(FONAFIFO)\n\nTexto Completo acta: 737B7\nNº 31767-MINAE\n\nNº 31767-MINAE\n\n LA PRIMERA VICEPRESIDENTA\n\n EN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA\n\n Y EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\n    En ejercicio de las facultades que les confiere el\nartículo 140, incisos 3) y 18) y el artículo 146 de la Constitución Política en\nrelación con los artículos 3º, 46, 47, inciso d) de la Ley Nº 7575, el artículo 5º\nde la Ley N° 8114 Simplificación y Eficiencia Tributaria del 4 de julio del 2001, la Ley\nNº 8058 Contrato de Préstamo entre el Banco Internacional de Reconstrucción y Fomento y\nel Gobierno de Costa Rica.\n\nConsiderando:\n\n     1º—Que la Administración Forestal\n del Estado es competencia del Ministerio del Ambiente y Energía, por medio del Sistema\n Nacional de Áreas de Conservación (SINAC) y el Fondo Nacional de Financiamiento Forestal\n (FONAFIFO), instituciones que tienen la competencia de fomentar el sector forestal,\n específicamente a través del Programa de Pago por Servicios Ambientales.\n     2º—Que el Fondo Nacional de\n Financiamiento Forestal tiene como función el trámite y pago de servicios ambientales\n que brindan los bosques y plantaciones forestales y otras actividades necesarias para\n fortalecer el desarrollo del sector de recursos naturales del país.\n     3º—Que al SINAC le corresponde el\n control y seguimiento del Programa de Pagos por Servicios Ambientales.\n     4º—Que a través de Convenios\n Internacionales nuestro país se ha comprometido a llevar a cabo programas de\n conservación, manejo de bosques y reforestación.\n     5º—Que es importante la\n consolidación de las áreas silvestres protegidas y el fortalecimiento de las reservas\n privadas y núcleos de producción forestal sostenible, mediante el reconocimiento de los\n servicios ambientales que brindan estas áreas.\n     6º—Que es importante para la\n actividad forestal el desarrollo de un horizonte claro en cuanto al planteamiento en la\n disponibilidad y uso de los recursos financieros, buscando mecanismos que permitan la\n sostenibilidad de ese financiamiento.\n     7º—Que mediante la negociación de\n proyectos de cooperación internacional y nacional el MINAE, ha solicitado el apoyo\n financiero al Banco Mundial, para fortalecer y dar continuidad al Programa de Pago de\n Servicios Ambientales, así como permitir que se desarrollen e institucionalicen otros\n mecanismos de financiamiento como la venta de servicios ambientales de mitigación de\n gases con efecto invernadero y el mecanismo de cobro del servicio ambiental de\n conservación de agua a los proyectos hidroeléctricos en Costa Rica.\n     8º—Que el Proyecto Ecomercados\n financiado conjuntamente por un empréstito con el Banco Internacional de Reconstrucción\n y Fomento (BIRF), una donación del Fondo para el Medio Ambiente Mundial (en sus siglas en\n inglés GEF) y la contrapartida nacional, busca incrementar los esfuerzos de conservación\n en Costa Rica, promoviendo el desarrollo de mercados y proveedores de servicios\n ambientales ofrecidos por bosques de propiedad privada, contempla dentro de sus metas a\n cinco años, el pago de servicios ambientales a:\n\n a. Cien mil hectáreas de bosque dedicados a la protección,\n en terrenos ubicados dentro de las áreas del Proyecto Corredor Biológico Mesoamericano\n (Sección Costa Rica).\n b. Aumento de 100% en la participación de comunidades\n indígenas en el Programa de Pago de Servicios Ambientales.\n c. Aumento de un 30% en la participación de mujeres\n propietarias en el Programa de Pago de Servicios Ambientales.\n\n     9º—Que en la selección de\n proyectos bajo la modalidad de protección de bosques las Oficinas Regionales del\n FONAFIFO, deben dar prioridad a las solicitudes de áreas ubicadas dentro del Proyecto\n Corredor Biológico Mesoamericano (Sección Costa Rica), con el fin de contribuir a su\n fortalecimiento y consolidación de este.\n     10.—Que según el artículo 38 y 62\n del reglamento a la Ley Forestal Nº 7575, el poder ejecutivo, establecerá mediante\n decreto las áreas prioritarias en las que se debe pagar servicios ambientales para cada\n área de conservación, la cantidad de hectáreas disponibles y el monto por hectárea.\n     11.—Que es función del FONAFIFO,\n como órgano adscrito al MINAE procurar mejorar los índices de desarrollo especialmente\n en las áreas rurales. Por lo tanto:\n\nDECRETAN:\n\n    Artículo 1º—Para el año dos mil cuatro el\nPresupuesto asignado al Programa de Servicios Ambientales es de seis mil novecientos\ntreinta y ocho millones ciento cuarenta y dos mil setecientos cincuenta y siete colones\nexactos (¢6.938.142.757,00), de los cuales dos mil quinientos noventa y un millones\ndoscientos mil colones exactos (¢2.591.200.000,00), corresponden al Presupuesto Nacional,\ndistribuidos de la siguiente forma mil quinientos once millones doscientos mil colones\nexactos (¢1.511.200.000,00) y mil ochenta millones de colones exactos\n(¢1.080.000.000,00) para el pago de servicios ambientales mediante CAF, además el Banco\nMundial a través del Proyecto Ecomercados va a destinar hasta tres mil quinientos treinta\ny seis millones de colones exactos (¢3.536.000.000,00) y el Convenio de Cooperación\nFinanciera para el Proyecto Forestal Huetar Norte la suma de ochocientos diez millones\nnovecientos cuarenta y dos mil setecientos cincuenta y siete colones exactos\n(¢810.942.757,00) para el pago de servicios ambientales, esos montos se distribuirán de\nla siguiente manera:\n\n a. Un 7% para cubrir los gastos de ejecución de este pago\n de conformidad con lo establecido en el artículo 64 del Decreto Ejecutivo Nº\n 25721-MINAE, Reglamento a la Ley Forestal Nº 7575, reformado por el Decreto Ejecutivo N°\n 30762-MINAE.\n b. Para el pago de compromisos pendientes de contratos del\n año 1997 al 2003, un total de cuatro mil setecientos diecinueve millones treinta y tres\n mil setecientos cincuenta y siete colones (¢4.719.033.757,00).\n c. Para pago de servicios ambientales proyectos de\n reforestación para 5.400 hectáreas ubicadas en las áreas prioritarias, para establecer\n plantaciones con el objetivo de producción de materia prima para industria forestal.\n d. Para pago de servicios ambientales de protección de\n bosques para 51.800 hectáreas ubicadas en las áreas prioritarias.\n e. Para el pago de servicios ambientales generados por\n plantaciones forestales establecidas, que se hayan realizado con recursos propios o\n créditos blandos, hasta un monto de cincuenta millones de colones.\n f. Para pago de servicios ambientales a proyectos de\n reforestación para 600 hectáreas con especies nativas, establecidos como prioritarios y\n contenidos en los decretos de vedas y especies amenazadas o en peligro de extinción\n (Decreto N° 25663-MINAE y Decreto N° 25700-MINAE).\n g. Para el pago de servicios ambientales para reforestación\n en sistemas agroforestales, hasta ciento cincuenta millones de colones exactos\n (¢150.000.000), lo cual incluye cuarenta y un millones quinientos treinta y ocho mil\n cuatrocientos sesenta y dos colones exactos (¢41.538.462) para financiar los compromisos\n adquiridos durante el año 2003 y el resto para la formalización de nuevos contratos.\n h. Para pago de servicios ambientales en 2.200 hectáreas de\n protección de bosque situadas en áreas que protegen fuentes de agua en general y en\n especial aquellas destinadas al consumo humano.\n\n    FONAFIFO podrá variar la distribución establecida\nen los incisos anteriores de acuerdo con la oferta de tierras que pretendan ingresar a las\nmodalidades, siempre y cuando no sobrepasen el monto total de los recursos autorizados en\neste artículo.\n\n    Los contratos que al efecto emita el Fondo Nacional\nde Financiamiento Forestal, establecerán las condiciones, plazos, forma de pago y otros\nrequisitos para cumplir con lo estipulado en este artículo.\n\n    En caso de contarse con una mayor asignación de\nrecursos según lo establece el artículo 5º de la Ley N° 8114 \"Ley de\nSimplificación y Eficiencia Tributaria\" y otros recursos financieros provenientes en\nproyectos en negociación o por otros ingresos que capte el FONAFIFO, para el pago de\nservicios ambientales, estos se distribuirán en forma proporcional para las mismas\nmodalidades establecidas en este decreto.\n\n    Artículo 2º—El FONAFIFO realizará el pago de\nservicios ambientales con fondos captados por instituciones públicas y privadas, por la\nutilización de servicios ambientales generados por los bosques y plantaciones forestales\nque contribuyan a la protección del recurso hídrico para uso urbano, rural o\nhidroeléctrico, las condiciones de los mismos serán establecidos por los Convenios y\ncontratos establecidos al efecto por el Fondo Nacional de Financiamiento Forestal.\n\n    Artículo 3º—El monto máximo a pagar por\nhectárea y por árboles según sea el caso para los proyectos de los incisos c), d), e),\nf), g) y h) del artículo 1º de este decreto será de:\n\n a. Pago de servicios ambientales para protección del bosque\n en noventa y cinco mil ochocientos colones exactos (¢95.800), desembolsados en un\n período de cinco años.\n b. Pago de servicios ambientales para reforestación en\n doscientos cuarenta y cinco mil colones exactos (¢245.000) desembolsados en un plazo de\n cinco años.\n c. Pago de servicios ambientales para proyectos de\n reforestación integrados a sistemas agroforestales un pago por árbol de trescientos\n cincuenta y dos colones (¢352), por árbol, desembolsados en un plazo de tres años.\n\n    Estos montos establecidos en los incisos a, b, c,\naplican únicamente para proyectos aprobados a partir del año 2004.\n\n    Los montos pendientes de desembolsar de años\nanteriores regirán según lo establecen los Decretos Ejecutivos N° 26977-MINAE para los\nproyectos aprobados durante 1998, el N° 27831-MINAE para los proyectos aprobados durante\n1999, N° 28610-MINAE para proyectos aprobados en el 2000, N° 29394-MINAE para proyectos\naprobados en el 2001, N° 30090-MINAE para proyectos aprobados en el año 2002 y\n31081-MINAE para proyectos del año 2003.\n\n    Artículo 4º—El Fondo Nacional de\nFinanciamiento Forestal (FONAFIFO), deberá incluir en la ejecución del programa de pago\nde servicios ambientales las políticas de género del MINAE, a fin de propiciar un\nincremento de la participación de las mujeres en el Pago de Servicios Ambientales.\n\n    Artículo 5º—Para el trámite de las\nsolicitudes para el año 2004 en las diferentes modalidades se considerarán como áreas\nprioritarias las siguientes:\n\nProyectos de reforestación. Se establecen como\n prioritarias para la ejecución de proyectos de reforestación las áreas con los\n siguientes criterios:\n\n a. Se dará prioridad a los sitios que presenten un alto\n potencial productivo para el desarrollo de plantaciones forestales (clases de capacidad de\n uso III, IV, V y VI de la metodología oficial establecida en el Manual para la\n determinación de la capacidad de uso de las tierras de Costa Rica, Decreto Ejecutivo N°\n 23214-MAG-MIRENEM).\n b. Sitios donde haya un alto potencial de bloques de\n plantación, dando especial prioridad a los proyectos que utilicen material genético\n mejorado.\n c. Además estas áreas deben ubicarse en las Áreas de\n Conservación Tortuguero, en la zona de influencia del Convenio de Cooperación Financiera\n Oficial del Gobierno de Alemania KfW (Área de Conservación Huetar Norte y subregión\n Sarapiquí del Área de Conservación Cordillera Volcánica Central), Tempisque, Pacífico\n Central y la subregión central del Área de Conservación Amistad Pacífico (área\n considerada con suficiente desarrollo industrial, social y tecnológico para la\n reforestación) y el Área de Conservación Osa.\n d. Se podrán incluir áreas en donde se ejecutaron\n proyectos de reforestación financiados por medio de incentivos y que hayan cumplido con\n los planes de manejo aprobados.\n e. Para los proyectos de reforestación con especies\n nativas, establecidos como prioritarios y contenidos en los decretos de vedas y especies\n amenazadas o en peligro de extinción, (Decreto N° 25663-MINAE y Decreto N°\n 25700-MINAE), se establece como prioritario todo el país.\n f. Los cantones con Índice de Desarrollo Social (IDS) menor\n a 35% según la determinación realizada por MIDEPLAN para 1999.\n\nB. Proyectos de protección de bosques. Se establecen como\nprioritarias para la ejecución de proyectos de protección de bosque las áreas con los\nsiguientes criterios:\n\n a. Para el trámite de proyectos de protección se dará\n prioridad a los proyectos ubicados en corredores biológicos reconocidos oficialmente por\n el SINAC en el año 2003 en el ámbito nacional, especialmente los prioritarios del\n proyecto Ecomercados (las propuestas del proyecto grúas en las Áreas de Conservación\n Tortuguero, Amistad Caribe y Osa; en la zona de influencia de la Cooperación Financiera\n Oficial del Gobierno de Alemania KfW (Área de Conservación Huetar Norte y subregión\n Sarapiquí del Área de Conservación Cordillera Volcánica Central), así como los\n corredores biológicos: Tortuguero, Barbilla, Fila Costeña y Corcovado.\n b. Proyectos de protección que cumplan con lo establecido\n en el punto anterior y tengan contratos vencidos de años anteriores.\n c. Áreas de bosque que tengan como función la protección\n de las fuentes de agua en general y en especial aquellas destinadas al consumo humano.\n d. Áreas privadas dentro de las áreas silvestres\n protegidas cualquiera que sea su categoría de manejo.\n e. Los cantones con Índice de Desarrollo Social (IDS) menor\n a 35% según la determinación realizada por MIDEPLAN para 2001.\n\nC. Proyectos de sistemas agroforestales. Se dará prioridad a\nproyectos tramitados por organizaciones que cumplan con los requisitos establecidos en el\nManual de Procedimientos. En cada una de las oficinas subregionales del SINAC y regionales\ndel FONAFIFO se mantendrá un mapa con las zonas prioritarias para ubicar si las fincas\nque apliquen solicitudes para el programa de PSA están dentro de las mismas.\n\n    Artículo 6º—Se faculta al Fondo Nacional de\nFinanciamiento Forestal (FONAFIFO) a emitir el pago de los servicios ambientales en sus\ndiferentes categorías por las cantidades máximas autorizadas por este decreto.\n\n    Artículo 7º—El pago de servicios ambientales\nse hará diferido en cinco años de acuerdo con las siguientes condiciones:\n\n a. Los Proyectos de reforestación con áreas menores de\n cincuenta hectáreas recibirán el pago por adelantado, para estos proyectos el primer\n desembolso del 50%, se hará una vez formalizado el contrato con el Estado siempre y\n cuando el monto a desembolsar este garantizado según se establezca en el manual de\n procedimientos. En el segundo año, recibirá 20%, un 15% para el tercer año, un 10% para\n el cuarto año y un 5% para el quinto año. El segundo, tercero, cuarto y quinto\n desembolso se realizará a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses\n de la fecha promedio de plantación.\n     Los Proyectos de reforestación que no\n reciben pago por adelantado recibirán el primer pago del 50% una vez formalizado el\n contrato con el Estado y que se cumpla con los requisitos establecidos en el manual de\n procedimiento 2004, el segundo, tercero, cuarto y quinto desembolso tendrán porcentajes\n iguales a los proyectos que tienen pago por adelantado y podrán solicitarse a los doce,\n veinticuatro, treinta y seis y cuarenta y ocho meses, respectivamente después de la fecha\n promedio de plantación.\n b. El Pago de Servicios Ambientales para los proyectos de\n protección del bosque, el primer desembolso del 20%, se hará una vez firmado el contrato\n con el Estado y que se cumpla con los requisitos establecidos en el manual de\n procedimiento 2004, los desembolsos de los años siguientes será de 20% cada año hasta\n el quinto año. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y\n cuarenta y ocho meses de la fecha de firma del contrato.\n c. El pago de servicios ambientales para los proyectos en\n los que se desarrollen Sistemas Agroforestales el primer desembolso se hará una vez\n firmado el respectivo contrato y sea recibida por FONAFIFO la garantía que se establezca\n en el manual de procedimientos, ese primer desembolso será de un 65% del monto\n establecido, para el segundo año será de un 20% y un 15 % para el tercer año.\n d. Los proyectos a los que se les pague los servicios\n ambientales mediante CAF recibirán el pago total el primer año a través de una cuenta\n que se abrirá en un fideicomiso especial que FONAFIFO habilitará en el Banco Nacional de\n Costa Rica para que este emita los pagos según lo establezca el contrato con cada\n beneficiario.\n\n    Artículo 8º—Los plazos de vigencia, la\nrespectiva afectación del inmueble en el Registro Público y las sesiones de derechos por\nlos servicios ambientales generados que se establezcan en los contratos forestales según\nel artículo 3º, inciso k) de la Ley Forestal N° 7575, serán los siguientes:\n\n a. Para los proyectos en los que se desarrollan sistemas\n agroforestales, no se realizaran afectaciones a la propiedad.\n\n    Artículo 9º—El plazo máximo para la\npresentación de solicitudes para el pago de servicios ambientales para el año dos mil\ncuatro, vence en el caso de reforestación el 15 de mayo, en protección y plantaciones\nestablecidas el treinta de junio del dos mil cuatro.\n\n    Artículo 10.—Podrán pagarse Servicios\nAmbientales en la modalidad de protección en fincas amparadas al derecho de posesión,\nsegún lo establecido en el Decreto Ejecutivo 30761-MINAE del 4 de octubre del 2002.\n\n    Artículo 11.—Los contratos para la ejecución\nde pago de servicios ambientales que se financien con los recursos autorizados en este\ndecreto deben firmarse a más tardar el 15 de diciembre del año dos mil cuatro.\n\n    Artículo 12.—Los recursos no utilizados por el\nFondo Nacional de Financiamiento Forestal, las devoluciones realizadas o los recursos\nrecuperados en virtud de incumplimientos contractuales, serán depositados en una cuenta\nque al efecto establezca el citado Fondo y serán presupuestados para la ejecución de\nnuevos proyectos de pago de servicios ambientales.\n\n    Artículo 13.—El control y seguimiento de los\nproyectos de pago de servicios ambientales suscritos durante y antes del período 2002,\nserán responsabilidad del SINAC.\n\n     Artículo 14.—Rige a partir de su\n publicación.\n     Dado en la Presidencia de la\n República.—San José, a los treinta días del mes de marzo del dos mil cuatro.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Norm 31767\n\n Budget for the year 2004 assigned to the Environmental Services Program\nof the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO)\n\nFull Text of act: 737B7\nNº 31767-MINAE\n\nNº 31767-MINAE\n\n THE FIRST VICE PRESIDENT\n\n IN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC\n\n AND THE MINISTER OF ENVIRONMENT AND ENERGY\n\n    In exercise of the powers conferred upon them by Article 140, subsections 3) and 18) and Article 146 of the Political Constitution in relation to Articles 3, 46, 47, subsection d) of Law Nº 7575, Article 5 of Law N° 8114 Tax Simplification and Efficiency of July 4, 2001, Law Nº 8058 Loan Contract between the International Bank for Reconstruction and Development and the Government of Costa Rica.\n\nConsidering:\n\n     1º—That the State Forest Administration is the competence of the Ministry of Environment and Energy, through the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO), institutions that have the competence to promote the forestry sector, specifically through the Payment for Environmental Services Program (Programa de Pago por Servicios Ambientales).\n     2º—That the National Forest Financing Fund has the function of processing and payment for environmental services provided by forests and forest plantations and other activities necessary to strengthen the development of the country's natural resources sector.\n     3º—That SINAC is responsible for the control and monitoring of the Payment for Environmental Services Program (Programa de Pagos por Servicios Ambientales).\n     4º—That through International Agreements our country has committed to carrying out conservation, forest management and reforestation programs.\n     5º—That the consolidation of protected wild areas and the strengthening of private reserves and sustainable forestry production nuclei, through the recognition of the environmental services provided by these areas, is important.\n     6º—That the development of a clear horizon regarding the planning, availability and use of financial resources is important for forestry activity, seeking mechanisms that allow the sustainability of that financing.\n     7º—That through the negotiation of international and national cooperation projects, the MINAE has requested financial support from the World Bank to strengthen and give continuity to the Payment for Environmental Services Program (Programa de Pago de Servicios Ambientales), as well as to allow the development and institutionalization of other financing mechanisms such as the sale of environmental services for the mitigation of greenhouse gases and the mechanism for charging the environmental service of water conservation to hydroelectric projects in Costa Rica.\n     8º—That the Ecomercados Project, jointly financed by a loan from the International Bank for Reconstruction and Development (IBRD), a donation from the Global Environment Facility (GEF) and the national counterpart, seeks to increase conservation efforts in Costa Rica by promoting the development of markets and suppliers of environmental services offered by privately owned forests, and includes within its five-year goals, the payment for environmental services to:\n\n a. One hundred thousand hectares of forest dedicated to protection, on lands located within the areas of the Mesoamerican Biological Corridor Project (Costa Rica Section).\n b. A 100% increase in the participation of indigenous communities in the Payment for Environmental Services Program (Programa de Pago de Servicios Ambientales).\n c. A 30% increase in the participation of women owners in the Payment for Environmental Services Program (Programa de Pago de Servicios Ambientales).\n\n     9º—That in the selection of projects under the forest protection modality, the Regional Offices of FONAFIFO must give priority to applications from areas located within the Mesoamerican Biological Corridor Project (Costa Rica Section), in order to contribute to its strengthening and consolidation.\n     10.—That according to Article 38 and 62 of the regulation to the Forestry Law (Ley Forestal) Nº 7575, the executive branch shall establish by decree the priority areas in which environmental services must be paid for each conservation area, the number of hectares available and the amount per hectare.\n     11.—That it is the function of FONAFIFO, as an entity attached to the MINAE, to seek to improve development indices, especially in rural areas. Therefore:\n\nTHEY DECREE:\n\n    Article 1º—For the year two thousand four, the Budget assigned to the Environmental Services Program is six billion nine hundred thirty-eight million one hundred forty-two thousand seven hundred fifty-seven colones exactly (¢6,938,142,757.00), of which two billion five hundred ninety-one million two hundred thousand colones exactly (¢2,591,200,000.00) correspond to the National Budget, distributed as follows: one billion five hundred eleven million two hundred thousand colones exactly (¢1,511,200,000.00) and one billion eighty million colones exactly (¢1,080,000,000.00) for the payment of environmental services through CAF; in addition, the World Bank through the Ecomercados Project will allocate up to three billion five hundred thirty-six million colones exactly (¢3,536,000,000.00) and the Financial Cooperation Agreement for the Huetar Norte Forestry Project the sum of eight hundred ten million nine hundred forty-two thousand seven hundred fifty-seven colones exactly (¢810,942,757.00) for the payment of environmental services; these amounts shall be distributed as follows:\n\n a. 7% to cover the execution costs of this payment in accordance with the provisions of Article 64 of Executive Decree Nº 25721-MINAE, Regulation to the Forestry Law (Ley Forestal) Nº 7575, amended by Executive Decree Nº 30762-MINAE.\n b. For the payment of outstanding commitments from contracts from the year 1997 to 2003, a total of four billion seven hundred nineteen million thirty-three thousand seven hundred fifty-seven colones (¢4,719,033,757.00).\n c. For payment of environmental services for reforestation projects covering 5,400 hectares located in the priority areas, to establish plantations with the objective of producing raw material for the forestry industry.\n d. For payment of environmental services for forest protection covering 51,800 hectares located in the priority areas.\n e. For the payment of environmental services generated by established forest plantations, carried out with own resources or soft loans, up to an amount of fifty million colones.\n f. For payment of environmental services to reforestation projects covering 600 hectares with native species, established as priorities and contained in the decrees on bans and threatened or endangered species (Decreto N° 25663-MINAE and Decreto N° 25700-MINAE).\n g. For the payment of environmental services for reforestation in agroforestry systems, up to one hundred fifty million colones exactly (¢150,000,000), which includes forty-one million five hundred thirty-eight thousand four hundred sixty-two colones exactly (¢41,538,462) to finance commitments acquired during the year 2003 and the remainder for the formalization of new contracts.\n h. For payment of environmental services on 2,200 hectares of forest protection located in areas that protect water sources in general and especially those destined for human consumption.\n\n    FONAFIFO may vary the distribution established in the preceding subsections according to the supply of lands intended to enter the modalities, provided they do not exceed the total amount of the resources authorized in this article.\n\n    The contracts issued for this purpose by the National Forest Financing Fund shall establish the conditions, terms, form of payment and other requirements to comply with what is stipulated in this article.\n\n    In the event of a greater allocation of resources as established in Article 5 of Law N° 8114 \"Tax Simplification and Efficiency Law\" and other financial resources from projects under negotiation or from other income captured by FONAFIFO for the payment of environmental services, these shall be distributed proportionally among the same modalities established in this decree.\n\n    Article 2º—FONAFIFO shall make the payment for environmental services with funds raised by public and private institutions for the use of environmental services generated by forests and forest plantations that contribute to the protection of water resources for urban, rural or hydroelectric use; the conditions thereof shall be established by the Agreements and contracts established for this purpose by the National Forest Financing Fund.\n\n    Article 3º—The maximum amount to be paid per hectare and per tree, as the case may be, for the projects under subsections c), d), e), f), g) and h) of Article 1 of this decree shall be:\n\n a. Payment for environmental services for forest protection at ninety-five thousand eight hundred colones exactly (¢95,800), disbursed over a period of five years.\n b. Payment for environmental services for reforestation at two hundred forty-five thousand colones exactly (¢245,000) disbursed over a term of five years.\n c. Payment for environmental services for reforestation projects integrated into agroforestry systems a payment per tree of three hundred fifty-two colones (¢352) per tree, disbursed over a term of three years.\n\n    These amounts established in subsections a, b, c, apply only to projects approved as of the year 2004.\n\n    The amounts pending disbursement from previous years shall be governed by the provisions of Executive Decrees N° 26977-MINAE for projects approved during 1998, N° 27831-MINAE for projects approved during 1999, N° 28610-MINAE for projects approved in 2000, N° 29394-MINAE for projects approved in 2001, N° 30090-MINAE for projects approved in the year 2002 and 31081-MINAE for projects from the year 2003.\n\n    Article 4º—The National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO) must include MINAE's gender policies in the execution of the payment for environmental services program, in order to promote an increase in the participation of women in the Payment for Environmental Services (Pago de Servicios Ambientales).\n\n    Article 5º—For the processing of applications for the year 2004 in the different modalities, the following shall be considered as priority areas:\n\nA. Reforestation Projects. The following criteria are established as priorities for the execution of reforestation projects in the areas:\n\n a. Priority shall be given to sites that present high productive potential for the development of forest plantations (land-use capability classes III, IV, V and VI of the official methodology established in the Manual for determining the land-use capability of Costa Rica, Executive Decree N° 23214-MAG-MIRENEM).\n b. Sites where there is high potential for plantation blocks, giving special priority to projects that use improved genetic material.\n c. Furthermore, these areas must be located in the Tortuguero Conservation Areas, in the zone of influence of the Official Financial Cooperation Agreement of the Government of Germany KfW (Huetar Norte Conservation Area and Sarapiquí subregion of the Cordillera Volcánica Central Conservation Area), Tempisque, Pacífico Central and the central subregion of the Amistad Pacífico Conservation Area (area considered to have sufficient industrial, social and technological development for reforestation) and the Osa Conservation Area.\n d. Areas may be included where reforestation projects financed through incentives were executed and that have complied with the approved management plans.\n e. For reforestation projects with native species, established as priorities and contained in the decrees on bans and threatened or endangered species, (Decreto N° 25663-MINAE and Decreto N° 25700-MINAE), the entire country is established as a priority.\n f. Cantons with a Social Development Index (Índice de Desarrollo Social, IDS) below 35% according to the determination made by MIDEPLAN for 1999.\n\nB. Forest Protection Projects. The following criteria are established as priorities for the execution of forest protection projects in the areas:\n\n a. For the processing of protection projects, priority shall be given to projects located in biological corridors officially recognized by SINAC in the year 2003 at the national level, especially the priority ones of the Ecomercados project (the proposals of the grúas project in the Tortuguero, Amistad Caribe and Osa Conservation Areas; in the zone of influence of the Official Financial Cooperation of the Government of Germany KfW (Huetar Norte Conservation Area and Sarapiquí subregion of the Cordillera Volcánica Central Conservation Area), as well as the biological corridors: Tortuguero, Barbilla, Fila Costeña and Corcovado.\n b. Protection projects that comply with the provisions of the previous point and have expired contracts from previous years.\n c. Forest areas whose function is the protection of water sources in general and especially those destined for human consumption.\n d. Private areas within protected wild areas, whatever their management category.\n e. Cantons with a Social Development Index (IDS) below 35% according to the determination made by MIDEPLAN for 2001.\n\nC. Agroforestry Systems Projects. Priority shall be given to projects processed by organizations that meet the requirements established in the Procedures Manual. In each of the subregional offices of SINAC and regional offices of FONAFIFO, a map with the priority zones shall be kept to determine if the farms applying for the Pago de Servicios Ambientales (PSA) program are within them.\n\n    Article 6º—The National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO) is authorized to issue the payment for environmental services in its different categories for the maximum amounts authorized by this decree.\n\n    Article 7º—The payment for environmental services shall be deferred over five years in accordance with the following conditions:\n\n a. Reforestation projects with areas smaller than fifty hectares shall receive payment in advance; for these projects, the first disbursement of 50% shall be made once the contract with the State is formalized, provided the amount to be disbursed is guaranteed as established in the procedures manual. In the second year, it shall receive 20%, 15% for the third year, 10% for the fourth year and 5% for the fifth year. The second, third, fourth and fifth disbursements shall be made at twelve, twenty-four, thirty-six and forty-eight months from the average planting date.\n     Reforestation projects that do not receive advance payment shall receive the first payment of 50% once the contract with the State is formalized and the requirements established in the 2004 procedures manual are met; the second, third, fourth and fifth disbursements shall have percentages equal to projects that have advance payment and may be requested at twelve, twenty-four, thirty-six and forty-eight months, respectively, after the average planting date.\n b. For the Payment for Environmental Services for forest protection projects, the first disbursement of 20% shall be made once the contract with the State is signed and the requirements established in the 2004 procedures manual are met; the disbursements for the following years shall be 20% each year until the fifth year. These may be requested at twelve, twenty-four, thirty-six and forty-eight months from the date of signing the contract.\n c. For the payment for environmental services for projects in which Agroforestry Systems are developed, the first disbursement shall be made once the respective contract is signed and the guarantee established in the procedures manual is received by FONAFIFO; this first disbursement shall be 65% of the established amount, the second year shall be 20% and 15% for the third year.\n d. Projects for which environmental services are paid through CAF shall receive the total payment in the first year through an account opened in a special trust that FONAFIFO shall enable at the Banco Nacional de Costa Rica so that the latter issues the payments as established in the contract with each beneficiary.\n\n    Article 8º—The terms of validity, the respective encumbrance of the property in the Public Registry and the assignments of rights over the environmental services generated, as established in the forestry contracts according to Article 3, subsection k) of the Forestry Law (Ley Forestal) N° 7575, shall be as follows:\n\n a. In reforestation projects that incorporate several forestry species with different harvest rotations, the validity shall be that of the species with the longest harvest rotation, provided it does not exceed fifteen years, in which case this would be the validity period.\n b. For forest protection projects, five years.\n c. For projects in which agroforestry systems are developed, no encumbrances shall be placed on the property.\n\n    Article 9º—The maximum deadline for submitting applications for the payment for environmental services for the year two thousand four expires, in the case of reforestation, on May 15, and for protection and established plantations, on June 30, two thousand four.\n\n    Article 10.—Payment for Environmental Services under the protection modality may be made on farms covered by the right of possession, as established in Executive Decree 30761-MINAE of October 4, 2002.\n\n    Article 11.—Contracts for the execution of payment for environmental services financed with the resources authorized in this decree must be signed no later than December 15 of the year two thousand four.\n\n    Article 12.—Resources not used by the National Forest Financing Fund, refunds made, or resources recovered due to contractual non-compliance, shall be deposited in an account established for this purpose by said Fund and shall be budgeted for the execution of new payment for environmental services projects.\n\n    Article 13.—The control and monitoring of the payment for environmental services projects signed during and before the 2002 period shall be the responsibility of SINAC.\n\n     Article 14.—It shall become effective upon its publication.\n     Given at the Presidency of the Republic.—San José, on the thirtieth day of March of two thousand four." }
