incidental de tortugas marinas.\n\n2º-Que\npara efectos de exportación de camarón al mercado estadounidense, capturado con\ntecnología de pesca comercial que pudiera afectar negativamente a ciertas\nespecies de tortugas marinas, se debe contar con la implementación de un\nprograma que promueva el uso de ciertos equipos que permitan el escape de las\ntortugas. \n\n3º-Que\nla Junta Directiva\ndel Instituto Costarricense de la\n Pesca y Acuacultura, fundamentada en las facultades y\ncompetencias establecidas en la\n Ley Nº 7384 del 16 de marzo de 1994, respecto a las\nregulaciones tendientes a la conservación y protección de la fauna marina y a\nlas políticas en materia de protección de la biodiversidad, establecidas por el\nEstado costarricense, ha implementado las regulaciones pertinentes para la\nutilización del Dispositivo Excluidor de Tortugas (DETs),\npor parte de la flota camaronera de arrastre, incluyendo las contenidas en el\nAcuerdo AJDIP/382 del 28 de setiembre del 2000, publicado en\nLa Gaceta Nº 212 del\n6 de noviembre del 2000.\n\n4º-Que en razón a recomendaciones emitidas por el Servicio Nacional de Pesca Marítima de los Estados\nUnidos de Norteamérica, respecto al uso de los DETs, se emitió el Acuerdo AJDIP/300 de 2 de julio\ndel 2004, publicado en La Gaceta Nº 147 del 28 de julio del mismo año, mediante el cual se\ndefinieron nuevas medidas y características para el uso de dichos dispositivos, considerándose su\nimplementación a partir del 1º de setiembre del 2004.\n\n5º-Que\nes importante y necesario poder definir mediante los estudios correspondientes,\nla eficacia y eficiencia del uso del nuevo dispositivo, en cuanto a los\nobjetivos perseguidos de protección de las tortugas marinas, en las aguas\njurisdiccionales costarricenses, en las que ordinariamente se realizan las\nfaenas de la flota camaronera, por lo cual es conveniente clarificar el\ncontenido y alcances del Acuerdo AJDIP/300 del 2 de julio del 2004.\n\n6º-Que\ncorresponde al INCOPESCA, garantizar el uso adecuado del Dispositivo Excluidor\nde Tortugas por parte de la\n Flota Camaronera de Arrastre de Orilla.
