  "excerpt_es": "Artículo 15.-La asamblea dará inicio en la fecha y hora fijada en la convocatoria, siempre y cuando, se cuente con un quórum de al menos la mitad más una de las organizaciones registradas ante el Departamento de Extensión y Capacitación del INCOPESCA.\n\nArtículo 22.—De los miembros de la asamblea, por propuesta de la misma, se procederá a elegir por mayoría simple al Representante propietario y al Representante suplente ante el Comité Especial del Fideicomiso. La votación podrá ser secreta o pública según lo determine la asamblea, por votación de mayoría simple. De no obtener mayoría ninguno de los postulados, se procederá a otra votación entre los que hayan obtenido mayor cantidad de votos. De persistir el empate, se recurrirá a sorteo.",

  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 0\n\n                        Reglamento de las Asambleas para la Elección de los Representantes de los\nPescadores y Acuicultores ante el Comité Especial del Fideicomiso Pesquero (Acuerdo AJDIP/338)\n\nTexto Completo acta: 9ADD0\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUACULTURA\n\n \n\nAJDIP/338.—Puntarenas,\na los veintitrés días del mes de julio del año dos mil cuatro.\n\n \n\nREGLAMENTO\nDE LAS ASAMBLEAS PARA LA ELECCIÓN\n\nDE LOS\nREPRESENTANTES DE LOS PESCADORES\n\nY ACUICULTORES ANTE EL\nCOMITÉ ESPECIAL\n\nDEL\nFIDEICOMISO PESQUERO\n\n \n\nCAPÍTULO\nI\n\nDisposiciones\ngenerales\n\n \n\nArtículo\n1º—Dentro del Comité Especial del Fideicomiso Pesquero, los pescadores y\nacuicultores contarán con un representante propietario y otro representante suplente.\n\n \n\n(Así reformado mediante acuerdo AJDIP/173 del 07 de abril del\n2006).\n\nArtículo\n2º—En las sesiones del Comité Especial, el Representante Titular de los Pescadores\ny/o de los Acuicultores tendrá derecho a voz y voto, el Representante Suplente solamente\na voz.\n\n \n\n(Así reformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n3º—La participación tanto del Representante titular como del suplente en las\nsesiones y actividades del Comité Especial, será Ad Honorem.\n\n \n\n(Así reformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n4º—La ausencia injustificada a tres sesiones consecutivas del Comité Especial, por\nparte del Representante Titular, será motivo de pérdida de la representación que\nostenta ante el Comité Especial, debiéndose recurrir a lo estipulado en el artículo 18.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n5º—El Representante Suplente ejercerá como titular en las sesiones del Comité\nEspecial en ausencia del Representante Titular o cuando el Titular se apersone a la\nsesión transcurridos treinta minutos después de iniciada la misma.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nCAPÍTULO\nII\n\nDe la\nconvocatoria\n\n \n\nArtículo\n6º—El Comité Especial convocará a asambleas generales ordinarias y extraordinarias\nsegún corresponda, para la elección de los miembros Propietario y Suplente de las\norganizaciones de Pescadores y Acuicultores ante este órgano.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo 7º-La convocatoria para las asambleas, se\nefectuará mediante el envío de una circular a las organizaciones y/o mediante\nuna publicación en un medio de comunicación colectiva.\n\nArtículo 8º-La convocatoria deberá señalar lugar,\nfecha, hora y el orden del día.\n\nArtículo 9º-Las organizaciones de Pescadores y\nAcuicultores, podrán designar a dos representantes; uno propietario y otro\nsuplente por organización pesquera o acuícola ante la asamblea convocada.\n\nCAPÍTULO\nIII\n\nDe la\nacreditación\n\n \n\nArtículo 10.—Las organizaciones de pescadores y de\nacuicultores debidamente acreditadas en el Registro de Organizaciones pesqueras y\nacuícolas que lleva el Departamento de Extensión y Capacitación del INCOPESCA, estarán\nrepresentadas por quien ostente la personería jurídica, quien concurrirá en calidad de\npropietario, sin demérito del nombramiento de un representante suplente por parte de la\nJunta Directiva de la Organización.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\n    Artículo 11.—El Representante suplente designado por las\norganizaciones descritas en el artículo 10, deberá aportar al momento de su registro\nante la Asamblea, el acuerdo de su nombramiento por parte de la organización que\nrepresenta.\n\n  (Así reformado mediante\nacuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n12.—El Comité Especial verificará la legalidad de las acreditaciones presentadas.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nCAPÍTULO\nIV\n\nDe las\nasambleas\n\n \n\nArtículo\n13.—Las asambleas serán presididas por el Presidente del Comité Especial, en\nausencia de este, la coordinación de la actividad se llevará a cabo por parte de alguno\nde los otros miembros del Comité Especial presentes.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo 14.—La Asamblea General para el nombramiento de los\nRepresentantes de los Pescadores y de los Acuicultores se llevará a cabo en la primera\nquincena del mes de diciembre, debiéndose convocar con al menos 22 días calendario de\nanticipación. Para todos los efectos restantes se procederá conforme a lo establecido en\néste Reglamento.\n\n \n\n(Así reformado mediante acuerdo AJDIP/173 del\n07 de abril del 2006).\n\nArtículo 15.-La asamblea dará inicio en la fecha y\nhora fijada en la convocatoria, siempre y cuando, se cuente con un quórum de al\nmenos la mitad más una de las organizaciones registradas ante el Departamento de\nExtensión y Capacitación del INCOPESCA.\n\nArtículo 16.-De no contarse con el quórum señalado\nen el artículo 15, se tendrá por convocada la misma, en segunda convocatoria,\nuna hora después de la hora señalada para la primera convocatoria, celebrándose\nla Asamblea General con los miembros de las organizaciones presentes, siempre y\ncuando el número de organizaciones presentes no sea menor de 10.\n\nArtículo 17.—De no contarse con el quórum contemplado en el\nartículo 16, se llevará a cabo la Asamblea en tercera convocatoria, una hora inmediata\ndespués de lo señalado en el artículo precedente, con el quórum de los representantes\nde las organizaciones presentes.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo 18.-En caso de renuncia o inhabilitación\nde alguno de los Representantes de Pescadores y Acuicultores elegidos en la asamblea,\nse convocará a una asamblea extraordinaria bajo las mismas condiciones de la\nasamblea ordinaria. El Representante de los Pescadores y de los Acuicultores\nelegido en una asamblea extraordinaria deberán ser nombrados por el período\nrestante del miembro que sustituye.\n\nCAPÍTULO\nV\n\nDe la\nelección\n\n \n\nArtículo\n19.—Será requisito para ser postulado a representante dentro del Comité Especial\nser mayor de edad, contar con al menos educación primaria aprobada y tres años de\nexperiencia dentro del sector pesquero o acuícola.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\n    Artículo 20.-En la asamblea, no obstante que podrán asistir y ser nominados\npara la elección dos miembros por organización, solamente, se contabilizará un\nvoto por organización.\n\n    Artículo 21.-Dentro de los miembros de la asamblea se designará un tribunal\nde elección integrado por tres asambleístas, el cual tendrá bajo su\nresponsabilidad el proceso de elección conforme a lo establecido en el presente\nReglamento.\n\n    Artículo 22.—De los miembros de la asamblea, por propuesta de\nla misma, se procederá a elegir por mayoría simple al Representante propietario y al\nRepresentante suplente ante el Comité Especial del Fideicomiso. La votación podrá ser\nsecreta o pública según lo determine la asamblea, por votación de mayoría simple. De\nno obtener mayoría ninguno de los postulados, se procederá a otra votación entre los\nque hayan obtenido mayor cantidad de votos. De persistir el empate, se recurrirá a\nsorteo.\n\n \n\n    (Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\n    Artículo 23.-Los representantes elegidos por la asamblea serán nombrados\npor un periodo de dos años.\n\n    Artículo 24.-Los Representantes de los pescadores y acuicultores podrán ser\nreelegidos por la asamblea.\n\n    Artículo 25.-El Representante propietario y el Representante suplente serán\nnombrados de forma alterna, de tal modo que no cumplan su periodo de\nrepresentación de forma común.\n\nCAPÍTULO\nVI\n\nDe los\ndeberes y obligaciones de los representantes\n\n \n\nArtículo\n26.—Participar en las sesiones ordinarias y extraordinarias que establezca el Comité\nEspecial.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n27.—Aprobar las actas de las sesiones del Comité Especial (o improbar).\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n28.—Participar en las actividades programadas por el Comité Especial del\nFideicomiso.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo\n29.—Representar al sector Pesquero y Acuícola en las sesiones y actividades del\nComité Especial.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/173 del 07 de abril del 2006).\n\nArtículo 30.-Brindar un Informe de Resultados del\nFideicomiso Pesquero a la asamblea.\n\nCAPÍTULO VII\n\nTransitorios\n\n \n\nTransitorio 1º-En la asamblea general ordinaria del año 2004, de conformidad con este Reglamento, se\nprocederá a elegir al Representante propietario por un periodo de dos años y al   periodo de un año,\na fin de cumplir con lo establecido en artículo 25.\n\n \n\nRige a partir de la aprobación por parte de Junta\nDirectiva del INCOPESCA y su publicación en el Diario Oficial La Gaceta.\n\n \n\n           \nPuntarenas, 6 de setiembre del 2004.",

the Alternate Representative shall have the right only to voice.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle\n3.—The participation of both the Principal Representative (Representante titular) and the alternate representative in the\nsessions and activities of the Special Committee shall be Ad Honorem.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle\n4.—Unjustified absence from three consecutive sessions of the Special Committee, on the\npart of the Principal Representative (Representante Titular), shall be grounds for loss of the representation that\nhe/she holds before the Special Committee, and recourse shall be made to the provisions of Article 18.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle\n5.—The Alternate Representative (Representante Suplente) shall act as the principal representative in the sessions of the Special\nCommittee in the absence of the Principal Representative (Representante Titular) or when the Principal Representative appears at the\nsession after thirty minutes have elapsed from the start thereof.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nCHAPTER\nII\n\nOn the\nCall to Meeting\n\n \n\nArticle\n6.—The Special Committee shall call ordinary and extraordinary general assemblies (asambleas generales)\nas applicable, for the election of the Principal (Propietario) and Alternate (Suplente) members from the\norganizations of Fishermen and Aquaculturists before this body.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle 7.—The call to meeting (convocatoria) for the assemblies, shall\nbe made by sending a circular to the organizations and/or by\npublication in a mass media outlet.\n\nArticle 8.—The call to meeting (convocatoria) shall indicate the place,\ndate, time, and agenda.\n\nArticle 9.—The organizations of Fishermen and\nAquaculturists may designate two representatives; one principal representative (propietario) and one\nalternate (suplente) per fishing or aquaculture organization before the convened assembly.\n\nCHAPTER\nIII\n\nOn\nAccreditation\n\n \n\nArticle 10.—The organizations of fishermen and\naquaculturists duly accredited in the Registry of Fishing and\nAquaculture Organizations maintained by the Department of Extension and Training of INCOPESCA shall be\nrepresented by the person who holds the legal representation (personería jurídica), who shall attend as the\nprincipal representative (propietario), without prejudice to the appointment of an alternate representative (suplente) by the\nBoard of Directors of the Organization.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\n    Article 11.—The Alternate Representative (Representante suplente) designated by the\norganizations described in Article 10 must provide, at the time of his/her registration\nbefore the Assembly, the agreement of his/her appointment by the organization he/she\nrepresents.\n\n  (Thus amended by\nagreement AJDIP/173 of April 7, 2006).\n\nArticle\n12.—The Special Committee shall verify the legality of the accreditations presented.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nCHAPTER\nIV\n\nOn the\nAssemblies\n\n \n\nArticle\n13.—The assemblies shall be chaired by the President of the Special Committee; in the\nabsence thereof, the coordination of the activity shall be carried out by one\nof the other members of the Special Committee present.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle 14.—The General Assembly (Asamblea General) for the appointment of the\nRepresentatives of the Fishermen and Aquaculturists shall be held in the first\nhalf of December, and must be called with at least 22 calendar days of\nnotice. For all other purposes, the provisions established in\nthese Regulations shall apply.\n\n \n\n(Thus amended by agreement AJDIP/173 of\nApril 7, 2006).\n\nArticle 15.—The assembly shall commence on the date and\ntime set in the call to meeting (convocatoria), provided that there is a quorum (quórum) of at\nleast half plus one of the organizations registered with the Department of\nExtension and Training of INCOPESCA.\n\nArticle 16.—If the quorum (quórum) indicated\nin Article 15 is not met, the meeting shall be deemed called, on second call,\none hour after the time set for the first call, and the\nGeneral Assembly (Asamblea General) shall be held with the members of the organizations present, provided\nthat the number of organizations present is no fewer than 10.\n\nArticle 17.—If the quorum (quórum) stipulated in\nArticle 16 is not met, the Assembly shall be held on third call, one hour immediately\nafter the time indicated in the preceding article, with the quorum (quórum) of the representatives\nof the organizations present.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle 18.—In the event of resignation or disqualification\nof any of the Representatives of Fishermen and Aquaculturists elected in the assembly,\nan extraordinary assembly shall be called under the same conditions as the\nordinary assembly. The Representative of the Fishermen and Aquaculturists\nelected in an extraordinary assembly must be appointed for the remaining\nterm of the member he/she replaces.\n\nCHAPTER\nV\n\nOn the\nElection\n\n \n\nArticle\n19.—A requirement to be nominated as a representative within the Special Committee\nshall be being of legal age, having at least completed primary education, and having three years of\nexperience within the fishing or aquaculture sector.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\n    Article 20.—In the assembly, notwithstanding that two members per organization may attend and be nominated\nfor the election, only\none vote per organization shall be counted.\n\n    Article 21.—From among the members of the assembly, an electoral tribunal (tribunal de elección)\nshall be designated, composed of three assembly members, which shall be\nresponsible for the election process in accordance with the provisions of these\nRegulations.\n\n    Article 22.—From the members of the assembly, upon proposal by\nthe same, a Principal Representative (Representante propietario) and an\nAlternate Representative (Representante suplente) before the Special Committee of the Trust shall be elected by simple majority (mayoría simple). The vote may be\nsecret or public as determined by the assembly, by a simple majority (mayoría simple) vote. If\nnone of the nominees obtains a majority, another vote shall be taken among those\nwho obtained the highest number of votes. If a tie persists, recourse shall be made to\na drawing of lots.\n\n \n\n    (Thus amended by agreement AJDIP/173 of April 7, 2006).\n\n    Article 23.—The representatives elected by the assembly shall be appointed\nfor a period of two years.\n\n    Article 24.—The Representatives of the fishermen and aquaculturists may be\nreelected by the assembly.\n\n    Article 25.—The Principal Representative (Representante propietario) and the Alternate Representative (Representante suplente) shall be\nappointed in an alternating manner, so that their term of\nrepresentation is not served concurrently.\n\nCHAPTER\nVI\n\nOn the\nDuties and Obligations of the Representatives\n\n \n\nArticle\n26.—Participate in the ordinary and extraordinary sessions established by the Special Committee.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle\n27.—Approve the minutes (actas) of the sessions of the Special Committee (or reject them).\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle\n28.—Participate in the activities scheduled by the Special Committee of the\nTrust.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle\n29.—Represent the Fishing and Aquaculture sector in the sessions and activities of the\nSpecial Committee.\n\n \n\n(Thus amended by agreement AJDIP/173 of April 7, 2006).\n\nArticle 30.—Provide a Results Report (Informe de Resultados) of the\nFishing Trust to the assembly.\n\nCHAPTER VII\n\nTransitory Provisions\n\n \n\nTransitory Provision 1.—In the ordinary general assembly (asamblea general ordinaria) of the year 2004, in accordance with these Regulations, an\nelection shall be held to choose the Principal Representative (Representante propietario) for a period of two years and the\nAlternate Representative (Representante suplente) for a period of one year,\nin order to comply with the provisions of Article 25.\n\n \n\nIt takes effect upon approval by the\nBoard of Directors of INCOPESCA and its publication in the Official Gazette La Gaceta.\n\n \n\n            \nPuntarenas, September 6, 2004."
