Las propuestas del MINAE serán sometidas a un proceso de negociación,\nmediante el uso de mesas de negociación, con los sectores de entes generadores\nprivados, sector comunal, sector de empresas de servicios públicos de\nsaneamiento y abastecimiento de agua potable, municipios, sector ambiental, y\notros presentes en cada zona de control, que tengan interés sobre el recurso, con\nel fin de implementar el principio de participación ciudadana, contemplado en\nel artículo 6 de la Ley Orgánica del Ambiente y que las decisiones se ajusten a\nlas exigencias ambientales y las necesidades del sector productivo del país\n\n \n\nConsiderando:\n\nÚnico.-Que\nes necesario establecer las reglas que se utilizarán en el proceso de\nnegociación, para fijar la meta de reducción de la carga contaminante vertida a\nlos cuerpos de agua, que permitirá alcanzar el nivel buscado de calidad hídrica\nen cada zona de control, con el fin de que el proceso sea eficiente,\ntransparente y representativo y permita llegar a los acuerdos necesarios para\nla implementación del canon ambiental por vertidos. Por tanto,\n\n \n\nEL MINISTRO\nDE AMBIENTE Y ENERGÍA, RESUELVE:\n\nDICTAR EL\nPROCEDIMIENTO PARA LA ACREDITACIÓN\n\nDE\nREPRESENTANTES Y REALIZACIÓN DE LAS MESAS\n\nDE\nNEGOCIACIÓN PARA LA FIJACIÓN DE METAS\n\nDE REDUCCIÓN\nDE LA CARGA CONTAMINANTE\n\nQUE SE\nPERMITIRÁ VERTER EN CADA\n\nZONA DE\nCONTROL\n\n1.-Convocatoria\ny realización de las mesas de negociación: El Ministerio de Ambiente y Energía\n(MINAE), convocará a las mesas de negociación mediante publicación en el Diario\nOficial La Gaceta y otro medio\nde comunicación nacional.\n\n2.-El\nMINAE, a través de la Dirección de Gestión de Calidad Ambiental (DIGECA),\nllevará a cada mesa de negociación, una propuesta de meta de reducción, para la\nzona de control específica, la cual pondrá en conocimiento de los representantes\nde cada sector para iniciar la negociación.\n\n3.-Los\nrepresentantes de cada sector a las mesas de negociación deberán estar electos\nen una asamblea, según lo indicado en el inciso b), del artículo 32 del Decreto\nEjecutivo 31176-MINAE. \n\n4.-Los\nsectores estarán integrados en cada zona de control de la siguiente forma:\n\na)     Entes Generadores privados: Entendido como aquellas personas físicas o jurídicas responsables\ndel vertimiento a un cuerpo de agua.  Estará integrado por dos representantes por cada zona de\ncontrol.\n\nb)     Sector Comunal: Estará integrado por dos\nrepresentantes de las Uniones Cantonales.\n\nc)     Sector\nde Empresas de Servicios Públicos de Saneamiento y Abastecimiento de agua\npotable: Estará integrado por dos representantes de las empresas de\nservicios públicos de alcantarillado sanitario y de las empresas de\nabastecimiento de agua potable presentes en la zona de control.\n\nd)     Municipios: Estará integrado por dos representantes de las Municipalidades\npresentes en la zona de control.\n\ne)     Sector Ambiental: Estará integrado por un representante\ndel Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y\nEnergía y un representante de las Oficinas Regionales del Ministerio de Salud.\n\nf)      Otros: Se incluirán en este grupo a: dos representantes de otras organizaciones\nque se encuentren desarrollando actividades, obras o proyectos directamente\nrelacionados con el uso, conservación o protección del recurso hídrico en esa\nzona de control. \n\n5.-Para\nparticipar en las mesas de negociación cada representante debe demostrar su\nacreditación con copia del acta notarial levantada el día de la Asamblea Previa\nde Representantes por sector.\n\n6.-Cada\nrepresentante debe solicitar a la Dirección de Gestión de Calidad Ambiental\n(DIGECA), que le acredite como tal, presentando una copia del acta respectiva,\ncomo mínimo tres días antes de la celebración de la mesa de negociación\ncorrespondiente.\n\n7.-La\nDirección de Gestión de Calidad Ambiental, quien presidirá las mesas de\nnegociación, iniciará la negociación en cada zona de control, con la propuesta\nde meta de reducción. El quórum para sesionar será de la mitad más uno de los\nrepresentantes y si no se completara podrá sesionar válidamente media hora\ndespués de la primera convocatoria con los presentes. MINAE's proposals will be submitted to a negotiation process,\nthrough the use of negotiation tables (mesas de negociación) with the sectors of private generating entities, the community sector, the sector of public utility companies for sanitation and drinking water supply, municipalities, the environmental sector, and\nothers present in each control zone that have an interest in the resource, in\norder to implement the principle of citizen participation, contemplated in\narticle 6 of the Organic Environmental Law (Ley Orgánica del Ambiente), and so that the decisions conform to\nthe environmental requirements and the needs of the country's productive sector.\n\n \n\nConsidering:\n\nSole.-That\nit is necessary to establish the rules to be used in the negotiation\nprocess to set the reduction goal for the pollution load discharged\ninto water bodies, which will allow the desired level of water quality\nto be achieved in each control zone, so that the process is efficient,\ntransparent and representative and allows the necessary agreements to be reached for\nthe implementation of the environmental discharge levy (canon ambiental por vertidos). Therefore,\n\n \n\nTHE MINISTER\nOF ENVIRONMENT AND ENERGY RESOLVES:\n\nTO ISSUE THE\nPROCEDURE FOR THE ACCREDITATION\n\nOF\nREPRESENTATIVES AND CONDUCT OF THE NEGOTIATION\n\nTABLES\nFOR THE SETTING OF REDUCTION GOALS\n\nFOR THE\nPOLLUTION LOAD\n\nTHAT\nWILL BE ALLOWED TO BE DISCHARGED IN EACH\n\nCONTROL ZONE\n\n1.-Convocation\nand conduct of the negotiation tables (mesas de negociación): The Ministry of Environment and Energy\n(MINAE) will convene the negotiation tables by publication in the Official Gazette La Gaceta and another\nnational media outlet.\n\n2.-MINAE,\nthrough the Directorate of Environmental Quality Management (DIGECA),\nwill bring to each negotiation table a proposed reduction goal for the\nspecific control zone, which it will make known to the representatives\nof each sector to begin the negotiation.\n\n3.-The\nrepresentatives of each sector to the negotiation tables must be elected\nin an assembly, as indicated in subsection b) of article 32 of Executive Decree 31176-MINAE.\n\n4.-The\nsectors in each control zone will be composed as follows:\n\na)     Private Generating Entities: Understood as those individuals or legal entities responsible\nfor the discharge into a water body.  It will be composed of two representatives per control zone.\n\nb)     Community Sector: It will be composed of two\nrepresentatives from the Canton Unions (Uniones Cantonales).\n\nc)     Sector\nof Public Utility Companies for Sanitation and Drinking Water Supply: It will be composed of two representatives from the\npublic sanitary sewerage utility companies and the drinking water\nsupply companies present in the control zone.\n\nd)     Municipalities: It will be composed of two representatives from the Municipalities\npresent in the control zone.\n\ne)     Environmental Sector: It will be composed of one representative\nfrom the National System of Conservation Areas (SINAC) of the Ministry of Environment and\nEnergy and one representative from the Regional Offices of the Ministry of Health.\n\nf)      Others: This group will include: two representatives from other organizations\nthat are carrying out activities, works or projects directly\nrelated to the use, conservation or protection of the water resource in that\ncontrol zone.\n\n5.-To\nparticipate in the negotiation tables, each representative must prove their\naccreditation with a copy of the notarial act (acta notarial) drawn up on the day of the Prior Assembly\nof Representatives by sector.\n\n6.-Each\nrepresentative must request the Directorate of Environmental Quality Management\n(DIGECA) to accredit them as such, by submitting a copy of the respective act (acta),\nat least three days before the corresponding negotiation table is held.\n\n7.-The\nDirectorate of Environmental Quality Management, which will chair the negotiation tables,\nwill begin the negotiation in each control zone with the proposed\nreduction goal. The quorum to meet will be half plus one of the\nrepresentatives, and if this is not reached, it may validly meet half an hour\nafter the first convocation with those present. Agreements will be reached\nby consensus; however, the taking of sectoral agreements will be permitted if so\ndecided by a negotiation table.\n\n8.-Each\nof the representatives indicated in point 4 will have the right to speak and vote.\nThey may also be accompanied by one or more advisors, who will not have\nthe right to speak or vote.\n\n9.-In\nthe event that no agreement is reached at the first convocation, the time, place and date will be designated on that same\nday to continue the negotiations. This designation itself will serve as the convocation, without the need to publish again.\n\n10.-In\ncases where there are no representatives to a negotiation table or no\nagreement is reached within three months from the first\nconvocation, MINAE, through DIGECA, will officially set the reduction goals for the respective control zone.
