Para realizar esta labor debe\nemplear la siguiente guía de inspección. (Ver formulario de inspección).\n\n6. Una\nvez evaluados estos cuatro factores el funcionario asignado por el Área de\nSalud debe llenar el acta de la siguiente acta de que se realice el\nespectáculo. Esta acta puede ir acompañada de la firma de un oficial de la\nFuerza Pública.\n\n7.\nLuego se debe esperar a la hora que se realizará el espectáculo manteniendo\nsupervisión del perímetro en coordinación con los funcionarios de la fuerza\npública, los cuales deberán estar custodiando el perímetro para evitar personas\najenas al área de quema, de personas ajenas a la empresa pirotécnica. Los\núnicos que pueden permanecer en el área donde se encuentran los pirotécnicos\nson funcionarios estatales y trabajadores pirotécnicos debidamente uniformados.\n\n8. En\nel momento de quema de los pirotécnicos el funcionario a cargo de la\nsupervisión de la Unidad de Protección del Ambiente Humano del Área de Salud en\ncoordinación con el oficial a cargo de la fuerza pública que cubre el perímetro\nsupervisará que no se presenten condiciones de riesgo para la Salud Pública y\nel ambiente. Por ejemplo caída excesiva de residuos en combustión sobre los\nespectadores o edificaciones vecinas con riesgo de incendio, bombetas detonando\na nivel del piso entre otros.\n\n9. En\ncaso de presentarse condiciones que atenten contra la Salud Pública el\nMinisterio de Salud puede ordenar corregir anomalías o proceder a suspender el\npermiso en forma inmediata. Para lo cual solicita el apoyo de la fuerza pública\npresente.\n\n10. Una\nvez terminada la quema de los pirotécnicos el técnico o profesional de la\nUnidad de Protección del Ambiente Humano le solicitará al responsable de la\nempresa pirotécnica que revise los morteros o cañones de que no hayan quedado\nexplosivos pirotécnicos sin detonar. Una vez que se hayan revisado el\nMinisterio de Salud le solicitará a la Fuerza Pública levantar la custodia del\nperímetro.\n\n11.\nSeguidamente el funcionario de Salud debe llenar el siguiente formato de\ninforme ejecutivo de las acciones realizadas en el espectáculo, para ser\nentregado al Director de Área o Regional.\n\n \n\n(NOTA DE SINALEVI: contiene formularios que pueden ser consultados en La\nGaceta No. 68 de 6 de abril de 2004)\n\n \n\nProcedimientos para la quema de bombetas de truenos\n\nLos siguientes requisitos y\nprocedimientos deben aplicarse en la quema de bombetas de trueno cuando no son\nespectáculos pirotécnicos.\n\n \n\n \n\n1.         Procedimientos del\nadministrado en el trámite de permiso:\n\n \n\n1.1. La persona física o\njurídica que desea detonar bombetas de doble, tres truenos debe solicitar en el\nÁrea de Salud que le corresponde a la comunidad, el permiso para la quema de\nlas mismas, presentando la solicitud con 15 días de anticipación del día de\nquema.\n\n1.2. La solicitud deberá ser\npresentada con 15 días de antelación a la quema de las bombetas junto con una\nnota donde se comprometen aplicar los requisitos y medidas de seguridad para la\nquema de bombetas de doble trueno establecidas por el Ministerio de Salud.\n\n \n\n2.         Procedimientos del\nfuncionario del Área de Salud en el trámite del permiso:\n\n \n\n2.1. El Área de Salud valorará\nla ubicación del lugar donde se quemará y en caso de ser aprobada, le entregará\na la persona física o jurídica el permiso correspondiente con las medidas de\nseguridad que deben de cumplir para salvaguardar la Salud Pública, para lo cual\ndebe firmar el recibido y el compromiso de cumplirlas fielmente.\n\n \n\nProcedimientos para el Área Rectora de Salud:\n\n \n\n1. Una vez recibida la\ndocumentación necesaria para el trámite de permiso de ubicación se cuenta con\nlos plazos establecidos por la Ley Nº 8220 para resolverla.\n\n2. Debe realizarse una visita al\nlugar propuesto y verificar distancias hacia linderos, edificaciones vecinas,\ncarreteras o ferrovías de acuerdo a las cantidades de productos pirotécnicos\nque se proyecta tener en la fábrica o bodega y los estudios de onda expansiva\nque presenten.\n\n3. Si la ubicación es aprobada\ndebe solicitarle al administrado los requisitos básicos para permisos de\nconstrucción y funcionamiento de industrias, incluyéndole aquellos legislación\nespecífica para la actividad pirotécnica. Coordinando con la Dirección General\nde Armamento del Ministerio de Seguridad Pública mediante el teléfono 294-0373\nó 229-3595.\n\n4. Como instrumento para las\nvisitas de inspección a las fábricas ya sea de seguimiento, control o trámite\nde solicitud de renovación de permisos para una fábrica de pólvora se debe\naplicar la siguiente guía de inspección:\n\n \n\n(NOTA DE SINALEVI: contiene formularios que pueden ser consultados en La\nGaceta No. 68 de 6 de abril de 2004)\n\n \n\nPROCEDIMIENTOS\nE INSTRUMENTOS PARA PERMISO\n\nDE VENTA DE\nPÓLVORA MENUDA DE LUCERÍA\n\n \n\nDefiniciones:\n\n.           Pólvora menuda: Productos pirotécnicos que por sus\ncaracterísticas de fabricación no son para eventos profesionales, si no que se\nvenden al menudeo. Estos productos se clasifican en dos clases de (permitida)\nlucería y explosivos (prohibida).\n\n.           Pólvora menuda permitida: Aquellos productos pirotécnicos\ncuando se les da ignición al quemarse la pólvora produce un efecto de luz\nblanca o de colores y no son explosivos. Por ejemplo: luces de bengala,\nvolcanes, mariposas, yoyos u otros.\n\n.           Pólvora menuda prohibida: Pólvora menuda que su efecto\nprincipal es el de explosión de su masa total por ejemplo bombetas, carpetas,\ntriquitraques,1/4 dinamita entre otros. \nA continuación, describimos los procedimientos que debe llevar a cabo el\nTécnico de Saneamiento para los trámites de permisos de funcionamiento de\nfábricas, bodegas de pólvora o para permisos de venta de los mismos.\n\n \n\nProcedimiento trámite del permiso:\n\n \n\nLos Permisos de Venta de Pólvora Menuda deberá tramitarse primero ante el Área de Salud de la zona\ndonde se ubicará la misma. In accordance\nwith the provisions of Article 4, subsection b) of Law No. 8220, published in\nAlcance No. 22 to La Gaceta No. 49\nof March 11, 2002, \"Ley de Protección al Ciudadano del Exceso de\nRequisitos y Trámites Administrativos,\" interested parties are hereby notified that the\nfollowing are the guides, instructions, manuals, forms, and other corresponding\ndocuments applied by the aforementioned Directorate in the performance of its\nduties.\n\n \n\nProcedures of the Ministry of Health:\n\n \n\n1. Once\nthe administered party has submitted the application to the Health Area (Área de Salud) with all\nthe requirements, said area has 10 days to issue the corresponding pronouncement for\nthe holding of the show and the corresponding administrative steps\nto carry out the supervision of the event.\n\n2. The\nHealth Area, through the Human Environment Protection Unit (Unidad de Protección del Ambiente Humano), must proceed\nto assess the location of the place where the show will be held, by reviewing\nthe sketch and through a site visit. It shall take into consideration the caliber\nof the pyrotechnics and their respective blast wave. Reference documents: the\nDecreto Nº 27502-S or current legislation and the Manual de Evaluación Espectáculos\nPirotécnicos, 2000 version, of the Ministry of Health.\n\n3. The\nHealth Area must review the Safety Program (Programa de Seguridad) submitted by the company,\nensuring it complies with the requirements established for it.\n\n4. Once\nthe event location has been approved and the Safety Program reviewed,\nthe Health Area proceeds to grant the permit for the show,\nusing the following template:\n\n5.\nThen, the Human Environment Protection Unit of the Health Area must\nproceed to carry out the respective inspection on the day of the show at the place\nwhere the event will be held, where it must supervise that the company complies\nwith what is indicated in the safety program regarding transport, unloading, storage,\nor installation of the pyrotechnic explosives. To perform this task, it must\nuse the following inspection guide. (See inspection form).\n\n6. Once\nthese four factors have been evaluated, the official assigned by the Health\nArea must fill out the record for the following record (acta) regarding the holding of the\nshow. This record may be accompanied by the signature of an official of the\nFuerza Pública.\n\n7.\nThen, one must wait until the time the show is to be held, maintaining\nsupervision of the perimeter in coordination with the officials of the Fuerza Pública,\nwho must be guarding the perimeter to keep unauthorized persons away from the burning area, persons unaffiliated with the pyrotechnic company. The\nonly individuals who can remain in the area where the pyrotechnics are located\nare state officials and pyrotechnic workers in proper uniform.\n\n8. At\nthe moment of burning the pyrotechnics, the official in charge of\nthe supervision from the Human Environment Protection Unit of the Health Area, in\ncoordination with the official in charge from the Fuerza Pública covering the perimeter,\nwill supervise that no risk conditions arise for Public Health and\nthe environment. For example, excessive fall of combustion residues onto the\nspectators or neighboring buildings with fire risk, firecrackers detonating\nat ground level, among others.\n\n9. In\nthe event of conditions arising that threaten Public Health, the\nMinistry of Health can order the correction of anomalies or proceed to suspend the\npermit immediately. For which purpose it requests the support of the Fuerza Pública\npresent.\n\n10. Once\nthe burning of the pyrotechnics is finished, the technician or professional from the\nHuman Environment Protection Unit will ask the person responsible for the\npyrotechnic company to check the mortars or cannons to ensure that no\nundetonated pyrotechnic explosives remain. Once they have been checked, the\nMinistry of Health will ask the Fuerza Pública to lift the custody of the\nperimeter.\n\n11.\nSubsequently, the Health official must fill out the following executive report\nformat on the actions taken at the show, to be\ndelivered to the Area or Regional Director.\n\n \n\n(SINALEVI NOTE: contains forms that can be consulted in La\nGaceta No. 68 of April 6, 2004)\n\n \n\nProcedures for the burning of thunder crackers (bombetas de truenos)\n\nThe following requirements and\nprocedures must be applied in the burning of thunder crackers when they do not constitute\npyrotechnic shows.\n\n \n\n \n\n1.         Procedures of the\nadministered party in the permit process (trámite de permiso):\n\n \n\n1.1. The natural or legal\nperson wishing to detonate double, triple thunder crackers must request from the\nHealth Area corresponding to the community the permit for the burning of\nsame, submitting the application 15 days in advance of the day of\nburning.\n\n1.2. The application must be\nsubmitted 15 days prior to the burning of the crackers, together with a\nnote undertaking to apply the requirements and safety measures for the\nburning of double thunder crackers established by the Ministry of Health.\n\n \n\n2.         Procedures of the\nHealth Area official in the permit process:\n\n \n\n2.1. The Health Area will assess\nthe location of the place where the burning will occur, and if approved, will deliver\nto the natural or legal person the corresponding permit with the safety\nmeasures they must comply with to safeguard Public Health, for which purpose they\nmust sign the acknowledgment of receipt and the commitment to comply with them faithfully.\n\n \n\nProcedures for the Área Rectora de Salud:\n\n \n\n1. Once the\ndocumentation necessary for the location permit process is received, the\ndeadlines established by Law No. 8220 apply for its resolution.\n\n2. A visit must be made to the\nproposed site to verify distances to boundaries (linderos), neighboring buildings,\nroads, or railways according to the quantities of pyrotechnic products\nprojected to be kept at the factory or warehouse and the blast wave studies\nthey submit.\n\n3. If the location is approved,\nthe administered party must be asked for the basic requirements for construction\nand operating permits for industries, including those from the legislation\nspecific to pyrotechnic activity. This shall be coordinated with the Dirección General\nde Armamento of the Ministry of Public Security via telephone 294-0373\nor 229-3595.\n\n4. As an instrument for\ninspection visits to factories, whether for follow-up, control, or the process\nof applying for renewal of permits for a gunpowder factory, the\nfollowing inspection guide must be applied:\n\n \n\n(SINALEVI NOTE: contains forms that can be consulted in La\nGaceta No. 68 of April 6, 2004)\n\n \n\nPROCEDURES\nAND INSTRUMENTS FOR THE PERMIT\n\nFOR THE SALE OF SMALL SPARKLER-TYPE\nGUNPOWDER (PÓLVORA MENUDA DE LUCERÍA)\n\n \n\nDefinitions:\n\n.           Small gunpowder (Pólvora menuda): Pyrotechnic products which, due to their\nmanufacturing characteristics, are not for professional events, but are\nsold at retail. These products are classified into two classes: (permitted)\nsparkler-type (lucería) and explosives (prohibited).\n\n.           Permitted small gunpowder: Those pyrotechnic products\nwhich, when ignited, produce a white or colored light effect upon burning the gunpowder\nand are not explosives. For example: sparklers (luces de bengala),\nvolcanoes (volcanes), butterflies (mariposas), yo-yos (yoyos), or others.\n\n.           Prohibited small gunpowder: Small gunpowder whose main effect\nis the explosion of its total mass, for example, thunder crackers (bombetas), carpetas,\ntriquitraques, 1/4 dinamita, among others. \nBelow, we describe the procedures that the Sanitation Technician (Técnico de Saneamiento) must carry out for\nthe operating permit processes for factories, gunpowder warehouses, or for sales permits for the same.\n\n \n\nProcedure for the permit process (trámite del permiso):\n\n \n\nThe Permits for Sale of Small Gunpowder (Permisos de Venta de Pólvora Menuda) must be processed first before the Health Area (Área de Salud) of the zone\nwhere it will be located. The permit will be granted by the Human Environment office (oficina del Ambiente Humano). Then, the\ninterested party must present said permit to the Dirección General de Armamento of the Ministry of\nPublic Security, in order to process the respective license for sales granted by that\nMinistry.
