  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 465\n\n                        Emite Reglamento autónomo de servicio del Instituto Costarricense de\nAcueductos y Alcantarillados\n\nTexto Completo acta: 76C2A\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS\n\nACUERDO N° 2004-465\n\nREGLAMENTO AUTÓNOMO DE SERVICIO DEL INSTITUTO COSTARRICENSE DE\nACUEDUCTOS Y ALCANTARILLADOS\n\nResultando:\n\n1º—Que mediante acuerdo N° 2004-94-108, adoptado en la sesión\nextraordinaria N° 94-025 celebrada el 12 de abril de 1994, la Junta Directiva aprobó el\nReglamento Autónomo de Servicio del Instituto Costarricense de Acueductos y\nAlcantarillados, publicado en La Gaceta N° 127 del 5 de julio de 1994, el cual\ndesde ese momento ha sido objeto de una serie de observaciones y objeciones por parte de\nla Administración Superior, Direcciones de Áreas, Jefaturas Regionales, Organizaciones\nSindicales, así como entes externos.\n\n2º—A efectos de actualizar el Reglamento vigente mediante una\nreforma integral, la Dirección de Recursos Humanos y la Dirección Jurídica de AyA en\ncoordinación con la Administración Superior han propuesto un nuevo proyecto denominado\n\"Reglamento Autónomo de Trabajo\", en el cual se incorporan una serie de\naspectos de orden institucional y legal que buscan convertirlo en un mecanismo idóneo que\nregule de forma clara y objetiva los derechos y deberes propios de la relación de empleo\ncon el Instituto.\n\n3º—El Instituto dentro de su actuar no se encuentra exento de los\ncambios que impone la sociedad, y con ello de los cambios de orden legal y administrativo\nque intervienen de forma directa en el campo laboral, los que deben ser incorporados\ndentro de la normativa interna.\n\n4º—Que el texto propuesto se hizo del conocimiento de las\nAgrupaciones Sindicales, Direcciones de Área, Jefaturas Regionales, Auditoría Interna,\nentre otros departamentos, cuyos aportes y observaciones han sido incorporados al proyecto\ndel Reglamento, a fin de armonizar las distintas posiciones de acuerdo a lo establecido en\nel ordenamiento jurídico.\n\nConsiderando:\n\nI.—La Constitución Política en sus artículos 56 y siguientes\nestablece las garantías y principios que rigen los derechos de los trabajadores.\nConsecuentemente con lo anterior, deviene de primordial importancia la regulación interna\nque dicte la Institución en cumplimiento de los principios consagrados en la Carta Magna.\n\nII.—El Instituto Costarricense de Acueductos y Alcantarillados,\ncomo parte integral de sus funciones, debe promover y cumplir las normas, principios y\nderechos laborales fundamentales. Dado el proceso evolutivo por el que atraviesan las\nsociedades, así como los distintos cuerpos legales que las rigen, se estima necesario y\nconveniente realizar la actualización integral de las normas que conforman el actual\nReglamento Autónomo de Trabajo, a fin de que pueda convertirse en un mecanismo idóneo\npara asegurar la adaptación a todo cambio en la necesidad social que satisface y de esa\nforma cumplir su función, acorde con la realidad jurídico-social que la integra.\n\nIII.—Que la Ley Constitutiva de AyA otorga en su artículo 11.i la\npotestad a la Junta Directiva, para reformar los reglamentos internos necesarios para el\nmejor desarrollo de los fines del Instituto; siendo uno de ellos el regular de forma clara\nlas normas que regirán para todos los trabajadores de la Institución.\n\nIV.—Que consultada la Secretaría Técnica de la Autoridad\nPresupuestaria, se incorporan sus recomendaciones, emitidas en Oficio N° STAP-835-04 de\nfecha 02 de junio del 2004, para los efectos de la Ley de la Administración Financiera y\nPresupuestos Públicos.\n\nPor tanto,\n\nArtículo 1º—Se acuerda aprobar el Reglamento Autónomo de\nTrabajo del Instituto Costarricense de Acueductos y Alcantarillados, cuyo texto integral\ndirá:\n\nNOTA DE SINALEVI: Por tener un artículado propio, ver\nReglamento Autónomo de Servicio del Instituto Costarricense de Acueductos y\nAlcantarillados, en forma independiente en el sistema.  \n\nArtículo 2º-Se recomienda a la Presidencia Ejecutiva, informar a la Secretaría Técnica de la\nAutoridad Presupuestaria, que las recomendaciones hechas en el STAP-835-04 del 02/06/2004, fueron\naprobadas e incorporadas en su totalidad en el presente Reglamento, que será publicado en el Diario\nOficial La Gaceta.
