corridor.\n\n8º—That with the issuance of the related decrees, some sectors were included in Palo Verde National Park where the Institute of Agrarian Development (Instituto de Desarrollo Agrario, IDA) had allocated parcels for agricultural purposes, mainly in the Bagatzí Settlement.\n\n9º—That as a diagnostic measure and proposal for solutions to the socioeconomic problem of Bagatzí, the IDA conducted a cadastral survey in two maps with cadastre numbers G-738420-2001 with an area of 8879Ha.7637.12 m² and No. G-714022-2001 with an area of 42 Ha. 4977.50 m² within Palo Verde National Park. 10.—That the cadastral study provided by IDA defined the real boundaries of the Palo Verde National Park in the Northern Sector, revealing to the Arenal-Tempisque Conservation Area the need for redefining the boundaries of this protected wild area. Therefore:\n\nTHEY DECREE:\n\nArticle 1º—To redefine the boundaries of Palo Verde National Park, as follows.\n\nAccording to the basic maps of the National Geographic Institute (Instituto Geográfico Nacional, IGN), topographic sheets Cañas, Tempisque, Talolinga, Abangares, at a scale of 1:50,000. It continues to a point located on the public road at coordinates N 263233.48 E 393481.04, continuing along the public road, passing through the points at coordinates N 263526.75 E 393244.93 and N 264079.04 E 393342.95, to a point at coordinates N 264449.86 E 393725.48. From the previous point, it continues along the public road to the intersection of the road to Falconeana and Bagatzi at coordinates N 265934.70 E 394008.12, continues along the road to the intersection of the old road to San Ramón, at coordinates N 267166.30 E 394251.30, continuing along the boundary line of the Inversiones Campos Bastos S. A. farm until intersecting with the West Canal (Canal Oeste) Section 2, at coordinates N 267294.82 E 394276.73. The boundary continues from coordinates N 267354.86 E 394285.06, located on the right bank of the West Canal Section 2, proceeding in a straight line until intersecting the boundary of the Lomas Barbudal Biological Reserve at the point of coordinates N 267670.41, E 394350.61, located on the 60-meter curve above sea level. From that point, said curve delimits the park to the north up to the vertex at coordinates N 267598.69 E 393.547.12, which is also located on the 60-meter contour line above sea level, on the boundary with the Lomas Barbudal Biological Reserve. The boundary continues to the point at coordinates N 267392.85 E 393191.37, located on the right bank of the West Canal Section 2. The boundary continues from the point at coordinates N 267371.32 E 393132.59, located within the right-of-way of the West Canal, corresponding to the point where it intersects the road to Aguas Frías, continuing along that same road in a southeasterly direction to the intersection of the road to Parcelas Bagatzi at coordinates N 267268.23 E 393129.78, the boundary continues along the public road to the intersection of the public road, in Parcel 33 of the Bagatzi Protection Ring, at coordinates N 267141.47 E 393547.12, continues along the public road to Parcelas Bagatzi to the intersection with the road in front of Parcel 28 and Parcel 33, at coordinates N 266994.63 E 393413.45, continuing along the road to a point at coordinates N 266903.42 E 393686.42, proceeding along the road to a point in the Bagatzi Protection Ring, at coordinates N 266560.27 E 393406.31.
