y\n\n    Considerando que los estudios de los atunes aleta\namarilla y patudo presentados en la presente reunión demuestran que ambas poblaciones\nestán por debajo de un nivel que produciría el rendimiento máximo sostenible promedio\n(RMSP).\n\n    Reconociendo la importancia de instar a la Comisión\nde Pesquerías del Pacífico Occidental y Central la adopción de medidas apropiadas de\nconservación para las poblaciones de atún en esa región;\n\n    Resuelve lo siguiente:\n\n 1. Que esta resolución es aplicable en 2004, 2005 y 2006 a\n buques de cerco pescando atunes aleta amarilla, patudo, y barrilete, y a buques\n palangreros.\n 2. Los buques cañeros y de pesca deportiva no quedan\n sujetos a esta resolución.\n 3. Que se vedará para 2004, 2005 y 2006 la pesca por buques\n atuneros cerqueros en el OPO, definido como la zona comprendida entre el litoral del\n continente americano y el meridiano de 150°O desde el paralelo de 40°N hasta el paralelo\n de 40°S, bien (1) a partir de las 0000 horas del 1 º de agosto hasta\n las 2400 horas del 11 de setiembre; o (2) a partir de las 0000 horas del 20 de noviembre\n hasta las 2400 horas del 31 de diciembre.\n 4. Cada Parte de la CIAT, parte no contratante cooperante,\n entidad pesquera u organización regional de integración económica (colectivamente\n \"CPC\") elegirá, para cada año, cuál de los dos períodos especificados será\n vedado a la pesca de cerco por todos sus buques, y notificará al Director de su decisión\n antes del 15 de julio. Todos los buques de una flota nacional deberán cesar la pesca de\n cerco durante el período elegido.\n 5. Cada buque que pesque durante 2004, 2005 y 2006,\n independientemente del pabellón bajo el cual opere o de si cambie de pabellón durante el\n año, debe acatar el período de veda al cual fue comprometido el 15 de julio de cada\n año.\n 6. Prohibir descargas, transbordos y transacciones\n comerciales de atún o productos derivados que hayan sido identificados positivamente como\n provenientes de actividades de pesca que contravengan esta resolución. El Director podrá\n proporcionar información pertinente a las Partes para apoyarles en este respecto. La\n Comisión desarrollará criterios y procedimientos transparentes y no discriminatorios\n para adoptar medidas comerciales restrictivas compatibles con el derecho internacional y\n las disposiciones de la Organización Mundial del Comercio para promover el cumplimiento\n en el OPO.\n 7. Cada CPC, para las pesquerías de cerco:\n\n 7.1. A más tardar 45 días antes de la fecha de entrada en\n vigor de una veda:\n 7.1.1. tomará las medidas jurídicas y administrativas\n necesarias para instrumentar la veda;\n 7.1.2. informará a todos los interesados de su industria\n atunera nacional de la veda;\n 7.1.3. informará al Director de que se han tomado estos\n pasos.\n 7.2 En el caso de las vedas de 2004, 2005 y 2006, asegurará\n que en el momento de iniciar la veda, y durante toda la duración de la misma, todos los\n buques atuneros cerqueros que pesquen atunes aleta amarilla, patudo, y barrilete y que\n enarbolen su pabellón en el OPO estén en puerto, excepto que buques que lleven un\n observador del Programa de Observadores a Bordo del APICD podrán permanecer en el mar,\n siempre que no pesquen. La única otra excepción a esta disposición será que buques que\n lleven un observador del Programa de Observadores a Bordo del APICD podrán salir de\n puerto durante la veda, siempre que no pesquen.\n\n 8. China, Japón, Corea y Taipei Chino tomarán las medidas necesarias para asegurar que\n su captura palangrera anual total de atún patudo en el OPO durante 2004, 2005 y 2006 no\n supere los niveles de captura siguientes:\n\n| China | 2.639 toneladas métricas |\n| --- | --- |\n| Japón | 34.076 toneladas métricas |\n| Corea | 12.576 toneladas métricas |\n| Taipe Chino | 7.953 toneladas métricas |\n\n Otras CPC tomarán las medidas necesarias para asegurar que\n su captura palangrera anual total de atún patudo en el OPO durante 2004, 2005 y 2006 no\n supere los niveles de captura respectivos de 2001. Cada CPC con LSTLV proveerá informes\n mensuales de captura al Director.\n 9. El Grupo de Trabajo Científico de la CIAT analizará, en\n 2005 y\n 2006, el efecto de estas medidas sobre las poblaciones, y\n propondrá, en caso necesario, medidas adecuadas a la Comisión en 2005 y 2006 para su\n consideración.\n 10. Toda CPC cumplirá con la presente resolución.\n 11. La presente resolución reemplaza la Resolución C-03-12\n         Por tanto, se\n acuerda:\n\n 1. Otorgar licencias de pesca de atún con red de cerco\n durante los periodos (1) a partir de las 00.00 horas del 1° de agosto\n hasta las 24.00 horas del 11 de setiembre; o (2) a partir de las 00.00 horas del 20 de\n noviembre hasta las 24.00 horas del 31 de diciembre. Lo anterior en base a las listas\n oficiales de barcos que enviará la CIAT para cada periodo, como barcos autorizados a\n pescar.\n 2. Aquellas embarcaciones que cuenten con licencia nacional\n de pesca con red de cerco vigente en un periodo en el que no están autorizados a pescar\n según la información oficial de la CIAT, les queda prohibido la realización de\n actividades en las aguas patrimoniales de Costa Rica en dicho periodo.\n 3. Las plantas procesadoras de atún establecidas en Costa\n Rica, para realizar un desembarque de atún durante alguno de los periodos de la veda,\n quedan obligados a solicitar una autorización previa a la autoridad nacional del\n INCOPESCA ante la CIAT. La autoridad nacional vía correo electrónico, a la mayor\n brevedad posible, enviará la solicitud al Director de la CIAT en la cual se anotará el\n nombre del barco atunero, bandera, tonelaje de atún que se estima descargar y fecha\n aproximada para la descarga, a fin de verificar que el atún en cuestión fue capturado\n sin violar la veda. En caso de que el Director de la Secretaría de la CIAT comunique que\n el embarque consultado no cumple con la veda o existen dudas fundamentales sobre el\n cumplimento, la autoridad nacional comunicará a la industria atunera y a la Agencia de\n Vapores representantes del barco, la negativa de desembarcar el atún en territorio\n costarricense y la denegatoria también de que se realice ninguna operación de trasbordo\n en aguas patrimoniales costarricenses. Se insta a la autoridad nacional y a la Secretaría\n de la CIAT a evacuar a la mayor brevedad posible, las consultas sobre la verificación del\n cumplimiento con la veda, a fin de no dificultar en tiempo las operaciones de las\n industrias atuneras costarricenses.\n 4. La comunicación interna, de la Autoridad Nacional debe\n realizarse vía facsímile.\n 5. Publíquese.\n\n    Puntarenas, 13 de julio del 2004.", "body_en_text": "...in the entirety of the text\n\n -\n\n Complete Text of Regulation 323\n\n Literally adopts resolution C-04-09, issued by the IATTC regarding\nthe tuna closure in the Eastern Pacific Ocean (EPO).\n\nComplete Text of minutes: 75C5C\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\n    AJDIP/323-2004.—Puntarenas, on the ninth\nday of the month of July of the year two thousand four.\n\nConsidering:\n\n     1º—That through\n agreement AJDIP/224-2004, this Board of Directors issued regulations for the closure of fishing\n by tuna fishing vessels in the Eastern Pacific Ocean (EPO), taking into\n consideration resolution C-03-12 on the Conservation of Tuna in the Eastern\n Pacific Ocean, adopted by the IATTC at its 71st Meeting, held in\n Guatemala from 24 to 27 June 2003.\n     2º—That at the 72nd\n meeting of the IATTC, held in Peru, from 14 to 19 June of this year,\n the regulations regarding the tuna closure were modified, making it necessary\n to adjust internal regulations and therefore to modify agreement\n 224-2004 accordingly.\n     Therefore, it is agreed:\n\n    Article 1º—To adopt in\nliteral form resolution C-04-09, issued by the IATTC, at its 72nd meeting,\nheld from 14 to 19 June of this year, in Peru, regarding the tuna closure in\nthe EPO, which shall read as follows:\n\n     \"Based on resolution\n C-04-09 regarding a multi-year program on the Conservation of tunas in the Eastern\n Pacific Ocean for 2004, 2005, and 2006.\n The Inter-American Tropical Tuna Commission (IATTC):\n     Recognizes, based on previous\n experience in these fisheries, that the potential production of the resource may be reduced\n if fishing effort is excessive: bearing in mind that the Resolution on the\n conservation of yellowfin and bigeye tunas in the Eastern Pacific Ocean approved\n by the IATTC at its 69th meeting in Manzanillo (Mexico), encourages states and fishing\n entities with large-scale tuna longline vessels (LSTLV) to undertake initiatives\n similar to that of Japan, that is, a 20% reduction of its fleet, in accordance with\n the FAO International Plan of Action, Aware with serious concern that,\n despite the aforementioned Resolution, the catch of bigeye by LSTLVs and their fishing\n capacity continue to grow in the Eastern Pacific Ocean (EPO),\n\n    Taking into account the best scientific information\navailable, reflected in the staff recommendations and in the report of the meeting\nof the Working Group on Stock Assessment in May 2004; and\n\n    Considering that the studies of yellowfin and bigeye\ntunas presented at this meeting demonstrate that both stocks\nare below a level that would produce the average maximum sustainable yield\n(MSY).\n\n    Recognizing the importance of urging the Western and\nCentral Pacific Fisheries Commission to adopt appropriate conservation\nmeasures for tuna stocks in that region;\n\n    Resolves as follows:\n\n 1. That this resolution is applicable in 2004, 2005, and 2006 to\n purse-seine vessels fishing for yellowfin, bigeye, and skipjack tunas, and to\n longline vessels.\n 2. Baitboat and sport-fishing vessels are not\n subject to this resolution.\n 3. That fishing by purse-seine tuna vessels in the EPO, defined as the area between the coastline of\n the American continent and the meridian of 150°W from the parallel of 40°N to the parallel\n of 40°S, shall be closed for 2004, 2005, and 2006, either (1) from 0000 hours on 1 August to\n 2400 hours on 11 September; or (2) from 0000 hours on 20 November\n to 2400 hours on 31 December.\n 4. Each Party to the IATTC, cooperating non-contracting party,\n fishing entity, or regional economic integration organization (collectively\n \"CPC\") shall choose, for each year, which of the two specified periods shall be\n closed to purse-seine fishing for all its vessels, and shall notify the Director of its decision\n before 15 July. All vessels of a national fleet shall cease purse-seine\n fishing during the chosen period.\n 5. Each vessel that fishes during 2004, 2005, and 2006,\n regardless of the flag under which it operates or whether it changes flag during the\n year, must observe the closure period to which it was committed on 15 July of each\n year.\n 6. To prohibit landings, transshipments (transbordos), and commercial transactions\n of tuna or tuna products that have been positively identified as\n originating from fishing activities that contravene this resolution. The Director may\n provide pertinent information to the Parties to support them in this regard. The\n Commission shall develop transparent and non-discriminatory criteria and procedures\n for adopting restrictive trade measures consistent with international law and\n the provisions of the World Trade Organization to promote compliance\n in the EPO.\n 7. Each CPC, for the purse-seine fisheries:\n\n 7.1. No later than 45 days before the date of entry into\n force of a closure:\n 7.1.1. shall take the necessary legal and administrative\n measures to implement the closure;\n 7.1.2. shall inform all interested parties in its national\n tuna industry of the closure;\n 7.1.3. shall inform the Director that these steps have\n been taken.\n 7.2 In the case of the closures of 2004, 2005, and 2006, shall ensure\n that at the commencement of the closure, and for its entire duration, all\n purse-seine tuna vessels fishing for yellowfin, bigeye, and skipjack tunas and\n flying its flag in the EPO are in port, except that vessels carrying\n an observer from the AIDCP On-Board Observer Program may remain at sea,\n provided they do not fish. The only other exception to this provision shall be that vessels\n carrying an observer from the AIDCP On-Board Observer Program may leave\n port during the closure, provided they do not fish.\n\n 8. China, Japan, Korea, and Chinese Taipei shall take the necessary measures to ensure that\n their total annual longline catch of bigeye tuna in the EPO during 2004, 2005, and 2006 does\n not exceed the following catch levels:\n\n| China | 2,639 metric tons |\n| --- | --- |\n| Japan | 34,076 metric tons |\n| Korea | 12,576 metric tons |\n| Chinese Taipei | 7,953 metric tons |\n\n Other CPCs shall take the necessary measures to ensure that\n their total annual longline catch of bigeye tuna in the EPO during 2004, 2005, and 2006 does\n not exceed their respective 2001 catch levels. Each CPC with LSTLVs shall provide\n monthly catch reports to the Director.\n 9. The IATTC Scientific Working Group shall analyze, in\n 2005 and\n 2006, the effect of these measures on the stocks, and\n shall propose, if necessary, appropriate measures to the Commission in 2005 and 2006 for its\n consideration.\n 10. Every CPC shall comply with this resolution.\n 11. This resolution replaces Resolution C-03-12.\n         Therefore, it\n is agreed:\n\n 1. To grant tuna fishing licenses with purse seine\n during the periods (1) from 00.00 hours on 1 August\n to 24.00 hours on 11 September; or (2) from 00.00 hours on 20\n November to 24.00 hours on 31 December. The foregoing based on the official\n lists of vessels that the IATTC shall send for each period, as vessels authorized to\n fish.\n 2. Those vessels that hold a valid national purse-seine fishing\n license in a period during which they are not authorized to fish\n according to the official IATTC information are prohibited from conducting\n activities in the patrimonial waters of Costa Rica during said period.\n 3. The tuna processing plants established in Costa\n Rica, in order to carry out a tuna landing during any of the closure periods,\n are obliged to request prior authorization from the national authority of\n INCOPESCA before the IATTC. The national authority, via electronic mail, as\n soon as possible, shall send the request to the IATTC Director, noting the\n name of the tuna vessel, flag, tonnage of tuna estimated to be landed, and\n approximate date for the landing, in order to verify that the tuna in question was caught\n without violating the closure. In the event that the Director of the IATTC Secretariat communicates that\n the consulted shipment does not comply with the closure or there are fundamental doubts regarding\n compliance, the national authority shall communicate to the tuna industry and to the\n Vessel Agencies representing the vessel, the denial of landing the tuna in Costa Rican\n territory and also the denial of conducting any transshipment (trasbordo) operation\n in Costa Rican patrimonial waters. The national authority and the\n IATTC Secretariat are urged to process, as soon as possible, the consultations on the verification of\n compliance with the closure, so as not to hinder the operations of the\n Costa Rican tuna industries in time.\n 4. Internal communication by the National Authority must\n be carried out via facsimile.\n 5.
