31772-G\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE GOBERNACIÓN Y POLICÍA\n\n \n\nDe\nconformidad con lo dispuesto en el artículo 140, incisos 3) y 18) de la\nConstitución Política de Costa Rica y la ley 4366 del 19 de agosto de 1969.\n\n \n\nConsiderando:\n\n \n\n1º-Que de\nconformidad con la Ley N° 4366 del 19 de agosto de 1969, corresponde al Poder\nEjecutivo declarar la creación de los distritos indicando su cabecera, poblados\nque lo conforman y sus límites detallados; así como el estudio de la división\nterritorial administrativa para promover la adecuada organización\nadministrativa del país. \n\n2º-Que las\norganizaciones del área de Puerto Viejo del distrito Cahuita por razones\ngeográficas, sociales y económicas solicitaron a la Comisión Nacional de\nDivisión Territorial Administrativa, la creación de esta área como una nueva\nunidad territorial administrativa en el cantón Talamanca.\n\n3º-Que el\nComité Técnico de División Territorial Administrativa después de realizar un\nestudio del área de Puerto Viejo y Manzanillo, donde se consultó a las\norganizaciones y a la Municipalidad de Talamanca sobre la solicitud de creación\nde dicha área como una nueva unidad distrital, consideró la necesidad de\nrealizar un Estudio Integral de la División Territorial Administrativa\nDistrital del cantón Talamanca. \n\n4º-Que como\nparte del Estudio Integral de la División Territorial Administrativa del cantón\nTalamanca, el 26 de setiembre de 2002, se realizó un taller de trabajo con las\norganizaciones, instituciones públicas y la Municipalidad del cantón Talamanca,\ndonde se concluyó en la importancia de establecer una nueva unidad\nadministrativa en el área de Alta Talamanca y modificar los límites distritales\nde los distritos en los sectores de Olivia y Manzanillo.\n\n5º-Que el\nComité Técnico de División Territorial Administrativa, notificó sobre la\npropuesta de creación de la nueva unidad distrital al Concejo Municipal del\ncantón Talamanca; y dicha corporación Municipal, en acuerdo tomado en la sesión\nordinaria Nº 82 del 17 de diciembre del 2003, acogió la recomendación dada.\n\n6º-Que la\nComisión Nacional de División Territorial Administrativa, por recomendación del\nComité Técnico, en sesión N° 89 del 13 de mayo del 2003; aprobó la creación del\ndistrito cuarto, Telire y la modificación de los límites de los distritos\nBratsi, Sixaola y Cahuita del\n\ncantón\nTalamanca. Por la misma divisoria de aguas se sigue\nhacia el noroeste, hasta llegar al cerro Dichibeta, de 1 525 m, ahora en\ndirección oeste, y siguiendo siempre la divisoria de aguas que divide las\nnacientes de los ríos Morein y Estrella, se llega a los puntos de elevación de\n1 200 m, 1 708 m y 2 002 m, hasta interceptar la Fila de Matama, en la\ncoordenada 184 300 611 550, ahora al suroeste por Fila de Matama, se llega al\nMacizo del cerro Chirripó Grande, de 3 749 m, luego hacia el sur y por la misma\nfila, se culmina en el cerro Chirripó de 3 819 m, en la coordenada 381 700 519\n300.\n\n \n\nc)\nCon el cantón Pérez Zeledón: Se inicia en el cerro Chirripó, a 3 819 m,\nen la coordenada 381 700 519 300, siguiendo luego hacia el sur por la línea de\ncresta, pasando por los cerros Pirámide, el Pico Noreste, el Pico Sureste\n(según hoja topográfica Durika), los cerros Amó, Amí, hasta llegar al cerro\nEna, de 3 126 m, en la coordenada 368 775 525 860. \n\n \n\nd)\nCon el cantón Buenos Aires: Se inicia en el cerro Ena, en la coordenada\n368 775 525 860, siguiendo la línea de cresta hacia el este, pasando por los\ncerros; Derí, Cabecar, Brunka, Akatá, Eli, Aká, Dúrika, Akó, Surí, Betsú, Betú,\nArbolado, Hakú, hasta llegar al cerro Utyum, por la misma línea de cresta se\nsigue ahora al sureste, por los cerros Diká, Mok, Dudu, Kasir, Bekom, Singri,\nAká, Platanillo, para terminar en la coordenada 338 900 576 225. \n\n \n\ne)\nCon el cantón Coto Brus: Iniciando en la coordenada 338 900 576 225, se\nsigue por la línea de cresta que va hacia el sureste, pasando por el cerro\nTurubo, hasta llegar al vértice Kiki de 2 732 m, siguiendo por la línea de\ncresta hacia el este, y terminar en la coordenada 336 925 580 300. \n\n \n\nf)\nCon la República Panamá: Se inicia en la coordenada 336 925 580 300,\npara seguir con un norte franco, de una distancia de 43 825 metros y así llegar\nal cerro Namú-Uoki, en la coordenada 380 750 580 225. De aquí se sigue por una\nlínea geodésica, que tiene una distancia de 10 500 metros, para llegar a la\ncoordenada 383 200 590 450, que intersecta con el río Yorkín. Finalmente se\nsigue aguas abajo por el río Yorkín, hasta terminar en la confluencia de los\nríos Yorkín y Sixaola en la coordenada 390 700 585 575. \n\nArtículo\n3º-Modifícanse los límites del distrito Bratsi, primero del cantón Talamanca,\nel cual tendrá a Bribrí como cabecera (ciudad), contando con los siguientes\npoblados Cuabre, Chase, Olivia, Shiroles, Suretka y Uatsi.\n\nArtículo\n4º-Con fundamento en las hojas topográficas a escala 1:50 000 editadas por el\nInstituto Geográfico Nacional y denominadas Amubri, Cahuita y Telire este\ndistrito tendrá la siguiente descripción de límites:\n\n \n\na)\nCon el distrito Telire: Inicia en la confluencia de los ríos Sixaola y\nYorkín, en la coordenada 390 700 585 575, de aquí se parte aguas arriba por el\nrío Telire, en dirección oeste, hasta llegar en la desembocadura de la quebrada\nShebei. Aguas arriba por la quebrada Shebei, se llega hasta su naciente, en el\ncerro Bitárkara, de 1 025 m, en la coordenada 398 975 557 975.\n\n \n\nb)\nCon el cantón Limón: Iniciando en el cerro Bitárkara, en la coordenada\n398 975 557 975, se sigue hacia el sur por la línea de cresta, hasta llegar al\nborde del punto de elevación de los 879 m, de aquí se sigue en dirección este,\npor la divisoria de aguas de las quebradas Jamey y Lucha sin fin, hasta el\npunto de elevación de los 665 m, siempre en dirección este, y por la línea de\ncresta de lo que se denomina Lomas Tsipúbeta, se llega hasta el cerro Mirador,\ny de aquí hasta el cerro Uatsi, de 630 m, se sigue ahora en dirección noreste,\nhasta llegar al punto de elevación de los 515 m, luego en dirección norte, se\nllega al punto de elevación de los 499 m, más hacia el norte se llega a los 510\nm. En dirección sureste, y por la misma línea de cresta, se culmina en la\ncoordenada 400 700 583 900. \n\n \n\nc)\nCon el distrito Cahuita: Partiendo de la coordenada 400 700 583 900, y\nsiguiendo la línea de cresta, en dirección sur, se llega al punto de elevación\nde los 478 m, luego por la misma línea de cresta, y ahora en dirección este, se\nbaja hasta cruzar el río Carbón, para luego subir y encontrarse con el punto de\nelevación de los 342 m, más adelante con el punto de elevación de los 318 m, se\nsigue por la misma línea de cresta, para luego bajar y cruzar el río Sand Box,\nse sigue hasta el vértice Turúa de 290 m, para finalizar, en dirección sureste,\nen el punto de elevación de los 187 m, en la coordenada 396 100 596 675. \n\n \n\nd)\nCon el distrito Sixaola: Comienza en el punto de elevación de los 187 m,\nen la coordenada 396 100 596 675, de aquí se sigue en dirección sur, hasta\ninterceptar una carretera que por la misma baja hasta el río Sixaola, y\nculminar en la coordenada 394 350 596 300.\n\ne)\nCon la República Panamá: Desde el río Sixaola, en la coordenada 394 350\n596 300, se sigue aguas arriba por el mismo río, hasta llegar a la\ndesembocadura del río Telire con el río Sixaola, en la coordenada 390 700 585\n575.\n\nArtículo\n5º-Modifícanse los límites del distrito Sixaola, segundo del cantón Talamanca,\nel cual tendrá a la villa Sixaola como cabecera, contando con los siguientes\npoblados Ania, Boca Sixaola, Catarina, Celia, Daytonia, Gandoca, Margarita,\nMata de Limón, Noventa y Seis, Palma, Paraíso, San Miguel, San Miguelito,\nVirginia y Zavala. \n\nArtículo\n6º-Con fundamento en las hojas topográficas a escala 1:50 000 editadas por el\nInstituto Geográfico Nacional y denominadas Amubri y Sixaola, este distrito\ntendrá la siguiente descripción de límites:\n\n \n\na)\nCon la República Panamá: Se inicia en la desembocadura del río Sixaola\nen el Mar Caribe, en la coordenada 391 500 620 775, luego siguiendo el mismo\nrío aguas arriba, hasta interceptar la calle que está en la coordenada 394 350\n596 300. \n\n \n\nb)\nCon el distrito Bratsi: Se inicia en la calle que intercepta el río\nSixaola en la coordenada 394 350 596 300, de aquí se sigue por esta misma vía\nhacía el norte, y luego cruzar la línea del ferrocarril, hasta llegar al punto\nde elevación de los 187 m, en la coordenada 396 100 596 675. \n\n \n\nc)\nCon el distrito Cahuita: Desde el punto de elevación de los 187 m, en la\ncoordenada 396 100 596 675, se continúa hacia el este por la línea de cresta,\nhasta llegar al punto de elevación de los 112 m, en la coordenada 396 275 601\n275, siempre en dirección este, se llega al punto de elevación de los 118 m, en\nla coordenada 395 300 605 150, y después al punto de elevación de los 114 m.\nSiguiendo ahora al sureste, y siempre en la línea de cresta hasta dar con el\nfilo de la naciente de la quebrada Caña, de aquí se parte hacia el norte,\ntambién por la línea de cresta, hasta llegar a la naciente de la quebrada\nMilla, siguiendo aguas abajo por la quebrada Milla, para terminar desembocando\nen el Mar Caribe, en la coordenada 395 500 615 500. \n\n \n\nd)\nCon el Mar Caribe: Desde la desembocadura de la quebrada Milla, en el\nMar Caribe, en la coordenada 395 500 615 500, se sigue por la línea de costa\nhacia el sureste para terminar en la desembocadura del río Sixaola, en la\ncoordenada 391 500 620 775. \n\nArtículo\n7º-Modifícanse los límites del distrito Cahuita, tercero del cantón Talamanca,\nel cual tendrá a la villa Cahuita como cabecera, contando con los siguientes\npoblados: Bordón, Carbón, Catarata, Cocles, Comadre, Dindiri, Gibraltar, Hone\nCreek, Hotel Creek, Limonal, Manzanillo, Mile Creek, Patiño, Puerto Viejo,\nPunta Caliente, Punta Cocles, Punta Mona, Punta Uva, Tuba Creek (parte). \n\nArtículo\n8º-Con fundamento en las hojas topográficas a escala 1:50 000 editadas por el\nInstituto Geográfico Nacional y denominadas Amubri, Cahuita y Sixaola, este\ndistrito tendrá la siguiente descripción de límites:\n\n \n\na)\nCon el cantón Limón: Inicia en la desembocadura del río Tuba en la\ncoordenada 194 200 660 450, para seguir aguas arriba por el río Tuba hasta llegar\na su naciente, luego subir hasta el punto de elevación de 401 m, luego se sigue\npor la línea de cresta y en dirección sureste, hasta llegar al punto de\nelevación de los 218 m, después a la de los 318 m. En la misma dirección, y por\nla línea de cresta, se continúa en el punto de elevación a 498 m, en la\ncoordenada 401 100 583 950, para finalizar en la coordenada 400 700 583\n900. \n\n \n\nb)\nCon el distrito Bratsi: Desde la coordenada 400 700 583 900, se sigue\npor la línea de cresta hacia el sur, hasta llegar al punto de elevación de los\n478 m, ahora en dirección este, y por la misma línea de cresta, se baja, y se\ncruza el río Carbón, tomándose de nuevo la línea de cresta, hasta llegar al\npunto de elevación de los 342 m, y más adelante al punto de elevación de los\n318 m. Siempre en dirección este, se cruza el río Sand Box, para tomar de nuevo\nla línea de cresta, hasta llegar al vértice Turúa de 290 m, luego en dirección\nsureste, se llega al punto de elevación de los 187 m, en la coordenada 396 100\n596 700. \n\n \n\nc)\nCon el distrito Sixaola: Desde el punto de elevación de los 187 m, en la\ncoordenada 396 100 596 700, se continúa hacia el este por la línea de cresta,\nhasta llegar al punto de elevación de los 112 m, en la coordenada: 396 275 601\n275, siempre en dirección este, se llega al punto de elevación de los 118 m, y\nluego al punto de elevación de los 114 m.
