  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31631\n\n                        Crea  Refugio Nacional de Vida Silvestre Rancho Mastatal en la modalidad de\npropiedad privada\n\nTexto Completo acta: 70F88\nNº 31631-MINAE\n\nNº 31631-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\nEn el ejercicio de las facultades conferidas por el artículo 140, incisos 3) y 18), y 146 de la\nConstitución Política y con fundamento en lo dispuesto en los artículos 82 y 87 de la Ley de\nConservación de la Vida Silvestre Nº 7317 del 30 de octubre de 1992, la Ley de Creación del\n\nServicio de Parques Nacionales Nº 6084, la Ley Orgánica del Ambiente Nº 7554 y los artículos 6º, 11\ny 27 de la Ley General de la Administración Pública, y\n\nConsiderando:\n\n1º-Que los artículos 82 y 87 de la Ley Nº 7317 del 30 de octubre de 1992, establecen que son\nrefugios nacionales de vida silvestre los que el Poder Ejecutivo declare como tales para la\nprotección e investigación de la flora y la fauna silvestre.\n\n2º-Que el artículo 84 de la Ley Nº 7317 autoriza al Poder Ejecutivo para establecer refugios\nnacionales de vida silvestre de propiedad privada en terrenos particulares, previa autorización de\nsu propietario.\n\n3º-Que el artículo 32 de la Ley Orgánica del Ambiente, del 4 de octubre de 1995, establece que el\nMinisterio del Ambiente y Energía está facultado para establecer áreas silvestres protegidas bajo la\ncategoría de manejo refugios nacionales de vida silvestre.\n\n4º-Que el 16 de junio del 2002, los señores Timothy O'Hara, de único apellido en razón de su\nnacionalidad estadounidense, soltero, gerente de ventas, vecino de Mastatal, distrito Chires, cantón\nde Puriscal, 50 metros al oeste de la Guardia de Asistencia Rural, pasaporte de su país número Z\nsiete dos tres nueve dos dos cinco y Robin Nunes, de único apellido en razón de su nacionalidad\nestadounidense, soltera, artesana, vecina de Mastatal, distrito Chires, cantón Puriscal, 50 metros\nal oeste de la Guardia de Asistencia Rural, pasaporte de su país número cero siete cinco seis seis\nsiete siete uno cinco, en sus calidades de tesorero y secretaria respectivamente de la sociedad\ndomiciliada en San José, Ecoeventos Montamar Dos Mil Sociedad Anónima, con cédula de persona\njurídica número tres-ciento uno-doscientos sesenta y ocho mil doscientos ocho, inscrita en la\nSección Mercantil del Registro Público, al tomo mil trescientos tres, folio ciento noventa y cuatro,\nasiento doscientos diecinueve, ambos con facultades de apoderados generalísimos sin límite de suma,\npudiendo actuar conjunta o separadamente, solicitaron al Director del Área de Conservación Pacífico\nCentral la inclusión de sus propiedades, conocidas como Rancho Mastatal, bajo el régimen de Refugio\nNacional de Vida Silvestre de propiedad privada.\n\n5º-Que de conformidad con informe de visita de inspección, fechado el 4 de noviembre del 2002, el\nRancho Mastatal se encuentra cubierto de bosque en diferentes estados de sucesión secundaria, con\nalgunos remanentes de bosque primario en los cauces de ríos y quebradas; y que el Rancho Mastatal se\nencuentra en la zona de vida Bosque Muy Húmedo Tropical y protege una gran diversidad de especies de\nárboles entre los que sobresalen: espavel (Anacardium exe1sum), gallinazo (Schizolobium parahybum),\nquira (Caryodapnoides burgueri), ronrrón (Astronium graveolens), nazareno (Peltogyne purpurea),\ncachimbo (Couratari guianensis), cristóbal (Platymiscium pinnatum), higuerón (Ficus sp.), jabillo\n(Hura crepitans), laurel (Cordial alliodora), guayacán (Tabebuia guayacan), mastate (Ficus ps),\npilón (Hieronima alchornoides), ojoche (Brosimum sp) cedro maría (Colophylum brasiliense), fruta\ndorada (Virola koschnyi), pavilla (Schefflera morototoni), bálsamo (Myroxylon balsamum) y ceiba\n(Ceiba pentandra).\n\n6º-Que el Rancho Mastatal protege el hábitat natural de gran variedad de fauna entre las que se\nencuentran la rana venenosa verde y negro (Dendrobates auratus), la tortuga candado (Kinosternon\nleucostomum), el cherepo (Basiliscus basiliscus), la boa (Boa constrictor), la tercipelo (Bothrops\nasper), el perezoso de dos dedos (Choloepus hoffmani), armadillo (Dasypus novemcinctus), martilla\n(Potos flavus), grisón (Gallictis vittata), pizote (Nasua narica), oso hormiguero (Tamandua\nmexicana), mono carablanca (Cebus capucinus), tepezcuintle (Agouti paca), saino (Tayassu tajacu),\nmanigordo (Felis pardalis), caucel (Felis Wiedii) y león breñero (Felis yagoaroundi), además de gran\ndiversidad de aves, entre las que destacan el martín pescador grande, perico barbianaranjado\n(Brotogeris jugularis), momoto común (Momotus momota), gavilán tijerilla, cuco ardilla (Piaya\ncayana), carpintero cabeza roja (Campephillus guatemalesis), lora verde (Amazona farinosa), cusingo\n(Pteroglossus torquatus), tucán quioro (Ramphastos swainsoni), tucán pico iris (Ramphastos\nsulfuratus), lechuza penachuda, tangara veranera, trogón coliplomizo, gavilán guaco (Herpetotheres\ncachinnans), chirincoca (Aramides cajanea), gallina de monte (Tinamus major).\n\n7º-Que el Rancho Mastatal se encuentra en la zona de amortiguamiento del Parque Nacional La Cangreja\ny junto con éste forman parte del Corredor Biológico del Pacífico Central, que posee una gran\ncantidad de especies endémicas de Costa Rica.  8º-Que la administración de la vida silvestre y la\nrecomendación de medidas que aseguren la perpetuidad de las especies es función del Ministerio del\nAmbiente y Energía.\n\n9º-Que los propietarios de los inmuebles accedieron voluntariamente a incorporarse a este régimen de\nprotección de la biodiversidad.\n\n10.-Que el Área de Conservación Pacífico Central aprobó el Plan de Manejo aportado por los\npropietarios. Por tanto,\n\nDECRETAN:\n\nArtículo 1º-Crease el Refugio Nacional de Vida Silvestre Rancho Mastatal en la modalidad de\npropiedad privada, que incluye los inmuebles pertenecientes a la sociedad Ecoeventos Montamar Dos\nMil Sociedad Anónima, ubicados en la Comunidad de Mastatal, distrito Chires, cantón Puriscal,\nprovincia de San José y que se encuentran inscritos en el Registro Público de la Propiedad bajo el\nSistema de Folio Real, partido de San José, la primera corresponde a la matrícula número doscientos\nsesenta y nueve mil doscientos setenta y uno-cero cero cero, que corresponde a su vez al plano\ncatastrado Nº SJ-seis cuatro siete nueve uno uno-dos cero cero cero, con una medida según registro\nde ochenta y cuatro hectáreas cinco mil quinientos cincuenta y cinco metros cuadrados, la segunda\npropiedad corresponde a la matrícula número doscientos sesenta y nueve mil doscientos sesenta y\nnueve-cero cero cero, que corresponde al plano catastrado Nº SJ-uno-uno-cuatro nueve dos cero-uno\nocho cuatro cero, con una medida según registro de cuatro mil quininentos un metros cuadrados y la\ntercera corresponde a la matrícula número dos seis nueve uno ocho nueve-cero cero cero, con una\nmedida de cinco hectáreas seis mil cuatrocientos treinta y ocho metros cuadrados con 55 decímetros\ncuadrados.\n\nArtículo 2º-El manejo y aprovechamiento de la vida silvestre dentro del Refugio queda sujeto al Plan\nde Manejo aprobado.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 31631\n\n                        Creates the Rancho Mastatal National Wildlife Refuge in the private\nproperty modality\n\nComplete Text of record: 70F88\nNo. 31631-MINAE\n\nNo. 31631-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn the exercise of the powers conferred by Article 140, subsections 3) and 18), and 146 of the\nPolitical Constitution and based on the provisions of Articles 82 and 87 of the Wildlife\nConservation Law No. 7317 of October 30, 1992, the Law Creating the\n\nNational Parks Service No. 6084, the Organic Environmental Law No. 7554, and Articles 6, 11,\nand 27 of the General Law of Public Administration, and\n\nConsidering:\n\n1.—That Articles 82 and 87 of Law No. 7317 of October 30, 1992, establish that national\nwildlife refuges are those that the Executive Branch declares as such for the\nprotection and research of wild flora and fauna.\n\n2.—That Article 84 of Law No. 7317 authorizes the Executive Branch to establish national\nwildlife refuges of private property on private lands, with the prior authorization of\ntheir owner.\n\n3.—That Article 32 of the Organic Environmental Law, of October 4, 1995, establishes that the\nMinistry of Environment and Energy is empowered to establish protected wild areas under the\nmanagement category of national wildlife refuges.\n\n4.—That on June 16, 2002, Mr. Timothy O'Hara, of a single surname by reason of his\nUnited States nationality, single, sales manager, resident of Mastatal, Chires district, canton\nof Puriscal, 50 meters west of the Guardia de Asistencia Rural, passport from his country number Z\nseven two three nine two two five, and Ms. Robin Nunes, of a single surname by reason of her\nUnited States nationality, single, artisan, resident of Mastatal, Chires district, canton of\nPuriscal, 50 meters west of the Guardia de Asistencia Rural, passport from her country number zero seven five six six\nseven seven one five, in their capacities as treasurer and secretary, respectively, of the company\ndomiciled in San José, Ecoeventos Montamar Dos Mil Sociedad Anónima, with legal entity identification\nnumber three-one zero one-two sixty-eight thousand two zero eight, registered in the\nMercantile Section of the Public Registry, at volume one thousand three three, folio one ninety-four,\nentry two nineteen, both with powers as unrestricted general agents without limit of sum,\nbeing able to act jointly or separately, requested the Director of the Pacific Central Conservation Area\nthe inclusion of their properties, known as Rancho Mastatal, under the regime of National\nWildlife Refuge of private property.\n\n5.—That in accordance with the inspection visit report, dated November 4, 2002, the\nRancho Mastatal is covered with forest in different states of secondary succession, with\nsome remnants of primary forest in the river and stream beds; and that the Rancho Mastatal is\nlocated in the Tropical Very Humid Forest life zone and protects a great diversity of tree\nspecies, among which stand out: espavel (Anacardium excelsum), gallinazo (Schizolobium parahybum),\nquira (Caryodaphnopsis burgeri), ron-ron (Astronium graveolens), nazareno (Peltogyne purpurea),\ncachimbo (Couratari guianensis), cristóbal (Platymiscium pinnatum), strangler fig (higuerón) (Ficus sp.), sandbox tree (jabillo) (Hura crepitans), laurel (Cordia alliodora), guayacán (Tabebuia guayacan), mastate (Ficus sp.),\npilón (Hieronyma alchorneoides), breadnut (ojoche) (Brosimum sp.), Santa Maria (cedro maría) (Calophyllum brasiliense), fruta dorada (Virola koschnyi), pavilla (Schefflera morototoni), bálsamo (Myroxylon balsamum), and ceiba (Ceiba pentandra).\n\n6.—That the Rancho Mastatal protects the natural habitat of a great variety of fauna, among which\nare the green and black poison dart frog (Dendrobates auratus), the white-lipped mud turtle (Kinosternon\nleucostomum), the common basilisk (cherepo) (Basiliscus basiliscus), the boa constrictor (Boa constrictor), the fer-de-lance (Bothrops\nasper), the two-toed sloth (Choloepus hoffmanni), the nine-banded armadillo (Dasypus novemcinctus), the kinkajou (martilla) (Potos flavus), the grison (Gallictis vittata), the coati (pizote) (Nasua narica), the northern tamandua (oso hormiguero) (Tamandua\nmexicana), the white-faced capuchin monkey (Cebus capucinus), the paca (tepezcuintle) (Cuniculus paca), the collared peccary (saino) (Pecari tajacu), the ocelot (manigordo) (Leopardus pardalis), the margay (caucel) (Leopardus wiedii), and the jaguarundi (león breñero) (Herpailurus yagouaroundi), in addition to a great\ndiversity of birds, among which stand out the ringed kingfisher, orange-chinned parakeet\n(Brotogeris jugularis), blue-crowned motmot (Momotus momota), swallow-tailed kite, squirrel cuckoo (Piaya\ncayana), pale-billed woodpecker (Campephilus guatemalensis), mealy parrot (Amazona farinosa), collared aracari (cusingo)\n(Pteroglossus torquatus), chestnut-mandibled toucan (Ramphastos swainsonii), keel-billed toucan (Ramphastos\nsulfuratus), spectacled owl, summer tanager, slaty-tailed trogon, laughing falcon\n(Herpetotheres cachinnans), grey-necked wood-rail (Aramides cajanea), great tinamou (Tinamus major).\n\n7.—That the Rancho Mastatal is located in the buffer zone of La Cangreja National Park\nand together with it forms part of the Pacific Central Biological Corridor, which possesses a great\nquantity of species endemic to Costa Rica. 8.—That the administration of wildlife and the\nrecommendation of measures that ensure the perpetuity of species is a function of the Ministry\nof Environment and Energy.\n\n9.—That the owners of the properties voluntarily agreed to enter into this regime of\nprotection of biodiversity.\n\n10.—That the Pacific Central Conservation Area approved the management plan (plan de manejo) provided by the\nowners. The Ministry of Environment and Energy shall also supervise its execution and may\nissue technical and scientific standards that the owners must follow.\n\nArticle 3.—The owners of said properties undertake not to develop any activity\nthat endangers the existence of the flora and fauna and shall provide the necessary collaboration\nto researchers and park rangers of the Ministry of Environment and Energy who visit the area in\nthe performance of their official duties.\n\nArticle 4.—In the event that the owners decide to change the purpose of the Refuge,\nthey must notify the Ministry of Environment and Energy at least six months in advance of the\nperiod of expiration of the ten-year term for which they voluntarily submit to the protection\nregime.\n\nArticle 5.—It shall be in force for a period of ten years from its publication, automatically\nextendable if the owners do not state in writing their intention not to continue under the\nprotection regime at least one month in advance of the expiration of the term established herein.\n\nGiven at the Presidency of the Republic.—San José, on the third day of the month of September of two thousand\nthree."
