Por tanto:\n\n \n\nDECRETAN:\n\n \n\nRegulaciones\npara la Caza Menor y Mayor y Pesca Continental e Insular\n\n \n\nCAPÍTULO I\n\nLa caza en\náreas protegidas\n\n \n\nArtículo\n1°-Se prohíbe la caza mayor y menor, la caza menor de aves canoras y de\nplumaje, así como la pesca en Parques Nacionales (excepto lo establecido en el\nartículo 10 de la Ley Nº 6084, Ley de Creación del Servicio de Parques\nNacionales), Reservas Biológicas, Monumentos Naturales, Reservas Forestales,\nZonas Protectoras del país, Reservas Indígenas (excepto la caza de subsistencia\npara los indígenas residentes), Refugios de Vida Silvestre, (excepto cuando se\ntrate de programas de manejo de poblaciones que realice el Sistema Nacional de Áreas\nde Conservación del MINAE) y las fincas sometidas al régimen de Pago de\nServicios Ambientales.\n\nCAPÍTULO II\n\nProhibiciones\n\n \n\nArtículo\n2°-Se prohíbe la caza mayor y menor de todas las especies con poblaciones\nreducidas o en peligro de extinción (artículos 58 y 60 del Reglamento de la Ley\nde Conservación de la Vida Silvestre) con excepción de lo que disponga\ntécnicamente el Sistema Nacional de Áreas de Conservación.\n\nArtículo\n3°-Se prohíbe:\n\n \n\na)\n\"Calentar\" (exponer al sol) aves silvestres en jaulas con trampas o jaulas\ncogedoras durante los días no autorizados para la caza.\n\n \n\nb) La caza\nde aves silvestres con luz artificial durante la noche, al igual que la captura\nde aves con pegamentos y redes de niebla.\n\n \n\nc) El\ntraslado dentro del país de aves en jaulas con trampas o jaulas cogedoras en\ntemporadas no autorizadas para la caza.\n\n \n\nd) La caza\nde todas las especies de aves silvestres residentes y migratorias en todo el\nterritorio nacional, con excepción de las que se indiquen en el presente\nDecreto Ejecutivo.\n\n \n\ne)\nTransportar aves canoras (aves con llamativos cantos) o de plumaje (aves con\nplumaje de llamativos colores) en jaulas echadoras o con trampas, en temporada\nno autorizadas para la caza, sin los respectivos permisos del SINAC (licencia\nde caza y permiso de tenencia vigente y permiso de traslado).\n\nf) La caza\nde aves canoras y de plumaje, en los lugares que se indican a continuación:\n\n \n\n1)\nEn los distritos de Los Ángeles, Piedades Norte y San Rafael del cantón de San\nRamón; la zona comprendida entre Alto Villegas del distrito de Volio del cantón\nde San Ramón, empezando en la Carretera que comunica Zarcero con San Ramón en\nel cruce a Angeles Norte, siguiendo por este camino hasta el puente de la\nQuebrada Plata continuando por el cauce aguas abajo hasta la desembocadura en\nel Río Espino, continuando por la margen derecha aguas arriba hasta el puente\nen el camino que comunica San Luis con Barranca, de este punto continua por el\ncamino hasta Barranca, siguiendo por la carretera que conduce a San Ramón hasta\nel punto inicial ubicado en Alto Villegas y el cruce a Angeles Norte; en la\nzona comprendida entre la carretera que conduce de San Ramón a la Fortuna entre\nlos ríos la Esperanza y Burro, margen izquierda hasta incluir El Bosque Eterno\nde los Niños en los distritos de La Tigra de San Carlos y San Isidro de Peñas\nBlancas del cantón de San Ramón.\n\n \n\n2)\nEn el distrito de Monterrey de San Carlos y en la zona comprendida entre la\ncarretera que lleva de la Comunidad del Tanque a Monterrey de San Carlos,\niniciando en el cruce a Montelimar, siguiendo por este camino a la derecha,\npasando por el poblado de San Andrés, hasta el poblado de Nieves siguiendo\nhasta encontrarse con la carretera que conduce a los Chiles, pasando por Santa\nRosa y Acapulco hasta llegar al paso del Río Chimurria, en este sitio se sigue\na la izquierda sobre el camino que lleva hacia San Jorge hasta interceptar la\ncarretera que une San Jorge con Chambacú, de este punto se sigue al sur por la\ncarretera hacia Chambacú, y Cedros, siguiendo hasta Mirador y el cruce que\nlleva a Montelimar en el punto inicial.\n\n \n\n3)\nEn los cantones de Puriscal, Turrubares, Mora, Dota y Tarrazú y, Perez Zeledón\nde la provincia de San José.\n\n \n\n4)\nEn el cantón de Aguirre, Buenos Aires y Coto Brus de la provincia de\nPuntarenas.\n\n \n\n5)\nEn el cantón del Guarco de la provincia de Cartago.\n\n \n\n6)\nUn kilómetro en ambas márgenes del río Virilla, en la zona comprendida entre el\npuente sobre la autopista General Cañas y el puente de Piedras Negras en la\ncarretera que comunica Puriscal con Turrúcares de Alajuela.\n\n \n\n7)\nPartiendo del puente sobre el Río Aranjuez en la Carretera Interamericana\nNorte, margen derecha siguiendo por dicha carretera hasta el punte sobre el Río\nLagarto, de este punto aguas arriba por la margen derecha hasta la confluencia\nde la Quebrada Rodríguez, cerca de Santa Elena, de este punto siguiendo por la margen\nderecha aguas arriba hasta su nacimiento en el Cerro Chomogo, continuando al\nsur por la divisoria de aguas y los límites políticos de la provincia de Alajuela\ny Puntarenas hasta intersecar el Cerro Ojo de Agua, siguiendo al sur hasta el\nnacimiento del Río Aranjuecito, continuando aguas abajo hasta el punto inicial\nen el puente sobre la Carretera Interamericana Norte.\n\ng) La caza\ndel jilguero (Myadestes melanops) en:\n\n \n\n1)\nEl cantón de Pérez Zeledón y en la fila Cruces, partiendo del punto 1, ubicado\nen el puente sobre el río Piedras Blancas la carretera interamericana sur hasta\nel punto 2 en Ciudad Neily, continuando por la carretera que conduce hasta el\npunto 3 en San Vito de Coto Brus, siguiendo por la carretera hacia Paso Real, pasando\npor la Unión hasta el punto 4 ubicado en el cruce a San Gerardo, de este punto\nse sigue hacia el punto 5, en Paraíso, continuando con una línea recta con\nrumbo sudoeste hasta las nacientes del río Piedras Blancas, punto 6;\ncontinuando por la margen izquierda aguas abajo hasta el puente sobre la\ncarretera Interamericana Sur, punto de inicio.\n\n \n\n2)\nEl cantón del Guarco de la provincia de Cartago, Buenos Aires y Coto Brus de la\nprovincia de Puntarenas.\n\n \n\n3)\nEl distrito central de Turrialba y el cantón de Jiménez de la provincia de\nCartago.\n\n \n\n4)\nEn la zona de amortiguamiento de 0.5 kilómetros de ancho alrededor del Parque\nNacional Braulio Carrillo y la Reserva Forestal Cordillera Volcánica Central.\n\n \n\n5)\nPara el distrito de Orosi del cantón de Paraíso solo se permite la\n\ncaptura\nde una pieza al año.\n\nArtículo\n4°-Se prohíbe la caza menor de las siguientes aves canoras, de plumaje, y otras\nespecies silvestres en todo el territorio nacional en el período que a\ncontinuación se indica:\n\nAves\ncanoras:\n\n \n\na) Solitario\ncarinegro, jilguero, (Myadestes melanops) del 1º de marzo al 30 de setiembre.\n\nb) Aguío\ncoroniamarillo, monjito (Euphonia luteicapilla) del 1º de enero al 30 de\nsetiembre.\n\nc) Aguío\ngorgiamarillo (Euphonia hirundinacea) del 1º de enero al 30 setiembre.\n\nd) Euphonia\nmenuda, canaria (Euphonia minuta) del 1º de enero al 30 setiembre.\n\ne) Finito\ngargantinegra, finito (Euphonia affinis) del 1º de enero al 30 setiembre.\n\nf) Gallito,\nsemillerito cariamarillo (Tiaris olivacea) del 1º de abril al 30 de setiembre.\n\ng) Setillero\ncollarejo (Sporophila torqueola) del 1º de abril al 30 de setiembre.\n\nh) Setillero\ngarganta negra (Sporophila aurita) del 1º de abril al 30 de setiembre.\n\n \n\nAves de\nplumaje:\n\n \n\na) Tangara\nmoteada, zebra (Tangara guttata) del 1º de marzo al 30 de setiembre.\n\nb) Tangara\ndorada, Juanita (Tangara icterocephata) del 1º de marzo al 30 de setiembre.\n\nc) Tangara\ncapuchidorada, siete colores, mariposa (Tangara larvata) del 1º de marzo al 30\nde setiembre.\n\nd) Gorrión\ncomún, eléctrico (Passer domesticus) del 1º de mayo al 30 agosto.\n\n \n\nCaza menor\nde aves con arma de fuego:\n\n \n\na) Paloma\ncollareja (Columba fasciata) durante el período comprendido del 1º de febrero\nal 31 de agosto.\n\nb) Paloma\narrocera (Zenaida macroura), paloma alablanca (Zenaida asiática), del 1º de\nabril al 31 de octubre.\n\nc) Piches\nalablanca (Dendrocygma autumnalis) y Cerceta aliazul (Anas discor) del 1º de\nabril al 31 de octubre.\n\nd) Codorniz\ncomún (Colinus leucopogon) del 1º de abril al 31 de setiembre.\n\ne) Paloma\nmorada (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nnigrirostris) del 1º de marzo al 30 setiembre.\n\nCAPÍTULO III\n\nAutorizaciones\n\nCaza menor\nde aves\n\n \n\nArtículo\n5°-Se podrá cazar aves silvestres canoras y de plumaje, en las condiciones\nsiguientes:\n\n \n\na) En tiempo\nautorizado y únicamente con una jaula cogedora por cazador.\n\nb) Máximo 2\nmachos adultos de cada especie autorizada por cazador por año, en todo el\nterritorio nacional, excepto lo establecido en el inciso f del artículo 3 de\neste decreto.\n\nc)\nÚnicamente durante los días sábados, domingos y feriados por ley, con horario\nde 6 a. m., a 5 p. m.\n\nd) En caso\nde torneos de caza de aves y la posterior liberación de las aves capturadas,\nestos torneos son para un día específico en un sitio autorizado según la\nsolicitud presentada, con un máximo de dos días por temporada para un sitio.\nLos sitios deben estar a más de 5 km de distancia uno de otro.\n\nArtículo\n6º-Se podrán cazar con arma de fuego, en tiempo autorizado, las siguientes\nespecies de aves de caza menor, en un horario de 6,00 a. m., a 5,00 p. m.,\ndurante los días sábado, domingo y feriados de ley con un límite máximo de\npiezas según se indica a continuación, (excepto los extranjeros no residentes\nque solo podrán cazar en Guanacaste y solo paloma arrocera (Zenaida macroura);\npaloma alablanca (Zenaida asiática):\n\n \n\na) Codorniz\ncomún (Colinus leucopogon), 10 piezas por día por temporada, por cazador, en\ntodo el territorio nacional en el período comprendido entre el 1º de octubre y\nel 31 de marzo.\n\nb) Zanate\n(Quiscalus mexicanus), sin límite de piezas, en todo el territorio nacional, en\nfechas autorizados para la caza en cada zona (artículos 10, 11, 12, 13 del\npresente Decreto).\n\nc) Paloma\narrocera (Zenaida macroura); paloma alablanca (Zenaida asiática), 20 piezas por\ndía, por cazador, en todo el territorio nacional, en el período comprendido\nentre el 1º de noviembre y el 31 de marzo.\n\nd) Piches\nalablanca (Dendrocygma autumnalis) y cerceta aliazul (Anas discor), 15 piezas\npor día, por cazador, en todo el territorio nacional, en el período comprendido\nentre el 1° de noviembre y el 31 de marzo.\n\ne) Paloma\nmorada (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nnigrirostris), 10 piezas por día, por cazador, en todo el territorio nacional,\nexcepto las zonas delimitadas en los incisos 10, 11, 12 y 13 de este decreto,\ncuando por la distribución de estas especies corresponda, en el período comprendido\nentre el 1° de octubre y el 29 de febrero.\n\nf) Paloma\ncollareja (Columba fasciata), 15 piezas por día, por cazador, en el período\ncomprendido entre el 1° de setiembre y el 31 de enero, en los siguientes\nlugares:\n\n1)\nEn fincas privadas en las márgenes de la Carretera Interamericana Sur, entre el\nKilómetro 34 hasta el Km 39, entre el Km 41 y el Km 47, entre el Km 52 y el Km\n55, entre el Km 57 y el Km 64 (sitio conocido como Madreselva). Únicamente a\nmás de 50 mts. del límite de la carretera y fuera de los límites de la Reserva Forestal\nLos Santos y El Parque Nacional Tapantí Macizo de la Muerte. En las zonas no\nautorizadas (entre el kilómetro 39 al Km 40, entre el Km 41 al Km 46, entre el\nKm 52 al Km 54, y entre el Km 55 al Km 56) que incluye poblados a la orilla de\nla carretera solo se permitirá la caza en fincas particulares fuera de la\nReservas Forestal Los Santos y El Parque Nacional Tapantí Macizo de la Muerte\nen sitios que se ubiquen a 1 Km o más de la carretera.\n\n2)\nEn fincas privadas, en ambas márgenes de la carretera entre Carrizal de\nAlajuela y Poasito, a más de 50 metros de los límites de carretera.\n\n3)\nEn fincas privadas en ambas márgenes de las carreteras entre Tarbaca y Vuelta\nde Jorco, a más de 50 más de los límites de carretera.\n\nCAPÍTULO IV\n\nZonas\nautorizadas para la caza\n\n \n\nArtículo\n7.-Se declaran las siguientes zonas de caza:\n\n \n\nZona 1.\nProvincia de Guanacaste.\n\nZona 2.\nProvincias de Alajuela y Heredia.\n\nZona 3.\nProvincias de Puntarenas y San José.\n\nZona 4.\nProvincias de Cartago y Limón.\n\nLa caza se\npermite solamente de 6 a. m., a 6 p. m., en los días autorizados.\n\nCAPÍTULO V\n\nDe la caza\nmenor y mayor con armas y métodos de caza autorizados\n\nen el\nReglamento de la Ley de Conservación de la Vida Silvestre\n\n \n\nArtículo\n8.-Se deberá de observar las regulaciones para las temporadas de caza, de\nacuerdo con las zonas declaradas en el artículo 7º.\n\nArtículo\n9.-Se autoriza únicamente la utilización de un perro por cazador.\n\nArtículo\n10.-Zona 1. (Guanacaste) Se prohíbe la caza mayor y menor: Con excepción de los\nsiguientes días: 3 y 4, 17 y 18, 25 de julio;\n\n2, 7 y 8 ,\n15, 21 y 22 de agosto; 4 y 5, 15, 18 y 19 de setiembre; 2 y 3, 16 y 17 de\noctubre, 6 y 7, 20 y 21 de noviembre del 2004 en los cuales se permite la caza.\nAdemás se prohíbe la caza mayor y menor en los siguientes sitios:\n\n \n\na) En la\nzona comprendida entre los siguientes puntos en la hoja cartográfica Tilarán:\nPartiendo del pueblo de Santa Elena de Monteverde, en el puente sobre la\nQuebrada Rodríguez, en la carretera que lleva a Las Nubes de Río Chiquito,\nmargen derecha hasta el punto conocido como la Esperanza, de este lugar siguiendo\nel camino que lleva a San Pedro hasta intersectar el Río Chiquito, siguiendo\npor este cauce en la margen derecha hasta su desembocadura en la Laguna Arenal\ncontinuando por la margen derecha del camino que conduce a el Castillo, hasta\nla desembocadura del Río Caño Negro, siguiendo aguas arriba hasta su\nnacimiento, de este punto siguiendo al norte por la divisoria de aguas y los\nlimites políticos de la Provincia de Guanacaste y Alajuela hasta el Cerro\nAmigos.\n\nb) En el\nárea delimitada por la carretera y comprendida entre las siguientes\npoblaciones: Playa El Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia,\nBelén, Santa Ana, Coyolillo, Portegolpe, Huacas y Brasilito; siguiendo la línea\nde la costa en dirección norte hasta la Playa El Coco.\n\nc) En la zona\ncomprendida entre el punto de las coordenadas 364,500 y 315,500 de la hoja\ncartográfica Murciélago Nº 3048 1 sobre la carretera interamericana norte,\nsiguiendo por esta carretera hacia la ciudad de Liberia hasta el cruce de\ncamino que conduce a la Hacienda La Esperanza, desviándose por esta camino\nhasta la Finca Bejuco pasando por el sitio Dama, continuando por el camino que conduce\na Papagayo hasta el cruce a Cabuyal desviándose por este camino hasta Playa\nCabuyal, continuando por la costa hasta el punto de coordenadas 354,500 y 302;\nHoja Cartográfica Ahogados Nº 3048 2, en el Cerro Carbonal, limite del Parque\nNacional Santa Rosa, continuando por el límite sur de dicho parque hasta el\nsitio inicial en coordenadas 364,500 y 315,500 sobre la Carretera Interamericana.\n\nd) En el\nárea comprendida entre los siguientes puntos: de Punta Coyote, en coordenadas\n193950 N 396400 E, siguiendo al noreste al camino que inicia en Caletas, en\ncoordenadas 193950 N 397150 E. Se continúa al noreste por ese mismo camino hasta\nSan Francisco de Coyote, en coordenadas 198650 N 399900 E. Se sigue al NE por el\ncamino hasta Javillo, en coordenadas 205925 N 401725 E. Sigue al NW por ese\ncamino hasta el cruce que va hacia Quebrada Grande, en coordenadas 207375 N\n396425 E, continúa luego al NW por el camino hasta el cruce que va hacia Los\nÁngeles, en coordenadas 209525 N 395675 E, de este cruce se continúa al NW por\nese camino hasta el cruce con el camino a San Ramón (Río Ora), en coordenadas\n213150 N 393650 E, continúa al NW por el camino a San Ramón hasta la\nintersección que va de Cangrejal a San Ramón en coordenadas 214275 N 389850 E.\nSigue al NE por el camino a San Ramón hasta la intersección de este con el río\nChiles en coordenadas 214300 N 389875 E, continúa al Suroeste aguas abajo del\nrío Chiles hasta su confluencia con el Río Ora, en coordenadas 213950 N 389600\nE, continúa al suroeste aguas abajo del río Ora hasta su desembocadura en\ncoordenadas 205300 N 376950 E, sigue luego al SE por la orilla de la playa\nhasta el punto inicial en Punta Coyote coordenadas 193950 N 396400 E.\n\ne) En la\nzona comprendida en los cerros Caballito y Quebrada Honda, área delimitada por\nel camino que conduce de Quebrada Honda, Caballito y Corralillo hasta encontrar\nel camino entre Puerto Humo y Nicoya, siguiendo por esta ruta hasta el cruce de\nSanta Ana, continuando por este camino pasando por los poblados de Santa Ana y\nBarra Honda hasta la carretera hacia Puerto Moreno, siguiendo hasta el poblado\nde Quebrada Honda, punto original de partida. Dicha área se encuentra ubicada\nen las hojas cartográficas Talolinga y Matambú, Provincia de Guanacaste.\n\nf) El cabro\nde monte (Mazama americana) en toda la provincia de Guanacaste.\n\ng) El venado\ncola blanca en el cantón de Santa Cruz de la provincia de Guanacaste mientras\nla Sala Cuarta resuelva un recurso de Amparo interpuesto a la caza de esta\nespecie.\n\nh) En las\nReservas Indígenas (excepto la caza de subsistencia que realicen los indígenas\ncon permiso del SINAC).\n\nArtículo\n11.-Zona 2. (Alajuela, Heredia) Se prohíbe la caza mayor y menor como se\ndetalla en los siguientes incisos:\n\n \n\na) Con\nexcepción de los siguientes días: 1º, 3 y 4, 17 y 18 de enero del 2004; 7 y 8,\n21 y22 de febrero del 2004; 6 y 7, 20 y 21 de marzo del 2004, 3 y 4, 11, 17 y\n18 de abril del 2004; 1º y 2, 15 y 16 de mayo del 2004; 1º y 2, 15 y 16 de\nenero del 2005; 5 y 6, 19 y 20 de febrero del 2005, 5 y 6, 19 y 20 de marzo del\n2005 en los cuales se permite la caza.\n\nb) En el\ncantón de Grecia y en los distritos de Piedades Norte, Los Ángeles, San Isidro\nde Peñas Blancas, Santiago, Piedades Sur, San Rafael y Zapotal del cantón de\nSan Ramón; el distrito de Monterrey del cantón de San Carlos, En la zona\ncomprendida en los distritos de Los Ángeles y Volio del cantón de San Ramón; la\nzona comprendida entre Alto Villegas del distrito de Volio del cantón de San\nRamón, empezando en la Carretera que comunica Zarcero con San Ramón en el cruce\na Angeles Norte, siguiendo por este camino hasta el puente de la Quebrada Plata\ncontinuando por el cauce aguas abajo hasta la desembocadura en el Río Espino, continuando\npor la margen derecha aguas arriba hasta el puente en el camino que comunica\nSan Luis con Barranca, de este punto continua por el camino hasta Barranca,\nsiguiendo por la carretera que conduce a San Ramón hasta el punto inicial\nubicado en Alto Villegas y el cruce a Angeles Norte; en la zona comprendida\nentre la carretera que conduce de San Ramón a la Fortuna entre los ríos la Esperanza\ny Burro, margen izquierda hasta incluir El Bosque Eterno de los Niños en los\ndistritos de La Tigra de San Carlos y San Isidro de Peñas Blancas del cantón de\nSan Ramón.\n\nc) En la\nzona comprendida entre la carretera que conduce de San Ramón a la Fortuna entre\nlos ríos la Esperanza y Río Burro, margen izquierda hasta colindar con El\nBosque Eterno de los Niños en los distritos de La Tigra de San Carlos y San\nIsidro de Peñas Blancas del Cantón de San Ramón.\n\nd) 100 m en\nambas márgenes del Río San Rafael en Muelle de San Carlos, entre el puente\nsobre la carretera que comunica la comunidad de Muelle con Pital y la\ndesembocadura del Río San Rafael en el río San Carlos.\n\ne) En la\nzona comprendida entre la carretera que lleva de la Comunidad del Tanque a\nMonterrey de San Carlos, iniciando en el cruce a Montelimar, siguiendo por este\ncamino a la derecha, pasando por el poblado de San Andrés, hasta el poblado de\nNieves siguiendo hasta encontrarse con la carretera que conduce a los Chiles,\npasando por Santa Rosa y Acapulco hasta llegar al paso del Río Chimurria, en\neste sitio se sigue a la izquierda sobre el camino que lleva hacia San Jorge\nhasta interceptar la carretera que une San Jorge con Chambacú, de este punto se\nsigue al sur por la carretera hacia Chambacú, y Cedros, siguiendo hasta Mirador\ny el cruce que lleva a Montelimar en el punto inicial.\n\nf) Un\nkilómetro en la margen derecha aguas abajo del Río Virilla, en la zona\ncomprendida entre el Puente sobre la autopista General Cañas y el Puente de\nPiedras Negras en la carretera que comunica Puriscal con Turrúcares de\nAlajuela.\n\ng) En las\nReservas Indígenas (excepto la caza de subsistencia que realicen los indígenas\ncon permiso del SINAC).\n\nArtículo\n12.-Zona 3. (Puntarenas, San José). Se prohíbe la caza mayor y menor como se\ndetalla en los siguientes incisos:\n\n \n\na) Con\nexcepción de los siguientes días: 3 y 4, 17 y 18, 25 de julio; 2, 7 y 8 , 15,\n21 y 22 de agosto; 4y 5, 15, 18 y 19 de setiembre; 2 y 3, 16 y 17 de octubre, 6\ny 7, 20 y 21 de noviembre del 2004 en los cuales se permite la caza. Además se\nprohíbe la caza mayor y menor en los siguientes sitios:\n\nb) En la\nIsla San Lucas.\n\nc) En la\nzona comprendida entre los siguientes puntos en la hoja cartográfica las\nJuntas: Partiendo del puente sobre el Río Aranjuez en la Carretera\nInteramericana Norte, margen derecha siguiendo por dicha carretera hasta el\npunte sobre el Río Lagarto, de este punto aguas arriba por la margen derecha\nhasta la confluencia de la Quebrada Rodríguez, cerca de Santa Elena, de este\npunto siguiendo por la margen derecha aguas arriba hasta su nacimiento en el\nCerro Chomogo, continuando al sur por la divisoria de aguas y los límites políticos\nde la provincia de Alajuela y Puntarenas hasta intersecar el Cerro Ojo de Agua,\nsiguiendo al sur hasta el nacimiento del Río Aranjuecito, continuando aguas\nabajo hasta el punto inicial en el puente sobre la Carretera Interamericana\nNorte.\n\nd) En la\nzona comprendida en el distrito único Parrita, del cantón de Parrita, partiendo\ndel poblado de Valle Vasconia entre el camino que conduce a la Fila Aguacate\nhasta intersectar el cauce del río Negro, siguiendo a partir de este punto el\ncauce del mismo río aguas abajo hasta su confluencia con el Río Chires. A\npartir de este punto se sigue el cauce de este río hasta intersectar la\ncarretera Puriscal Parrita a la altura del poblado de Vista de Mar; y de aquí\nse sigue la Carretera Costanera hasta intersectar el Río Pirris, aguas arriba hasta\nllegar al poblado de Valle Vasconia.\n\ne) En la\nzona comprendida entre Golfito de la provincia de Puntarenas, siguiendo por la\ncarretera que conduce hasta Río Claro, continuando por la margen izquierda de\nla Carretera Interamericana Sur hasta el puente sobre el Río Térraba, en Palmar\nSur, de este punto continua por la margen derecha del río hasta la Boca\nCoronado, para cerrar finalmente en Golfito, punto original, se exceptúa de\nesta prohibición la caza de patos y palomas que se realice en lagunas y áreas\nsembradas de arroz ubicadas fuera de áreas protegidas.\n\nf) Un\nkilómetro en ambas márgenes del Río María Aguilar, en la zona comprendida entre\nel puente Los Anonos en la carretera vieja que comunica a San José con Escazú y\nla desembocadura en el Río Virilla.\n\ng) Un\nkilómetro en la margen izquierda del río Virilla, aguas abajo, en la zona\ncomprendida entre el Puente sobre la autopista General Cañas y el puente de\nPiedras Negras en la carretera que comunica Puriscal con Turrúcares de\nAlajuela.\n\nh) La caza\nde la paloma collareja en la carretera que conduce entre Vuelta de Jorco y\nPalmichal de Acosta, en ambas márgenes y en el Cerro el Guabal ubicado en\ncoordenadas 205,500 latitud Norte y 51,800 longitud oeste, Lambert Norte, Hoja\nCaraigres.\n\ni) En las\nReservas Indígenas (excepto la caza de subsistencia que realicen los indígenas\ncon permiso del SINAC).\n\nj) En los\ncantones de Perez Zeledón, Buenos Aires y Coto Brus, excepto lo establecido en\nel inciso f del artículo 6º de este decreto, en esta zona se podrá cazar luego\nde los 50 metros medidos de la margen de la carretera y hasta los límites de la\nzona protegida.\n\nArtículo\n13.-Zona 4. (Cartago, Limón). Se prohíbe la caza mayor y menor como se detalla\nen los siguientes incisos:\n\na) Con\nexcepción de los siguientes días: 1º, 3 y 4, 17 y 18 de enero del 2004; 7 y 8,\n21 y 22 de febrero del 2004; 6 y 7, 20 y 21 de marzo del 2004, 3 y 4, 11, 17 y\n18 de abril del 2004; 1 y 2, 15 y 16 de mayo del 2004; 1º y 2, 15 y 16 de enero\ndel 2005; 5 y 6, 19 y 20 de febrero del 2005, 5 y 6, 19 y 20 de marzo del 2005.\n\nb) Del\ntepezcuintle (Agouti paca) en el distrito de Orosí del cantón de Paraíso.\n\nc) Cantones\nde Jiménez y Turrialba, provincia de Cartago.\n\nd) En el\ncantón del Guarco, excepto los sitios establecidos en el inciso f del artículo\n6 de este decreto, en esta zona se podrá cazar luego de los 50 metros medidos\nde la margen de la carretera y hasta los límites de la zona protegida.\n\ne) De\nconejos silvestres en los cantones: Cartago, Paraíso, La Unión, Jiménez,\nAlvarado y Oreamuno todos de la provincia de Cartago, con excepción de las\nfechas 2 y 3, 16 y 17 de octubre y 6 y 7, 20 y 21 de noviembre del 2004.\n\nf) En las\nReservas Indígenas (excepto la caza de subsistencia que realicen los indígenas\ncon permiso del SINAC).\n\nArtículo\n14.-Se declaran como especies de caza mayor los mamíferos listados en este\nartículo; se podrán cazar, de acuerdo a las fechas autorizadas (artículos 11 al\n14 de este decreto) para cada zona, excepto las zonas delimitadas en los\nincisos 10, 11, 12 y 13 de este Decreto.\n\n \n\na)\nOdocoileus virginianus: Venado cola blanca; 2 machos por año.\n\nb) Mazama\namericana: cabro de monte, 1 macho por año.\n\nc) Canis\nlatrans: coyote; 6 animales por año, sujeto a temporada de\n\ncaza\nautorizada por zona.\n\nArtículo\n15.-Se declaran como especies de caza menor los animales listados en este\nartículo, se podrán cazar de acuerdo a las fechas autorizadas para cada zona,\nexcepto en las zonas delimitadas en los artículos 10, 11, 12 y 13 de este\nDecreto:\n\n \n\na) Didelphis\nmarsupialis: zorro pelón; 5 piezas por año, por cazador.\n\nb) Didelphis\nvirginiana: zorro pelón; 5 piezas por año, por cazador.\n\nc)\nSylvilagus brasilensis: conejo de monte; 10 piezas por año, por cazador.\n\nd)\nSylvilagus floridanus: conejo de monte; 10 piezas por año, por cazador.\n\ne) Sciurus\nvariegatoides: ardilla común; 10 piezas por año, por cazador.\n\nf) Agouti\npaca: tepezcuintle; 2 piezas por año por cazador.\n\ng)\nDasyprocta punctata: guatuza; 2 piezas por año, por cazador.\n\nh) Urocyon\ncineroargenteus: zorra gris; 2 piezas por año, por cazador.\n\ni)\nCtenosaura similis: garrobo; 4 piezas por año, por cazador.\n\nCAPÍTULO VI\n\nGeneralidades\nsobre la caza mayor y menor\n\nArtículo\n16.-Tratándose de fincas privadas, los cazadores deberán obtener el\ncorrespondiente permiso del propietario, de conformidad con lo establecido en\nel artículo 32 de la Ley de Conservación de la Vida Silvestre.\n\nArtículo\n17.-De conformidad con lo establecido en los artículos 12, 17, 30 y 63 de la\nLey Nº 7317, Ley de Conservación de la Vida Silvestre, las Oficinas\nSubregionales, así como las oficinas de Administración de los Refugios\nNacionales de Fauna Silvestre y aquellas otras oficinas que se establezcan con\neste fin en las diferentes Áreas de Conservación, que conforman el Sistema\nNacional de Áreas de Conservación, serán las encargadas de autorizar, emitir y\nsuscribir o denegar las licencias de caza y pesca deportiva continental. En aquellas\náreas protegidas que incluyen extensiones marinas, las oficinas administradoras\nde dichas áreas, serán las encargadas de autorizar, emitir y suscribir o\ndenegar los permisos de pesca deportiva.\n\nArtículo\n18.-Se define como \"límite de piezas\" al máximo número de animales de caza\nautorizada en el presente decreto. El límite de piezas podrá ser acumulativo\npor días de caza en el caso de los patos, palomas y codornices, siempre y\ncuando el cazador reporte el número de piezas cazado por día, en la Delegación\nde la Guardia de Asistencia Rural o a la oficina del SINAC, más cercana a la\nzona de caza visitada, quienes deberán llevar un registro detallado de los\nreportes proporcionados por los cazadores.\n\nArtículo\n19.-El Sistema Nacional de Áreas de Conservación (SINAC) a través de sus\noficinas subregionales podrá autorizar la realización de torneos de caza de\nconformidad con el Art. 24 del reglamento de la Ley de Conservación de la Vida\nSilvestre, mediante resolución administrativa, solo cuando se trate de:\n\n \n\na) Rastreo\nde huellas preparadas para los efectos del torneo en un día determinado; para lo\ncual no se autoriza el acoso, maltrato o muerte de animales silvestres.\n\nb) Torneos\nde caza menor de aves canoras y de plumaje y su liberación en el mismo sitio de\ncaptura, con un máximo de 2 fechas por sitio por el período autorizado,\ndependiendo del comportamiento de las poblaciones.\n\nc) Torneos\nde canto de aves canoras en sitios bajo techo o cerrados y acondicionados para\ntal efecto.\n\nPara los\ntorneos de caza menor de aves canoras y de plumaje, los participantes deberán\nportar y mostrar si fuera requerido la correspondiente licencia de caza\nvigente. Los torneos de caza deberán ser fiscalizados por funcionarios del\nSINAC del Área de Conservación correspondiente.\n\nCAPÍTULO VII\n\nDe la pesca\ncontinental\n\n \n\nArtículo\n20.-Se prohíbe la pesca:\n\na) De trucha\nArco Iris (Salmo gardnieri) en todos los ríos nacionales, entre el 1 de febrero\ny el 30 de abril inclusive; fuera de ese plazo se podrá pescar con un límite de\n5 piezas con un tamaño mínimo de 25 cm. de longitud, por persona por día. La\npesca de truchas cultivadas en estanques se pueda realizar durante todo el año.\n\nb) De la\ntrucha en el río Toro y sus afluentes en el distrito Toro Amarillo del cantón\nde Valverde Vega.\n\nc) De\nguapote (Parachromis spp) róbalo (Centropomus undecimalis), sábalo (Megalops\natlanticus) y demás especies de peces, en los siguientes ríos y sus afluentes:\nFrío, Zapote, Niño o Pizote, lagunas del Refugio de Fauna Silvestre de Caño\nNegro y el Refugio de Fauna Silvestre las Camelias, entre el 1º de abril y el\n31 de julio inclusive.  Fuera de este plazo,\nse podrá pescar con un límite de 5 peces con un tamaño mínimo de 25 cm. de\nlongitud, por persona por día. La pesca de peces cultivados en estanques se\npuede realizar durante todo el año.\n\nd) Del\ngaspar (Atractosteus tropicus) en los siguientes ríos y sus afluentes: Frío,\nZapote, Niño o Pizote, lagunas del Refugio de Fauna Silvestre de Caño Negro y\nel Refugio de Fauna Silvestre las Camelias, entre el 1º de marzo y el 31 de\nagosto inclusive.  Fuera de este plazo,\nse podrá pescar con un límite de 2 peces con un tamaño mínimo de 60 cm de\nlongitud, por persona por día.\n\ne) De todas\nlas especies de peces de agua dulce en todos los ríos incluyendo sus afluentes,\nlagos y lagunas (exceptuando lo establecido en el inciso c y d de este\nartículo), entre el 1º de setiembre y el 30 de noviembre inclusive. Fuera de\nese plazo se podrá pescar con un límite de 5 piezas con un tamaño mínimo de 25\ncm. de longitud, por persona con licencia por día. Se exceptúa el tepemechín\n(Agonostomus monticola), para el cual no se establece límite de longitud y\ngaspar (Atractosteus tropicus) para el cual se fija un tamaño mínimo de 60 cm.\n\nf) Del\nlangostino o camarón de río (Macrobrachium spp.) en todos los ríos nacionales\nentre el 15 de mayo y el 31 de diciembre, inclusive.  Fuera de este plazo, se podrá pescar con un\nlímite de 10 piezas por persona, por día.\n\ng) La pesca\ndeportiva en la Laguna de Hule, ubicada en el Refugio de Fauna Privado Bosque\nAlegre, Cariblanco.\n\nh) En las\nReservas Indígenas (excepto la pesca de subsistencia que realicen los indígenas\ncon permiso del SINAC).\n\ni) 100 m en\nambas márgenes del Río San Rafael en Muelle de San Carlos, entre el puente\nsobre la carretera que comunica la comunidad de Muelle con Pital y la\ndesembocadura del Río San Rafael en el río San Carlos.\n\nArtículo\n21.-Se autoriza:\n\n \n\na) La pesca\ndeportiva, con caña y carrete, así como cuerdas de mano, en un horario de 6:00\na. m., a 5:00 p. m.\n\nb) La pesca\ntodos los días del año en:\n\n1)\nEl Río Reventazón desde Palomo de Orosí hasta su desembocadura, con excepción\nde sus afluentes. El límite de piezas se establece en 5 peces con un tamaño\nsuperior a 25 cm, por pescador con licencia por día.\n\n2)\nLa que se realice con cuerda de mano o caña y carrete en el Embalse de Arenal.\nSe establece el límite de piezas en 10 peces por pescador con licencia por día.\n\n3)\nEn las Barras de Colorado, Parismina, Tortuguero y Matina.\n\nEl\nlímite de piezas en las barras citadas será de 5 peces por pescador por día. Therefore:\n\n \n\nTHEY DECREE:\n\n \n\nRegulations\nfor Minor and Major Hunting and Continental and Insular Fishing\n\n \n\nCHAPTER I\n\nHunting in\nprotected areas\n\n \n\nArticle\n1°-Major and minor hunting, the minor hunting of songbirds (aves canoras) and plumage birds (aves de plumaje), as well as fishing, are prohibited in National Parks (except as established in\narticle 10 of Law Nº 6084, Law for the Creation of the National Parks Service),\nBiological Reserves, Natural Monuments, Forest Reserves,\nProtected Zones of the country, Indigenous Reserves (except subsistence hunting\nfor resident indigenous people), Wildlife Refuges, (except when\ndealing with population management programs carried out by the National System of Conservation\nAreas of MINAE) and properties subject to the Payment of\nEnvironmental Services (Pago de Servicios Ambientales) regime.\n\nCHAPTER II\n\nProhibitions\n\n \n\nArticle\n2°-Major and minor hunting of all species with reduced\npopulations or in danger of extinction (articles 58 and 60 of the Regulations to the Wildlife Conservation Law) is prohibited, with the exception of what is technically determined\nby the National System of Conservation Areas.\n\nArticle\n3°-The following is prohibited:\n\n \n\na)\n\"Calentar\" (exposing to the sun) wild birds in trap cages or\ncatching cages during days not authorized for hunting.\n\n \n\nb) Hunting\nwild birds with artificial light at night, as well as the capture\nof birds with adhesives (pegamentos) and mist nets (redes de niebla).\n\n \n\nc) The\ntransport within the country of birds in trap cages or catching cages during\nseasons not authorized for hunting.\n\n \n\nd) The hunting\nof all species of resident and migratory wild birds in all the\nnational territory, with the exception of those indicated in this\nExecutive Decree.\n\n \n\ne)\nTransporting songbirds (birds with striking songs) or plumage birds (birds with\nstrikingly colored plumage) in decoy cages (jaulas echadoras) or with trap cages, during\na season not authorized for hunting, without the respective permits from SINAC (hunting\nlicense and valid possession permit and transport permit).\n\nf) The hunting\nof songbirds and plumage birds, in the locations indicated below:\n\n \n\n1)\nIn the districts of Los Ángeles, Piedades Norte and San Rafael of the canton of San\nRamón; the zone between Alto Villegas of the district of Volio of the canton\nof San Ramón, starting at the road that connects Zarcero with San Ramón at the\nintersection to Angeles Norte, following this road to the bridge of the\nQuebrada Plata, continuing along the watercourse downstream to its mouth in\nthe Río Espino, continuing along the right bank upstream to the bridge\non the road that connects San Luis with Barranca, from this point continuing along the\nroad to Barranca, following the highway that leads to San Ramón to the starting point\nlocated in Alto Villegas and the intersection to Angeles Norte; in the\nzone between the highway that leads from San Ramón to La Fortuna between\nthe rivers La Esperanza and Burro, left bank up to include El Bosque Eterno\nde los songbirds and plumage birds may be hunted, under the following\nconditions:\n\n \n\na) In authorized\ntime and only with one catching cage (jaula cogedora) per hunter.\n\nb) Maximum 2\nadult males of each authorized species per hunter per year, in all the\nnational territory, except as established in subsection f of article 3 of\nthis decree.\n\nc)\nOnly during Saturdays, Sundays, and legal holidays, with hours\nfrom 6 a.m. to 5 p.m.\n\nd) In case\nof bird hunting tournaments and the subsequent release of the captured birds,\nthese tournaments are for one specific day at an authorized site according to the\nsubmitted application, with a maximum of two days per season for one site.\nThe sites must be more than 5 km apart from each other.\n\nArticle\n6º-The following minor game bird species may be hunted with a firearm, in authorized time,\nduring the hours of 6:00 a.m. to 5:00 p.m.,\non Saturdays, Sundays, and legal holidays with a maximum limit of\nspecimens as indicated below, (except non-resident foreigners\nwho may only hunt in Guanacaste and only mourning dove (Zenaida macroura);\nwhite-winged dove (Zenaida asiática)):\n\n \n\na) Spot-bellied bobwhite (Colinus leucopogon), 10 specimens per day per season, per hunter, in\nall the national territory in the period between October 1\nand March 31.\n\nb) Great-tailed grackle (Zanate) (Quiscalus mexicanus), with no limit of specimens, in all the national territory, on\ndates authorized for hunting in each zone (articles 10, 11, 12, 13 of this\nDecree).\n\nc) Mourning dove (Zenaida macroura); white-winged dove (Zenaida asiática), 20 specimens per\nday, per hunter, in all the national territory, in the period between\nNovember 1 and March 31.\n\nd) Black-bellied whistling-duck (Dendrocygma autumnalis) and blue-winged teal (Anas discor), 15 specimens\nper day, per hunter, in all the national territory, in the period between\nNovember 1 and March 31.\n\ne) Red-billed pigeon, Ruddy pigeon, Pale-vented pigeon, Short-billed pigeon (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nnigrirostris), 10 specimens per day, per hunter, in all the national territory,\nexcept the zones delimited in subsections 10, 11, 12 and 13 of this decree,\nas per the distribution of these species, in the period between\nOctober 1 and February 29.\n\nf) Band-tailed pigeon (Columba fasciata), 15 specimens per day, per hunter, in the period\nbetween September 1 and January 31, in the following\nlocations:\n\n1)\nOn private properties along the margins of the Carretera Interamericana Sur, between\nKilometer 34 and Km 39, between Km 41 and Km 47, between Km 52 and Km\n55, between Km 57 and Km 64 (site known as Madreselva). Only\nmore than 50 m from the highway boundary and outside the boundaries of the Reserva Forestal\nLos Santos and El Parque Nacional Tapantí Macizo de la Muerte. In the unauthorized zones\n(between kilometer 39 and Km 40, between Km 41 and Km 46, between\nKm 52 and Km 54, and between Km 55 and Km 56) which include towns at the edge of\nthe highway, hunting is only permitted on private properties outside the\nReservas Forestal Los Santos and El Parque Nacional Tapantí Macizo de la Muerte\nat sites located 1 Km or more from the highway.\n\n2)\nOn private properties, on both margins of the highway between Carrizal de\nAlajuela and Poasito, more than 50 meters from the highway boundaries.\n\n3)\nOn private properties on both margins of the highways between Tarbaca and Vuelta\nde Jorco, more than 50 meters from the highway boundaries.\n\nCHAPTER IV\n\nZones authorized\nfor hunting\n\n \n\nArticle\n7.-The following hunting zones are declared:\n\n \n\nZone 1.\nProvince of Guanacaste.\n\nZone 2.\nProvinces of Alajuela and Heredia.\n\nZone 3.\nProvinces of Puntarenas and San José.\n\nZone 4.\nProvinces of Cartago and Limón.\n\nHunting is\nonly permitted from 6 a.m. to 6 p.m., on authorized days.\n\nCHAPTER V\n\nOn minor\nand major hunting with authorized weapons and hunting methods\n\nin the\nRegulations to the Wildlife Conservation Law\n\n \n\nArticle\n8.-The regulations for hunting seasons must be observed, in accordance\nwith the zones declared in article 7.\n\nArticle\n9.-The use of only one dog per hunter is authorized.\n\nArticle\n10.-Zone 1. (Alajuela, Heredia) Major and minor hunting is prohibited as\ndetailed in the following subsections:\n\n \n\na) With\nthe exception of the following days: January 1, 3 and 4, 17 and 18 of 2004; February 7 and 8,\n21 and 22 of 2004; March 6 and 7, 20 and 21 of 2004; April 3 and 4, 11, 17 and\n18 of 2004; May 1 and 2, 15 and 16 of 2004; January 1 and 2, 15 and 16 of\n2005; February 5 and 6, 19 and 20 of 2005; March 5 and 6, 19 and 20 of\n2005 on which hunting is permitted.\n\nb) In the\ncanton of Grecia and in the districts of Piedades Norte, Los Ángeles, San Isidro\nde Peñas Blancas, Santiago, Piedades Sur, San Rafael and Zapotal of the canton of\nSan Ramón; the district of Monterrey of the canton of San Carlos, In the zone\nencompassed in the districts of Los Ángeles and Volio of the canton of San Ramón; the\nzone between Alto Villegas of the district of Volio of the canton of San\nRamón, starting at the road that connects Zarcero with San Ramón at the\nintersection to Angeles Norte, following this road to the bridge of the Quebrada Plata,\ncontinuing along the watercourse downstream to the mouth in the Río Espino, continuing\nalong the right bank upstream to the bridge on the road that connects\nSan Luis with Barranca, from this point continuing along the road to Barranca,\nfollowing the highway that leads to San Ramón to the starting point\nlocated in Alto Villegas and the intersection to Angeles Norte; in the zone\nbetween the highway that leads from San Ramón to La Fortuna between the rivers La Esperanza\nand Burro, left bank up to include El Bosque Eterno de los Niños in the\ndistricts of La Tigra de San Carlos and San Isidro de Peñas Blancas of the canton of\nSan Ramón.\n\nc) In the\nzone between the highway that leads from San Ramón to La Fortuna between\nthe rivers La Esperanza and Río Burro, left bank up to bordering El\nBosque Eterno de los Niños in the districts of La Tigra de San Carlos and San\nIsidro de Peñas Blancas of the Canton of San Ramón.\n\nd) 100 m on\nboth banks of the Río San Rafael in Muelle de San Carlos, between the bridge\nover the highway that connects the community of Muelle with Pital and the\nmouth of the Río San Rafael in the río San Carlos.\n\ne) In the\nzone between the road that goes from Comunidad del Tanque to\nMonterrey de San Carlos, starting at the intersection to Montelimar, following this\nroad to the right, passing through the town of San Andrés, to the town of\nNieves, following until meeting the highway that leads to Los Chiles,\npassing through Santa Rosa and Acapulco until reaching the crossing of the Rio Chimurria, in\nthis place continue left on the road that leads to San Jorge\nuntil intersecting the highway that joins San Jorge with Chambacú, from this point continue\nsouth on the highway towards Chambacú, and Cedros, continuing to Mirador\nand the intersection that leads to Montelimar at the starting point.\n\nf) One\nkilometer on the right bank downstream of the Río Virilla, in the zone\nbetween the Bridge on the General Cañas highway and the Bridge of\nPiedras Negras on the highway that connects Puriscal with Turrúcares de\nAlajuela.\n\ng) In the\nIndigenous Reserves (except subsistence hunting carried out by indigenous people\nwith permission from SINAC).\n\nArticle\n12.-Zone 3. (Puntarenas, San José). Major and minor hunting is prohibited as\ndetailed in the following subsections:\n\n \n\na) With\nthe exception of the following days: July 3 and 4, 17 and 18, 25; August 2, 7 and 8, 15,\n21 and 22; September 4 and 5, 15, 18 and 19; October 2 and 3, 16 and 17; November 6\nand 7, 20 and 21 of 2004 on which hunting is permitted. Furthermore,\nmajor and minor hunting is prohibited in the following sites:\n\nb) On\nIsla San Lucas.\n\nc) In the\nzone between the following points on the Las Juntas cartographic sheet:\nStarting from the bridge over the Río Aranjuez on the Carretera Interamericana\nNorte, right bank following said highway to the bridge over the Río\nLagarto, from this point upstream along the right bank to the confluence\nof the Quebrada Rodríguez, near Santa Elena, from this point following the right\nbank upstream to its spring at Cerro Chomogo, continuing south along the watershed divide and the political boundaries\nof the province of Alajuela and Puntarenas until intersecting Cerro Ojo de Agua,\ncontinuing south to the spring of the Río Aranjuecito, continuing\ndownstream to the starting point on the bridge over the Carretera Interamericana\nNorte.\n\nd) In the\nzone encompassed in the single district of Parrita, of the canton of Parrita, starting\nfrom the town of Valle Vasconia between the road that leads to the Fila Aguacate\nuntil intersecting the watercourse of the río Negro, following from this point the\nwatercourse of the same river downstream to its confluence with the Río Chires. From\nthis point follow the watercourse of this river until intersecting the\nPuriscal Parrita highway at the level of the town of Vista de Mar; and from here\nfollow the Carretera Costanera until intersecting the Río Pirris, upstream until\nreaching the town of Valle Vasconia.\n\ne) In the\nzone between Golfito of the province of Puntarenas, following the\nhighway that leads to Río Claro, continuing along the left bank of\nthe Carretera Interamericana Sur to the bridge over the Río Térraba, in Palmar\nSur, from this point continue along the right bank of the river to Boca\nCoronado, to finally close at Golfito, original point, excluding from\nthis prohibition the hunting of ducks and pigeons carried out in lagoons and\nareas planted with rice located outside protected areas.\n\nf) One\nkilometer on both banks of the Río María Aguilar, in the zone between\nthe Puente Los Anonos on the old road that connects San José with Escazú and\nthe mouth at the Río Virilla.\n\ng) One\nkilometer on the left bank of the río Virilla, downstream, in the zone\nbetween the Bridge on the General Cañas highway and the bridge of\nPiedras Negras on the highway that connects Puriscal with Turrúcares de\nAlajuela.\n\nh) The hunting\nof the band-tailed pigeon on the highway that leads between Vuelta de Jorco and\nPalmichal de Acosta, on both margins and on Cerro el Guabal located at\ncoordinates 205,500 North latitude and 51,800 West longitude, Lambert North, Hoja\nCaraigres.\n\ni) In the\nIndigenous Reserves (except subsistence hunting carried out by indigenous people\nwith permission from SINAC).\n\nj) In the\ncantons of Perez Zeledón, Buenos Aires and Coto Brus, except as established in\nsubsection f of article 6 of this decree, in this zone hunting is permitted after\n50 meters measured from the highway margin and up to the limits of the\nprotected zone.\n\nArticle\n13.-Zone 4. (Cartago, Limón). Major and minor hunting is prohibited as detailed\nin the following subsections:\n\na) With\nthe exception of the following days: January 1, 3 and 4, 17 and 18 of 2004; February 7 and 8,\n21 and 22 of 2004; March 6 and 7, 20 and 21 of 2004; April 3 and 4, 11, 17 and\n18 of 2004; May 1 and 2, 15 and 16 of 2004; January 1 and 2, 15 and 16 of\n2005; February 5 and 6, 19 and 20 of 2005; March 5 and 6, 19 and 20 of 2005.\n\nb) Of the\nlowland paca (tepezcuintle) (Agouti paca) in the district of Orosí of the canton of Paraíso.\n\nc) Cantons\nof Jiménez and Turrialba, province of Cartago.\n\nd) In the\ncanton of El Guarco, except the sites established in subsection f of article\n6 of this decree, in this zone hunting is permitted after 50 meters measured\nfrom the highway margin and up to the limits of the protected zone.\n\ne) Of\nwild rabbits in the cantons: Cartago, Paraíso, La Unión, Jiménez,\nAlvarado and Oreamuno, all of the province of Cartago, with the exception of the\ndates October 2 and 3, 16 and 17 and November 6 and 7, 20 and 21 of 2004.\n\nf) In the\nIndigenous Reserves (except subsistence hunting carried out by indigenous people\nwith permission from SINAC).\n\nArticle\n14.-The mammals listed in this article are declared as major game species; they may be hunted, according to the authorized dates (articles 11 through\n14 of this decree) for each zone, except the zones delimited in\nsubsections 10, 11, 12 and 13 of this Decree.\n\n \n\na)\nOdocoileus virginianus: White-tailed deer; 2 males per year.\n\nb) Mazama\namericana: Red brocket deer (cabro de monte), 1 male per year.\n\nc) Canis\nlatrans: Coyote; 6 animals per year, subject to hunting\n\nseason authorized by zone.\n\nArticle\n15.-The animals listed in this article are declared as minor game species; they may be hunted according to the authorized dates for each zone,\nexcept in the zones delimited in articles 10, 11, 12 and 13 of this\nDecree:\n\n \n\na) Didelphis\nmarsupialis: Common opossum (zorro pelón); 5 specimens per year, per hunter.\n\nb) Didelphis\nvirginiana: Virginia opossum (zorro pelón); 5 specimens per year, per hunter.\n\nc)\nSylvilagus brasilensis: Forest rabbit (conejo de monte); 10 specimens per year, per hunter.\n\nd)\nSylvilagus floridanus: Eastern cottontail (conejo de monte); 10 specimens per year, per hunter.\n\ne) Sciurus\nvariegatoides: Variegated squirrel (ardilla común); 10 specimens per year, per hunter.\n\nf) Agouti\npaca: Lowland paca (tepezcuintle); 2 specimens per year per hunter.\n\ng)\nDasyprocta punctata: Central American agouti (guatuza); 2 specimens per year, per hunter.\n\nh) Urocyon\ncinereoargenteus: Gray fox (zorra gris); 2 specimens per year, per hunter.\n\ni)\nCtenosaura similis: Black spiny-tailed iguana (garrobo); 4 specimens per year, per hunter.\n\nCHAPTER VI\n\nGeneral Provisions\non major and minor hunting\n\nArticle\n16.-In the case of private properties, hunters must obtain the\ncorresponding permission from the owner, in accordance with the provisions of\narticle 32 of the Wildlife Conservation Law.\n\nArticle\n17.-In accordance with the provisions of articles 12, 17, 30 and 63 of\nLaw Nº 7317, Wildlife Conservation Law, the Subregional\nOffices, as well as the Administration offices of the\nNational Wildlife Refuges and those other offices established for\nthis purpose in the different Conservation Areas, that make up the\nNational System of Conservation Areas, shall be responsible for authorizing, issuing\nand endorsing or denying continental hunting and sport fishing licenses. In those\nprotected areas that include marine extensions, the administrative offices\nof said areas shall be responsible for authorizing, issuing and endorsing or\ndenying sport fishing permits.\n\nArticle\n18.-The \"specimen limit (límite de piezas)\" is defined as the maximum number of game animals\nauthorized in this decree. The specimen limit may be cumulative\nper hunting days in the case of ducks, pigeons and bobwhites, as long\nas the hunter reports the number of specimens hunted per day, at the\nRural Assistance Guard Post or the nearest SINAC office\nto the hunting zone visited, who must keep a detailed record of the\nreports provided by the hunters.\n\nArticle\n19.-The National System of Conservation Areas (SINAC), through its\nsubregional offices, may authorize the holding of hunting tournaments in\naccordance with Art. 24 of the regulations to the Wildlife Conservation Law,\nby means of an administrative resolution, only when dealing with:\n\n \n\na) Tracking\nof prepared trails for the purposes of the tournament on a specific day; for\nwhich the harassment, mistreatment or death of wild animals is not authorized.\n\nb) Tournaments\nfor small-game hunting of songbirds and plumage birds and their release at the same site of capture, with a maximum of 2 dates per site per the authorized period, depending on the behavior of the populations.\n\nc) Tournaments\nfor the singing of songbirds at indoor or enclosed sites suitably adapted for that purpose.\n\nFor\nsmall-game hunting tournaments of songbirds and plumage birds, participants must carry and show, if required, the corresponding valid hunting license. Hunting tournaments must be supervised by officials of SINAC from the corresponding Conservation Area.\n\nCHAPTER VII\n\nOn continental fishing\n\nArticle 20.—The fishing of the following is prohibited:\n\na) Rainbow trout (Salmo gardnieri) in all national rivers, between February 1 and April 30 inclusive; outside of that period, fishing is permitted with a limit of 5 specimens with a minimum size of 25 cm in length, per person per day. Fishing for trout raised in ponds may be carried out year-round.\n\nb) Trout in the Toro River and its tributaries in the Toro Amarillo district of the canton of Valverde Vega.\n\nc) Guapote (Parachromis spp), róbalo (Centropomus undecimalis), sábalo (Megalops atlanticus), and other fish species, in the following rivers and their tributaries: Frío, Zapote, Niño or Pizote, the lagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge, between April 1 and July 31 inclusive. Outside of this period, fishing is permitted with a limit of 5 fish with a minimum size of 25 cm in length, per person per day. Fishing for fish raised in ponds may be carried out year-round.\n\nd) Gaspar (Atractosteus tropicus) in the following rivers and their tributaries: Frío, Zapote, Niño or Pizote, the lagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge, between March 1 and August 31 inclusive. Outside of this period, fishing is permitted with a limit of 2 fish with a minimum size of 60 cm in length, per person per day.\n\ne) All species of freshwater fish in all rivers including their tributaries, lakes, and lagoons (except as established in subsections c and d of this article), between September 1 and November 30 inclusive. Outside of that period, fishing is permitted with a limit of 5 specimens with a minimum size of 25 cm in length, per person with a license per day. The tepemechín (Agonostomus monticola) is excepted, for which no length limit is established, and the gaspar (Atractosteus tropicus), for which a minimum size of 60 cm is set.\n\nf) River shrimp or prawn (Macrobrachium spp.) in all national rivers between May 15 and December 31, inclusive. Outside of this period, fishing is permitted with a limit of 10 specimens per person, per day.\n\ng) Sport fishing in Laguna de Hule, located in the Bosque Alegre Private Wildlife Refuge, Cariblanco.\n\nh) In Indigenous Reserves (except for subsistence fishing carried out by indigenous people with permission from SINAC).\n\ni) 100 m on both banks of the San Rafael River in Muelle de San Carlos, between the bridge on the road connecting the community of Muelle with Pital and the mouth of the San Rafael River in the San Carlos River.\n\nArticle 21.—The following is authorized:\n\na) Sport fishing, with rod and reel, as well as hand lines, during the hours of 6:00 a.m. to 5:00 p.m.\n\nb) Fishing every day of the year in:\n\n1)\nThe Reventazón River from Palomo de Orosí to its mouth, with the exception of its tributaries. The limit of specimens is established at 5 fish with a size greater than 25 cm, per licensed fisher per day.\n\n2)\nFishing carried out with hand line or rod and reel in the Arenal Reservoir. The limit of specimens is established at 10 fish per licensed fisher per day.\n\n3)\nAt the Bars of Colorado, Parismina, Tortuguero, and Matina.\n\nThe limit of specimens at the cited bars shall be 5 fish per fisher per day. A river bar shall be understood as the riverbed extending up to one kilometer upstream, starting from its mouth.\n\nc) Subsistence fishing carried out by indigenous people in Indigenous Reserves with permission from SINAC.\n\nd) Fishing in Wildlife Refuges and National Parks when the activity is provided for in the Management Plan or public-use regulations.\n\nArticle 22.—Fishing is prohibited for an indefinite period in the following rivers:\n\nSarapiquí, between the confluence of the Peje River to its junction with the Puerto Viejo; Puerto Viejo, between the confluence of the Sábalo Esquina River to its junction with the Sarapiquí.\n\nArticle 23.—The National System of Conservation Areas (SINAC), through its subregional offices, may authorize the holding of sport fishing tournaments (Art. 24 of the regulation of the Wildlife Conservation Law) to organized groups, depending on the behavior of the populations, by means of an administrative resolution. Participants must present their valid fishing license.\n\nCHAPTER VIII\n\nOn the possession of wild animals in captivity\n\nArticle 24.—In accordance with article 19 of Law No. 7317 of October 30, 1992, individuals who capture wild animals authorized by this decree and under the corresponding license must register said animals with the corresponding subregional office of the National System of Conservation Areas of MINAE within one month following the capture. In the case of possession of plumage and song birds in captivity in aviaries with minimum dimensions of 4 cubic meters, adequately conditioned, a limit of 15 birds in total per aviary is established for each licensed permit holder.\n\nArticle 25.—The hunting or capture of species that do not appear on the lists of species authorized for hunting in articles 4, 6, 14, and 15 of this Decree is prohibited for an indefinite period.\n\nArticle 26.—The possession and exhibition of songbirds or plumage birds at farmers' markets and commercial establishments is prohibited.\n\nArticle 27.—The possession of wild birds in captivity shall be governed by the provisions of this Decree and Executive Decrees No. 26435 MINAE and 28312 MINAE.\n\nArticle 28.—The application of this Decree is excepted for hunting farms (fincas cinegéticas) duly registered with the National System of Conservation Areas of MINAE.\n\nArticle 29.—Executive Decree No. 31077-MINAE, published on March 27, 2003, is hereby repealed.\n\nArticle 30.—It shall take effect upon its publication in the Official Gazette and expires on March thirty-first, two thousand five.\n\nGiven at the Presidency of the Republic.—San José, on the twenty-ninth day of the month of March, two thousand four." }
