  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 31978\n\n                        Declara de interés público y nacional las actividades que realiza el\nPrograma Bandera Azul Ecológica.\n\nTexto Completo acta: 107522\nN° 31978-MEP-MINAE-S-TUR\n\nN°\n31978-MEP-MINAE-S-TUR\n\nEL PRESIDENTE DE LA REPÚBLICA,\n\nLA MINISTRA DE SALUD, EL MINISTRO DE AMBIENTE(*)\n\nY ENERGÍA, EL MINISTRO DE EDUCACIÓN PÚBLICA\n\nY EL MINISTRO DE TURISMO\n\n \n\n(*)(Modificada su denominación por el artículo 11 de\nla Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al\nMinisterio de Ciencia y Tecnología\", N° 9046 del 25 de junio de 2012)\n\n \n\n \n\nEn uso de las facultades que les confiere el artículo 140, incisos 3) y 18) de la\nConstitución Política, y\n\n \n\nConsiderando:\n\n \n\nI.-Que por Decreto Ejecutivo N° 25636-MINAE-S\ndel 31 de octubre de 1996, publicado en el Diario Oficial, el jueves 28 de\nnoviembre de 1996, se le dio fundamento legal al Programa Bandera Azul\nEcológica (PBAE) y mediante el Decreto Ejecutivo N° 27010-MINAE-S del 21 de\nabril de 1998, publicado el jueves 4 de junio de 1998, se modificó el Decreto\noriginal con el objetivo de introducir la gradación de las estrellas o\ncategorías \"A\", \"AA\" y \"AAA\", en el incentivo Bandera Azul Ecológica, los\ncuales fueron derogados por el decreto ejecutivo número 31610-SMINAE-TUR, del\n22 de enero del 2004.\n\nII.-Que mediante el Decreto Ejecutivo número\n31610-S-MINAETUR, del 22 de enero del 2004, publicado en el Diario Oficial La\nGaceta, el martes 9 de marzo del 2004, se redefinió el fundamento legal del\nPrograma Bandera Azul Ecológica y se extendió a playas y comunidades al\ninterior del país.\n\nIII.-Que mediante el Decreto Ejecutivo número\n31648-MEPMINAE-S-TUR, dado el 9 de febrero del 2004 y publicado en el Diario\nOficial La Gaceta del 15 de marzo del 2004, se amplió la filosofía del\nprograma a Centros Educativos, con el propósito de generar conciencia en los\nestudiantes y sostenibilidad al Programa Bandera Azul Ecológica. \n\nIV.-Que el Programa Bandera Azul Ecológica,\nse ha convertido en buen instrumento para incentivar la organización comunal y\nla excelencia higiénico-sanitaria y la protección de los recursos\nhídricos y naturales en general en las zonas participantes.\n\nV.-Que el artículo 5º del Decreto Ejecutivo número 31610-SMINAE-TUR,\npermite que las Instituciones miembros de la Comisión Nacional del Programa\nBandera Azul Ecológica contemplen dentro de sus planes de trabajo y de igual\nforma asignen recursos que le darán contenido para su real ejecución.\n\nVI.-Que debido a que los recursos siempre serán escasos, se hace\nnecesario utilizar la estructura administrativa del Programa Bandera Azul\nEcológica, para que sirva de facilitador para trasladar recursos logísticos del\nsector privado hacia los comités locales del PBAE participantes.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 31978\n\n                        Declares the activities carried out by the Ecological Blue Flag Program to be of public and national interest.\n\nComplete Text of record: 107522\nNo. 31978-MEP-MINAE-S-TUR\n\nNo. 31978-MEP-MINAE-S-TUR\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nTHE MINISTER OF HEALTH, THE MINISTER OF ENVIRONMENT(*)\n\nAND ENERGY, THE MINISTER OF PUBLIC EDUCATION\n\nAND THE MINISTER OF TOURISM\n\n(*)(Name amended by Article 11 of Law \"Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology\", No. 9046 of June 25, 2012)\n\nExercising the powers conferred by Article 140, subsections 3) and 18) of the Political Constitution, and\n\nConsidering:\n\nI.—That by Decreto Ejecutivo No. 25636-MINAE-S of October 31, 1996, published in the Diario Oficial on Thursday, November 28, 1996, the legal basis was given to the Ecological Blue Flag Program (Programa Bandera Azul Ecológica, PBAE) and through Decreto Ejecutivo No. 27010-MINAE-S of April 21, 1998, published on Thursday, June 4, 1998, the original Decree was amended with the objective of introducing the grading of stars or categories \"A\", \"AA\" and \"AAA\", in the Ecological Blue Flag incentive, which were repealed by decreto ejecutivo number 31610-S-MINAE-TUR, of January 22, 2004.\n\nII.—That through Decreto Ejecutivo number 31610-S-MINAETUR, of January 22, 2004, published in the Diario Oficial La Gaceta on Tuesday, March 9, 2004, the legal basis of the Ecological Blue Flag Program was redefined and extended to beaches and communities inland.\n\nIII.—That through Decreto Ejecutivo number 31648-MEPMINAE-S-TUR, issued on February 9, 2004 and published in the Diario Oficial La Gaceta of March 15, 2004, the philosophy of the program was expanded to Educational Centers, with the purpose of generating awareness among students and sustainability for the Ecological Blue Flag Program.\n\nIV.—That the Ecological Blue Flag Program has become a good instrument to incentivize community organization and hygienic-sanitary excellence and the protection of water resources and natural resources in general in the participating areas.\n\nV.—That Article 5 of Decreto Ejecutivo number 31610-S-MINAE-TUR, allows the member Institutions of the National Commission of the Ecological Blue Flag Program to include within their work plans and likewise allocate resources that will provide content for its real execution.\n\nVI.—That because resources will always be scarce, it is necessary to use the administrative structure of the Ecological Blue Flag Program, so that it serves as a facilitator to transfer logistical resources from the private sector to the local committees of the participating PBAE.
