  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 362\n\n                        Reforma  acuerdo que establece las formas de conservación de los recursos\nhidrobiológicos y garantizar una explotación sostenible de los mismos\n\nTexto Completo acta: 77B93\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUACULTURA\n\n \n\nAJDIP/362-2004.-Puntarenas, a los cinco días del\nmes de agosto del año dos mil cuatro.\n\n \n\nConsiderando:\n\n \n\n1º-Que mediante oficio SDGT-135-2004, el señor\nMarvin Mora, Director Técnico, emite criterio respecto a solicitud planteada a\nefecto que se permita durante la época de veda, utilizar el chinchorro\nbolinchero para capturar carnada.\n\n2º-Que la Dirección Técnica recomienda autorizar el\nuso del chinchorro bolinchero y a la vez, sugiere modificar el acuerdo AJDIP/252-2004,\ncon el objetivo de regular la longitud del chinchorro playero para barrer\ncarnada. Por tanto:\n\n \n\nSE ACUERDA:\n\n \n\n1º-Acoger criterio vertido por la Dirección Técnica\nMediante oficio SDGT-135-2004, y modificar los artículos 3º, 4º y 5º, del\nacuerdo AJDIP/252-2004, para que en lo sucesivo se lea de la siguiente manera:\n\n \n\n\"Artículo 3º-Durante el período comprendido entre\nel 1°de junio al 31 de julio del 2004 y del 16 de octubre y el 15 de noviembre\nde 2004, únicamente se puede utilizar en la pesca artesanal en pequeña escala\nla Línea Planera de trescientos (300) anzuelos número 6 (N° 6), la cuerda de\nmano, el chinchorro playero de barrer para extraer carnada, el cual no deberá\ncontar con bolsa y su longitud no será mayor de 8 metros. Se prohíbe la\nutilización del trasmallo de cualquier luz de malla. Esta regulación se aplica en\nel área comprendida entre una línea recta imaginaria que va desde Punta Torres\n(84° 43\" 52' W, 9° 53\" 31' N) hasta Punta Cuchillos (84'51'50\"W, 9°49'36\"N) y\nde ahí aguas adentro hasta el extremo occidental de dicho Golfo en la Península\nde Nicoya (Desembocadura del Río Tempisque).\n\n \n\nArtículo 4º-A los pescadores que se les encuentre\nrealizando labores de pesca con su licencia de pesca inactiva o vencida, así como\ncapturando especies o grupos comerciales o en zonas y con artes de pesca no\nautorizadas en su respectiva licencia de pesca, se les iniciará los\nprocedimientos administrativos correspondientes y se les iniciarán los procesos\nlegales para que se les suspenda el subsidio económico o tenga que reintegrar\nel dinero otorgado con tal fin.   "body_en_text": "INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\nINCOOPESCA\n\nINCOOPESCA\n\nAJDIP/362-2004.—Puntarenas, on the fifth day of the month of August of the year two thousand four.\n\nConsidering:\n\n1.—That by official communication SDGT-135-2004, Mr. Marvin Mora, Technical Director, issues an opinion regarding a request made so that the use of the bolinchero purse seine (chinchorro bolinchero) to catch bait is permitted during the closed season (veda).\n\n2.—That the Technical Directorate recommends authorizing the use of the bolinchero purse seine (chinchorro bolinchero) and, at the same time, suggests modifying agreement AJDIP/252-2004, with the objective of regulating the length of the beach seine (chinchorro playero) for sweeping bait. Therefore:\n\nIT IS AGREED:\n\n1.—To accept the opinion issued by the Technical Directorate through official communication SDGT-135-2004, and to modify articles 3, 4, and 5 of agreement AJDIP/252-2004, so that henceforth they read as follows:\n\n\"Article 3.—During the period from June 1 to July 31, 2004, and from October 16 to November 15, 2004, only the horizontal longline (Línea Planera) with three hundred (300) number 6 (N° 6) hooks, the handline (cuerda de mano), and the sweeping beach seine (chinchorro playero de barrer) for extracting bait, which shall not have a bag and whose length shall not be greater than 8 meters, may be used in small-scale artisanal fishing. The use of the trammel net (trasmallo) of any mesh size (luz de malla) is prohibited. This regulation applies in the area comprised between an imaginary straight line running from Punta Torres (84° 43' 52\" W, 9° 53' 31\" N) to Punta Cuchillos (84° 51' 50\" W, 9° 49' 36\" N) and from there offshore to the western end of said Gulf on the Nicoya Peninsula (mouth of the Tempisque River).\n\nArticle 4.—For fishermen found carrying out fishing activities with an inactive or expired fishing license, as well as those catching commercial species or groups, or fishing in zones and with fishing gear not authorized in their respective fishing license, the corresponding administrative procedures shall be initiated, and legal processes shall be commenced to suspend their economic subsidy or require them to reimburse the money granted for that purpose. Furthermore, the corresponding legal processes shall be initiated against them.\n\nArticle 5.—The use of the bolinchero purse seine (chinchorro bolinchero) for catching live bait is permitted with the following characteristics: without a bag, maximum 30 meters in length and 8 meters in height, and maximum mesh size (luz de malla) of 1/4 inch.\"\n\n2.—Let it be published.\n\nPuntarenas, September 6, 2004."
