31857\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\n    En ejercicio de las facultades que les confiere el\nartículo 140 incisos 3), 8) 18) y 20) y 146 de la Constitución Política, los artículos\n25, 27.1, 28.2b, de la Ley N\nº\n 6227 de 2 de mayo de 1978, Ley General de\nla Administración Pública, la Ley N\nº\n 7064 de 29 de abril de 1987, Ley\nde Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de\nAgricultura y Ganadería y la Ley N\nº\n 8149 del 5 de noviembre del 2001,\nLey de Creación del Instituto Nacional de Innovación y Transferencia en Tecnología\nAgropecuaria.\n\nConsiderando:\n\n    1\nº\n—Que la Ley N\nº\n\n8149 de fecha 5 de noviembre del 2001, publicada el 22 de noviembre del 2001 en La\nGaceta N\nº\n 225, crea el Instituto Nacional de Innovación y\nTransferencia en Tecnología Agropecuaria -INTA-.\n\n    2\nº\n—Que el objetivo del\nInstituto establecido por Ley es contribuir al mejoramiento y la sostenibilidad del Sector\nAgropecuario, por medio de la generación, innovación, validación, investigación y\ndifusión de tecnología, en beneficio de la sociedad costarricense con proyección a la\ncomunidad internacional.\n\n    3\nº\n—Que para cumplir con el\nobjetivo del Instituto, se plantean los siguientes objetivos estratégicos en relación\ncon los Sectores Agropecuario y de Recursos Naturales:\n\na) Generar e innovar tecnologías para que los sistemas\n productivos incrementen la competitividad técnica, económica y ambiental; así como su\n sostenibilidad con énfasis en los pequeños y medianos productores.\n\nb) Adaptar tecnologías que incrementen la productividad y\n sostenibilidad de los sistemas de producción y contribuya a llenar las necesidades de los\n consumidores.\n\nc) Contribuir a una mayor adopción tecnológica, por medio\n de la transferencia y la divulgación de tecnología.\n\nd) Ofrecer servicios y productos tecnológicos para el\n mejoramiento y beneficio de la sociedad en general.\n\ne) Gestionar recursos financieros y de cooperación técnica\n necesarios para el cumplimiento de sus objetivos ante organismos nacionales e\n internacionales.\n\nf) Disponer del personal idóneo, de la infraestructura y\n los equipos requeridos para el desarrollo tecnológico.\n\ng) Lograr el posicionamiento del INTA en el ámbito nacional\n e internacional por medio del mercadeo de tecnologías, productos y servicios propios de\n su gestión.\n\n    4\nº\n—Que de conformidad con lo\ndispuesto en el artículo 22 de la Ley N\nº\n 8149 de fecha 5 de noviembre\ndel 2001, corresponde al Poder Ejecutivo emitir el Reglamento a la ley. Por tanto,\n\nDECRETAN:\n\n    El siguiente;\n\nReglamento a la Ley N\nº\n 8149 de creación del Instituto\n\nNacional de Innovación y Transferencia\n\nen Tecnología Agropecuaria (INTA)\n\n \n\nCAPÍTULO I\n\nDe las Definiciones\n\n    Artículo 1\nº\n—A los efectos de\nla aplicación de las disposiciones contenidas en el presente Reglamento, se establecen\nlas siguientes definiciones:\n\n    Actividad: Corresponde a la\n acción que tiene el máximo grado de concreción y especificidad, a través del cual -\n junto con otras actividades- se ejecuta un componente de un proyecto.\n\n    Adopción: Proceso mediante el\n cual un individuo adquiere tecnología, se apropia de ésta y la pone en práctica con un\n fin utilitario.\n\n    Agrícola: Comprende cultivos,\n ganadería, recursos naturales, pesca, los productos acuícolas y del mar, los bosques y\n los productos primarios forestales.\n\n    Agricultura: Arte, ciencia e\n industria que se ocupa de la explotación de las plantas y los animales para el uso\n humano. En sentido amplio, la agricultura incluye la producción de bienes vegetales y\n pecuarios para satisfacer necesidades industriales, energéticas, vestido, vivienda,\n alimenticias y otras.\n\n    Asistencia técnica: Asesorías\n especializadas dirigidas hacia productores, profesionales, técnicos, comerciantes,\n agroindustriales y otros.\n\n    Difusión: Transmisión de la\n información bajo mecanismos y medios de comunicación idóneos.\n\n    Extensión agrícola: Servicio o\n proceso organizado que mediante el empleo de procedimientos, didácticas y técnicas\n participativas, por medio de la difusión de opciones técnicas, ayuda a la población a\n mejorar el conocimiento, los métodos de producción y el nivel de ingresos, lo que\n repercute en el mejoramiento de su calidad de vida.\n\n    Innovación: Las innovaciones son\n procesos, productos y/o servicios mejorados o nuevos; es decir, es la incorporación de un\n cambio (mayor o menor) para tener un producto, proceso o servicio diferenciado en alguna\n característica o propiedad que genere alguna ventaja.\n\n    -INTA- Instituto Nacional de\n Innovación y Transferencia en Tecnología Agropecuaria: Instituto creado por\n Ley N\nº\n 8149 de fecha 5 de noviembre del año 2001, publicada en La\n Gaceta N\nº\n 225 del 22 de noviembre del 2001.\n\n    Investigación: Proceso de estudio\n experimental de modo sistemático y científico, encaminado a aumentar los conocimientos\n en la ciencia y la tecnología, tratando de descubrir nuevas técnicas o fenómenos\n científicos poco conocidos o insuficientemente estudiados.\n\n    Plan: Se refiere al aspecto global\n de todas las actividades de un determinado proceso de desarrollo, establecido dentro de un\n período específico que puede ser de corto, mediano y largo plazo. Se trata de un\n conjunto organizado de fines, objetivos, metas, instrumentos, medios y recursos para\n lograr el desarrollo de un área determinada.\n\n    Programa: Hace referencia a un\n conjunto de proyectos relacionados y coordinados entre sí, todos ellos como parte de las\n acciones a realizar para alcanzar las metas y los objetivos definidos en un plan, dentro\n de un período determinado. Puede ser formulado con diversos grados de detalle y\n profundidad. Los objetivos, metas y recursos asignados deben ser compatibles con los\n objetivos, metas y recursos considerados por el Plan.\n\n    Proyecto: Conjunto de actividades\n concatenadas que constituye la unidad más pequeña que forma parte de un programa y que\n puede realizarse con independencia de otros proyectos. Procura satisfacer una necesidad\n específica o aprovechar una determinada oportunidad, tiene fechas de inicio y término,\n utiliza insumos materiales, financieros y humanos. Está integrado por más de un\n componente que corresponde a un área específica de un proyecto.\n\n    Sector Agropecuario: Es una\n división de naturaleza económica, comprende la agricultura, la silvicultura, la pesca y\n la acuicultura, incluyendo las diferentes fases de la agrocadena y el medio rural.\n\n    Tecnología agropecuaria: Son las\n opciones técnicas generadas y derivadas a partir de un proceso de experimentación,\n investigación o innovación agropecuaria.\n\n    Transferencia de Tecnología:\n Proceso de comunicación multidireccional, en el cual las opciones tecnológicas fluyen\n entre los diferentes actores de la sociedad. Contempla una serie de actividades de\n difusión, capacitación e información efectuadas bajo diferentes métodos y técnicas.\n\n    Validación: Etapa final del\n proceso de investigación, en la cual se evalúa una tecnología o parte de ella por los\n agricultores en sus fincas y bajo sus propias condiciones de producción. Posterior a la\n validación prosigue el proceso de extensión agrícola.\n\n    Verificación: Etapa avanzada del\n proceso de investigación sistemática, en el cual el investigador comprueba de manera\n integral y extensiva (comercial o semi-comercial), una tecnología próxima a pasar a uso\n de los agricultores; corresponde a una etapa anterior a la validación.\n\nCAPÍTULO II\n\nDel Funcionamiento del Instituto\n\n    Artículo 2\nº\n—El INTA es un\nórgano de desconcentración máxima, adscrito al Ministerio de Agricultura y Ganadería\n-MAG- que cuenta con personería jurídica instrumental para cumplir su objetivo y\nadministrar su patrimonio; así como con los recursos que le faculta la Ley, ya sea vía\npresupuesto o transferencias provenientes del MAG o de otras instituciones del Sector\nAgropecuario y los de su propia gestión.\n\n    Artículo 3\nº\n—El INTA está\nsujeto a la fiscalización de la Contraloría General de la República y a las\ndisposiciones aplicables provenientes de la Autoridad Presupuestaria.\n\n    Artículo 4\nº\n—El INTA es el\nórgano oficial del Estado especializado en innovación, investigación y transferencia en\ntecnología agropecuaria, designado por Ley N\nº\n 8149 que le permite\ncumplir con lo estipulado en los Artículos 48 y 49 de la Ley de Fomento a la Producción\nAgropecuaria -FODEA- N\nº\n 7064 del 29 de abril de 1987; así como para\ncumplir aquellas funciones asignadas en su Ley de Creación y en otras leyes conexas; en\nlo que respecta a su competencia.\n\n    Artículo 5\nº\n—Las funciones\nestablecidas en la Ley N\nº\n 7779 del 30 de abril de 1998, \"Ley de\nUso, Manejo y Conservación de Suelos\" que correspondían al Departamento de Suelos\nde la Dirección Nacional de Investigaciones Agropecuarias del Ministerio de Agricultura y\nGanadería, pasan a formar parte según corresponda, del marco de funciones y competencias\nespecíficas del INTA.\n\n    Artículo 6\nº\n—El INTA producto\nde su gestión dispondrá de productos y servicios de interés estratégico, ambiental y\nsocial para el país, orientados principalmente hacia el pequeño y mediano productor, sin\nque ello limite la participación de otros grupos del Sector Agropecuario.\n\nCAPÍTULO III\n\nDe los Recursos del INTA\n\n    Artículo 7\nº\n—Serán\npatrimonio del INTA todos aquellos indicados en el Artículo 3\nº\n de la\nLey N\nº\n 8149:\n\na) Los ingresos que genere la venta de productos, servicios\n y tecnología, así como los rendimientos de sus inversiones.\n\nb) Los créditos que se obtengan de entidades financieras\n nacionales o internacionales que operen, legalmente, en Costa Rica.\n\nc) Las donaciones, las herencias y los legados provenientes\n de personas físicas y jurídicas, las instituciones públicas y privadas, u\n organizaciones internacionales.\n\nd) Los derechos y los bienes muebles o inmuebles\n pertenecientes al Instituto.\n\ne) Los recursos que capte del sector privado.\n\nf) Los aportes financieros del Estado mediante presupuestos\n ordinarios y extraordinarios de la República y los que realicen las instituciones\n descentralizadas y los demás entes públicos.\n\ng) Los ingresos provenientes del financiamiento de proyectos\n de investigación.\n\nh) El cuarenta por ciento (40%) del superávit de las\n instituciones del Sector Público Agropecuario que reciban transferencias del Estado.\n\ni) Los recursos depositados en el fideicomiso, autorizado\n por la Ley N\nº\n 8149 y los réditos del mismo que se emplearán en la\n atención de sus gastos operativos.\n\nj) Cualquier otro que llegara a obtener.\n\n    Artículo 8\nº\n—El Ministerio de\nAgricultura y Ganadería proporcionará al INTA el personal, los recursos económicos, los\nequipos, bienes muebles e inmuebles, la infraestructura y en general, el contenido\npresupuestario necesario para su funcionamiento, incluyendo los que estaban siendo\nutilizados por la antes denominada \"Dirección Nacional de Investigaciones\nAgropecuarias\", mediante los mecanismos legales que garanticen su adecuada\nutilización, sin dar margen a conflictos de intereses interinstitucionales.\n\n    Artículo 9\nº\n—Todos aquellos\nservidores de la Dirección Nacional de Investigaciones Agropecuarias, así como aquellos\nde otras dependencias del MAG o de otras instituciones públicas que fueron trasladados al\nInstituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria -INTA- o que\nllegaren a trasladarse en el futuro; conservarán todos los derechos adquiridos antes de\nla promulgación de la Ley N\nº\n 8149 o a la fecha efectiva del traslado.\n\n    Artículo 10.—El Ministerio de Agricultura y\nGanadería deberá incorporar dentro de sus presupuestos, los recursos para el pago del\npersonal que fue trasladado al INTA, en las partidas correspondientes a Servicios\nPersonales y Cargas Sociales o bien aquellas partidas o subpartidas que se lleguen a\nutilizar al efecto; conforme a los lineamientos establecidos por la Dirección General de\nPresupuesto Nacional del Ministerio de Hacienda; para lo cual el MAG deberá mantener un\ntítulo presupuestario para el INTA.\n\nCAPÍTULO IV\n\nDe la Estructura Orgánica y Funciones\n\nArtículo\n11. -El\nINTA estará conformado por los siguientes órganos:\n\na) Una Junta Directiva conformada por siete miembros y un fiscal, y dos Unidades de\nnaturaleza asesora, constituidas por una Auditoría Interna y una Contraloría de\nServicios.\n\n b) Una Dirección Ejecutiva que estará\nconformada por un Director(a) y un Subdirector(a) cuyos nombramientos son de\nconfianza y serán de libre nombramiento y remoción de la Junta Directiva. Ambos\npuestos requieren como mínimo el título profesional de Licenciatura en\nIngeniería Agronómica o en alguna de las ramas de las ciencias agropecuarias\ndebidamente incorporados al Colegio de Ingenieros Agrónomos, experiencia en administración\ny dos años de experiencia en supervisión de personal. Las funciones del Sub\ndirector del INTA serán asignadas por quien ocupe el cargo de Director(a).\n\nEn caso de ausencias\ntemporales del Director(a), el subdirector(a), asumirá la Dirección del INTA\ncon todas sus funciones y responsabilidades. Además; el Director(a) queda\nfacultado para nombrar en forma temporal a un sustituto del Subdirector(a) en\nausencias temporales del Subdirector(a). Formará parte también de la Dirección\nEjecutiva la Unidad de Gestión de Conocimiento.\n\n(Así reformado el inciso b) anterior por el artículo 1° del\ndecreto ejecutivo N° 44773 del 30 de octubre de 2024)\n\nc) Una Dirección de\nInvestigación y Desarrollo Tecnológico, que estará conformada por los\nsiguientes Departamentos y Unidades:\n\nc.1) Departamento\nCentro de Innovación Agropecuaria Enrique Jiménez Núñez.\n\nc.1.1) Unidad Pecuaria\nTrópico Seco.\n\nc.1.2) Unidad Agrícola\nTrópico Seco.\n\nc.1.3) Unidad Centro\nExperimental La Managua.\n\nc.2) Departamento\nCentro de Innovación Agropecuaria Central.\n\nc.2.1) Unidad Pecuaria\nCentral.\n\nc.2.2) Unidad Agrícola\nCentral.\n\nc.2.3) Unidad Centro\nExperimental Carlos Durán.\n\nc.3) Departamento\nCentro de Innovación Agropecuaria Los Diamantes.\n\nc.3.1) Unidad Pecuaria\nTrópico Húmedo.\n\nc.3.2) Unidad Agrícola Trópico\nHúmedo.\n\nc.4) Departamento de\nLaboratorios.\n\nc.5) Departamento de\nEstudios Básicos de Tierras.\n\n(Así reformado el inciso c) anterior por el artículo 1° del\ndecreto ejecutivo N° 44773 del 30 de octubre de 2024)\n\nd) (Derogado por el artículo 50 (actual artículo 53) del Reglamento\norgánico del Ministerio de Agricultura y Ganadería, aprobado mediante decreto\nejecutivo N° 45282 del 5° de setiembre de 2025)\n\n(Así reformado por el artículo 1° del decreto ejecutivo N° 42683 del 20\nde octubre del 2020)\n\n    Artículo 12.—Los órganos del INTA en lo que\nles corresponda, tendrán además de las funciones y responsabilidades que se describen\npara cada uno de ellos en este Reglamento, el deber de establecer, mantener, perfeccionar\ny evaluar el sistema de control interno institucional, debiendo la administración activa\nrealizar las acciones necesarias para garantizar su efectivo funcionamiento,\nproporcionando seguridad en la consecución de los siguientes objetivos:\n\na) Proteger y conservar el patrimonio del INTA y los bienes\n en uso contra cualquier pérdida, despilfarro, uso indebido, irregularidad o acto ilegal.\n\nb) Exigir confiabilidad y oportunidad de la información.\n\nc) Garantizar eficiencia y eficacia de las operaciones.\n\nd) Cumplir con el ordenamiento jurídico y técnico.\n\nDe la Junta Directiva\n\n            Artículo 13.-El Instituto tendrá una Junta\nDirectiva compuesta por siete miembros, en quienes recaerá la máxima dirección.\nEstará integrada de la siguiente manera:\n\na) El Ministro de\nAgricultura y Ganadería o su representante.\n\nb) El Ministro de\nCiencia y Tecnología o su representante.\n\nc) El Presidente\nEjecutivo del Consejo Nacional de Producción o su representante.\n\nd) Un representante de\nla Cámara Nacional de Agricultura y Agroindustria de Costa Rica.\n\ne) Un representante de\nla Cámara Costarricense de la Industria Alimentaria.\n\nf) Un representante de\nlos pequeños y medianos productores agropecuarios organizados con\nrepresentación nacional y con personería jurídica vigente, que se acreditará\npor medio de la certificación respectiva.\n\ng) Un representante del\nConsejo Nacional de Rectores.\n\n            A las sesiones de la Junta Directiva deberá asistir el\nDirector Ejecutivo del Instituto, quien tendrá voz, pero no voto. De igual manera\nel fiscal designado por la Junta Directiva.\n\n(Así\nreformado el párrafo anterior por el artículo 1° del decreto ejecutivo N° 42683\ndel 20 de octubre del 2020)\n\nEl quórum para que\npueda sesionar válidamente la Junta Directiva se formará con cuatro de sus\nmiembros. Los acuerdos y resoluciones serán adoptados por mayoría simple de los\npresentes, salvo en aquellos casos que por disposición legal, se exija una mayoría\ncalificada. En caso de empate, el Presidente tendrá doble voto.\n\n    En lo no regulado en el\npresente artículo rige supletoriamente lo dispuesto en el Capítulo Tercero del\nTítulo Segundo de la Ley General de la Administración Pública y sus respectivas\nconcordancias.\n\n    Artículo 14.—Los representantes a que se\nrefieren los incisos d), e), f) y g) del Artículo 13, serán designados por el Poder\nEjecutivo, de la terna que para ese efecto suministrará la entidad correspondiente. En el\ncaso del representante de los pequeños y medianos productores, se abrirá por un período\nde un mes calendario, la recepción de las ternas que remitirán las organizaciones de\npequeños y medianos productores agropecuarios, para su posterior selección por parte del\nPoder Ejecutivo, según lo indicado.\n\n    Artículo 15.—El Ministro de Agricultura y\nGanadería o su representante será el Presidente de la Junta Directiva. La Junta elegirá\nde entre sus miembros a un vicepresidente y un secretario, siendo los miembros restantes\nvocales.\n\n    Artículo 16.—Los miembros de la Junta\nDirectiva, excepto los Ministros que la integran, deberán reunir los siguientes\nrequisitos:\n\na) Ser costarricense\n\nb) Poseer una experiencia mínima de cinco años y\n reconocida trayectoria en materia agropecuaria, agroindustrial o agroempresarial en\n tecnología de alimentos o economía agrícola.\n\nc) Suscribir una póliza de fidelidad que garantice el\n correcto cumplimiento de sus funciones durante el ejercicio del cargo.\n\n    Artículo 17.—La convocatoria para la\npresentación de las ternas para efectuar el nombramiento de los representantes de los\npequeños y medianos productores, se realizará mediante publicación en un diario de\namplia circulación nacional. Transcurridos treinta días calendario, contados a partir de\nla publicación, se procederá a realizar el nombramiento respectivo.\n\n    Artículo 18.—Ocurrida una vacante, el Poder\nEjecutivo dispondrá de un período de un mes calendario para solicitar el envío de una\nnueva terna por parte de la organización representada correspondiente. La persona que\nresulte escogida, durará en el cargo por el resto del período. El plazo máximo que\ndispone el Poder Ejecutivo, según lo indicado, para seleccionar al nuevo miembro, será\nde diez días hábiles contados a partir de recibida la terna.\n\n    Artículo 19.—Los miembros de la Junta\nDirectiva durarán en sus cargos un período de tres años, excepto los representantes del\nPoder Ejecutivo definidos en los incisos a), b) y c) del artículo 13, quienes\npermanecerán en sus cargos por un período presidencial o en su defecto, durante el\ntiempo que ocupen su puesto en el Poder Ejecutivo.\n\n    Artículo 20.—El fiscal será nombrado por la\nJunta Directiva del INTA, no podrá ser miembro de dicha Junta; y, deberá contar\npreferiblemente con conocimientos en administración pública y en materia tecnológica.\nEl período de nombramiento del Fiscal será por doce meses y podrá ser reelecto. El\nFiscal podrá asistir a las sesiones de la Junta Directiva, con derecho a voz pero no a\nvoto. El mecanismo de nombramiento del fiscal será establecido por la Junta Directiva.\n\n    Artículo 21.—Los miembros de la Junta\nDirectiva responderán personalmente por sus actos y su gestión. Ninguno podrá tener\nintereses directos en empresas privadas dedicadas a la transferencia y la generación de\ntecnología agropecuaria; de ser así, recaerá sobre ellos la responsabilidad civil y\npenal del caso, procediéndose con la separación del cargo, mediante la apertura y\ntrámite del procedimiento que garantice el debido proceso.\n\nArtículo 22.-Los funcionarios gubernamentales y el fiscal ejercerán sus\nfunciones directivas sin percibir dietas. Los demás miembros directivos, salvo\nque sean funcionarios públicos, devengarán dietas cuyo monto corresponderá al\npromedio de los montos establecidos por tal concepto para los miembros de las\njuntas directivas de las siguientes instituciones del Sector Agropecuario: el\nConsejo Nacional de Producción (CNP), el Instituto de Desarrollo Rural (INDER)(*),\nel Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), el\nSistema-Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) y el\nPrograma Integral de Mercadeo Agropecuario (PIMA); se les reconocerá el pago de\nhasta dos sesiones ordinarias por mes y tres extraordinarias por año.\n\n   \n El monto de las dietas citadas en el párrafo anterior será fijado por el\n Poder Ejecutivo.\n\n(Así\nreformado por el artículo 1° del decreto ejecutivo N° 36563 del 8 de marzo\ndel 2011)\n\n(*)\n(Modificada su denominación por el artículo 14° de la Ley N° 9036 del 11 de\nmayo de 2012, \"Transforma el Instituto de Desarrollo Agrario (IDA) en el\nInstituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo\nRural\")\n\nArtículo 23.-Las funciones, los deberes, atribuciones\ny responsabilidades de la Junta Directiva del Instituto son:\n\na.\nDefinir, aprobar e implementar las políticas y estrategias de desarrollo del Instituto,\nasí como aprobar el Plan Anual Operativo para cumplir con el objetivo de la Ley\nNº 8149.\n\nb.\nDefinir y aprobar la organización y estructura administrativa.\n\nc.\nAprobar los mecanismos para evaluar periódicamente, el funcionamiento del\nInstituto y el control de calidad de sus funciones. Así mismo, deberá rendir\ncuentas en forma periódica ante el jerarca del Ministerio de Agricultura y\nGanadería, sobre el cumplimiento de objetivos y metas.\n\nd.\nAprobar las políticas del Instituto en materia de inversión.\n\ne.\nConocer, aprobar o improbar la propuesta de presupuesto ordinario y\nextraordinario y sus modificaciones presentadas por el Director Ejecutivo, así\ncomo el informe anual de las actividades y la situación del Instituto.\n\nf.\nNombrar y remover según lo establezca el ordenamiento administrativo, al\nauditor del Instituto y, en casos necesarios, contratar auditorías externas.\n\ng.\nConocer y aprobar cuando corresponda las propuestas del Director Ejecutivo y\nlos contratos en que sea parte el Instituto.\n\nh. Conocer\ny aprobar fideicomisos u otros mecanismos de uso y manejo de los recursos\neconómicos, para facilitar el cumplimiento de los fines encomendados al\nInstituto.\n\ni.\nConocer y aprobar las donaciones, herencias y los legados que las personas\nfísicas, jurídicas o privadas y los organismos nacionales e internacionales\nhagan al Instituto.\n\nj. Nombrar y remover de su puesto al Director\nEjecutivo y al Sub Director de conformidad con el inciso g) del artículo 4 del\nEstatuto del Servicio Civil, ambos deberán ser costarricenses y tener como\nmínimo el título profesional de Licenciatura en Ingeniería Agronómica o en\nalguna de las ramas de las ciencias agropecuarias debidamente incorporados al\nColegio de Ingenieros Agrónomos con experiencia en Administración y dos años de\nsupervisión de personal.\n\n(Así reformado el inciso anterior\npor el artículo 1° del decreto ejecutivo N° 44773 del 30 de octubre de 2024)\n\nk.\nAprobar los reglamentos atinentes al funcionamiento y la operación del Instituto.\n\nl.\nAprobar las tarifas para la venta de productos y servicios que realiza el\nInstituto.\n\nm.\nVelar por la adecuada administración de los recursos financieros del Instituto.\n\nn.\nEstablecer los mecanismos presupuestarios requeridos por el Instituto para\nbrindar un servicios de excelencia y competitivo con\notras opciones del mercado nacional.\n\no.\nDesarrollar alianzas estratégicas con el sector público y privado a nivel\nnacional e internacional, que permitan captar los recursos requeridos para la\ngeneración de tecnología y demás actividades propias de su gestión. Los\ningresos generados a raíz de las alianzas mencionadas en este Inciso, deberán\npresupuestarse en su totalidad de acuerdo con el artículo 18 de la Ley Orgánica\nde la Contraloría General de la República. El INTA contará con una cuenta\nbancaria para el manejo de los fondos generados por este concepto.\n\np. Las funciones que se\ndetallan en el Reglamento Interno de Funcionamiento de la Junta Directiva del\nInstituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria.\n\n(Así\nreformado el inciso anterior por el artículo 1° del decreto ejecutivo N° 42683\ndel 20 de octubre del 2020)\n\n   Artículo 24. -Los órganos asesores de la Junta Directiva serán la\nAuditoría Interna y la Contraloría de Servicios, ambos dependerán\nJerárquicamente de la Junta Directiva, y asistirán a las sesiones cuando ésta\nlo solicite.\n\nLa Auditoria Interna fiscalizará con independencia funcional\ny de criterio, las operaciones y la efectividad en la administración del\nriesgo, el control y los procesos de dirección, así como asesorar en el ámbito\nde su competencia, contribuyendo en forma positiva y constructiva a la\nprotección de los recursos, el fortalecimiento del sistema de control interno y\nel logro de los objetivos institucionales.\n\nFuncionará y se organizará de conformidad con lo señalado en\nel Capítulo IV de la Ley General de Control Interno Nº 8292, el Reglamento a\ndicha Ley, el Reglamento de Organización y Funcionamiento de la Auditoría\nInterna y las normas técnicas y disposiciones que emita la Contraloría General\nde la República. La Junta Directiva del INTA definirá y establecerá mediante\nacuerdos, las regulaciones de tipo administrativo aplicables al (la) Auditor(a)\nInterno (a) en los términos que señala el Artículo 24 de la Ley Nº 8292. El\n(la) Auditor (a) Interno (a) deberá presentar a la Junta Directiva el Plan\nAnual de Trabajo, un Informe Anual de su ejecución y del estado de recomendaciones\ny disposiciones, sin perjuicio de que se elaboren otros informes, en caso de\nque las circunstancias lo ameriten. Cuando lo considere necesario, y sin\ndetrimento de lo señalado en el Capítulo IV de la Ley Nº 8292, la Junta\nDirectiva solicitará al (la) Auditor (a) Interno(a) incluir en el Plan Anual de\nTrabajo, auditorías o estudios especiales.\n\nLa Contraloría de Servicios funcionará y se organizará de\nconformidad con las disposiciones del Capítulo II, Sección III de la Ley 9158 y\nel Capítulo IV del Decreto Ejecutivo 39096-PLAN y el Reglamento de Creación,\nFuncionamiento y Operación de la Contraloría de Servicios del Instituto\nNacional de Innovación y Transferencia en Tecnología Agropecuaria, publicado en\nel Diario Oficial La Gaceta N° 208, del 29 de octubre de 2014.\n\n(Así reformado\npor el artículo 1° del decreto ejecutivo N° 42683 del 20 de octubre del 2020)\n\n    Artículo 25.—La representación legal del\nInstituto la ejercerán el Presidente de la Junta Directiva y el Director Ejecutivo,\nquienes tendrán la representación judicial y extrajudicial, con las facultades de\napoderados generales sin límite de suma conforme al Artículo 1255 del Código Civil,\ncuando actúen separadamente; o de apoderados generalísimos sin límite de suma de\nconformidad con el Artículo 1253 del Código Civil, cuando actúen conjuntamente. Se\nrequerirá de la autorización de la Junta Directiva del INTA para enajenar bienes.\n\nDe la Dirección Ejecutiva\n\n    Artículo 26.—La persona que ocupe el cargo de\nDirector Ejecutivo, deberá reunir los siguientes requisitos:\n\na) Ser costarricense.\n\nb) Ser profesional en el área de las ciencias\n agropecuarias.\n\nc) Poseer experiencia en administración.\n\n    Artículo 27.—El proceso de selección para\nefectuar el nombramiento de la persona que ocupe el cargo de Director Ejecutivo, será\ndefinido por la Junta Directiva del INTA y se regirá según lo establecido en el\nArtículo 4, inciso g) del Estatuto del Servicio Civil.\n\n            Artículo 28.-Son atribuciones y\ndeberes del Director Ejecutivo:\n\na.\nSer el jefe superior del personal de todas las dependencias del Instituto,\nexcepto del auditor interno que dependerá de la Junta Directiva.\n\nb. Ser\nel responsable ante la Junta Directiva del funcionamiento eficiente y correcto\ndel Instituto; así como de cumplir los acuerdos y resoluciones adoptados por\ndicha Junta, en la forma y tiempo solicitados.\n\nc.\nAsistir con voz, pero sin voto, a todas las sesiones de Junta Directiva.\n\nd.\nServir de apoyo en las actividades y eventos que programe la Junta Directiva.\n\ne.\nAprobar proyectos de investigación, innovación y transferencia en tecnología\nagropecuaria.\n\nf.\nGestionar recursos para fortalecer los planes, programas y proyectos de\ninvestigación, capacitación y transferencia de tecnología de interés\ninternacional, nacional, regional o local, mismos que deberán ser incorporados\nen los respectivos presupuestos.\n\ng.\nFomentar la coordinación entre las organizaciones de productores, empresas\nprivadas del Sector, instituciones internacionales públicas y privadas,\nuniversidades públicas y privadas, instituciones gubernamentales y no\ngubernamentales, para el logro de los objetivos comunes.\n\nh.\nSometer al conocimiento de la Junta Directiva, los proyectos de reglamentos,\nmanuales, procedimientos e instrumentos relativos a la gestión administrativa y\nfinanciera del INTA.\n\ni.\nAprobar la contratación de los servicios profesionales, técnicos y\nadministrativos necesarios para ejecutar y controlar las operaciones del INTA.\n\nj.\nSuministrar a la Junta Directiva la información, documentación y el apoyo\nlogístico necesario.\n\nk.\nFomentar el desarrollo del talento humano del INTA, mediante el establecimiento\nde programas de capacitación y formación.\n\nl.\nAsegurar un clima de respeto y disciplina en el entorno laboral del Instituto.\n\nm.\nVelar por la correcta operación técnica, administrativa, laboral y financiera\nde las Estaciones Experimentales a cargo del Instituto.\n\nn.\nRepresentar al INTA en comisiones y eventos de naturaleza nacional e\ninternacional, con la aprobación de la Junta Directiva.\n\no.\nPresentar ante las instancias correspondientes informes de rendición de\ncuentas.\n\np. Coordinar lo correspondiente con las instancias\nasesoras del MAG, para el buen funcionamiento del INTA.\n\n(Así reformado el inciso anterior\npor el artículo 1° del decreto ejecutivo N°44773 del 30 de octubre de 2024)\n\nq.\nCualquier otra que la Junta Directiva le asigne.\n\n    Artículo 29.—Es competencia del Director\nEjecutivo nombrar al personal administrativo y en el caso de los Directores, Jefes de los\nDepartamentos y Coordinadores del INTA, se presentará a conocimiento previo de la Junta\nDirectiva dicho nombramiento. Para los respectivos nombramientos se seguirá estrictamente\nlo establecido en los manuales de puestos y procedimientos definidos por el INTA y demás\nórganos competentes.\n\n    Artículo 30.—La Dirección Ejecutiva podrá\nestablecer mecanismos de coordinación con la Secretaría Ejecutiva de Planificación del\nSector Agropecuario (SEPSA) y otras direcciones del Ministerio de Agricultura y\nGanadería, para articular acciones conjuntas en beneficio de los productores agrícolas.\n\n    Artículo 31.—La Dirección Ejecutiva\nestablecerá un mecanismo formal de acción coordinada con el Servicio de Extensión\nAgrícola del Estado, que garantice la transferencia de tecnología a los pequeños y\nmedianos productores agropecuarios, en forma directa, efectiva y sin costo al productor;\nsiempre y cuando la investigación no haya sido producto de la venta de servicios o su uso\nsea restringido y/o confidencial. Asimismo, podrá establecer mecanismos de vinculación\ncon el Sistema Nacional de Investigación y Transferencia de Tecnología Agropecuaria\n(SNITTA), el Sistema de Información Sectorial (INFOAGRO) y otras redes de información,\nque asegure la divulgación de la información generada.\n\n    Artículo 32.—La Dirección Ejecutiva\nconformará y coordinará un Comité Asesor integrado por los responsables de las\nDirecciones del INTA y otras instancias asesoras que designe.\n\nArtículo 33. -(Derogado\npor el artículo 2° del decreto ejecutivo N° 44115 del 24 de junio del 2023)\n\nArtículo 34. - Unidad de Gestión\ndel Conocimiento. Es la\nUnidad de carácter operativo de la Dirección Ejecutiva encargada de acopiar,clasificar, ordenar,\nseleccionar, conservar, administrar y facilitar mediante informes técnicos,\nla información generada en cada proceso de innovación (investigación,\nvalidación, verificación, estudios especiales, servicios y\ntransferencia) ordenada en archivos físico y digital; y clasificada en\nexpedientes de acuerdo con un código alfanumérico. Esta unidad tendrá\ndos áreas a su cargo: gestión de información técnica y la coordinación de la\ntransferencia de tecnología. Además, a esta Unidad le corresponde la\ncoordinación del proceso editorial institucional y la función de ser el\nenlace con la Unidad de Comunicación del MAG para los temas de\ntransferencia.\n\nLas funciones de la Unidad de\nGestión del Conocimiento son las siguientes:\n\na) Canalizar los formatos de\ninvestigación, estudios especiales y transferencia de tecnología enviada por el\njefe respectivo, trasladándolos a los miembros del Comité Técnico Asesor\n(COTECA) para su revisión y aprobación final.\n\nb) Participar como miembro activo\ndel Comité Técnico Asesor, fungiendo como la Secretaría Técnica.\n\nc) Acopiar y administrar los\ninformes semestrales de las actividades de investigación generados por los\nfuncionarios del INTA.\n\nd) Elaborar informes de gestión\ncon base en las actividades de investigación, estudios especiales, y\ntransferencia de tecnología registradas.\n\ne) Recopilar, caracterizar y\nsistematizar las opciones tecnológicas verificadas y/o validadas para\ntransferirlas a los diferentes usuarios.\n\nf) Diseñar, coordinar, organizar\ny ejecutar eventos de capacitación y difusión de la información tecnológica a\ntravés de los diferentes servicios de extensión estatales y privados.\n\ng) Diseñar y aplicar las\nmetodologías, mecanismos y herramientas de gestión de conocimiento,\ninformación, comunicación y transferencia de acuerdo con los diferentes\nusuarios y tipologías de producción.\n\nh) Mantener estrecha coordinación\ncon el Sistema Nacional de Investigación y Transferencia de Tecnología\nAgropecuaria SNITTA-, los servicios de información del Sector Agropecuario y el\nservicio de extensión del Estado.\n\ni) Cualquier otra que le asigne\nla Dirección Ejecutiva.\n\n(Así\nreformado por el artículo 2° del decreto ejecutivo N° 44773 del 30 de octubre\nde 2024)\n\nDe las Direcciones y Departamentos del INTA\n\nArtículo 35. -Dirección de\nInvestigación y Desarrollo Tecnológico. Es la encargada de dirigir la generación,\ninnovación y transferencia de tecnología, para obtener opciones\ntecnológicas de calidad, con la finalidad del aumento de la productividad, competitividad\ny sostenibilidad de los sistemas agropecuarios en beneficio de los productores.\n\nLas funciones de la Dirección de\nInvestigación y Desarrollo Tecnológico son las siguientes:\n\na) Participar activamente en los\nprocesos y actividades de planificación estratégica y operativa del INTA.\n\nb) Ejercer la jefatura inmediata\ny supervisión del personal de la Dirección a su cargo.\n\nc) Consolidar, priorizar y dar\nrespuesta a las necesidades de investigación, innovación y transferencia de\ntecnología que demandan los usuarios en los ámbitos local, regional y nacional.\n\nd) Coordinar, asesorar y orientar\nla investigación y la transferencia de tecnología agropecuaria, para cumplir\ncon los objetivos y metas establecidas en las políticas institucionales.\n\ne) Participar de manera activa en\nla revisión y supervisión de proyectos de investigación, innovación y\ntransferencia de tecnología.\n\nf) Formular y elaborar documentos\ntécnicos y administrativos para los jerarcas.\n\nd) Elaborar informes de gestión\ncon base en las actividades de investigación, estudios especiales, y\ntransferencia de tecnología registradas.\n\ng) Rendir cuentas a las\nautoridades superiores.\n\nh) Cualquier otra que le asigne\nla Dirección Ejecutiva.\n\nLa Dirección de Investigación y\nDesarrollo Tecnológico estará conformada por los siguientes Departamentos y\nUnidades:\n\n1- Departamento Centro de\nInnovación Agropecuaria Enrique Jiménez Núñez. Tiene como objetivo generar, innovar\ny brindar tecnologías que permitan a los sistemas productivos del\nTrópico Seco de Costa Rica el incremento de su competitividad y su sostenibilidad.\nAdemás, coordinar y canalizar la ejecución de las investigaciones e innovaciones\nque resuelvan las demandas tecnológicas de los sectores suscritos.\n\nLas funciones del Departamento\nson:\n\na) Identificar y priorizar las\nnecesidades de investigación e innovación de tecnología agropecuaria al nivel\nlocal, regional y nacional en granos básicos, las actividades pecuarias de la\nregión Tropical Seca, y otras actividades agropecuarias de la región.\n\nb) Formular y ejecutar proyectos\nde investigación e innovación, utilizando el método científico en el área de su\ncompetencia para alcanzar los objetivos y metas propuestas en beneficio de los\nproductores.\n\nc) Validar la tecnología generada\nde los proyectos de su competencia, que permita valorar su pertinencia\ntécnica-económica y mejorar la efectividad de su adopción por parte de los\nusuarios.\n\nd) Participar activamente en los\nprocesos y actividades de planificación estratégica y operativa del INTA.\n\ne) Coordinar y colaborar con la\nTransferencia de Tecnología y la difusión de las opciones tecnológicas\ngeneradas por el INTA.\n\nf) Formular el consolidado del\nPAO/ Presupuesto y Plan de compras.\n\ng) Elaborar informes anuales,\nsemestrales y técnicos.\n\nh) Coordinar reuniones y sesiones\nde trabajo con los grupos técnicos integrantes de cada unidad bajo su\nsupervisión y de otras unidades para la elaboración de proyectos de\ninvestigación e innovación.\n\ni) Difundir mediante\npublicaciones técnicas la labor del INTA en el ámbito nacional e internacional.\n\nj) Cualquier otra que le asigne\nla Dirección de Investigación y Desarrollo Tecnológico.\n\nEl Departamento está conformado\npor las siguientes Unidades:\n\n1.1- Unidad Pecuaria Trópico\nSeco. Las\nfunciones de la Unidad Pecuaria Trópico Seco son las siguientes:\n\na) Identificar limitantes en\nmateria tecnológica señaladas en los diferentes eslabones de la cadena\nagroalimentaria, incluidas las demandas y gustos de los consumidores.\n\nb) Generar tecnología que\nincremente el rendimiento de los cultivos de granos básicos, frutales,\nhortalizas y otros cultivos estratégicos de la región, incorporando prácticas\namigables con el ambiente que permita la obtención de productos inocuos y\nrespondan a las exigencias del consumidor.\n\nc) Introducir, evaluar y\nseleccionar nuevas variedades e híbridos de alto valor comercial, con\nexcelentes características agronómicas, adaptadas al cambio climático,\ntolerantes a plagas y enfermedades y alta aceptación por el industrial y el\nconsumidor.\n\nd) Desarrollar técnicas de manejo\nque mejoren la producción, la sanidad y la calidad de las cosechas bajo el\nconcepto de buenas prácticas agrícolas.\n\ne) Desarrollar tecnología para la\nproducción eficiente en ambientes protegidos para disponer de una producción\nconstante y de calidad a lo largo del año.\n\nf) Desarrollar alianzas\nestratégicas con organizaciones de productores, academia, empresa privada, programas\nde investigación y transferencia de tecnología y las organizaciones científicas\ninternacionales.\n\ng) Generar tecnología\nincorporando el análisis socioeconómico para los cultivos.\n\nh) Coordinar y colaborar con\notros actores del sector agropecuario, cooperativas, asociaciones y la\nDirección Nacional de Extensión Agropecuaria del MAG y para la transferencia de\ntecnología, la difusión y la capacitación de la tecnología generada y validada.\n\ni) Producir semilla de arroz,\nmaíz, frijol, sorgo, entre otras, de las variedades desarrolladas por el INTA.\n\nj) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n1.2.- Unidad Agrícola Trópico\nSeco Las\nfunciones de la Unidad Agrícola Trópico Seco son las siguientes:\n\na) Contribuir a la eficiencia y\ncompetitividad de los sistemas de producción pecuaria del trópico seco,\nmediante manejo apropiado y conservación de especies forrajeras, nutrición y\nsalud animal, genética, registros, reducción de costos, y la utilización de\nproductos y subproductos agroindustriales locales y nacionales.\n\nb) Desarrollar opciones\ntecnológicas para racionalizar y mejorar la eficiencia de la nutrición animal\nmediante manejo apropiado y conservación de especies forrajeras, desechos\nagroindustriales y prácticas de conservación de la calidad de los mismos.\n\nc) Desarrollar opciones\ntecnológicas que contribuyan a la sostenibilidad de los sistemas productivos y\nque mitiguen el cambio climático.\n\nd) Evaluar en conjunto con el\nsector ganadero el hato bovino con el objetivo de identificar y seleccionar la\nmejor genética productiva y adaptada al cambio climático\n\ne) Elaborar y ejecutar proyectos\npara el mejoramiento de la raza utilizando recursos genéticos nacionales e\nimportados para promover la productividad, la calidad y la adaptación al cambio\nclimático.\n\nf) Evaluar modelos bioeconómicos en sistemas sostenibles de producción bovina\npara mejorar la adaptación y mitigación al cambio climático, aumentar\nproducción, disminuyendo el efecto ambiental y los costos de producción.\n\ng) Desarrollar alianzas\nestratégicas con organizaciones de ganaderos, academia e instituciones\nnacionales e internacionales, y organizaciones técnicas y científicas\ninternacionales.\n\nh) Coordinar y colaborar para la\ncapacitación, la difusión y transferencia de la tecnología, generada y validada\nen actividades pecuarias del Trópico Seco.\n\ni) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n1.3.- Unidad Centro Experimental\nLa Managua Las\nfunciones de la Unidad Centro Experimental La Managua son las siguientes:\n\na) En coordinación con el\nDepartamento del Centro de Innovación Agropecuaria Enrique Jiménez Núñez,\ngenerar y validar tecnología en cultivos tropicales y actividades pecuarias\npara la zona de transición de trópico seco a húmedo y, para el trópico húmedo\nen la zona de influencia de este Centro Experimental.\n\nb) En coordinación con Centro de\nInnovación Agropecuaria Enrique Jiménez Núñez, coordinar y colaborar con la\ntransferencia de la tecnología desarrollada por el INTA.\n\nc) En coordinación con el Centro\nde Innovación Agropecuaria Enrique Jiménez Núñez, generar tecnologías para la\nadaptación y mitigación al cambio climático para las actividades productivas\ndesarrolladas en la zona de influencia de este Centro Experimental.\n\nd) Coordinar con el Centro de\nInnovación Agropecuaria Los Diamantes lo atinente a las actividades típicas del\nTrópico Húmedo.\n\ne) Promover la creación y\nmantenimiento de bancos de germoplasma y recursos fitogenéticos\nde cultivos tropicales de interés para la zona.\n\nf) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n2. Departamento Centro de\nInnovación Agropecuaria Central El Departamento Centro de Innovación Agropecuaria\nCentral es el encargado de generar, innovar y brindar tecnologías que\npermitan a los sistemas productivos agrícolas y pecuarias de la Región\nCentral, incrementar la competitividad y su sostenibilidad. Además, coordinar\ny canalizar la ejecución de las investigaciones e innovaciones que\nresuelvan las demandas tecnológicas de los sectores suscritos. Las\nfunciones del Departamento son las siguientes:\n\na) Identificar y priorizar las\nnecesidades de investigación e innovación de tecnología agropecuaria al nivel\nlocal, regional y nacional de los rubros de hortalizas, frutales de altura, las\nactividades pecuarias de la región Central, y otras actividades agropecuarias\nde la región.\n\nb) Formular y ejecutar proyectos\nde investigación e innovación en las áreas de su competencia, utilizando el\nmétodo científico, para alcanzar los objetivos y metas propuestas en beneficio\nde los productores.\n\nc) Validar la tecnología generada\nde los proyectos de su competencia, que permita valorar su pertinencia técnica\neconómica y mejorar la efectividad de su adopción por parte de los usuarios.\n\nd) Participar activamente en los\nprocesos y actividades de planificación estratégica y operativa del INTA.\n\ne) Coordinar y colaborar con la\nTransferencia de Tecnología y la difusión de las opciones tecnológicas\ngeneradas por el INTA.\n\nf) Desarrollar vínculos con el\nSistema Nacional de Investigación y Transferencia de Tecnología Agropecuaria,\nlos servicios de información del Sector Agropecuario, la Dirección Nacional de\nExtensión Agropecuaria y otros organismos dedicados a la ciencia y tecnología\ndel Sector Agropecuario y en el nivel científico nacional e internacional.\n\ng) Formular el consolidado del\nPAO/ Presupuesto y Plan de compras.\n\nh) Elaborar informes anuales,\nsemestrales y técnicos.\n\ni) Coordinar reuniones y sesiones\nde trabajo con los grupos técnicos integrantes de cada unidad bajo su\nsupervisión y de otras unidades para la elaboración de proyectos de\ninvestigación e innovación.\n\nj) Difundir mediante\npublicaciones técnicas la labor del INTA en el ámbito nacional e internacional.\n\nk) Cualquier otra que le asigne\nla Dirección de Investigación y Desarrollo Tecnológico.\n\nEste Departamento está conformado\npor las siguientes Unidades:\n\n2.1.-Unidad Pecuaria Central Las funciones de la Unidad\nPecuaria Central son las siguientes:\n\na) Contribuir a la eficiencia y\ncompetitividad de los sistemas de producción de leche y especies menores,\nmediante manejo apropiado y conservación de especies forrajeras, nutrición y\nsalud animal, genética, registros, reducción de costos, y la utilización de\nproductos y subproductos agroindustriales locales y nacionales.\n\nb) Desarrollar opciones\ntecnológicas para racionalizar y mejorar la eficiencia de la nutrición animal\nmediante manejo apropiado y conservación de especies forrajeras,\nsuplementación, desechos agroindustriales y prácticas de conservación de la\ncalidad de los mismos.\n\nc) Desarrollar opciones\ntecnológicas que contribuyan a la sostenibilidad de los sistemas productivos y\nque mitiguen el cambio climático\n\nd) Evaluar en conjunto con los\nsectores los hatos para identificar y seleccionar la mejor genética productiva\ny adaptada al cambio climático\n\ne) Elaborar y ejecutar proyectos\npara el mejoramiento de las razas utilizando recursos genéticos nacionales e\nimportados para promover la productividad, la calidad y la adaptación al cambio\nclimático.\n\nf) Evaluar modelos bioeconómicos en sistemas sostenibles de producción bovina\npara mejorar la adaptación y mitigación al cambio climático, aumentar\nproducción, disminuyendo el efecto ambiental y los costos de producción.\n\ng) Desarrollar alianzas\nestratégicas con organizaciones de ganaderos, academia e instituciones\nnacionales e internacionales, y organizaciones técnicas y científicas\ninternacionales.\n\nh) Coordinar y colaborar para la\ncapacitación, la difusión y transferencia de la tecnología, generada y validada\nen ganadería de leche y especies menores.\n\ni) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n2.2-Unidad Agrícola Central. Las funciones de la Unidad\nAgrícola Central son las siguientes:\n\na) Identificar limitantes y\nofrecer soluciones en materia tecnológica señaladas en los diferentes eslabones\nde la cadena agroalimentaria, incluidas las demandas y gustos de los\nconsumidores.\n\nb) Generar tecnología que\nincremente el rendimiento de los cultivos de hortalizas, frutales de altura y\notros cultivos estratégicos de la región, incorporando prácticas amigables con\nel ambiente que permita la obtención de productos inocuos y respondan a las\nexigencias del consumidor.\n\nc) Introducir, evaluar y\nseleccionar germoplasma superior, con excelentes características agronómicas,\ntolerantes a plagas y enfermedades, adaptadas al cambio climático.\n\nd) Desarrollar tecnología para la\nproducción eficiente en ambiente protegido para disponer de una producción\nconstante y de calidad a lo largo del año.\n\ne) Generar tecnología con buenas\nprácticas agrícolas en nutrición mineral y orgánica, riego, fertirriego,\nmanejo agronómico, poscosecha, manejo integrado de\nplagas y enfermedades, para una producción sostenible en beneficio del\nproductor y consumidor.\n\nf) Desarrollar alianzas\nestratégicas con las organizaciones de productores, academia, empresa privada,\nprogramas de investigación y transferencia de tecnología y las organizaciones\ncientíficas internacionales.\n\ng) Generar tecnología\nincorporando el análisis socioeconómico para los cultivos.\n\nh) Coordinar y colaborar con\notros actores del sector agropecuario, cooperativas, asociaciones y la\nDirección Nacional de Extensión Agropecuaria del MAG y para la transferencia de\ntecnología, la difusión y la capacitación de la tecnología generada y validada\nen Hortalizas.\n\ni) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n2.3- Unidad Centro Experimental\nCarlos Durán. Las\nfunciones de la Unidad Centro Experimental Carlos Durán son las siguientes:\n\na) Evaluar y seleccionar nuevos\nmateriales y variedades de papa para mesa e industria mediante la provenientes\nde centros internacionales de investigación.\n\nb) Desarrollar tecnología para el\nmanejo integrado del cultivo de la papa.\n\nc) Validar los materiales de papa\nseleccionados en las principales zonas productoras.\n\nd) Producir semilla prebásica y básica de papa a fin de cubrir la demanda de\nlos productores de semilla bajo un esquema de semilla de calidad.\n\ne) Incrementar la producción de\nsemilla in vitro de otros cultivos bajo esquema de demanda específica,\nconcretamente del Laboratorio de Cultivo de Tejidos de la Carlos Durán.\n\nf) En coordinación con el\nDepartamento del Centro de Innovación Agropecuaria Central, generar tecnologías\npara la adaptación y mitigación al cambio climático.\n\ng) Coordinar y colaborar en\nacciones de investigación y transferencia de tecnología con otros actores del\nsector agropecuario, cooperativas, asociaciones y la Dirección Nacional de\nExtensión Agropecuaria del MAG.\n\nh) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n3.- Departamento Centro de\nInnovación Agropecuaria Los Diamantes. El Departamento Centro de Innovación Agropecuaria\nLos Diamantes tiene como objetivo generar, innovar y brindar tecnologías\nque permitan a los sistemas productivos del Trópico húmedo, incrementar\nla competitividad y su sostenibilidad. Además, coordinar y canalizar la\nejecución de las investigaciones e innovaciones que resuelvan las demandas\ntecnológicas de los sectores suscritos. Las funciones del departamento\nson:\n\na) Identificar y priorizar las\nnecesidades de investigación e innovación de tecnología agropecuaria al nivel\nlocal, regional y nacional de las actividades agrícolas y pecuarias del trópico\nhúmedo, y otras actividades agropecuarias de la región.\n\nb) Formular y ejecutar proyectos\nde investigación e innovación, utilizando el método científico en el área de su\ncompetencia alcanzando los objetivos y metas propuestas en beneficio de los\nproductores.\n\nc) Validar la tecnología generada\nde los proyectos de su competencia, que permita valorar su pertinencia técnica\neconómica y mejorar la efectividad de su adopción por parte de los usuarios.\n\nd) Asesorar en áreas específicas\ncomplementarias de investigación agropecuaria, tales como protección de\ncultivos, mejoramiento genético, agronomía, bioestadística, socio economía y\notras relacionadas.\n\ne) Participar activamente en los\nprocesos y actividades de planificación estratégica y operativa del INTA.\n\nf) Coordinar y colaborar con la\nTransferencia de Tecnología y la difusión de las opciones tecnológicas\ngeneradas por el INTA.\n\ng) Desarrollar vínculos con el\nSistema Nacional de Investigación y Transferencia de Tecnología Agropecuaria,\nlos servicios de información del Sector Agropecuario, la Dirección Nacional de\nExtensión Agropecuaria y otros organismos dedicados a la ciencia y tecnología\ndel Sector Agropecuario y en el nivel científico nacional e internacional.\n\nh) Formular el consolidado del\nPAO/ Presupuesto y Plan de compras.\n\ni) Elaborar informes anuales,\nsemestrales y técnicos.\n\nj) Coordinar reuniones y sesiones\nde trabajo con los grupos técnicos integrantes de cada unidad bajo su\nsupervisión y de otras unidades para la elaboración de proyectos de\ninvestigación e innovación.\n\nk) Difundir mediante\npublicaciones técnicas la labor del INTA en el ámbito nacional e internacional.\n\nl) Coordinar las actividades de\ninvestigación y reproducción del laboratorio de Tejidos de Los Diamantes.\n\nm) Cualquier otra que le asigne\nla Dirección de Investigación y Desarrollo Tecnológico.\n\nEste Departamento está conformado\npor las siguientes Unidades:\n\n3.1.-Unidad Pecuaria Trópico\nHúmedo. Las\nfunciones de la Unidad de Pecuaria Trópico Húmedo son las siguientes:\n\na) Contribuir a la eficiencia y\ncompetitividad de los sistemas del trópico húmedo, mediante manejo apropiado y\nconservación de especies forrajeras, nutrición y salud animal, genética,\nregistros, reducción de costos, y la utilización de productos y subproductos\nagroindustriales locales y nacionales.\n\nb) Desarrollar opciones\ntecnológicas para racionalizar y mejorar la eficiencia de la nutrición animal\nmediante manejo apropiado y conservación de especies forrajeras,\nsuplementación, desechos agroindustriales y prácticas de conservación de la\ncalidad de los mismos.\n\nc) Desarrollar opciones\ntecnológicas que contribuyan a la sostenibilidad de los sistemas productivos y\nque mitiguen el cambio climático\n\nd) Evaluar en conjunto con los\nsectores los hatos para identificar y seleccionar la mejor genética productiva\ny adaptada al cambio climático\n\ne) Elaborar y ejecutar proyectos\npara el mejoramiento de las razas utilizando recursos genéticos nacionales e\nimportados para promover la productividad, la calidad y la adaptación al cambio\nclimático.\n\nf) Evaluar modelos bioeconómicos en sistemas sostenibles de producción bovina\npara mejorar la adaptación y mitigación al cambio climático, aumentar\nproducción, disminuyendo el efecto ambiental y los costos de producción.\n\ng) Desarrollar alianzas\nestratégicas con organizaciones de ganaderos, academia e instituciones\nnacionales e internacionales, y organizaciones técnicas y científicas\ninternacionales.\n\nh) Coordinar y colaborar para la\ncapacitación, la difusión y transferencia de la tecnología, generada y validada\nen Ganadería del Trópico húmedo.\n\ni) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n3.2.-Unidad Agrícola Trópico\nHúmedo. Las\nfunciones de la Unidad Agrícola Trópico Húmedo son las siguientes:\n\na) Brindar respuesta a la demanda\ntecnológica que se solicita en las agrocadenas de la\nregión del Trópico Húmedo de Costa Rica.\n\nb) Seleccionar cultivares con\nresistencia a plagas, alta productividad, aceptación por parte del consumidor,\nla industria, adaptados al cambio climático.\n\nc) Generar y utilizar métodos\nespecializados de multiplicación de material de siembra por medio de estacas,\nacodos, hijos, estolones, injertos y cultivo de tejidos entre otros, por la\ngran variabilidad que muestran las especies frutales.\n\nd) Desarrollar tecnología\nrelacionada con la nutrición orgánica y mineral y fomentar prácticas de manejo\namigables con el ecosistema agrícola.\n\ne) Producir y fomentar el uso de\nsemilla limpia libre de patógenos y alto vigor, con el fin de lograr\nincrementos de la productividad.\n\nf) Desarrollar y promover\nproductos de valor agregado para dinamizar el mercado nacional y de\nexportación.\n\ng) Incorporar buenas prácticas de\nmanejo y trazabilidad, para que los frutos sean inocuos tanto de pesticidas,\ncomo de microorganismos patógenos para el ser humano.\n\nh) Desarrollar métodos adecuados\nde cosecha y manejo poscosecha, para que en su\nmayoría las frutas perecederas puedan mantener y prolongar su vida en anaquel.\n\ni) Desarrollar tecnología para\ndar valor agregado a la mayoría de las especies frutales tropicales para\ndinamizar los mercados y beneficiar a los productores.\n\nj) Efectuar investigaciones en\nmétodos de riego, fertirriego, equipos, materiales,\npara incrementar producción y adaptarse al cambio climático.\n\nk) Evaluar la nutrición mineral y\norgánica, manejo de copa en caso de especies arbóreas, manejo integrado de\nplagas y enfermedades, para una producción sostenible apropiada a los sistemas\ndel productor.\n\nl) Desarrollar alianzas\nestratégicas con las organizaciones de productores, academia, empresa privada,\nprogramas de investigación y transferencia de tecnología y las organizaciones\ncientíficas internacionales.\n\nm) Generar tecnología\nincorporando el análisis socioeconómico para los cultivos.\n\nn) Coordinar y colaborar con\notros actores del sector agropecuario, cooperativas, asociaciones y la\nDirección Nacional de Extensión Agropecuaria del MAG y para la transferencia de\ntecnología, la difusión y la capacitación de la tecnología generada y validada\nen Hortalizas.\n\no) Cualquier otra que les sea\nencomendada por la jefatura respectiva.\n\n4.- Departamento de Laboratorios.\nCorresponde\nal Departamento de Laboratorios la implementación de metodologías, el análisis\nde muestras, emisión de diagnósticos, la multiplicación in vitro de germoplasma\ny ejecución de estudios específicos que complementen las líneas de\ninvestigación, innovación y validación de la Dirección de Investigación\ny Desarrollo Tecnológico por lo que contará con personal multidisciplinario,\nprofesionales y técnicos formados en los diferentes campos de acción que\naseguren su competencia.\n\nEl Departamento estará conformado\npor áreas laboratoriales que le permitan ejecutar las\nsiguientes funciones:\n\na) Desarrollar los procedimientos\ne implementar metodologías para análisis y diagnósticos en fitoprotección,\nnutrición animal, química y física de suelos, plantas y aguas, características\nquímica y microbiológica de insumos agrícolas y abonos orgánicos, entre otros\nrequeridos en la institución que soporten el respaldo científico de las\ninvestigaciones.\n\nb) Acompañar el mejoramiento\ngenético asistido por marcadores moleculares.\n\nc) Desarrollar e implementar\ntécnicas de reproducción masiva de germoplasma de interés.\n\nd) Apoyar el desarrollo y\nejecución de propuestas de investigación según los lineamientos\ninstitucionales.\n\ne) Desarrollar y actualizar los\nprocedimientos y actividades técnicas y administrativas del Departamento.\n\nf) Brindar servicios a usuarios\nen el área de su competencia según las tarifas autorizadas por la Junta\nDirectiva.\n\ng) Coordinar con el Departamento\nde Transferencia de Tecnología la capacitación a funcionarios y Usuarios en\nmaterias de su competencia.\n\nh) Coordinar con otras\ndependencias internas o externas a fin de ejecutar actividades especiales\nrequeridas en el sector agropecuario, de acuerdo con las competencias y\ncapacidades del Departamento.\n\ni) Desarrollar otras funciones\nque le asigne el superior jerárquico.\n\n5.-\nDepartamento de Estudios Básicos de Tierras. Con sustento en lo estipulado en el Artículo 20 de\nla ley N°8149, este Departamento coadyuvará en la realización de\nestudios relativos al uso conforme del suelo, clasificación y zonificación\nagroecológica de los cultivos, así como la planificación y ordenamiento territorial\ncon una participación en la elaboración y ejecución de los planes nacionales de\nmanejo, conservación y recuperación de suelos, como lo establece la ley\npara el Uso, Manejo y Conservación de Suelos número 7779 y su\nReglamento, de igual manera colaborará con la Dirección de Investigación\ny Desarrollo Tecnológico, en las investigaciones e innovaciones que se\ndesarrollen. A este departamento le corresponde: a) Realizar las\ninvestigaciones y estudios relativos a lo autorizado en los Artículos 6 incisos\na), b) y c), 27, 49 y 66 de la Ley N°7779, los artículos 2, 6, 34, 35, 36,\n37, 38, 39, 40, 59, 131, 132, 133, y 135 del Decreto Ejecutivo\nN°29375-MAG-MINAE-S H-MOPT y los artículos 1, 2, 3,7, 8, 9, 10, 11 y 12\ndel Decreto Ejecutivo N°30636-MAG, en materia de uso conforme del suelo,\nemisión de criterio técnico para autorizaciones y permisos.\n\nb) Vender servicios a usuarios en\nel área de su competencia según las tarifas autorizadas por la Junta Directiva.\n\nc) Realizar levantamientos semidetallados de suelos y capacidad de uso de las tierras\nagroecológicas del país, así como la zonificación agroecológica de los\ncultivos, en el marco de la planificación y ordenamiento territorial, apoyando\nla ejecución de los Planes Nacionales de manejo, conservación y recuperación de\nsuelos.\n\nd) Colaborar con la Dirección de\nInvestigación y Desarrollo Tecnológico del INTA, en las investigaciones e\ninnovaciones que se desarrollen.\n\ne) Solicitar, centralizar y\ncanalizar las solicitudes de recursos al nivel interno del INTA.\n\nf) Mantener las bases de datos\nactualizadas y disponibles para los usuarios en materia de suelos, tierras y\naguas correspondiente a la información generada por el INTA.\n\ng) Participar en los estudios de\nzonificación agropecuaria en el ámbito nacional, regional o local, para\ncontribuir a orientar la producción en forma eficiente.\n\nh) Mantener actualizado el\nsistema de información geográfico para facilitar el ordenamiento territorial en\nel mediano y largo plazos.\n\ni) Cualquier otra que le asigne\nla Jefatura de la Dirección.\n\n(Así\nreformado por el artículo 1° del decreto ejecutivo N° 44773 del 30 de octubre\nde 2024)\n\nArtículo 36.-Dirección de Gestión de Proyectos\ny Recursos.(Derogado por el artículo 2°\ndel decreto ejecutivo N° 42683 del 20 de octubre del 2020)\n\n   Artículo 37.- Dirección Administrativa-Financiera. (Derogado por el artículo 50 (actual artículo\n53) del Reglamento orgánico del Ministerio de Agricultura y Ganadería, aprobado mediante decreto\nejecutivo N° 45282 del 5° de setiembre de 2025)\n\nCAPÍTULO V\n\nDe los Derechos de Propiedad Intelectual\n\n    Artículo 38.—Toda innovación tecnológica\nresultado de la iniciativa de investigación del INTA, será inscrita por el Instituto en\nlos Registros que correspondan, de acuerdo con la naturaleza propia de la innovación y la\nnormativa vigente.\n\n    Artículo 39.—El Instituto deberá inscribir en\nlos Registros que correspondan, las marcas, signos, mapas, información de carácter\nintelectual, tales como textos, audiovisuales, material divulgativo y todo nuevo\ndesarrollo intelectual que resulte de su propia iniciativa.\n\n    Artículo 40.—El INTA deberá proteger los\nderechos de propiedad industrial de aquellas innovaciones obtenidas a partir de su propia\ngestión o iniciativa, en líneas de investigación tales como: diseño industrial,\nmaquinaria, equipos, software, métodos analíticos y otros.\n\n    Artículo 41.—En el caso de que se contrate al\nINTA para desarrollar variedades vegetales, se deberá contemplar y establecer en forma\nexpresa, la aplicación y definición de los derechos de obtentor, debiendo incorporarse\nen el Contrato de Venta de Servicios adicionalmente, los términos y alcances de la\nparticipación del INTA en la explotación comercial de la nueva variedad vegetal\ngenerada.\n\n    Artículo 42.—Aquellas variedades vegetales\ndesarrolladas por el INTA como resultado de su propia gestión; el Instituto deberá\ninscribirlas en el Registro de Variedades Protegidas que lleva la Oficina Nacional de\nSemillas -ONS-, de acuerdo con la Ley de Semillas Nº 6289 y con la normativa\ncorrespondiente en materia de protección de obtenciones vegetales.\n\n    Artículo 43.—Para el caso de germoplasma\nanimal que desarrolle el INTA como resultado de su propia gestión, el Instituto\nprocederá a su inscripción en los Registros respectivos.\n\nCAPÍTULO VI\n\nDe las Atribuciones y Disposiciones Generales\n\nAdministración y Generación de Recursos\n\n    Artículo 44.—Al amparo de lo dispuesto en el\nartículo 15 de la Ley Nº 8149, la administración financiera y contable del Fideicomiso\npodrá ser contratada con uno de los bancos estatales del Sistema Bancario Nacional, sin\nperjuicio del control que le corresponde ejercer a la Auditoria Interna del Instituto o a\nla Contraloría General de la República. Asimismo, el INTA podrá administrar los\ncréditos internos y externos que se otorguen, para lograr su objetivo siempre y cuando\nasí lo autorice el Poder Ejecutivo.\n\n    Artículo 45.—Para el financiamiento y la\nejecución de las funciones que se deriven de la aplicación de la Ley y de otras\nrelacionadas con el accionar del INTA, el Instituto contará con los recursos de su\npatrimonio, según lo dispuesto en el artículo 3 de la Ley N\nº\n 8149, de\nconformidad con los presupuestos aprobados internamente por la Junta Directiva y\nexternamente por la Contraloría General de la República.\n\nProhibiciones\n\n    Artículo 46.—Prohíbase celebrar toda clase de\ncontratos con el Instituto a los miembros de la Junta Directiva y a todos los demás\nfuncionarios y sus parientes hasta el tercer grado de consanguinidad o afinidad inclusive,\nasí como a las sociedades de cualquier tipo en las que ellos tengan participación o\ninterés. La infracción comprobada de lo dispuesto en este artículo se sancionará con\nla destitución inmediata del infractor, sin perjuicio de las responsabilidades penales y\nciviles que puedan corresponderle e implicará la nulidad absoluta de los actos celebrados\nentre éste y el Instituto.\n\nContribuciones\n\n    Artículo 47.—De conformidad con lo dispuesto\nen la Ley Nº 8149, las contribuciones, donaciones y los aportes económicos que cualquier\npersona física o jurídica dé al Instituto, así como la compra de equipo, vehículos,\nmaquinaria e insumos necesarios para la investigación, estarán exonerados del pago de\ntodo tipo de timbres y de los impuestos de la renta, ventas y traspaso.\n\nCAPÍTULO VII\n\nDerogatorias y Modificaciones\n\n    Artículo 48.—Deróguese el Artículo 36 y\nmodifíquense los artículos 33 y 34 del Decreto Ejecutivo Nº 26431-MAG del 2 de octubre\nde 1997, publicado en La Gaceta Nº 213 del 5 de noviembre de 1997, los cuales se\nleerán de la siguiente manera:\n\n\"Artículo 33.—Las Direcciones Regionales\n\nLas Direcciones Regionales tendrán las siguientes funciones:\n\n1. Planificar, presupuestar, ejecutar, dar seguimiento y\n evaluar los programas del Ministerio de Agricultura y Ganadería que atienden y apoyan a\n los agricultores y sus organizaciones con base en los diagnósticos participativos en las\n diferentes regiones del país.\n\n2. Promover a nivel regional el desarrollo agropecuario a\n partir de la extensión y protección agropecuaria, bajo los principios de sostenibilidad,\n competitividad y equidad.\n\n3. Facilitar otros servicios de apoyo a la producción.\n\n4. Contribuir con el funcionamiento del Comité Técnico\n Sectorial Agropecuario y posibilitar la prestación integral de servicios a los\n productores y productoras.\n\n5. Coordinar con instancias superiores del Ministerio la\n aplicación de las políticas, planes y proyectos y lineamientos, en materia de\n extensión, salud animal y Servicios de Protección Fitosanitaria.\n\n6. Representar al MAG en todas las actividades relacionadas\n con su región.\n\n7. Fortalecer los procesos de integración de los servicios\n extensión, salud animal y Dirección de Servicios de Protección Fitosanitaria a efecto\n de lograr una mejor atención de los agricultores por parte de la institución.\n\n8. Asegurar una respuesta inmediata en casos de emergencia\n de sanidad agropecuaria y responder a las directrices de la Ley de Protección\n Fitosanitaria y Salud Animal.\n\n9. Velar porque la prestación de los servicios\n agropecuarios se realice por medio de los Centros Agrícolas Básicos como instrumentos\n cogestionarios de prestación de servicios, mediante la aplicación de metodologías\n participativas y dialógicas. A su vez, promover el CAB en el ámbito sectorial, de tal\n manera que las instituciones del Sector Agropecuario, en el nivel regional, asuman\n progresivamente esta modalidad de prestación de servicios.\n\n10.Cualquier otra función que las autoridades superiores,\n leyes y decretos le asignen\".\n\n\"Artículo 34.—Las Direcciones Regionales contarán con los siguientes\n equipos:\n\n—Equipo de Extensión Agropecuaria\n\n—Equipo de Servicios de Protección Fitosanitaria\n\n—Equipo de Salud Animal\n\n—Agencias de Servicios Agropecuarios\".\n\n    Artículo 49.—Las funciones y competencias que\nen el Decreto Ejecutivo Nº 26431-MAG del 2 de octubre de 1997, publicado en La Gaceta Nº\n213 del 5 de noviembre de 1997, artículos 12, 13, 14, 15, y 16 se establecían a la\nDirección Nacional de Investigaciones Agropecuarias del Ministerio de Agricultura y\nGanadería, serán ejecutadas y corresponderán al Instituto Nacional de Innovación y\nTransferencia en Tecnología Agropecuaria -INTA- comprendiendo dentro de éstas las\ncorrespondientes a la administración y funcionamiento de las Estaciones y Campos\nExperimentales.\n\n    Artículo 50.—Modifíquese el Artículo 3 del\nDecreto Ejecutivo Nº 26431-MAG del 2 de octubre de 1997, publicado en La Gaceta Nº\n213 del 5 de noviembre de 1997, en lo que respecta a la \"Coordinación\nAgropecuaria\", para que la misma, se lea de la siguiente manera:\n\n\"…\n\n- Coordinación Agropecuaria\n\nLa Coordinación Agropecuaria tendrá las siguientes\n funciones:\n\n1. Promover y coordinar procesos de extensión y fomento\n tendientes a provocar cambios de actitud progresivos y permanentes en los pequeños\n productores y productoras, sus familias y organizaciones, orientados hacia la solución de\n sus problemas productivos y ambientales, acordes a sus condiciones agroecológicas y\n socioeconómicas y sistemas productivos, que provoquen un mejoramiento continuo del nivel\n de vida de la población rural y urbana, en equilibrio con el medio ambiente.\n\n2. Coordinar acciones para mantener y mejorar los servicios\n de protección fito y zoosanitaria, para lo cual ejercerá el control y fiscalización de\n productos e insumos de uso agropecuario, con el fin de preservar la producción y la salud\n pública.\n\n3. Apoyar al Ministro Rector del Sector Agropecuario en la\n ejecución de las políticas y lineamientos dictados para el desarrollo del sector,\n promoviendo el incremento en los niveles de competitividad y sostenibilidad en las\n actividades agropecuarias.\n\n4. Asesorar a las autoridades ministeriales en la toma de\n decisiones tendientes al fortalecimiento técnico y la integración operativa de la\n Institución, para alcanzar los mayores niveles de eficiencia y dar respuesta en mayor\n grado a los demandas de pequeños y medianos productores y productoras, bajo un enfoque de\n género, especialmente en materia relativa a protección y extensión agropecuaria.\n\n5. Coordinar con organismos nacionales e internacionales el\n manejo de información técnica en el campo de la extensión y protección agropecuaria.\n\n6. Promover la planificación, coordinación, seguimiento y\n evaluación de las acciones de las Direcciones correspondientes, a efecto de maximizar el\n uso de los recursos y lograr mayor impacto en el desarrollo del sector agropecuario.\n\n7. Definir y ejecutar normas y procedimientos para la\n supervisión y establecimiento de mecanismos de organización de la información primaria\n generada en protección, extensión, estudios especiales y consultorías agropecuarias.\n\n8. Coordinar la protección del patrimonio agropecuario\n nacional, mediante el estricto control y cumplimiento de las leyes establecidas para tal\n efecto.\n\n9. Proponer y generar políticas, instrumentos legales y\n normas administrativas para orientar y regular las actividades del servicio de extensión\n y protección agropecuaria.\n\n10. Coordinar, orientar, dar seguimiento y evaluar todas las\n acciones y proyectos que se ejecuten a nivel regional o nacional en el área agropecuaria.\n\n11. Velar porque las políticas de la Institución respondan\n a los lineamientos y políticas del Sistema Nacional de Investigación y Transferencia\n Tecnológica (SNITTA).\n\n12. Facilitar los procesos de desarrollo rural conforme a\n los lineamientos del Despacho Ministerial.\n\n13. Contribuir en la promoción y desarrollo de procesos de\n capacitación y educación no formal y formal tendientes a provocar cambios en la conducta\n productiva y en las actitudes de los pequeños productores y productoras en sus familias y\n organizaciones orientados hacia la eficiencia productiva, capacidad de gestión\n autogestionaria y fortalecimiento de las capacidades organizativas.\n\n14. Promover y asesorar en métodos, técnicas e\n instrumentos que integren la labor de las diferentes instancias a nivel regional.\n\n15. Therefore,\n\nTHEY DECREE:\n\n    The following;\n\nRegulation to Law N\nº\n 8149 creating the National\n\nInstitute of Innovation and Transfer\n\nin Agricultural Technology (INTA)\n\n \n\nCHAPTER I\n\nDefinitions\n\n    Article 1\nº\n—For the purposes of\nthe application of the provisions contained in this Regulation, the following\ndefinitions are established:\n\n    Activity: Corresponds to the\n action that has the highest degree of concreteness and specificity, through which -\n together with other activities- a component of a project is executed.\n\n    Adoption: Process through\n which an individual acquires technology, appropriates it, and puts it into practice for a\n utilitarian purpose.\n\n    Agricultural: Comprises crops,\n livestock, natural resources, fishing, aquaculture and marine products, forests, and\n primary forest products.\n\n    Agriculture: Art, science, and\n industry concerned with the exploitation of plants and animals for human\n use. In a broad sense, agriculture includes the production of plant and\n livestock goods to satisfy industrial, energy, clothing, housing,\n food, and other needs.\n\n    Technical assistance: Specialized\n advisory services directed toward producers, professionals, technicians, traders,\n agro-industrialists, and others.\n\n    Dissemination: Transmission of\n information under suitable mechanisms and means of communication.\n\n    Agricultural extension: Service or\n organized process that, through the use of participatory procedures, didactics, and\n techniques, by means of disseminating technical options, helps the population\n improve knowledge, production methods, and income levels, which\n impacts the improvement of their quality of life.\n\n    Innovation: Innovations are\n improved or new processes, products, and/or services; that is, it is the incorporation of a\n change (major or minor) to have a product, process, or service differentiated in some\n characteristic or property that generates some advantage.\n\n    -INTA- National Institute of\n Innovation and Transfer in Agricultural Technology: Institute created by\n Law N\nº\n 8149 of November 5, 2001, published in La\n Gaceta N\nº\n 225 of November 22, 2001.\n\n    Research: Process of systematic\n and scientific experimental study, aimed at increasing knowledge\n in science and technology, trying to discover new techniques or\n little-known or insufficiently studied phenomena.\n\n    Plan: Refers to the global aspect\n of all the activities of a given development process, established within a\n specific period that may be short, medium, and long term. It is an\n organized set of ends, objectives, goals, instruments, means, and resources to\n achieve the development of a determined area.\n\n    Program: Refers to a\n set of projects related and coordinated with each other, all of them as part of the\n actions to be carried out to achieve the goals and objectives defined in a plan, within\n a specific period. It can be formulated with varying degrees of detail and\n depth. The objectives, goals, and assigned resources must be compatible with the\n objectives, goals, and resources considered by the Plan.\n\n    Project: Set of interconnected\n activities that constitutes the smallest unit that is part of a program and that\n can be carried out independently of other projects. It seeks to satisfy a specific\n need or take advantage of a particular opportunity, has start and end dates,\n and uses material, financial, and human inputs. It is composed of more than one\n component that corresponds to a specific area of a project.\n\n    Agricultural Sector: It is a\n division of an economic nature, comprising agriculture, forestry, fishing, and\n aquaculture, including the different phases of the agro-chain and the rural environment.\n\n    Agricultural technology: These are the\n technical options generated and derived from a process of experimentation,\n research, or agricultural innovation.\n\n    Technology Transfer:\n Multidirectional communication process, in which technological options flow\n among the different actors in society. It encompasses a series of activities of\n dissemination, training, and information carried out under different methods and techniques.\n\n    Validation: Final stage of the\n research process, in which a technology or part of it is evaluated by\n farmers on their farms and under their own production conditions. After\n validation, the agricultural extension process continues.\n\n    Verification: Advanced stage of the\n systematic research process, in which the researcher comprehensively\n and extensively (commercially or semi-commercially) verifies a technology nearing release for\n farmers' use; it corresponds to a stage prior to validation.\n\nCHAPTER II\n\nOperation of the Institute\n\n    Article 2\nº\n—INTA is a\nbody of maximum deconcentration, attached to the Ministry of Agriculture and Livestock\n-MAG- that has instrumental legal personality to fulfill its objective and\nadminister its assets; as well as the resources authorized by Law, whether via\nbudget or transfers from MAG or other institutions of the Agricultural\nSector and those from its own management.\n\n    Article 3\nº\n—INTA is\nsubject to the oversight of the Comptroller General of the Republic and to the\napplicable provisions from the Budgetary Authority.\n\n    Article 4\nº\n—INTA is the\nofficial State body specialized in innovation, research, and transfer in\nagricultural technology, designated by Law N\nº\n 8149 that allows it\nto fulfill what is stipulated in Articles 48 and 49 of the Law for the Promotion of Agricultural\nProduction -FODEA- N\nº\n 7064 of April 29, 1987; as well as to\nfulfill those functions assigned in its Creation Law and in other related laws;\nregarding its competence.\n\n    Article 5\nº\n—The functions\nestablished in Law N\nº\n 7779 of April 30, 1998, \"Law of\nUse, Management, and Conservation of Soils\" that corresponded to the Soils Department\nof the National Directorate of Agricultural Research of the Ministry of Agriculture and\nLivestock, become part, as applicable, of the framework of functions and specific\ncompetencies of INTA.\n\n    Article 6\nº\n—As a product\nof its management, INTA will have products and services of strategic, environmental, and\nsocial interest for the country, mainly oriented toward the small and medium-sized producer, without\nthat limiting the participation of other groups in the Agricultural Sector.\n\nCHAPTER III\n\nINTA Resources\n\n    Article 7\nº\n—All those indicated in Article 3\nº\n of\nLaw N\nº\n 8149 shall be the assets of INTA:\n\na) The income generated by the sale of products, services,\n and technology, as well as the returns on its investments.\n\nb) The credits obtained from national or international financial\n entities operating legally in Costa Rica.\n\nc) Donations, inheritances, and legacies from\n natural and legal persons, public and private institutions, or\n international organizations.\n\nd) The rights and movable or immovable property\n belonging to the Institute.\n\ne) The resources it captures from the private sector.\n\nf) The financial contributions from the State through\n ordinary and extraordinary budgets of the Republic and those made by\n decentralized institutions and other public entities.\n\ng) The income from the financing of research\n projects.\n\nh) Forty percent (40%) of the surplus of the\n institutions of the Agricultural Public Sector that receive transfers from the State.\n\ni) The resources deposited in the trust, authorized\n by Law N\nº\n 8149, and the proceeds thereof that will be used in\n covering its operating expenses.\n\nj) Any other that it may come to obtain.\n\n    Article 8\nº\n—The Ministry of\nAgriculture and Livestock shall provide INTA with the personnel, the economic resources, the\nequipment, movable and immovable property, the infrastructure, and in general, the\nnecessary budgetary content for its operation, including those that were being\nused by the formerly named \"National Directorate of Agricultural\nResearch\", through legal mechanisms that guarantee their adequate\nutilization, without giving rise to conflicts of inter-institutional interests.\n\n    Article 9\nº\n—All those\nservants of the National Directorate of Agricultural Research, as well as those\nfrom other dependencies of MAG or from other public institutions who were transferred to the\nNational Institute of Innovation and Transfer in Agricultural Technology -INTA- or who\nmay be transferred in the future; shall retain all rights acquired before\nthe enactment of Law N\nº\n 8149 or as of the effective date of the transfer.\n\n    Article 10.—The Ministry of Agriculture and\nLivestock must incorporate into its budgets the resources for the payment of the\npersonnel that was transferred to INTA, in the items corresponding to Personal\nServices and Social Charges or those items or sub-items that may come to be\nused for that purpose; in accordance with the guidelines established by the General Directorate of\nNational Budget of the Ministry of Finance; for which MAG must maintain a\nbudgetary heading for INTA.\n\nCHAPTER IV\n\nOrganic Structure and Functions\n\nArticle\n11. -INTA\nshall be composed of the following bodies:\n\na) A Board of Directors composed of seven members and a comptroller, and two Units of an\nadvisory nature, constituted by an Internal Audit and a Services Comptroller's Office.\n\n b) An Executive Directorate that shall be\ncomposed of a Director and a Sub-director whose appointments are of\ntrust and shall be freely appointed and removed by the Board of Directors. Both\npositions require, as a minimum, the professional degree of Licentiate in\nAgronomic Engineering or in one of the branches of agricultural sciences,\nduly incorporated into the College of Agronomic Engineers, experience in\nadministration, and two years of experience in personnel supervision. The functions of the\nSub-director of INTA shall be assigned by whoever holds the position of Director.\n\nIn the event of temporary\nabsences of the Director, the Sub-director shall assume the Directorship of INTA\nwith all its functions and responsibilities. Furthermore, the Director is\nempowered to temporarily appoint a substitute for the Sub-director during\ntemporary absences of the Sub-director. The Knowledge Management Unit shall also form part of the\nExecutive Directorate.\n\n(Thus amended subsection b) above by article 1 of\nexecutive decree N° 44773 of October 30, 2024)\n\nc) A Directorate of\nResearch and Technological Development, which shall be composed of the\nfollowing Departments and Units:\n\nc.1) Department\nCenter for Agricultural Innovation Enrique Jiménez Núñez.\n\nc.1.1) Dry Tropics Livestock\nUnit.\n\nc.1.2) Dry Tropics Agricultural\nUnit.\n\nc.1.3) Experimental Center La Managua\nUnit.\n\nc.2) Department\nCentral Center for Agricultural Innovation.\n\nc.2.1) Central Livestock\nUnit.\n\nc.2.2) Central Agricultural\nUnit.\n\nc.2.3) Experimental Center Carlos Durán\nUnit.\n\nc.3) Department\nCenter for Agricultural Innovation Los Diamantes.\n\nc.3.1) Humid Tropics Livestock\nUnit.\n\nc.3.2) Humid Tropics Agricultural\nUnit.\n\nc.4) Department of\nLaboratories.\n\nc.5) Department of\nBasic Land Studies.\n\n(Thus amended subsection c) above by article 1 of\nexecutive decree N° 44773 of October 30, 2024)\n\nd) (Repealed by article 50 (current article 53) of the Organic\nRegulation of the Ministry of Agriculture and Livestock, approved by executive\ndecree N° 45282 of September 5, 2025)\n\n(Thus amended by article 1 of executive decree N° 42683 of October\n20, 2020)\n\n    Article 12.—The bodies of INTA in what\nconcerns them, shall have, in addition to the functions and responsibilities described\nfor each of them in this Regulation, the duty to establish, maintain, perfect,\nand evaluate the institutional internal control system, with the active administration being obliged to\ncarry out the necessary actions to guarantee its effective functioning,\nproviding assurance in the achievement of the following objectives:\n\na) Protect and conserve the assets of INTA and the goods\n in use against any loss, waste, improper use, irregularity, or illegal act.\n\nb) Demand reliability and timeliness of information.\n\nc) Guarantee efficiency and effectiveness of operations.\n\nd) Comply with the legal and technical framework.\n\nThe Board of Directors\n\n            Article 13.-The Institute shall have a Board of\nDirectors composed of seven members, in whom the highest direction shall rest.\nIt shall be composed as follows:\n\na) The Minister of\nAgriculture and Livestock or their representative.\n\nb) The Minister of\nScience and Technology or their representative.\n\nc) The Executive\nPresident of the National Production Council or their representative.\n\nd) A representative of\nthe National Chamber of Agriculture and Agroindustry of Costa Rica.\n\ne) A representative of\nthe Costa Rican Chamber of the Food Industry.\n\nf) A representative of\nthe small and medium-sized agricultural producers organized with\nnational representation and with current legal personality, who shall be accredited\nby means of the respective certification.\n\ng) A representative of the\nNational Council of Rectors.\n\n            The Executive Director of the Institute must attend the sessions of the Board of Directors,\nwho shall have a voice, but no vote. Similarly,\nthe comptroller designated by the Board of Directors.\n\n(Thus\namended the preceding paragraph by article 1 of executive decree N° 42683\nof October 20, 2020)\n\nThe quorum for\nthe Board of Directors to validly meet shall be formed with four of its\nmembers. The agreements and resolutions shall be adopted by a simple majority of those\npresent, except in those cases where, by legal provision, a qualified\nmajority is required. In case of a tie, the President shall have a casting vote.\n\n    In matters not regulated in\nthis article, the provisions of Chapter Three of the\nTitle Two of the General Law of Public Administration and their respective\nconcordances shall apply supplementarily.\n\n    Article 14.—The representatives referred to\nin subsections d), e), f), and g) of Article 13 shall be designated by the Executive\nBranch, from the shortlist that the corresponding entity shall provide for that purpose. In the\ncase of the representative of the small and medium-sized producers, the receipt of the shortlists that\nthe organizations of small and medium-sized agricultural producers will submit shall be opened for a\nperiod of one calendar month, for their subsequent selection by the\nExecutive Branch, as indicated.\n\n    Article 15.—The Minister of Agriculture and\nLivestock or their representative shall be the President of the Board of Directors. The Board shall elect\nfrom among its members a vice president and a secretary, with the remaining members being\ndirectors.\n\n    Article 16.—The members of the Board of\nDirectors, except the Ministers that compose it, must meet the following\nrequirements:\n\na) Be Costa Rican.\n\nb) Possess a minimum of five years of experience and a\n recognized track record in agricultural, agro-industrial, or agri-business matters, in\n food technology, or agricultural economics.\n\nc) Subscribe to a fidelity bond that guarantees the\n correct fulfillment of their functions during the exercise of the position.\n\n    Article 17.—The call for the\nsubmission of shortlists to make the appointment of the representatives of the\nsmall and medium-sized producers shall be made by publication in a newspaper with\nwide national circulation. After thirty calendar days, counted from\nthe publication, the respective appointment shall proceed.\n\n    Article 18.—Once a vacancy occurs, the Executive\nBranch shall have a period of one calendar month to request the sending of a\nnew shortlist by the corresponding represented organization. The person\nselected shall remain in the position for the remainder of the period. The maximum period\navailable to the Executive Branch, as indicated, to select the new member shall be\nten business days counted from receipt of the shortlist.\n\n    Article 19.—The members of the Board of\nDirectors shall hold their positions for a period of three years, except the representatives of the\nExecutive Branch defined in subsections a), b), and c) of article 13, who\nshall remain in their positions for one presidential term or, failing that, during the\ntime they hold their position in the Executive Branch.\n\n    Article 20.—The comptroller shall be appointed by the\nBoard of Directors of INTA, may not be a member of said Board, and must preferably have\nknowledge in public administration and in technological matters.\nThe term of appointment of the Comptroller shall be for twelve months and may be reelected. The\nComptroller may attend the sessions of the Board of Directors, with the right to voice but not to\nvote. The mechanism for appointing the comptroller shall be established by the Board of Directors.\n\n    Article 21.—The members of the Board of\nDirectors shall be personally liable for their acts and their management. None may have\ndirect interests in private companies dedicated to the transfer and generation of\nagricultural technology; if so, they shall bear the civil and\ncriminal liability of the case, proceeding with their separation from office, through the opening and\nprocessing of the procedure that guarantees due process.\n\nArticle 22.-The government officials and the comptroller shall exercise their\ndirective functions without receiving per diems. The other board members, unless\nthey are public officials, shall earn per diems whose amount shall correspond to the\naverage of the amounts established for that concept for the members of the\nboards of directors of the following institutions of the Agricultural Sector: the\nNational Production Council (CNP), the Institute of Rural Development (INDER)(*),\nthe Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), the\nNational System of Groundwater, Irrigation, and Drainage (SENARA), and the\nPrograma Integral de Mercadeo Agropecuario (PIMA); they shall be recognized the payment of\nup to two ordinary sessions per month and three extraordinary ones per year.\n\n   \n The amount of the per diems cited in the preceding paragraph shall be fixed by the\n Executive Branch.\n\n(Thus\namended by article 1 of executive decree N° 36563 of March 8,\n2011)\n\n(*)\n(Its denomination modified by article 14 of Law N° 9036 of May 11,\n2012, \"Transforms the Institute of Agrarian Development (IDA) into the\nInstitute of Rural Development (INDER) and Creates the Technical Secretariat of Rural\nDevelopment\")\n\nArticle 23.-The functions, duties, powers,\nand responsibilities of the Institute's Board of Directors are:\n\na.\nDefine, approve, and implement the development policies and strategies of the Institute,\nas well as approve the Annual Operating Plan to fulfill the objective of Law\nNº 8149.\n\nb.\nDefine and approve the organization and administrative structure.\n\nc.\nApprove the mechanisms to periodically evaluate the functioning of the\nInstitute and the quality control of its functions. Likewise, it shall render\naccounts periodically to the head of the Ministry of Agriculture and\nLivestock, on the fulfillment of objectives and goals.\n\nd.\nApprove the Institute's policies regarding investment.\n\ne.\nHear, approve, or reject the proposal for the ordinary and extraordinary\nbudget and its modifications presented by the Executive Director, as well\nas the annual report of activities and the situation of the Institute.\n\nf.\nAppoint and remove, as established by administrative law, the\nauditor of the Institute and, in necessary cases, hire external audits.\n\ng.\nHear and approve, when applicable, the proposals of the Executive Director and\nthe contracts in which the Institute is a party.\n\nh. Hear\nand approve trusts or other mechanisms for the use and management of economic\nresources, to facilitate the fulfillment of the purposes entrusted to the\nInstitute.\n\ni.\nHear and approve the donations, inheritances, and legacies that natural,\nlegal, or private persons and national and international organizations\nmake to the Institute.\n\nj. Appoint and remove from their position the Executive\nDirector and the Sub Director in accordance with subsection g) of article 4 of the\nCivil Service Statute, both must be Costa Rican and hold, as a\nminimum, the professional degree of Licentiate in Agronomic Engineering or in\none of the branches of agricultural sciences, duly incorporated into the\nCollege of Agronomic Engineers, with experience in Administration and two years of\npersonnel supervision.\n\n(Thus amended the preceding subsection\nby article 1 of executive decree N° 44773 of October 30, 2024)\n\nk.\nApprove the regulations related to the functioning and operation of the Institute.\n\nl.\nApprove the fees for the sale of products and services carried out by the\nInstitute.\n\nm.\nEnsure the proper administration of the financial resources of the Institute.\n\nn.\nEstablish the budgetary mechanisms required by the Institute to\nprovide excellent and competitive service compared to\nother options in the national market.\n\no.\nDevelop strategic alliances with the public and private sector at the national\nand international level, that allow capturing the resources required for the\ngeneration of technology and other activities inherent to its management. The\nincome generated as a result of the alliances mentioned in this Subsection must be\nbudgeted in its entirety in accordance with article 18 of the Organic Law\nof the Comptroller General of the Republic. INTA shall have a bank\naccount for the management of the funds generated for this concept.\n\np. The functions detailed in the Internal Regulation for the Functioning of the Board of Directors of the\nNational Institute of Innovation and Transfer in Agricultural Technology.\n\n(Thus\namended the preceding subsection by article 1 of executive decree N° 42683\nof October 20, 2020)\n\n   Article 24. -The advisory bodies to the Board of Directors shall be\nthe Internal Audit and the Services Comptroller's Office, both shall depend\nhierarchically on the Board of Directors, and shall attend sessions when it\nso requests.\n\nThe Internal Audit shall oversee, with functional independence\nand criteria, the operations and the effectiveness of risk\nmanagement, control, and direction processes, as well as advise within the scope\nof its competence, contributing positively and constructively to the\nprotection of resources, the strengthening of the internal control system, and\nthe achievement of institutional objectives.\n\nIt shall function and be organized in accordance with the provisions of\nChapter IV of the General Law of Internal Control Nº 8292, the Regulation to\nsaid Law, the Regulation for the Organization and Functioning of the Internal\nAudit, and the technical standards and provisions issued by the Comptroller General\nof the Republic. The Board of Directors of INTA shall define and establish through\nagreements, the administrative-type regulations applicable to the Internal\nAuditor under the terms indicated in Article 24 of Law Nº 8292. The\nInternal Auditor must submit to the Board of Directors the Annual\nWork Plan, an Annual Report on its execution and on the status of recommendations\nand provisions, without prejudice to the preparation of other reports, if\ncircumstances warrant it. When it deems necessary, and without\ndetriment to the provisions of Chapter IV of Law Nº 8292, the Board of\nDirectors shall request the Internal Auditor to include in the Annual Work\nPlan, special audits or studies.\n\nThe Services Comptroller's Office shall function and be organized in\naccordance with the provisions of Chapter II, Section III of Law 9158 and\nChapter IV of Executive Decree 39096-PLAN and the Regulation for the Creation,\nFunctioning, and Operation of the Services Comptroller's Office of the National\nInstitute of Innovation and Transfer in Agricultural Technology, published in\nthe Official Newspaper La Gaceta N° 208, of October 29, 2014.\n\n(Thus amended\nby article 1 of executive decree N° 42683 of October 20, 2020)\n\n    Article 25.—The legal representation of the\nInstitute shall be exercised by the President of the Board of Directors and the Executive Director,\nwho shall have judicial and extrajudicial representation, with the powers of\ngeneral agents without limit of sum in accordance with Article 1255 of the Civil Code,\nwhen acting separately; or of generalissimus agents without limit of sum in\naccordance with Article 1253 of the Civil Code, when acting jointly. The\nauthorization of the Board of Directors of INTA shall be required to alienate property.\n\nThe Executive Directorate\n\n    Article 26.—The person holding the position of\nExecutive Director must meet the following requirements:\n\na) Be Costa Rican.\n\nb) Be a professional in the area of agricultural\n sciences.\n\nc) Possess experience in administration.\n\n    Article 27.—The selection process for\nmaking the appointment of the person holding the position of Executive Director shall be\ndefined by the Board of Directors of INTA and shall be governed as established in\nArticle 4, subsection g) of the Civil Service Statute.\n\n            Article 28.-The duties and powers\nof the Executive Director are:\n\na.\nBe the superior head of personnel of all the dependencies of the Institute,\nexcept for the internal auditor who shall depend on the Board of Directors.\n\nb. Be\nresponsible before the Board of Directors for the efficient and correct\nfunctioning of the Institute; as well as for complying with the agreements and resolutions adopted by\nsaid Board, in the manner and time requested.\n\nc.\nAttend, with voice but without vote, all sessions of the Board of Directors.\n\nd.\nServe as support in the activities and events programmed by the Board of Directors.\n\ne.\nApprove research, innovation, and transfer projects in agricultural\ntechnology.\n\nf.\nManage resources to strengthen plans, programs, and projects of\nresearch, training, and technology transfer of international,\nnational, regional, or local interest, which must be incorporated\ninto the respective budgets.\n\ng.\nPromote coordination among producer organizations, private\ncompanies of the Sector, public and private international institutions,\npublic and private universities, governmental and non-governmental\ninstitutions, for the achievement of common objectives.\n\nh.\nSubmit to the Board of Directors draft regulations, manuals, procedures, and instruments related to the administrative and financial management of INTA.\n\ni.\nApprove the contracting of professional, technical, and administrative services necessary to execute and control INTA's operations.\n\nj.\nProvide the Board of Directors with the necessary information, documentation, and logistical support.\n\nk.\nPromote the development of INTA's human talent through the establishment of training and education programs.\n\nl.\nEnsure a climate of respect and discipline in the Institute's work environment.\n\nm.\nOversee the proper technical, administrative, labor, and financial operation of the Experimental Stations under the Institute's charge.\n\nn.\nRepresent INTA on commissions and at events of a national and international nature, with the approval of the Board of Directors.\n\no.\nPresent accountability reports to the corresponding authorities.\n\np.\nCoordinate relevant matters with the advisory bodies of the MAG (Ministry of Agriculture and Livestock) for the proper functioning of INTA.\n\n(As amended by Article 1 of Decreto Ejecutivo N°44773 of October 30, 2024)\n\nq.\nAny other duties assigned by the Board of Directors.\n\nArticle 29.—It is the competence of the Executive Director to appoint administrative personnel; in the case of Directors, Department Heads, and Coordinators of INTA, said appointment shall be submitted for the prior knowledge of the Board of Directors. For the respective appointments, the provisions established in the position and procedure manuals defined by INTA and other competent bodies shall be strictly followed.\n\nArticle 30.—The Executive Directorate may establish coordination mechanisms with the Executive Secretariat for Agricultural Sector Planning (SEPSA) and other directorates of the Ministry of Agriculture and Livestock to articulate joint actions for the benefit of agricultural producers.\n\nArticle 31.—The Executive Directorate shall establish a formal mechanism for coordinated action with the State Agricultural Extension Service to guarantee technology transfer (transferencia de tecnología) to small and medium-sized agricultural producers directly, effectively, and at no cost to the producer, provided that the research has not resulted from the sale of services or its use is restricted and/or confidential. Likewise, it may establish linkage mechanisms with the National System for Agricultural Technology Research and Transfer (SNITTA), the Sectoral Information System (INFOAGRO), and other information networks to ensure the dissemination of the generated information.\n\nArticle 32.—The Executive Directorate shall form and coordinate an Advisory Committee composed of the heads of INTA's Directorates and other advisory bodies it designates.\n\nArticle 33.—(Repealed by Article 2 of Decreto Ejecutivo N° 44115 of June 24, 2023)\n\nArticle 34.—Knowledge Management Unit. This is the operational unit of the Executive Directorate responsible for collecting, classifying, organizing, selecting, preserving, managing, and providing access—via technical reports—to the information generated in each innovation process (research, validation, verification, special studies, services, and transfer), organized in physical and digital files and classified into expedientes according to an alphanumeric code. This unit shall have two areas under its charge: management of technical information and coordination of technology transfer. Furthermore, this Unit is responsible for coordinating the institutional editorial process and serving as the liaison with the MAG Communication Unit on transfer matters.\n\nThe functions of the Knowledge Management Unit are as follows:\n\na) Channel the research, special studies, and technology transfer formats sent by the respective head, forwarding them to the members of the Technical Advisory Committee (COTECA) for their review and final approval.\n\nb) Participate as an active member of the Technical Advisory Committee, serving as its Technical Secretariat.\n\nc) Collect and manage the semi-annual reports on research activities generated by INTA staff.\n\nd) Prepare management reports based on the registered research activities, special studies, and technology transfer.\n\ne) Compile, characterize, and systematize the verified and/or validated technological options for transfer to the various users.\n\nf) Design, coordinate, organize, and execute training and dissemination events for technological information through the different state and private extension services.\n\ng) Design and apply knowledge management, information, communication, and transfer methodologies, mechanisms, and tools according to the different users and production typologies.\n\nh) Maintain close coordination with the National System for Agricultural Technology Research and Transfer (SNITTA), the information services of the Agricultural Sector, and the state extension service.\n\ni) Any other duties assigned by the Executive Directorate.\n\n(As amended by Article 2 of Decreto Ejecutivo N° 44773 of October 30, 2024)\n\nINTA Directorates and Departments\n\nArticle 35.—Directorate of Research and Technological Development. It is responsible for directing the generation, innovation, and technology transfer to obtain quality technological options, with the aim of increasing the productivity, competitiveness, and sustainability of agricultural systems for the benefit of producers.\n\nThe functions of the Directorate of Research and Technological Development are as follows:\n\na) Actively participate in INTA's strategic and operational planning processes and activities.\n\nb) Exercise immediate supervision and oversight over the personnel of the Directorate under its charge.\n\nc) Consolidate, prioritize, and respond to the research, innovation, and technology transfer needs demanded by users at the local, regional, and national levels.\n\nd) Coordinate, advise on, and guide agricultural technology research and transfer to meet the objectives and goals established in institutional policies.\n\ne) Actively participate in the review and supervision of research, innovation, and technology transfer projects.\n\nf) Formulate and prepare technical and administrative documents for senior officials.\n\nd) Prepare management reports based on the registered research activities, special studies, and technology transfer.\n\ng) Report to higher authorities.\n\nh) Any other duties assigned by the Executive Directorate.\n\nThe Directorate of Research and Technological Development shall be composed of the following Departments and Units:\n\n1- Enrique Jiménez Núñez Agricultural Innovation Center Department. Its objective is to generate, innovate, and provide technologies that enable the production systems of the Dry Tropics of Costa Rica to increase their competitiveness and sustainability. Additionally, to coordinate and channel the execution of research and innovations that address the technological demands of the designated sectors.\n\nThe Department's functions are:\n\na) Identify and prioritize the needs for agricultural technology research and innovation at the local, regional, and national levels in basic grains, livestock activities of the Dry Tropical region, and other agricultural activities of the region.\n\nb) Formulate and execute research and innovation projects, using the scientific method in its area of competence, to achieve the proposed objectives and goals for the benefit of producers.\n\nc) Validate the technology generated from projects within its competence, allowing for an assessment of its technical-economic relevance and improving the effectiveness of its adoption by users.\n\nd) Actively participate in INTA's strategic and operational planning processes and activities.\n\ne) Coordinate and collaborate with Technology Transfer and the dissemination of technological options generated by INTA.\n\nf) Formulate the consolidated Annual Operating Plan (PAO) / Budget and Procurement Plan.\n\ng) Prepare annual, semi-annual, and technical reports.\n\nh) Coordinate meetings and work sessions with the technical groups comprising each unit under its supervision and other units for the development of research and innovation projects.\n\ni) Disseminate INTA's work nationally and internationally through technical publications.\n\nj) Any other duties assigned by the Directorate of Research and Technological Development.\n\nThe Department is composed of the following Units:\n\n1.1- Dry Tropics Livestock Unit. The functions of the Dry Tropics Livestock Unit are as follows:\n\na) Identify technological limitations identified in the different links of the agri-food chain, including consumer demands and tastes.\n\nb) Generate technology that increases the yield of basic grain crops, fruits, vegetables, and other strategic crops in the region, incorporating environmentally friendly practices that allow for the production of safe products that respond to consumer demands.\n\nc) Introduce, evaluate, and select new varieties and hybrids of high commercial value, with excellent agronomic characteristics, adapted to climate change, tolerant to pests and diseases, and highly accepted by industry and consumers.\n\nd) Develop management techniques that improve production, health, and harvest quality under the concept of good agricultural practices.\n\ne) Develop technology for efficient production in protected environments to provide a constant and quality supply throughout the year.\n\nf) Develop strategic alliances with producer organizations, academia, private enterprise, research and technology transfer programs, and international scientific organizations.\n\ng) Generate technology incorporating socioeconomic analysis for crops.\n\nh) Coordinate and collaborate with other actors in the agricultural sector, cooperatives, associations, and the National Directorate of Agricultural Extension of the MAG for technology transfer, dissemination, and training on generated and validated technology.\n\ni) Produce seeds of rice, corn, beans, sorghum, among others, of varieties developed by INTA.\n\nj) Any other duties assigned by the respective superior.\n\n1.2.- Dry Tropics Agricultural Unit. The functions of the Dry Tropics Agricultural Unit are as follows:\n\na) Contribute to the efficiency and competitiveness of dry tropics livestock production systems through appropriate management and conservation of forage species, animal nutrition and health, genetics, records, cost reduction, and the utilization of local and national agro-industrial products and by-products.\n\nb) Develop technological options to rationalize and improve animal nutrition efficiency through appropriate management and conservation of forage species, agro-industrial waste, and quality conservation practices thereof.\n\nc) Develop technological options that contribute to the sustainability of production systems and mitigate climate change.\n\nd) Evaluate, jointly with the livestock sector, the bovine herd with the objective of identifying and selecting the best productive genetics adapted to climate change.\n\ne) Develop and execute projects for breed improvement using national and imported genetic resources to promote productivity, quality, and adaptation to climate change.\n\nf) Evaluate bioeconomic models in sustainable bovine production systems to improve adaptation to and mitigation of climate change, increase production, and decrease environmental impact and production costs.\n\ng) Develop strategic alliances with livestock organizations, academia and national and international institutions, and international technical and scientific organizations.\n\nh) Coordinate and collaborate for the training, dissemination, and transfer of technology generated and validated in Dry Tropics livestock activities.\n\ni) Any other duties assigned by the respective superior.\n\n1.3.- La Managua Experimental Center Unit. The functions of the La Managua Experimental Center Unit are as follows:\n\na) In coordination with the Enrique Jiménez Núñez Agricultural Innovation Center Department, generate and validate technology in tropical crops and livestock activities for the transition zone from dry to humid tropics and for the humid tropics in the area of influence of this Experimental Center.\n\nb) In coordination with the Enrique Jiménez Núñez Agricultural Innovation Center, coordinate and collaborate with the transfer of technology developed by INTA.\n\nc) In coordination with the Enrique Jiménez Núñez Agricultural Innovation Center, generate technologies for adaptation to and mitigation of climate change for the productive activities carried out in the area of influence of this Experimental Center.\n\nd) Coordinate with the Los Diamantes Agricultural Innovation Center on matters pertaining to typical Humid Tropics activities.\n\ne) Promote the creation and maintenance of germplasm banks and plant genetic resources (recursos fitogenéticos) of tropical crops of interest to the area.\n\nf) Any other duties assigned by the respective superior.\n\n2. Central Agricultural Innovation Center Department. The Central Agricultural Innovation Center Department is responsible for generating, innovating, and providing technologies that enable the agricultural and livestock production systems of the Central Region to increase their competitiveness and sustainability. Additionally, to coordinate and channel the execution of research and innovations that address the technological demands of the designated sectors. The Department's functions are as follows:\n\na) Identify and prioritize the needs for agricultural technology research and innovation at the local, regional, and national levels for the categories of vegetables, high-altitude fruits, livestock activities of the Central region, and other agricultural activities of the region.\n\nb) Formulate and execute research and innovation projects in its areas of competence, using the scientific method, to achieve the proposed objectives and goals for the benefit of producers.\n\nc) Validate the technology generated from projects within its competence, allowing for an assessment of its technical-economic relevance and improving the effectiveness of its adoption by users.\n\nd) Actively participate in INTA's strategic and operational planning processes and activities.\n\ne) Coordinate and collaborate with Technology Transfer and the dissemination of technological options generated by INTA.\n\nf) Develop links with the National System for Agricultural Technology Research and Transfer, the information services of the Agricultural Sector, the National Directorate of Agricultural Extension, and other entities dedicated to science and technology in the Agricultural Sector and at the national and international scientific level.\n\ng) Formulate the consolidated Annual Operating Plan (PAO) / Budget and Procurement Plan.\n\nh) Prepare annual, semi-annual, and technical reports.\n\ni) Coordinate meetings and work sessions with the technical groups comprising each unit under its supervision and other units for the development of research and innovation projects.\n\nj) Disseminate INTA's work nationally and internationally through technical publications.\n\nk) Any other duties assigned by the Directorate of Research and Technological Development.\n\nThis Department is composed of the following Units:\n\n2.1.- Central Livestock Unit. The functions of the Central Livestock Unit are as follows:\n\na) Contribute to the efficiency and competitiveness of milk and minor species production systems through appropriate management and conservation of forage species, animal nutrition and health, genetics, records, cost reduction, and the utilization of local and national agro-industrial products and by-products.\n\nb) Develop technological options to rationalize and improve animal nutrition efficiency through appropriate management and conservation of forage species, supplementation, agro-industrial waste, and quality conservation practices thereof.\n\nc) Develop technological options that contribute to the sustainability of production systems and mitigate climate change.\n\nd) Evaluate, jointly with the sectors, the herds to identify and select the best productive genetics adapted to climate change.\n\ne) Develop and execute projects for breed improvement using national and imported genetic resources to promote productivity, quality, and adaptation to climate change.\n\nf) Evaluate bioeconomic models in sustainable bovine production systems to improve adaptation to and mitigation of climate change, increase production, and decrease environmental impact and production costs.\n\ng) Develop strategic alliances with livestock organizations, academia and national and international institutions, and international technical and scientific organizations.\n\nh) Coordinate and collaborate for the training, dissemination, and transfer of technology generated and validated in dairy farming and minor species.\n\ni) Any other duties assigned by the respective superior.\n\n2.2- Central Agricultural Unit. The functions of the Central Agricultural Unit are as follows:\n\na) Identify limitations and offer technological solutions identified in the different links of the agri-food chain, including consumer demands and tastes.\n\nb) Generate technology that increases the yield of vegetable crops, high-altitude fruits, and other strategic crops in the region, incorporating environmentally friendly practices that allow for the production of safe products that respond to consumer demands.\n\nc) Introduce, evaluate, and select superior germplasm with excellent agronomic characteristics, tolerant to pests and diseases, and adapted to climate change.\n\nd) Develop technology for efficient production in protected environments to provide a constant and quality supply throughout the year.\n\ne) Generate technology with good agricultural practices in mineral and organic nutrition, irrigation, fertigation, agronomic management, postharvest, integrated pest and disease management, for sustainable production for the benefit of the producer and consumer.\n\nf) Develop strategic alliances with producer organizations, academia, private enterprise, research and technology transfer programs, and international scientific organizations.\n\ng) Generate technology incorporating socioeconomic analysis for crops.\n\nh) Coordinate and collaborate with other actors in the agricultural sector, cooperatives, associations, and the National Directorate of Agricultural Extension of the MAG for technology transfer, dissemination, and training on technology generated and validated in vegetables.\n\ni) Any other duties assigned by the respective superior.\n\n2.3- Carlos Durán Experimental Center Unit. The functions of the Carlos Durán Experimental Center Unit are as follows:\n\na) Evaluate and select new potato materials and varieties for fresh consumption and industry, originating from international research centers.\n\nb) Develop technology for integrated potato crop management.\n\nc) Validate selected potato materials in the main production areas.\n\nd) Produce pre-basic and basic potato seed to meet the demand of seed producers under a quality seed scheme.\n\ne) Increase the production of in vitro seed of other crops under a specific demand scheme, specifically from the Carlos Durán Tissue Culture Laboratory.\n\nf) In coordination with the Central Agricultural Innovation Center Department, generate technologies for adaptation to and mitigation of climate change.\n\ng) Coordinate and collaborate on research and technology transfer actions with other actors in the agricultural sector, cooperatives, associations, and the National Directorate of Agricultural Extension of the MAG.\n\nh) Any other duties assigned by the respective superior.\n\n3.- Los Diamantes Agricultural Innovation Center Department. The Los Diamantes Agricultural Innovation Center Department has the objective of generating, innovating, and providing technologies that enable the production systems of the Humid Tropics to increase their competitiveness and sustainability. Additionally, to coordinate and channel the execution of research and innovations that address the technological demands of the designated sectors. The department's functions are:\n\na) Identify and prioritize the needs for agricultural technology research and innovation at the local, regional, and national levels for agricultural and livestock activities of the humid tropics and other agricultural activities of the region.\n\nb) Formulate and execute research and innovation projects, using the scientific method in its area of competence, achieving the proposed objectives and goals for the benefit of producers.\n\nc) Validate the technology generated from projects within its competence, allowing for an assessment of its technical-economic relevance and improving the effectiveness of its adoption by users.\n\nd) Advise on specific complementary areas of agricultural research, such as crop protection, genetic improvement, agronomy, biostatistics, socioeconomics, and other related areas.\n\ne) Actively participate in INTA's strategic and operational planning processes and activities.\n\nf) Coordinate and collaborate with Technology Transfer and the dissemination of technological options generated by INTA.\n\ng) Develop links with the National System for Agricultural Technology Research and Transfer, the information services of the Agricultural Sector, the National Directorate of Agricultural Extension, and other entities dedicated to science and technology in the Agricultural Sector and at the national and international scientific level.\n\nh) Formulate the consolidated Annual Operating Plan (PAO) / Budget and Procurement Plan.\n\ni) Prepare annual, semi-annual, and technical reports.\n\nj) Coordinate meetings and work sessions with the technical groups comprising each unit under its supervision and other units for the development of research and innovation projects.\n\nk) Disseminate INTA's work nationally and internationally through technical publications.\n\nl) Coordinate the research and reproduction activities of the Los Diamantes Tissue Culture Laboratory.\n\nm) Any other duties assigned by the Directorate of Research and Technological Development.\n\nThis Department is composed of the following Units:\n\n3.1.- Humid Tropics Livestock Unit. The functions of the Humid Tropics Livestock Unit are as follows:\n\na) Contribute to the efficiency and competitiveness of humid tropics systems through appropriate management and conservation of forage species, animal nutrition and health, genetics, records, cost reduction, and the utilization of local and national agro-industrial products and by-products.\n\nb) Develop technological options to rationalize and improve animal nutrition efficiency through appropriate management and conservation of forage species, supplementation, agro-industrial waste, and quality conservation practices thereof.\n\nc) Develop technological options that contribute to the sustainability of production systems and mitigate climate change.\n\nd) Evaluate, jointly with the sectors, the herds to identify and select the best productive genetics adapted to climate change.\n\ne) Develop and execute projects for breed improvement using national and imported genetic resources to promote productivity, quality, and adaptation to climate change.\n\nf) Evaluate bioeconomic models in sustainable bovine production systems to improve adaptation to and mitigation of climate change, increase production, and decrease environmental impact and production costs.\n\ng) Develop strategic alliances with livestock organizations, academia and national and international institutions, and international technical and scientific organizations.\n\nh) Coordinate and collaborate for the training, dissemination, and transfer of technology generated and validated in Humid Tropics Livestock.\n\ni) Any other duties assigned by the respective superior.\n\n3.2.- Humid Tropics Agricultural Unit. The functions of the Humid Tropics Agricultural Unit are as follows:\n\na) Respond to the technological demand requested in the agri-food chains of the Humid Tropics region of Costa Rica.\n\nb) Select cultivars with pest resistance, high productivity, acceptance by consumers and industry, and adapted to climate change.\n\nc) Generate and use specialized methods for multiplying planting material through cuttings, layering, suckers, stolons, grafts, and tissue culture, among others, due to the high variability shown by fruit species.\n\nd) Develop technology related to organic and mineral nutrition and promote management practices friendly to the agricultural ecosystem.\n\ne) Produce and promote the use of clean seed free of pathogens and with high vigor, in order to achieve increases in productivity.\n\nf) Develop and promote value-added products to energize the national and export markets.\n\ng) Incorporate good management and traceability practices so that the fruits are safe from both pesticides and pathogenic microorganisms for humans.\n\nh) Develop appropriate harvesting and postharvest management methods so that the majority of perishable fruits can maintain and prolong their shelf life.\n\ni) Develop technology to add value to the majority of tropical fruit species to energize markets and benefit producers.\n\nj) Carry out research on irrigation methods, fertigation, equipment, and materials to increase production and adapt to climate change.\n\nk) Evaluate mineral and organic nutrition, canopy management in the case of tree species, and integrated pest and disease management for sustainable production appropriate to producer systems.\n\nl) Develop strategic alliances with producer organizations, academia, private enterprise, research and technology transfer programs, and international scientific organizations.\n\nm) Generate technology incorporating socioeconomic analysis for crops.\n\nn) Coordinate and collaborate with other actors in the agricultural sector, cooperatives, associations, and the National Directorate of Agricultural Extension of the MAG for technology transfer, dissemination, and training on technology generated and validated in vegetables.\n\no) Any other duties assigned by the respective superior.\n\n4.- Laboratories Department. The Laboratories Department is responsible for the implementation of methodologies, sample analysis, issuance of diagnostics, in vitro multiplication of germplasm, and execution of specific studies that complement the lines of research, innovation, and validation of the Directorate of Research and Technological Development; therefore, it shall have multidisciplinary personnel, professionals, and technicians trained in the different fields of action to ensure its competence.\n\nThe Department shall be composed of laboratory areas that allow it to execute the following functions:\n\na) Develop procedures and implement methodologies for analysis and diagnostics in plant protection, animal nutrition, soil, plant, and water chemistry and physics, chemical and microbiological characteristics of agricultural inputs and organic fertilizers, among others required by the institution that provide scientific support for research.\n\nb) Support marker-assisted genetic improvement.\n\nc) Develop and implement mass reproduction techniques for germplasm of interest.\n\nd) Support the development and execution of research proposals according to institutional guidelines.\n\ne) Develop and update the Department's technical and administrative procedures and activities.\n\nf) Provide services to users in its area of competence according to the rates authorized by the Board of Directors.\n\ng) Coordinate with the Technology Transfer Department the training of staff and users in matters of its competence.\n\nh) Coordinate with other internal or external departments to execute special activities required in the agricultural sector, in accordance with the Department's competencies and capabilities.\n\ni) Perform other duties assigned by the hierarchical superior.\n\n5.-\nDepartment of Basic Land Studies (Departamento de Estudios Básicos de Tierras). Based on the provisions of Article 20 of Law No. 8149, this Department will assist in conducting studies related to the compliant use of land, agroecological classification and zoning of crops, as well as land-use planning (planificación y ordenamiento territorial), participating in the development and execution of national plans for soil management, conservation, and recovery, as established by the Law for the Use, Management and Conservation of Soils No. 7779 and its Regulations. It will also collaborate with the Directorate of Research and Technological Development (Dirección de Investigación y Desarrollo Tecnológico) on research and innovations developed. This department is responsible for: a) Conducting research and studies related to what is authorized in Articles 6, subsections a), b), and c), 27, 49, and 66 of Law No. 7779, articles 2, 6, 34, 35, 36, 37, 38, 39, 40, 59, 131, 132, 133, and 135 of Executive Decree No. 29375-MAG-MINAE-S H-MOPT, and articles 1, 2, 3, 7, 8, 9, 10, 11, and 12 of Executive Decree No. 30636-MAG, regarding compliant land use and the issuance of technical criteria for authorizations and permits.\n\nb) Selling services to users in its area of competence according to the rates authorized by the Board of Directors (Junta Directiva).\n\nc) Conducting semi-detailed soil surveys and land-use capability assessments (capacidad de uso de las tierras) of the country's agroecological lands, as well as the agroecological zoning of crops, within the framework of land-use planning (planificación y ordenamiento territorial), supporting the execution of National Plans for soil management, conservation, and recovery.\n\nd) Collaborating with the INTA's Directorate of Research and Technological Development (Dirección de Investigación y Desarrollo Tecnológico) on the research and innovations that are developed.\n\ne) Requesting, centralizing, and channeling resource requests within the INTA.\n\nf) Maintaining updated databases available to users regarding soils, lands, and waters, corresponding to the information generated by the INTA.\n\ng) Participating in agricultural zoning studies at the national, regional, or local level to help guide production efficiently.\n\nh) Keeping the geographic information system updated to facilitate land-use planning (ordenamiento territorial) in the medium and long term.\n\ni) Any other function assigned by the Directorate's Leadership.\n\n(As amended by Article 1 of Executive Decree No. 44773 of October 30, 2024)\n\nArticle 36.—Project and Resource Management Directorate (Dirección de Gestión de Proyectos y Recursos). (Repealed by Article 2 of Executive Decree No. 42683 of October 20, 2020)\n\nArticle 37.— Administrative-Financial Directorate (Dirección Administrativa-Financiera). (Repealed by Article 50 (current Article 53) of the Organic Regulations of the Ministry of Agriculture and Livestock, approved by Executive Decree No. 45282 of September 5, 2025)\n\nCHAPTER V\n\nIntellectual Property Rights\n\nArticle 38.—Any technological innovation resulting from INTA's research initiative shall be registered by the Institute in the corresponding Registries, in accordance with the nature of the innovation and current regulations.\n\nArticle 39.—The Institute must register in the corresponding Registries the trademarks, signs, maps, intellectual property information such as texts, audiovisuals, dissemination material, and any new intellectual development resulting from its own initiative.\n\nArticle 40.—The INTA must protect the industrial property rights of those innovations obtained from its own management or initiative, in lines of research such as: industrial design, machinery, equipment, software, analytical methods, and others.\n\nArticle 41.—In the event that the INTA is contracted to develop plant varieties, the application and definition of plant breeders' rights (derechos de obtentor) must be expressly contemplated and established, and must be incorporated into the Service Sales Contract (Contrato de Venta de Servicios) additionally, the terms and scope of the INTA's participation in the commercial exploitation of the new plant variety generated.\n\nArticle 42.—For those plant varieties developed by the INTA as a result of its own management, the Institute must register them in the Registry of Protected Varieties (Registro de Variedades Protegidas) kept by the National Seed Office -ONS-, in accordance with the Seed Law No. 6289 and the corresponding regulations on the protection of plant varieties (protección de obtenciones vegetales).\n\nArticle 43.—In the case of animal germplasm developed by the INTA as a result of its own management, the Institute shall proceed with its registration in the respective Registries.\n\nCHAPTER VI\n\nGeneral Powers and Provisions\n\nAdministration and Generation of Resources\n\nArticle 44.—Under the provisions of Article 15 of Law No. 8149, the financial and accounting administration of the Trust (Fideicomiso) may be contracted with one of the state banks of the National Banking System, without prejudice to the control exercised by the Institute's Internal Audit or the Comptroller General of the Republic (Contraloría General de la República). Likewise, the INTA may administer the internal and external credits granted to achieve its objective, provided that the Executive Branch authorizes it.\n\nArticle 45.—For the financing and execution of the functions derived from the application of the Law and others related to the INTA's actions, the Institute shall have the resources of its assets, as provided in Article 3 of Law No. 8149, in accordance with the budgets approved internally by the Board of Directors (Junta Directiva) and externally by the Comptroller General of the Republic (Contraloría General de la República).\n\nProhibitions\n\nArticle 46.—It is forbidden for the members of the Board of Directors (Junta Directiva) and all other officials and their relatives up to the third degree of consanguinity or affinity inclusive, as well as companies of any type in which they have participation or interest, to enter into any kind of contracts with the Institute. The proven violation of the provisions of this article shall be sanctioned with the immediate dismissal of the offender, without prejudice to the criminal and civil liabilities that may apply, and shall imply the absolute nullity of the acts executed between the latter and the Institute.\n\nContributions\n\nArticle 47.—In accordance with the provisions of Law No. 8149, contributions, donations, and economic contributions made by any natural or legal person to the Institute, as well as the purchase of equipment, vehicles, machinery, and supplies necessary for research, shall be exempt from the payment of all types of stamps and income, sales, and transfer taxes.\n\nCHAPTER VII\n\nRepeals and Modifications\n\nArticle 48.—Repeal Article 36 and modify Articles 33 and 34 of Executive Decree No. 26431-MAG of October 2, 1997, published in La Gaceta No. 213 of November 5, 1997, which shall read as follows:\n\n\"Article 33.—The Regional Directorates (Direcciones Regionales)\n\nThe Regional Directorates shall have the following functions:\n\n1. Plan, budget, execute, monitor, and evaluate the programs of the Ministry of Agriculture and Livestock that serve and support farmers and their organizations based on participatory diagnostics in the different regions of the country.\n\n2. Promote at the regional level agricultural development through agricultural extension (extensión) and protection, under the principles of sustainability, competitiveness, and equity.\n\n3. Facilitate other production support services.\n\n4. Contribute to the functioning of the Sectoral Technical Agricultural Committee (Comité Técnico Sectorial Agropecuario) and enable the comprehensive provision of services to producers.\n\n5. Coordinate with higher instances of the Ministry the application of policies, plans, projects, and guidelines regarding extension (extensión), animal health, and Plant Protection Services (Servicios de Protección Fitosanitaria).\n\n6. Represent the MAG in all activities related to its region.\n\n7. Strengthen the integration processes of the extension (extensión), animal health, and Directorate of Plant Protection Services (Dirección de Servicios de Protección Fitosanitaria) services in order to achieve better attention to farmers by the institution.\n\n8. Ensure an immediate response in cases of agricultural health emergencies and respond to the guidelines of the Plant Protection and Animal Health Law.\n\n9. Ensure that the provision of agricultural services is carried out through the Basic Agricultural Centers (Centros Agrícolas Básicos, CAB) as co-management instruments for service provision, through the application of participatory and dialogic methodologies. In turn, promote the CAB at the sectoral level, so that the institutions of the Agricultural Sector, at the regional level, progressively adopt this modality of service provision.\n\n10. Any other function assigned by higher authorities, laws, and decrees.\"\n\n\"Article 34.—The Regional Directorates shall have the following teams:\n\n—Agricultural Extension Team (Equipo de Extensión Agropecuaria)\n\n—Plant Protection Services Team (Equipo de Servicios de Protección Fitosanitaria)\n\n—Animal Health Team (Equipo de Salud Animal)\n\n—Agricultural Service Agencies (Agencias de Servicios Agropecuarios).\"\n\nArticle 49.—The functions and competencies established in Executive Decree No. 26431-MAG of October 2, 1997, published in La Gaceta No. 213 of November 5, 1997, articles 12, 13, 14, 15, and 16 for the National Directorate of Agricultural Research (Dirección Nacional de Investigaciones Agropecuarias) of the Ministry of Agriculture and Livestock, shall be executed and correspond to the National Institute of Innovation and Transfer in Agricultural Technology -INTA-, including within these those corresponding to the administration and operation of the Experimental Stations and Fields.\n\nArticle 50.—Modify Article 3 of Executive Decree No. 26431-MAG of October 2, 1997, published in La Gaceta No. 213 of November 5, 1997, regarding the \"Agricultural Coordination (Coordinación Agropecuaria)\", so that it reads as follows:\n\n\"…\n\n- Agricultural Coordination (Coordinación Agropecuaria)\n\nThe Agricultural Coordination shall have the following functions:\n\n1. Promote and coordinate extension (extensión) and development processes aimed at causing progressive and permanent changes in attitude in small producers, their families, and organizations, oriented towards solving their production and environmental problems, according to their agroecological and socioeconomic conditions and production systems, leading to a continuous improvement in the standard of living of the rural and urban population, in balance with the environment.\n\n2. Coordinate actions to maintain and improve plant and animal health protection services (protección fito y zoosanitaria), for which it will exercise control and oversight of products and inputs for agricultural use, in order to preserve production and public health.\n\n3. Support the Rector Minister of the Agricultural Sector in the execution of policies and guidelines issued for the sector's development, promoting increased levels of competitiveness and sustainability in agricultural activities.\n\n4. Advise ministerial authorities in decision-making aimed at the technical strengthening and operational integration of the Institution, to achieve higher levels of efficiency and better respond to the demands of small and medium-sized producers, under a gender approach, especially in matters relating to agricultural protection and extension (extensión).\n\n5. Coordinate with national and international organizations the management of technical information in the field of agricultural extension (extensión) and protection.\n\n6. Promote the planning, coordination, monitoring, and evaluation of the actions of the corresponding Directorates, in order to maximize the use of resources and achieve greater impact on the development of the agricultural sector.\n\n7. Define and execute rules and procedures for the supervision and establishment of mechanisms for organizing the primary information generated in protection, extension (extensión), special studies, and agricultural consultancies.\n\n8. Coordinate the protection of the national agricultural heritage, through strict control and compliance with the laws established for that purpose.\n\n9. Propose and generate policies, legal instruments, and administrative rules to guide and regulate the activities of the extension (extensión) and agricultural protection service.\n\n10. Coordinate, guide, monitor, and evaluate all actions and projects executed at the regional or national level in the agricultural area.\n\n11. Ensure that the Institution's policies respond to the guidelines and policies of the National System of Research and Technology Transfer (SNITTA).\n\n12. Facilitate rural development processes in accordance with the guidelines of the Ministerial Office.\n\n13. Contribute to the promotion and development of non-formal and formal training and education processes aimed at causing changes in productive behavior and in the attitudes of small producers, in their families and organizations, oriented towards productive efficiency, self-management capacity, and strengthening of organizational capacities.\n\n14. Promote and advise on methods, techniques, and instruments that integrate the work of the different instances at the regional level.\n\n15. Any other function assigned by higher authorities, laws, and regulations.\"\n\nArticle 51.—For all formal, operational, and administrative purposes, the National Directorate of Agricultural Research (Dirección Nacional de Investigaciones Agropecuarias) is removed from the organic structure of the Ministry of Agriculture and Livestock.\n\nArticle 52.—The National Institute of Innovation and Transfer in Agricultural Technology shall be responsible for the collection, administration, and management of resources derived from the provision of services by its different instances, in fulfillment of its functions and competencies, as well as the administration and use of movable and immovable property, equipment, and infrastructure in general that, in compliance with Law No. 8149, are transferred and made available to it by administrative resolution by the Ministry of Agriculture and Livestock.\n\nArticle 53.—Effective upon publication.\n\nGiven at the Presidency of the Republic.—San José, on the nineteenth day of May, two thousand four." }
