Ciencia y Tecnología\", N° 9046 del 25 de junio de 2012)\n\n \n\n \n\nEn uso de\nlas facultades que le confiere el artículo 140, incisos 3) y 18) de la\nConstitución Política y;\n\n \n\nConsiderando:\n\n \n\nI.-Que\npor Decreto Ejecutivo Nº 25636-MINAE-S del 31 de octubre de 1996, publicado en\nel Diario Oficial, el jueves 28 de noviembre de 1996, se le dio fundamento\nlegal al Programa Bandera Azul Ecológica.\n\nII.-Que\nmediante el Decreto Ejecutivo Nº 27010-MINAE-S del 21 de abril de 1998,\npublicado el jueves 4 de junio de 1998, se modificó el Decreto original con el\nobjetivo de introducir la gradación de las estrellas o categorías \"A\", \"AA\" y\n\"AAA\", en el incentivo Bandera Azul Ecológica.\n\nIII.-Que el\nPrograma Bandera Azul Ecológica, nace como una respuesta al constante peligro\nde contaminación existente en nuestras costas, que atenta contra la salud\npública y la industria del turismo. \n\nIV.-Que\nla Comisión Nacional del Programa Bandera Azul Ecológica, realizó, el 3 de mayo\ndel 2001 un Plan Estratégico para el período 2001-2006, en el cual se modificó\nel objetivo general, se establecieron nuevas metas y se amplió el programa a\ncomunidades; para lo cual se definen dos categorías de agrupaciones participantes:\nOrganización comunal de playas y comunidades. \n\nV.-Que es\nde interés nacional promover la excelencia higiénicosanitaria\nde las playas y comunidades, con el objetivo de fortalecer la salud pública y\nel atractivo turístico del mayor número de comunidades y playas ubicadas en el\nterritorio nacional. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo\n1º-El Programa BAE tiene por objetivo general establecer un incentivo para\npromover la organización de comités locales que involucren la participación de\nla ciudadanía, con el afán de desarrollar las playas y comunidades y mejorar\nlas condiciones higiénico sanitarias, en concordancia con la protección de los\nrecursos hídricos y ambiente en general.\n\n \n\n(NOTA: Mediante\nDecreto Ejecutivo No. 31648 de 9 de febrero de 2004, se amplían los alcances\ndel Programa Bandera Azul Ecológica contenidos en este decreto, \"como\nincentivo para organizar a los educadores, educandos y personal del área\nadministrativa de los centros educativos públicos y privados (preescolar,\nescuelas y colegios), con el fin de promover la adopción de prácticas\nsostenibles y sustentables, amigables con el ambiente, mediante la mejora\ncontinua de las condiciones higiénico sanitarias de su infraestructura física,\ncampañas de protección de los recursos naturales, programas de educación\nambiental y la incorporación del centro estudiantil a la comunidad respectiva,\nentre otros\").\n\n(NOTA:\nMediante decreto ejecutivo N° 33604 del 31 de enero de 2007, se amplían los\nalcances del Programa Bandera Azul Ecológica,incluyendo, una nueva categoría denominada Espacios\nNaturales Protegidos (privados), con la finalidad de reconocer a los gestores\nde estos espacios los esfuerzos realizados en la promoción y adopción de\nprácticas, sostenibles y amigables con el ambiente, mediante conservación del\nbosque priario, ecoturismo y mixtos (zonas destinadas\na conservación boscosa combinadas con actividades agropecuarias y turísticas)\n\nArtículo 2º-Para efectos de este\ndecreto, se entenderá por:\n\n \n\n1) Programa Bandera Azul Ecológica (PBAE): Incentivo para que los\nhabitantes de las organizaciones comunales de playas y las comunidades se\norganicen, con el afán de proteger los recursos naturales, los atractivos\nturísticos y así brindar una mejor calidad de vida a los habitantes y turistas.\n\n2) Bandera Azul Ecológica (BAE): Signo externo que identifica a las\norganizaciones comunales de playas y comunidades que cumplen con los parámetros\nestablecidos.\n\n3) Comisión Nacional del Programa Bandera Azul Ecológica (CNPBAE):\nEncargada de la administración del Programa, conformada por el Ministerio de\nSalud, el Ministerio de Ambiente y Energía(*), el Instituto Costarricense de\nAcueductos y Alcantarillados, el Instituto Costarricense de Turismo,  la\nCámara Nacional de Turismo y *Comisión Nacional del Programa Bandera Azul\nEcológica.\n\n \n\n(*Así incorporado por el artículo\n7° del decreto ejecutivo N° 33604 del 31 de enero de 2007)\n\n \n\n4) Organización comunal de playa: Está constituida por la ciudadanía,\nempresa privada, organizaciones no gubernamentales, gobierno local e\ninstituciones públicas, que conforman el entorno y el litoral de una zona costera.\n\n5) Comunidad: Ciudadanía, empresa\nprivada, organizaciones no gubernamentales, gobierno local e instituciones\npúblicas de una localidad determinada.\n\n6) Comité Local: Miembros de la organización de la playa o comunidad\nque se integran con el fin de participar en pro del Programa.\n\n7) Equipo Técnico de Trabajo: El grupo encargado de realizar las\nevaluaciones correspondientes, de acuerdo al tipo de organización comunal de\nplaya o comunidad participante.\n\n8) Categorías o Estrellas: Gradación establecida para el Programa BAE\nen organizaciones comunales de playas y comunidades que van de una estrella-dos\nestrellas-tres estrellas o cuatro estrellas y serán otorgadas a partir del\ncumplimiento del 90% de los parámetros definidos.\n\n9) Sello de Calidad Sanitaria: Incentivo para organizar a los entes\noperadores de los diferentes tipos de acueductos, para que suministren agua de\ncalidad potable en forma sostenible y en armonía con la naturaleza.\n\nDe los fines del Programa Bandera Azul\nEcológica\n\n \n\n(*)(Modificada su denominación por el artículo 11 de\nla Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al\nMinisterio de Ciencia y Tecnología\", N° 9046 del 25 de junio de 2012)\n\nArtículo\n3º-El Programa BAE tiene como objetivos específicos:\n\n \n\nInciso 1) En el caso de\nlas organizaciones comunales de las playas:\n\na)\nLa organización de los habitantes de las zonas costeras para lograr el\ndesarrollo en concordancia con la protección de la calidad sanitaria de las\nplayas.\n\nb)\nEl suministro de agua para consuno humano de calidad potable.\n\nc)\nEl tratamiento previo de desechos líquidos industriales y domésticos que\ndescargan directa o indirectamente al mar.\n\nd)\nLa limpieza de las playas, eliminando las basuras inorgánicas y colocando\nrecipientes para la basura a lo largo de la playa.\n\ne)\nLa educación ambiental en las respectivas zonas costeras.\n\nf)\nLa rotulación adecuada que guíe y oriente al turista.\n\ng)\nLa mejora en la calidad de vida de los habitantes y visitantes de las zonas\ncosteras.\n\nh)\nProporcionar facilidades que permitan disfrutar de la playa y las instalaciones\ndel entorno, a cualquier ciudadano sin discriminaciones, de modo que ofrezca\naccesos cómodos y seguros para personas con algún padecimiento o discapacitada.\n\n \n\nInciso 2) En el caso de\nlas Comunidades:\n\na)\nOrganizar a las comunidades con el fin de administrar y vigilar integralmente\nlos recursos naturales, promoviendo el desarrollo de programas de saneamiento\nbásico, educación ambiental y la atención integral de la salud en cada comunidad.\n\nb)\nPromover la disposición adecuada de los desechos sólidos y líquidos producidos\nen las comunidades participantes.\n\nc)\nImpulsar la rotulación en la comunidad en general y lugares turísticos que\nguíen y orienten a los habitantes y turistas.\n\nd)\nPromover el tratamiento de los desechos líquidos domésticos e industriales.\n\ne)\nFomentar la protección de los recursos hídricos y los recursos naturales en\ngeneral.\n\nf)\nImpulsar la seguridad policial de las comunidades.\n\ng)\nDesarrollar programas de educación ambiental con el afán de generar una conciencia\nambiental en los habitantes y visitantes.\n\nh)\nInventariar los recursos hídricos y definir sus usos en cada comunidad.\n\ni)\nPromover la atención integral de la salud comunitaria y mejorar la calidad de\nvida de los turistas y habitantes locales de cada comunidad participante.\n\nDe la Comisión Nacional del Programa Bandera Azul Ecológica\n\n \n\nArtículo\n4.-  El\nPrograma Bandera Azul Ecológica se administra mediante una Comisión Nacional\nBandera Azul Ecológica, integrada por un representante del Ministerio de Salud,\ndos del Ministerio de Ambiente, Energía y Telecomunicaciones, uno de ellos\nrelacionado con Cambio Climático, uno del Instituto Costarricense de Turismo,\nuno del Instituto Costarricense de Acueductos y Alcantarillados, uno de\n\nla Cámara Nacional\n de Turismo, uno del Ministerio de Educación, uno del Instituto Costarricense\nde Electricidad, y uno de\n\nla Compañía Nacional\n de Fuerza y Luz. Dichos representantes y sus respectivos suplentes serán\nnombrados por el jerarca de cada entidad participante por un período de tres años,\nque podrán ser prorrogables. Asimismo,\n\nla Comisión\n nombrará de su seno un Director Ejecutivo por el mismo periodo.\n\n \n\n  (Así reformado por el artículo 9° del decreto ejecutivo N° 35162\n de 13 de marzo de 2009).\n\nArtículo\n5º-Las entidades públicas miembros de la Comisión Nacional BAE, deberán\nconsiderar el Programa dentro de sus planes de trabajo y de igual forma asignar\nlos recursos que le darán contenido para su real ejecución.\n\nArtículo\n6º-Las funciones de la Comisión Nacional BAE, serán las siguientes:\n\na)\nEstablecer o modificar requisitos, criterios de evaluación y los manuales\ncorrespondientes al otorgamiento de la BAE.\n\nb)\nEstablecer los mecanismos de evaluación y verificación.\n\nc)\nAprobar las solicitudes de inscripción de las playas y comunidades participantes.\n\nd)\nNombrar el Equipo Técnico, el cual se encargará de realizar las inspecciones y\npromoverá el programa en todo el territorio nacional.\n\ne)\nReconocer anualmente a las playas y comunidades que hayan calificado.\n\nf)\nEntregar anualmente la BAE a las playas y comunidades ganadoras.\n\ng)\nDesarrollar estrategias de financiamiento y el otorgamiento de incentivos para\nlas playas y comunidades participantes.\n\nh)\nDesarrollar estrategias de promoción nacional e internacional para PBAE.\n\ni)\nReadecuar o adaptar los objetivos y criterios de evaluación, para incentivar la\norganización de centros académicos e instalaciones para recreación, con el\npropósito de buscar la excelencia higiénico sanitaria de los mismos.\n\nArtículo\n7º-Los resultados de las evaluaciones finales para la premiación son\ninapelables.\n\nArtículo\n8º-La CNPBAE tiene la facultad de promover campañas de limpieza y reforestación\ncuando lo considere necesario para la protección del recurso hídrico y el\nambiente en general.\n\nDel Comité Local Pro-Bandera Azul Ecológica\n\n \n\nArtículo\n9º-Los habitantes de organizaciones comunales de playas y comunidades deberán\nconstituirse mediante un comité local pro-BAE, el cual podrá ser integrado por\nrepresentantes del sector privado, municipales, instituciones del Estado y\nciudadanía.\n\nArtículo\n10.-El comité local pro-BAE de forma voluntaria se inscribirá en el Programa\nmediante el cuestionario de candidatura en los meses de enero a marzo de cada\naño.\n\nArtículo\n11.-El comité local pro-BAE asume la responsabilidad de implementar las\nacciones en pro del programa a través del año.\n\nArtículo\n12.-Le corresponde a los comités de la categoría comunidad establecer un\nprograma de trabajo, ejecutar las actividades planteadas en él, involucrando a\nla ciudadanía y presentar un informe final de autoevaluación; dicho informe\nserá auditado por la CNPBAE en el mes de noviembre de cada año.\n\nArtículo\n13.-El comité local PBAE en su categoría de Organización Comunal de Playa,\ndeberá presentar un programa de trabajo a más tardar en el primer trimestre de\ncada año, el cual será evaluado en forma periódica (tres veces al año) por el\nequipo técnico de trabajo de la CNPBAE.\n\nDe las Evaluaciones de las Organizaciones Comunales de Playas\n\n \n\nArtículo\n14.-Las playas inscritas en el programa serán evaluadas a través del año de\nacuerdo a los siguientes parámetros, teniendo que alcanzar un mínimo del 90%:\n\n \n\na)\nCalidad microbiológica del agua de mar 35%\n\nb)\nCalidad del agua para consumo humano 15%\n\nc)\nCalidad Sanitaria de las costas:\n\n1.\n-Basuras y basureros 10%\n\n2.\n-Vertidos industriales tratados 5%\n\n3.\n-Aguas residuales tratadas 15%\n\nd)\nEducación ambiental 10%\n\ne)\nSeguridad y administración 10%\n\n \n\nTotal 100%\n\nArtículo\n15.-La organización comunal de la playa participante obtendrá el galardón BAE,\ncon:\n\n \n\na)\nUna estrella (A): Si el valor\nobtenido está entre 90% y 100%.\n\nb)\nDos estrellas (AA): Si la evaluación\nobtenida es del 100% y se tiene: Señalización de corrientes marinas en caso de\nque existan y vigilancia y socorrismo en temporadas altas.\n\nc)\nTres estrellas (AAA): Cumple con lo\nindicado para dos estrellas y se tiene: Plan Regulador o Plan de Manejo en caso\nde Áreas de Conservación y accesos cómodos y seguros para personas con discapacidad,\nduchas y servicios sanitarios públicos.\n\nd)\nCuatro estrellas (AAAA): Cumple con\nlo indicado para tres estrellas y se tiene: Separación y reciclaje de desechos\nsólidos, cuenta con vigilancia y socorrismo de forma permanente, cuenta con\nComité de Emergencia Local y tenga participación en el programa \"Sello de\nCalidad Sanitaria\"; impulsado por el AyA.\n\nDe las Evaluaciones de las Comunidades\n\n \n\nArtículo\n16.-Las comunidades inscritas en el programa tendrán que presentar en el mes de\nnoviembre las pruebas de cumplimiento sobre los parámetros que a continuación\nse describen, teniendo que alcanzar un mínimo del 90%. Therefore,\n\nDECREE:\n\nArticle\n1.-The PBAE Program has as its general objective to establish an incentive to\npromote the organization of local committees that involve the participation of\nthe citizenry, with the aim of developing beaches and communities and improving\nhygienic-sanitary conditions, in accordance with the protection of\nhydric resources (recursos hídricos) and the environment in general.\n\n(NOTE: Through\nExecutive Decree No. 31648 of February 9, 2004, the scope\nof the Programa Bandera Azul Ecológica contained in this decree is expanded, \"as\nan incentive to organize educators, students and personnel of the\nadministrative area of public and private educational centers (preschool,\nschools and high schools), in order to promote the adoption of\nsustainable and sustainable practices, friendly to the environment, through the continuous\nimprovement of the hygienic-sanitary conditions of their physical infrastructure,\nnatural resource protection campaigns, environmental education\nprograms and the incorporation of the student center into the respective community,\namong others\").\n\n(NOTE:\nThrough executive decree No. 33604 of January 31, 2007, the\nscope of the Programa Bandera Azul Ecológica is expanded, including a new category called Protected Natural Spaces (private), with the purpose of recognizing the managers\nof these spaces the efforts made in the promotion and adoption of\npractices, sustainable and friendly to the environment, through primary forest (bosque priario) conservation, ecotourism and mixed (zones destined\nto forest conservation combined with agricultural and tourism activities)\n\nArticle 2.-For the purposes of this\ndecree, it shall be understood as:\n\n1) Programa Bandera Azul Ecológica (PBAE): Incentive for the\ninhabitants of the communal beach organizations and communities to\norganize, with the aim of protecting natural resources, tourist\nattractions and thus providing a better quality of life for inhabitants and tourists.\n\n2) Bandera Azul Ecológica (BAE): External sign that identifies the\ncommunal beach organizations and communities that comply with the established\nparameters.\n\n3) National Commission of the Programa Bandera Azul Ecológica (Comisión Nacional del Programa Bandera Azul Ecológica, CNPBAE):\nResponsible for administering the Program, composed of the Ministry of\nHealth, the Ministry of Environment and Energy(*), the Instituto Costarricense de\nAcueductos y Alcantarillados, the Instituto Costarricense de Turismo, the\nCámara Nacional de Turismo and *National Commission of the Programa Bandera Azul\nEcológica.\n\n(*Thus incorporated by Article\n7 of executive decree No. 33604 of January 31, 2007)\n\n4) Comunal beach organization: It is constituted by the citizenry,\nprivate enterprise, non-governmental organizations, local government and\npublic institutions, that make up the environment and the coastline of a beach or community organization\nthat are integrated in order to participate in favor of the Program.\n\n7) Technical Work Team: The group in charge of carrying out the\ncorresponding evaluations, according to the type of participating communal\nbeach organization or community.\n\n8) Categories or Stars: Gradation established for the PBAE Program\nin communal beach organizations and communities that range from one star-two\nstars-three stars or four stars and will be awarded upon\nfulfillment of 90% of the defined parameters.\n\n9) Sello de Calidad Sanitaria: Incentive to organize the operating\nentities of the different types of aqueducts, so that they supply\nquality potable water in a sustainable manner and in harmony with nature.\n\nOf the purposes of the Programa Bandera placing\ntrash containers along the beach.\n\ne)\nEnvironmental education in the respective coastal zones.\n\nf)\nAdequate signage to guide and orient the tourist.\n\ng)\nThe improvement in the quality of life of the inhabitants and visitors of coastal\nzones.\n\nh)\nProvide facilities that allow any citizen to enjoy the beach and the surrounding installations without discrimination, in a way that offers\ncomfortable and safe accesses for persons with any ailment or disability.\n\nSubsection 2) In the case of\nCommunities:\n\na)\nOrganize communities in order to integrally administer and monitor\nnatural resources, promoting the development of basic sanitation programs,\nenvironmental education and comprehensive health care in each community.\n\nb)\nPromote the adequate disposal of solid and liquid waste produced\nin the participating communities.\n\nc)\nPromote signage in the community in general and tourist places that\nguide and orient inhabitants and tourists.\n\nd)\nPromote the treatment of domestic and industrial liquid waste.\n\ne)\nFoster the protection of hydric resources and natural resources in\ngeneral.\n\nf)\nPromote police security of the communities.\n\ng)\nDevelop environmental education programs with the aim of generating environmental\nconsciousness among the inhabitants and visitors.\n\nh)\nInventory the hydric resources and define their uses in each community.\n\ni)\nPromote comprehensive community health care and improve the quality\nof life of tourists and local inhabitants of each participating community.\n\nOf the National Commission of the Programa Bandera Azul Ecológica\n\nArticle\n4.- The\nPrograma Bandera Azul Ecológica is administered through a National Commission\nBandera Azul Ecológica, composed of one representative from the Ministry of Health,\ntwo from the Ministry of Environment, Energy and Telecommunications, one of them\nrelated to Climate Change, one from the Instituto Costarricense de Turismo,\none from the Instituto Costarricense de Acueductos y Alcantarillados, one from\n\nthe Cámara Nacional\n de Turismo, one from the Ministry of Education, one from the Instituto Costarricense\nde Electricidad, and one from\n\nthe Compañía Nacional\n de Fuerza y Luz. Said representatives and their respective alternates will be\nappointed by the head of each participating entity for a period of three years,\nwhich may be renewable. Likewise,\n\nthe Commission\n shall appoint an Executive Director from within its ranks for the same period.\n\n (Thus amended by Article 9 of executive decree No. 35162\n of March 13, 2009).\n\nArticle\n5.-The public entities members of the National BAE Commission, must\nconsider the Program within their work plans and likewise assign\nthe resources that will give it content for its real execution.\n\nArticle\n6.-The functions of the National BAE Commission, shall be the following:\n\na)\nEstablish or modify requirements, evaluation criteria and the manuals\ncorresponding to the granting of the BAE.\n\nb)\nEstablish the evaluation and verification mechanisms.\n\nc)\nApprove the registration applications of the participating beaches and communities.\n\nd)\nAppoint the Technical Team, which will be in charge of carrying out inspections and\npromoting the program throughout the national territory.\n\ne)\nAnnually recognize the beaches and communities that have qualified.\n\nf)\nAnnually deliver the BAE to the winning beaches and communities.\n\ng)\nDevelop financing strategies and the granting of incentives for\nthe participating beaches and communities.\n\nh)\nDevelop national and international promotion strategies for the PBAE.\n\ni)\nReadjust or adapt the objectives and evaluation criteria, to incentivize the\norganization of academic centers and recreational facilities, with the\npurpose of seeking their hygienic-sanitary excellence.\n\nArticle\n7.-The results of the final evaluations for the awarding are\nunappealable.\n\nArticle\n8.-The CNPBAE has the power to promote cleaning and reforestation campaigns\nwhen it deems it necessary for the protection of hydric resources and the\nenvironment in general.\n\nOf the Local Committee Pro-Bandera Azul Ecológica\n\nArticle\n9.-The inhabitants of communal beach organizations and communities must\nconstitute themselves through a local pro-BAE committee, which may be composed of\nrepresentatives from the private sector, municipalities, State institutions and\ncitizenry.\n\nArticle\n10.-The local pro-BAE committee will voluntarily register in the Program\nthrough the candidacy questionnaire in the months of January to March each\nyear.\n\nArticle\n11.-The local pro-BAE committee assumes the responsibility to implement the\nactions in favor of the program throughout the year.\n\nArticle\n12.-It corresponds to the committees of the community category to establish a\nwork program, execute the activities set forth in it, involving\nthe citizenry and present a final self-evaluation report; said report\nwill be audited by the CNPBAE in the month of November of each year.\n\nArticle\n13.-The local PBAE committee in its Comunal Beach Organization category,\nmust present a work program no later than the first trimester of\neach year, which will be evaluated periodically (three times a year) by the\ntechnical work team of the CNPBAE.\n\nOf the Evaluations of the Comunal Beach Organizations\n\nArticle\n14.-The beaches registered in the program will be evaluated throughout the year\naccording to the following parameters, having to achieve a minimum of 90%:\n\na)\nMicrobiological quality of seawater 35%\n\nb)\nQuality of water for human consumption 15%\n\nc)\nSanitary Quality of the coasts:\n\n1.\n-Trash and trash dumpsters 10%\n\n2.\n-Treated industrial discharges 5%\n\n3.\n-Treated wastewater 15%\n\nd)\nEnvironmental education 10%\n\ne)\nSecurity and administration 10%\n\nTotal 100%\n\nArticle\n15.-The participating communal beach organization will obtain the BAE award,\nwith:\n\na)\nOne star (A): If the value\nobtained is between 90% and 100%.\n\nb)\nTwo stars (AA): If the evaluation\nobtained is 100% and it has: Signaling of marine currents in case\nthey exist and lifeguard and rescue services in high seasons.\n\nc)\nThree stars (AAA): Complies with what is\nindicated for two stars and it has: Regulatory Plan or Management Plan in case\nof Conservation Areas and comfortable and safe accesses for persons with disabilities,\nshowers and public sanitary services.\n\nd)\nFour stars (AAAA): Complies with what is\nindicated for three stars and it has: Separation and recycling of solid\nwaste, has permanent lifeguard and rescue services, has a\nLocal Emergency Committee and has participation in the \"Sello de\nCalidad Sanitaria\" program; promoted by the AyA.\n\nOf the Evaluations of Communities\n\nArticle\n16.-The communities registered in the program will have to present in the month of\nNovember the proofs of compliance on the parameters described\nbelow, having to achieve a minimum of 90%.
