además estipula que el Estado debe garantizar y\npreservar el derecho de las personas a un ambiente sano y ecológicamente\nequilibrado, en respeto del derecho a la protección de la salud humana que se\nderiva del derecho a la vida; siendo entonces que el objetivo primordial del\nuso y protección del ambiente es obtener un desarrollo y evolución favorable al\nser humano en armonía con éste, en el que la calidad ambiental y los medios económicos\nresultan ser uno de los parámetros fundamentales para la calidad de vida de las\npersonas.\n\n2º-Que la actividad agropecuaria en Costa Rica\nes una actividad profundamente arraigada en la organización social del país y\nque forma parte integral de la economía nacional.\n\n3º-Que en el uso y aprovechamiento racional de\nlos recursos naturales y energéticos debe garantizarse un balance entre el\ndesarrollo socioeconómico y la protección del ambiente.\n\n4º-Que el Ministerio de Agricultura y Ganadería\ntiene como objetivo principal promover el desarrollo de la agricultura nacional\nbrindando al productor servicios integrados, tecnologías para la protección de\ncultivos y de los hatos contra las plagas y enfermedades; buscando y promoviendo\nmayor eficiencia en el uso de los factores de producción.\n\n5º-Que el Ministerio de Agricultura y Ganadería\ntiene como principal función, crear las condiciones adecuadas para desarrollar tecnologías\nque aumenten la productividad y bajen los costos de producción de la\nagricultura nacional, y con ello elevar el nivel de competitividad interna y\nexterna de los productores, el nivel de vida de los productores y preservar los\nrecursos naturales.\n\n6º-Que para lograr este objetivo, la institución\ngenera, gerencia y difunde información especializada vital para la toma de\ndecisiones de los productores y la institución.\n\n7º-Que el contacto directo y cotidiano con los\nproductores nacionales organizados, pequeños y medianos, el grupo más\nsignificativo de los productores nacionales y la base del sistema democrático\nnacional, se logra principalmente a través de los servicios de Extensión\nAgropecuaria.\n\n8º-Que fue aprobado el Convenio de Préstamo Nº\n1436/OCCR entre el Gobierno de la República y el Banco Interamericano de Desarrollo\n(BID) mediante el cual se ejecutará el Programa de \"Fomento de la Producción\nAgropecuaria Sostenible\", publicado en La\nGaceta Nº 81 del 27 de abril del 2004.\n\n9º-Que corresponde al Ministerio de Agricultura\ny Ganadería la ejecución de dicho Programa de Fomento. Asegurar que los criterios para evaluar,\npriorizar y seleccionar los proyectos presentados por las organizaciones de\nproductores sean cumplidos por los órganos de análisis y aprobación técnica.\n\n5. Aprobar los requisitos mínimos, formales y de\ncontenido, que deben incluir las propuestas de perfiles de proyectos.\n\n6. Emitir las directrices correspondientes a los\nComités Regionales Mixtos, mediante el análisis y aprobación del Reglamento Operativo\nde los Comités Regionales Mixtos (CRM).\n\n7. Aprobar la conformación de los órganos de\nanálisis y aprobación técnica de los proyectos.\n\n8. Actuar como instancia superior para resolver\nconflictos que se puedan generar en el ámbito regional en la selección y ejecución\nde proyectos.\n\n9. Seleccionar mediante los procedimientos\nestablecidos y nombrar al Director del Programa, previa solicitud de noobjeción\ndel BID.\n\n10. Aprobar las escalas de valoración y\npuntajes, así como los procedimientos para la aprobación de las propuestas de proyectos\nbajo los términos y condiciones establecidos en la Ley Nº 8408.\n\n11. Ratificar el personal designado como\ncontraparte del MAG, el cual se seleccionará de la planilla del Ministerio, sin\nincurrir en contrataciones adicionales, de conformidad con lo estipulado en la\nLey Nº 8408, Anexo A, Título VII, cláusula 7.01, acápite (v).\n\n12. En el caso del Ministro su suplente será el Viceministro. Deberá\ntambién asistir a las sesiones del Consejo, el Director del Programa, quien\nsólo tendrá derecho a voz. El Consejo, deberá ser convocado por su Presidente. El\nConsejo requerirá de un quórum de cuatro miembros para sesionar y tomar\ndecisiones. Therefore:\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1º-The National Directive Council (CND)\nof the Program for the Promotion of Sustainable Agricultural Production is created, with the\npurpose of complying with the stipulations contained in the \"Loan\nContract No. 1436/OC-CR\".\n\nArticle 2º-The main functions and\npowers of the National Directive Council (CND) are:\n\n \n\n- The National Directive Council is the highest-ranking\ndecision-making body that has the responsibility of establishing the\npriorities and guidelines of the Program. It would act as a Council attached to\nthe MAG, as a body of maximum deconcentration, which its Minister will preside over and\nwill be composed of public and private entities, with their active\nparticipation and with direct influence on proposals to introduce\nchanges in the execution of actions and the provision of technical services, to\nachieve the competitiveness of small and medium-sized producers and their\norganizations, in the development of their agricultural production activities at a\nnational and international level.\n\n- The responsibility of the CND shall be to\nestablish the Program's priorities, review and adjust annual plans,\napprove its Operational Regulation and future changes with the approval of the\nInter-American Development Bank (IDB), review annual financial statements,\nagree on the execution structure, and resolve any\noperational aspect that arises during the execution of the Program.\n\n- The CND shall have the following functions and\npowers:\n\n \n\n1. Ensure that the criteria for evaluating,\nprioritizing, and selecting projects submitted by producer\norganizations are met by the bodies for technical analysis and approval.\n\n5. Approve the minimum requirements, formal and content-related,\nthat must include project profile proposals.\n\n6. Issue the corresponding guidelines to the\nMixed Regional Committees, through the analysis and approval of the Operational\nRegulation of the Mixed Regional Committees (CRM).\n\n7. Approve the composition of the bodies for technical\nanalysis and approval of projects.\n\n8. Act as the higher body to resolve\nconflicts that may arise at the regional level in the selection and execution\nof projects.\n\n9. Select through the established\nprocedures and appoint the Program Director, upon prior request for no-objection\nfrom the IDB.\n\n10. Approve the assessment scales and\nscores, as well as the procedures for the approval of project proposals\nunder the terms and conditions established in Law No. 8408.\n\n11. Ratify the personnel designated as\ncounterpart of the MAG, which shall be selected from the Ministry's payroll, without\nincurring additional hiring, in accordance with what is stipulated in\nLaw No. 8408, Annex A, Title VII, clause 7.01, subparagraph (v).\n\n12. Any others in accordance with its objectives\nand nature.\n\nArticle 3º-The National Directive Council (CND)\nshall be composed, as established by Law No. 8408 Annex A, Title VII,\nclause 7.02, of seven members:\n\n \n\n1. A representative of Agricultural\nCooperatives appointed by the National Institute of Cooperative Development (Instituto Nacional de Fomento Cooperativo, INFOCOOP).\n\n \n\nAll members who do not come from the Public\nSector shall be elected for a period of two years. Each one of the mentioned\ninstitutions shall designate its representatives directly.\n\nAll members of the Council must have\na duly accredited alternate, who shall be designated by the\nrespective organization, in the same act of designation of the principal\nrepresentative. In the case of the Minister, his alternate shall be the Vice Minister. The Program Director must\nalso attend the Council sessions, but shall only have the right to speak. The Council must be convened by its President. The\nCouncil shall require a quorum of four members to meet and make\ndecisions. Its agreements shall be adopted by a simple majority of votes present.\n\nNone of the members of the National Directive\nCouncil shall receive per diems, nor any other type of payment or emolument.\n\nArticle 4º-The National Directive Council\nshall have, for its coordination, the logistical support of the Executive Secretariat\nfor Agricultural Sector Planning (Secretaría Ejecutiva\nde Planificación Sectorial Agropecuaria, SEPSA) and of the National Directorate of\nAgricultural Extension (Dirección Nacional de\nExtensión Agropecuaria, DNEA), without the public officials of these\nbodies receiving any payment or emolument whatsoever, not even in an additional form, for\ncarrying out such management.\n\nArticle 5º-In matters not expressly provided for in this\ndecree and regarding the functioning of the National Directive Council (CND),\nas a collegiate body, the provisions on this matter in\nthe General Law of Public Administration shall apply supplementally.\n\nArticle 6º-It shall be effective as of its publication.\n\n \n\nGiven at the Presidency of the Republic.-San\nJosé, on the twenty-eighth day of the month of July of two thousand four." }
