Cuando la\npresentación de la solicitud la hiciere un tercero, bastará con que la firma\ndel interesado se encuentre debidamente autenticada.\n\n \n\n Artículo 39.-Para solicitar la desconexión de un\nservicio es necesario que el abonado cumpla con los siguientes requisitos:\n\n \n\na) Llenar la fórmula de desconexión correspondiente.\n\nb) Comprobar que se encuentra al día en el pago de los\nservicios con la presentación del recibo o recibos respectivos.\n\nc) Cancelar por adelantado la factura correspondiente\nal período en curso.\n\nd) El formulario deberá ser firmado por la persona\ncuyo nombre aparece en el recibo o en su defecto por el dueño actual del inmueble,\nen cuyo caso deberá aportar certificación literal de propiedad expedida por el\nRegistro o por Notario Público.\n\ne) El gestionante deberá exhibir su cédula de\nidentidad y aportar su fotocopia por ambos lados.\n\n \n\nLa Empresa no tramitará solicitudes de desconexión de\nningún servicio de casas o locales habitados por inquilinos, sin que conste su expreso\nconsentimiento, de conformidad con lo dispuesto en el artículo 9º de la Ley\nGeneral de Agua Potable.\n\n \n\nArtículo 40.-Para solicitar el traspaso de un servicio\nel interesado deberá:\n\n \n\na) Llenar la fórmula de solicitud de traspaso,\nindicando número telefónico, fax o dirección para notificaciones.\n\nb) Exhibir la cédula de identidad y presentar la\nfotocopia respectiva, por ambos lados.\n\nc) Certificación literal y actualizada expedida por el\nRegistro de la Propiedad o por Notario Público, del inmueble de que se trata.\n\nd) Presentación del (los) comprobante (s) de pago de\nservicio o servicios de acueducto o alcantarillado de los meses anteriores a la\nfecha de la solicitud, en su caso, debidamente cancelados. En caso de no contar\ncon los comprobantes deberá acompañar nota explicatoria a satisfacción de la\nEmpresa dando cuenta del motivo de dicha omisión.\n\n \n\nArtículo 41.-En toda solicitud de certificación, el\ninteresado deberá presentar petición escrita en papel común tamaño oficio, con reintegro\nde ¢12,50 (doce colones cincuenta céntimos) en timbres fiscales, debidamente\nfirmada por el petente, especificando lo que desea que se le certifique. Además\ndeberá indicar el lugar en el cual está ubicada la propiedad a cuyo servicio se\nrefiere la certificación y sus datos de identificación.\n\n \n\nArtículo 42.-Para solicitar devoluciones de sumas por\npagos duplicados se requiere la presentación de ambos recibos originales cancelados\no, en su defecto, de una gestión suscrita por el interesado en la cual se\nexplique a satisfacción de la Empresa, las razones por las cuales no\n\nse pueden presentar estos recibos.\n\nDicha solicitud indicará: Número telefónico, fax o\ndirección para notificaciones en su caso, debiendo el interesado exhibir su\ncédula de identidad y aportar fotocopia del documento por ambos lados. Cuando\nla presentación de la solicitud la hiciere un tercero, bastará con que la firma\ndel interesado se encuentre debidamente autenticada.\n\n \n\nArtículo 70.-Para que la Empresa instale las acometidas\ny preste sus servicios deberá cancelarse de previo el costo de las obras\nrequeridas y depositarse la suma que en cada caso corresponda como valor\nestimado de los servicios durante el plazo solicitado y otro tanto más para\nprever extensiones del mismo. When the\nsubmission of the request is made by a third party, it will be sufficient for the signature\nof the interested party to be duly authenticated.\n\nArticle 39.-To request the disconnection of a\nservice, it is necessary for the subscriber (abonado) to meet the following requirements:\n\na) Complete the corresponding disconnection form.\n\nb) Prove that they are current in the payment of\nservices by presenting the respective receipt(s).\n\nc) Pay in advance the invoice corresponding\nto the current period.\n\nd) The form must be signed by the person\nwhose name appears on the receipt, or failing that, by the current owner of the property,\nin which case they must provide a literal certification of ownership issued by the\nRegistry (Registro) or by a Notary Public.\n\ne) The applicant must present their identity card (cédula de identidad)\nand provide a photocopy of it on both sides.\n\nThe Company (Empresa) will not process disconnection requests for\nany service for houses or premises inhabited by tenants, without their express\nconsent being recorded, in accordance with the provisions of Article 9 of the\nLey General de Agua Potable.\n\nArticle 40.-To request the transfer of a service,\nthe interested party must:\n\na) Complete the transfer request form,\nindicating a telephone number, fax, or address for notifications.\n\nb) Present their identity card (cédula de identidad) and submit the\nrespective photocopy, on both sides.\n\nc) A literal and updated certification issued by the\nProperty Registry (Registro de la Propiedad) or by a Notary Public, for the property in question.\n\nd) Presentation of the payment receipt(s) for the\naqueduct or sewerage service(s) for the months prior to the\nrequest date, as applicable, duly paid. In the event of not having\nthe receipts, they must attach an explanatory note, to the satisfaction of\nthe Company (Empresa), giving an account of the reason for said omission.\n\nArticle 41.-For any certification request, the\ninterested party must submit a written petition on plain letter-sized paper, with a affixed\n¢12.50 (twelve colones fifty céntimos) in fiscal stamps (timbres fiscales), duly\nsigned by the petitioner, specifying what they wish to be certified. In addition,\nthey must indicate the location of the property to whose service\nthe certification refers and their identification data.\n\nArticle 42.-To request refunds of sums for\nduplicate payments, the presentation of both canceled original receipts is required\nor, failing that, a request signed by the interested party in which they\nexplain, to the satisfaction of the Company (Empresa), the reasons why\n\nthese receipts cannot be presented.\n\nSaid request shall indicate: a telephone number, fax, or\naddress for notifications as applicable, and the interested party must present their\nidentity card (cédula de identidad) and provide a photocopy of the document on both sides. When\nthe submission of the request is made by a third party, it will be sufficient for the signature\nof the interested party to be duly authenticated.\n\nArticle 70.-For the Company (Empresa) to install the service connections (acometidas)\nand provide its services, the cost of the required works must be paid\nin advance, and the sum that in each case corresponds as the estimated\nvalue of the services during the requested period must be deposited, plus an equal amount to\nprovide for extensions of the same. In order to request a temporary service, the interested\nparty must:\n\na) Submit the corresponding written request,\nindicating a telephone number, fax, or address for notifications.\n\nb) Present their identity card (cédula de identidad) and submit the\nrespective photocopy, on both sides.\n\nc) A literal and updated certification issued by the\nProperty Registry (Registro de la Propiedad) or by a Notary Public, for the property in question.\n\nThe corresponding request must be submitted to\nthe New Services Section, also expressing: the type of service requested;\nthe place where the service is to be used, the duration of the activity, and the estimated\nnumber of users who will use the service.\n\nWhen dealing with services for civic festivals,\npublic spectacles, and other activities of this nature,\nthe authorizations and permits required from the competent\nauthorities must be attached.\n\nWhen the request comes from one of the\ncurrent clients of ESPH, they must prove they are current with\nthe payment of services and other obligations they have with the Company (Empresa)\nand authorize the cost of consumption exceeding the\ndeposit given as a guarantee to be included in their billing.\n\n2.-It becomes effective upon its publication in the\nOfficial Gazette La Gaceta.\n\n3.-Final agreement.\n\nHeredia, July 2004." }
