  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31815\n\n                        Reglamento sobre la Definición del Régimen Administrativo de las Áreas de\nMar Cercanas a Puerto Limón\n\nTexto Completo acta: 74467\nNº 31815-MOPT-SP\n\n  Nº 31815-MOPT-SP\n\n   \n\n  EL PRESIDENTE DE LA REPÚBLICA,\n\n  EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES\n\n  Y EL MINISTRO DE GOBERNACIÓN Y POLICÍA,\n\n  Y SEGURIDAD PÚBLICA\n\n    En uso de las facultades que les confiere el\nartículo 140 incisos 3) y 18) y artículo 146 de la Constitución Política, el artículo\n2° inciso c) de la Ley de Creación del Ministerio de Obras Públicas y Transportes (Ley\nNº 4786 del 5 de julio de 1971), la Ley Orgánica del Ministerio de Seguridad Pública\n(Ley Nº 5482 del 24 de diciembre de 1973), la Ley del Servicio Nacional de Guardacostas\n(Ley Nº 8000 del 5 de mayo del 2000) y la Ley General de la Administración Pública (Ley\nNº 6227 del 2 de mayo de 1978).\n\nConsiderando:\n\n      1º—Que la Ley Nº 4786 del 5 de\n    julio de 1971, confiere al Ministerio de Obras Públicas y Transportes competencia en lo\n    relativo a la regulación y control del transporte marítimo internacional, de cabotaje y\n    por vías de navegación interior y lo constituye en autoridad oficial única en todo lo\n    relativo a los objetivos nacionales, haciendo extensiva esa autoridad a las actividades de\n    cualquier orden que tengan relación o sean consecuencia de ella.\n      2º—Que mediante el Decreto\n    Ejecutivo Nº 29547- MOPT publicado en La Gaceta Nº 108 del 6 de junio del 2001,\n    se modificaron las funciones de la Dirección de Navegación y Seguridad y se estableció\n    que la precitada Dirección velará por la adecuada planificación, construcción,\n    operación y mantenimiento de los servicios de señalización marítima y ayudas a la\n    navegación en aguas y costas nacionales.\n      3º—Que con el propósito de evitar\n    que se produzcan percances en la zona marítima aledaña al Puerto de Limón que pongan en\n    peligro la seguridad de la navegación y de la vida humana, se hace necesario establecer\n    un orden de prioridades a los buques y barcos que naveguen o fondean cerca de estas aguas,\n    con la debida colaboración de la Junta de Administración Portuaria y de Desarrollo\n    Económico de la Vertiente Atlántica, (JAPDEVA).\n      4º—Que con el propósito de mejorar\n    el ordenamiento de la navegación en el área de mar aledaña a Puerto Limón, es\n    importante establecer oficialmente una zona de fondeo oficial, definir una boya de mar,\n    así como señalar la ubicación de una baliza que indique el extremo del nuevo muelle\n    turístico en Puerto Limón. Por Tanto:\n\nDECRETAN:\n\n    El siguiente:\n\n  Reglamento sobre la Definición del Régimen\n\n  Administrativo de las Áreas de Mar\n\n  Cercanas a Puerto Limón\n\n    Artículo 1º—Para los propósitos del presente\nreglamento se tienen las definiciones siguientes:\n\n    a) Baliza: Todo instrumento, aparato o cuerpo\n      instalado por la autoridad correspondiente, que sirve para señalar un peligro o\n      indicaciones precisas para la navegación, principalmente a la entrada de ríos, canales y\n      puertos. Las balizas más usadas son boyas, embarcaciones fondeadas y perchas clavadas en\n      el fondo.\n    b) Duque de Alba: Elemento proyectado para defensa o\n      amarre, formado por un haz de pilotes hundidos en el fondo marino y cuyas cabezas salen\n      fuera del agua y quedan amarradas entre sí formando un bloque.\n    c) AISM: Siglas de la Asociación Internacional de\n      Señalización Marítima. Es una organización internacional no gubernamental cuyo\n      objetivo es reunir los servicios de señales marítimas, para velar por la mejora y la\n      armonización de las ayudas a la navegación y de los métodos de gestión del tráfico\n      marítimo.\n    d) Triángulo de la zona de fondeo: Área de forma\n      triangular en la superficie marítima de profundidad suficiente para que las embarcaciones\n      puedan asegurar o fijarse por medio de anclas. Los límites de la zona de fondeo\n      triangular, son los lados del triángulo o perímetro y sus límites se definen en la\n      práctica entre cada uno de los vértices del triángulo, señalados por la colocación de\n      una boya luminosa.\n    e) Zona de Fondeo: Zona marítima con suficiente\n      profundidad para que las embarcaciones puedan asegurarse o mantenerse fijas en la\n      superficie del mar por medio de anclas.\n    f) Zona Provisional de Cuarentena. Es una zona\n      marítima establecida provisionalmente para que los barcos fondeen mientras se encuentren\n      en cuarentena, deberá estar suficientemente alejada de otros sitios para no permitir la\n      propagación de alguna enfermedad contagiosa. Su ubicación corresponde definirla a la\n      Dirección de Navegación y Seguridad del Ministerio de Obras Públicas y Transportes en\n      coordinación con la Gerencia Portuaria de JAPDEVA, la Dirección Regional del Ministerio\n      de Salud y la Dirección Regional del Ministerio de Agricultura y Ganadería.\n\n    Artículo 2º—Zona de fondeo, determinada por\nlos puntos con las siguientes coordenadas:\n\n  1) Punto vértice NE: Latitud: 09°59’12\"NORTE /\n    Longitud: 83°00’24\"OESTE.\n  2) Punto vértice Sur: Latitud: 09°58’27\" NORTE /\n    Longitud: 83°00’ 40\" OESTE.\n  3) Punto vértice Suroeste: Latitud:\n    09°58’51\"NORTE / Longitud: 83°01’29\"OESTE.\n\n    Para la señalización del área de fondeo se\nubicarán boyas luminosas en los puntos anteriormente descritos, las características de\nlas boyas serán indicadas por el Ministerio de Obras Públicas y Transportes, conforme a\nla normativa internacional que rige esta materia.\n\n    Artículo 3º—Boya de mar, ubicada en el punto\nsiguiente:\n\n      Latitud: 09°59’12\" NORTE /\n    Longitud: 83°00’24\" OESTE (mismo punto Nº 1 anterior).\n      En este punto se colocará una sola boya\n    que cumple dos funciones, demarcar un vértice del triángulo de la zona de fondeo y\n    señalar la ubicación de la boya de mar.\n      La función de esta boya de mar es\n    señalar la ubicación de Puerto Limón a las embarcaciones nacionales e internacionales.\n      Esta boya deberá ser visible como\n    mínimo a tres millas náuticas, tendrá un color de luz blanca. El color del cuerpo de la\n    boya será blanco con negro en rayas verticales (según normas internacionales de la\n    AISM).\n\n    Artículo 4º—El nuevo muelle turístico\ndeberá ser señalado con la colocación de una baliza ubicada en el extremo del mismo en\nel último duque de alba. Su posición será: Latitud: 09°00’ 22\" Norte y\nLongitud: 83° 01’ 22\" Oeste, con una luz de destellos color rojo en intervalos\nde 10 segundos.\n\n    Artículo 5º—En la zona de fondeo solo podrá\nnavegar y fondear aquella embarcación autorizada por el Departamento Marino de JAPDEVA.\nNo se permitirán embarcaciones fondeadas entre la zona de fondeo y los puestos de atraque\nde Puerto Limón.\n\n    Artículo 6º—En caso de requerirse, la\nCapitanía de Puerto Limón coordinará con la Gerencia Portuaria de JAPDEVA y con el\nDirector Regional del Ministerio de Salud o el Director Regional del Ministerio de\nAgricultura y Ganadería, para el establecimiento de una zona provisional de cuarentena. A\neste evento deberá dársele la debida publicidad en aras de proteger la salud pública.\n\n    En el área de cuarentena se fondearán aquellos\nbarcos que por razones de salud pública deban permanecer aislados hasta tanto los\nfuncionarios que decretaron el aislamiento no lo levanten y se pueda proceder\nposteriormente a la visita oficial o al despacho del buque.\n\n    Queda prohibida la navegación y fondeo de cualquier\nembarcación en esta zona si no cuenta con la autorización expresa de la Capitanía de\nPuerto.\n\n    Artículo 7º—El Instituto Geográfico Nacional\nrealizará las gestiones pertinentes para que las zonas establecidas en el presente\ndecreto figuren en la hoja cartográfica correspondiente.\n\n    Artículo 8º—La correcta aplicación del\npresente reglamento será responsabilidad de la Capitanía de Puerto Limón, dependencia\nque podrá solicitar la colaboración de JAPDEVA para remolcar cualquier embarcación que\nse encuentre en una zona no autorizada y del Servicio Nacional de Guardacostas del\nMinisterio de Seguridad Pública para colaborar en la vigilancia y resguardo de la\noperación de remolque o bien para conminar a abandonar zonas no autorizadas a las\nembarcaciones que se encuentren irregularmente en dichos espacios.\n\n    Artículo 9º—El Ministerio de Obras Públicas\ny Transportes brindará la asesoría que la Junta de Administración Portuaria y de\nDesarrollo Económico de la Vertiente Atlántica le requiera, con el propósito que se\nadquieran los equipos necesarios para la debida señalización de las áreas descritas en\nel presente decreto.\n\n    Artículo 10.—Las coordenadas mencionadas en\neste decreto se tomaron con base en la carta náutica Nº 1798 Puerto Limón, elaborada\npor la Oficina Hidrográfica de los Estados Unidos de América.\n\n    Artículo 11.—Rige a partir de su publicación.\n\n    Transitorio único: se establece un\nplazo de seis meses a partir de la publicación de este decreto para que la\nAdministración proceda a colocar el equipo que permita señalar las áreas y puntos\nmarítimos establecidos en este decreto.\n\n    Dado en la Presidencia de la República.—San\nJosé, a los dieciocho días del mes de marzo del dos mil cuatro.",
  "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Regulation 31815\n\n                        Regulation on the Definition of the Administrative Regime of the Sea\nAreas Near Puerto Limón\n\nFull Text record: 74467\nNº 31815-MOPT-SP\n\n  Nº 31815-MOPT-SP\n\n   \n\n  THE PRESIDENT OF THE REPUBLIC,\n\n  THE MINISTER OF PUBLIC WORKS AND TRANSPORT\n\n  AND THE MINISTER OF GOVERNANCE AND POLICE,\n\n  AND PUBLIC SECURITY\n\n    In exercise of the powers conferred by\nArticle 140, subsections 3) and 18) and Article 146 of the Political Constitution, Article\n2, subsection c) of the Law Creating the Ministry of Public Works and Transport (Ley\nNº 4786 of July 5, 1971), the Organic Law of the Ministry of Public Security\n(Ley Nº 5482 of December 24, 1973), the Law of the National Coast Guard Service\n(Ley Nº 8000 of May 5, 2000), and the General Law of Public Administration (Ley\nNº 6227 of May 2, 1978).\n\nConsidering:\n\n      1st—That Ley Nº 4786 of July 5,\n    1971, grants the Ministry of Public Works and Transport competence regarding the\n    regulation and control of international maritime transport, cabotage, and\n    inland waterway navigation, and constitutes it as the sole official authority in all\n    matters relating to national objectives, extending that authority to activities of any\n    nature that are related to or a consequence thereof.\n      2nd—That through Decreto\n    Ejecutivo Nº 29547-MOPT, published in La Gaceta Nº 108 of June 6, 2001, the\n    functions of the Directorate of Navigation and Safety were modified, and it was established\n    that the aforementioned Directorate shall ensure the adequate planning, construction,\n    operation, and maintenance of maritime signaling services and aids to\n    navigation in national waters and coasts.\n      3rd—That for the purpose of preventing\n    mishaps from occurring in the maritime zone adjacent to Puerto Limón that endanger\n    the safety of navigation and human life, it is necessary to establish\n    an order of priorities for vessels and ships that navigate or anchor near these waters,\n    with the due collaboration of the Junta de Administración Portuaria y de Desarrollo\n    Económico de la Vertiente Atlántica, (JAPDEVA).\n      4th—That for the purpose of improving\n    the management of navigation in the sea area adjacent to Puerto Limón, it is\n    important to officially establish an official anchorage zone (zona de fondeo), define a sea buoy,\n    as well as indicate the location of a beacon (baliza) that marks the end of the new tourist\n    pier in Puerto Limón. Therefore:\n\nDECREE:\n\n    The following:\n\n  Regulation on the Definition of the Administrative\n\n  Regime of the Sea Areas\n\n  Near Puerto Limón\n\n    Article 1—For the purposes of this\nregulation, the following definitions shall apply:\n\n    a) Beacon (Baliza): Any instrument, apparatus, or body\n      installed by the corresponding authority, which serves to indicate a danger or\n      precise indications for navigation, mainly at the entrance of rivers, canals, and\n      ports. The most commonly used beacons are buoys, anchored vessels, and perches driven into\n      the bottom.\n    b) Dolphin (Duque de Alba): Element designed for defense or\n      mooring, formed by a cluster of piles sunk into the sea floor, the heads of which\n      emerge from the water and are lashed together to form a block.\n    c) IALA: Acronym for the International Association of Marine Aids to Navigation and Lighthouse Authorities. It is a non-governmental international organization whose\n      objective is to bring together marine signaling services to ensure the improvement and\n      harmonization of aids to navigation and maritime traffic\n      management methods.\n    d) Anchorage Zone Triangle (Triángulo de la zona de fondeo): Triangular-shaped area\n      on the sea surface with sufficient depth for vessels to\n      secure or fix themselves by means of anchors. The limits of the triangular\n      anchorage zone are the sides of the triangle, or perimeter, and its limits are defined in\n      practice between each of the vertices of the triangle, marked by the placement of\n      a lighted buoy (boya luminosa).\n    e) Anchorage Zone (Zona de Fondeo): Maritime zone with sufficient\n      depth for vessels to secure themselves or remain fixed on the\n      surface of the sea by means of anchors.\n    f) Provisional Quarantine Zone (Zona Provisional de Cuarentena). This is a\n      maritime zone provisionally established for ships to anchor while in\n      quarantine; it must be sufficiently distant from other sites to prevent the\n      spread of any contagious disease. Its location is to be defined by the\n      Dirección de Navegación y Seguridad of the Ministerio de Obras Públicas y Transportes in\n      coordination with the Port Management of JAPDEVA, the Regional Directorate of the Ministerio\n      de Salud, and the Regional Directorate of the Ministerio de Agricultura y Ganadería.\n\n    Article 2—Anchorage zone, determined by\nthe points with the following coordinates:\n\n  1) Vertex point NE: Latitude: 09°59'12\" NORTH /\n    Longitude: 83°00'24\" WEST.\n  2) Vertex point South: Latitude: 09°58'27\" NORTH /\n    Longitude: 83°00' 40\" WEST.\n  3) Vertex point Southwest: Latitude:\n    09°58'51\" NORTH / Longitude: 83°01'29\" WEST.\n\n    For the signaling of the anchorage area,\nlighted buoys shall be placed at the points described above; the characteristics of\nthe buoys shall be indicated by the Ministerio de Obras Públicas y Transportes, in accordance\nwith the international regulations governing this matter.\n\n    Article 3—Sea buoy, located at the following\npoint:\n\n      Latitude: 09°59'12\" NORTH /\n    Longitude: 83°00'24\" WEST (same point Nº 1 above).\n      At this point, a single buoy shall be placed\n    that fulfills two functions: demarcating a vertex of the anchorage zone triangle and\n    marking the location of the sea buoy.\n      The function of this sea buoy is to\n    indicate the location of Puerto Limón to national and international vessels.\n      This buoy must be visible for\n    at least three nautical miles and shall have a white light color. The color of the body of the\n    buoy shall be white with black vertical stripes (according to international IALA\n    standards).\n\n    Article 4—The new tourist pier must\nbe marked by the placement of a beacon located at its end, on the last\ndolphin. Its position shall be: Latitude: 09°00' 22\" North and\nLongitude: 83° 01' 22\" West, with a red flashing light at intervals\nof 10 seconds.\n\n    Article 5—Only vessels authorized by\nthe Marine Department of JAPDEVA may navigate and anchor in the anchorage zone.\nNo anchored vessels shall be permitted between the anchorage zone and the berthing positions\nof Puerto Limón.\n\n    Article 6—If required, the\nCapitanía de Puerto Limón shall coordinate with the Port Management of JAPDEVA and with the\nRegional Director of the Ministerio de Salud or the Regional Director of the Ministerio de\nAgricultura y Ganadería, for the establishment of a provisional quarantine zone. Due\npublicity must be given to this event in the interest of protecting public health.\n\n    In the quarantine area, those\nships that, for public health reasons, must remain isolated shall anchor until such time as the\nofficials who decreed the isolation lift it, and the official visit or\ndispatch of the vessel can subsequently proceed.\n\n    Navigation and anchoring by any\nvessel in this zone is prohibited if it does not have the express authorization of the\nCapitanía de Puerto.\n\n    Article 7—The Instituto Geográfico Nacional\nshall undertake the pertinent steps so that the zones established in this\ndecree appear on the corresponding chart sheet.\n\n    Article 8—The correct application of this\nregulation shall be the responsibility of the Capitanía de Puerto Limón, a unit\nthat may request the collaboration of JAPDEVA to tow any vessel that\nis in an unauthorized zone, and of the Servicio Nacional de Guardacostas of the\nMinisterio de Seguridad Pública to collaborate in the surveillance and safeguarding of the\ntowing operation or to compel vessels irregularly in such\nspaces to leave unauthorized zones.\n\n    Article 9—The Ministerio de Obras Públicas\ny Transportes shall provide the advice that the Junta de Administración Portuaria y de\nDesarrollo Económico de la Vertiente Atlántica requires of it, for the purpose of acquiring\nthe necessary equipment for the proper signaling of the areas described in\nthis decree.\n\n    Article 10—The coordinates mentioned in\nthis decree were taken based on nautical chart Nº 1798 Puerto Limón, produced\nby the Hydrographic Office of the United States of America.\n\n    Article 11—It shall take effect upon its publication.\n\n    Single transitory provision: a\nperiod of six months is established from the publication of this decree for the\nAdministration to proceed to place the equipment that allows for the signaling of the areas and\nmaritime points established in this decree.\n\n    Given at the Presidency of the Republic.—San\nJosé, on the eighteenth day of March, two thousand four."
