TRABAJO Y SEGURIDAD SOCIAL\n\n \n\nEn uso de las facultades que les confieren los\nartículos 140, incisos 3), 8) y 18) de la Constitución Política, y 25, 26 y 27\nde la Ley General de Administración Pública.\n\n \n\nConsiderando:\n\n \n\n1º-Que de conformidad con lo dispuesto en el\nartículo 2º, incisos e), f) y g) de la Ley Orgánica del Ministerio de Trabajo y\nSeguridad Social, Nº 1860 del 21 de abril de 1955 y sus reformas, es función de\ndicho Ministerio velar porque la política nacional en el campo del bienestar\nsocial, cuente con una reglamentación adecuada que garantice una asistencia\nefectiva a los costarricenses, sus familias y la comunidad.\n\n2º-Que el Instituto Costarricense de Pesca y\nAcuacultura (INCOPESCA) de conformidad con la Ley Nº 7384 del 16 de marzo de 1994\nque le otorga la competencia de proteger y conservar los recursos hidrobiológicos,\nen aras de garantizar a las generaciones venideras, los recursos vivos del mar,\npromoviendo una explotación sostenible de los recursos mediante el\nestablecimiento de períodos y áreas de veda, emite el acuerdo Nº AJDIP/252 del\n4 de junio del 2004, publicado en el Diario Oficial La Gaceta Nº 113 del\njueves 10 de junio del 2004.\n\n3º-Que en el citado acuerdo del considerando\nanterior, INCOPESCA prohíbe faenar a los barcos de arrastre y pescadores\nartesanales de la provincia de Puntarenas y el Golfo de Nicoya (desembocadura\ndel río Tempisque) en diferentes períodos durante el presente año.\n\n4º-Que este acuerdo impide a los pescadores que\nutilizan \"trasmallo\", desempeñar su actividad remunerada y por ende percibir ingresos\npor este concepto, afectando la satisfacción de sus necesidades básicas.\n\n5º-Que la Ley de Creación del Instituto Mixto de\nAyuda Social, Nº 4760 del 4 de mayo de 1971, establece en su artículo 2º la\nfinalidad de resolver el problema de la pobreza extrema en el país y en su\nartículo 4º inciso e) define dentro de sus fines de creación \"atender las\nnecesidades de los grupos sociales o de las personas que deban ser provistas de\nmedios de subsistencia cuando carezcan de ellos\".\n\n6º-Que el artículo 4 del Reglamento para la\nPrestación de Servicios y el Otorgamiento de Beneficios del Instituto Mixto de\nAyuda Social, publicado en La Gaceta Nº 102 del 29 de mayo del 2000,\ndefine el concepto de pobreza como: Fenómeno o situación compleja de índole coyuntural\no estructural multifacético y heterogéneo, que afecta a las personas y que se\ncaracteriza por sus precarias condiciones de vivienda y sanitarias, bajo niveles\neducacionales, inserción inestable en el sistema productivo, condiciones de\nriesgo social, con poca o ninguna incorporación en mecanismos de participación\nsocial, recursos insuficientes para satisfacer necesidades básicas\n(nutricionales, salud, educación y vivienda) y en algunos casos ausencia o\ninsuficiencia de destrezas, aptitudes, herramientas y oportunidades para\ngenerar y acumular ingresos\".\n\n7º-Que en el artículo 21, inciso h) del citado\nReglamento, se señala en cuanto a los sujetos de los servicios institucionales,\nlo siguiente: \"En casos de excepción debidamente documentados y con el\ncorrespondiente informe técnico social, autorizados por quien ejerza la\nGerencia Regional respectiva, se podrán otorgar beneficios a personas o\nfamilias que presenten una situación de pobreza coyuntural, no necesariamente\nregistrada como tal en el SIPO, o que mediante algún decreto o ley específica,\nse considere, beneficiarios de la acción institucional\".\n\n8º-Que no se cuenta con un fondo compensatorio\npara brindar un subsidio económico a los pescadores afectados por la veda y\nesta circunstancia provoca una situación de pobreza coyuntural, por la carencia\nde ingresos de los pescadores en época de veda.\n\n9º-Que en respuesta al Decreto Nº 31904-MP-MTSS,\npublicado en La Gaceta Nº 151 del miércoles 4 de agosto del 2004, el\nInstituto Mixto de Ayuda Social (IMAS) otorgó un subsidio a las familias de los\npescadores afectados que se encuentran en dicha situación, por la suma de\nsetenta y cinco mil colones para el período de julio y agosto del 2004, monto\nque es necesario complementar con un beneficio adicional por un monto único de\ncuarenta mil colones a cada familia, como apoyo a su situación socioeconómica,\nen virtud del segundo período que se extiende del 16 de octubre al 15 de noviembre\ndel 2004. them by articles 140, subsections 3), 8), and 18) of the Political Constitution, and 25, 26, and 27 of the General Public Administration Act.\n\n \n\nConsidering:\n\n \n\n1º—That in accordance with the provisions of article 2, subsections e), f), and g) of the Organic Law of the Ministry of Labor and Social Security, No. 1860 of April 21, 1955, and its amendments, it is the function of said AJDIP/252 of June 4, 2004, published in the Official Gazette (Diario Oficial La Gaceta) No. 113 of Thursday, June 10, 2004.\n\n3º—That in the aforementioned agreement of the previous considering, INCOPESCA prohibits trawl boats and artisanal fishers of the province of Puntarenas and the Gulf of Nicoya (mouth of the Tempisque River) from fishing (faenar) during different periods throughout the current year.\n\n4º—That this agreement prevents fishers who use \"trasmallo\" nets from performing their remunerated activity and therefore from receiving income from this source, affecting the satisfaction of their basic needs.\n\n5º—That the Law for the Creation of the Joint Institute for Social Assistance (Instituto Mixto de Ayuda Social), No. 4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country, and in its article 4, subsection e), defines among its founding purposes \"to attend to the needs of social groups or persons who must be provided with means of subsistence when they lack them.\"\n\n6º—That article 4 of the Regulation for the Provision of Services and Granting of Benefits of the Joint Institute for Social Assistance, published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: \"A complex phenomenon or situation of a circumstantial (coyuntural) or structural, multifaceted, and heterogeneous nature, which affects persons and is characterized by their precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to satisfy basic needs (nutritional, health, education, and housing), and in some cases an absence or insufficiency of skills, aptitudes, tools, and opportunities to generate and accumulate income.\"\n\n7º—That in article 21, subsection h) of the cited Regulation, it states regarding the subjects of institutional services, the following: \"In duly documented exceptional cases, and with the corresponding technical social report, authorized by the respective Regional Management (Gerencia Regional), benefits may be granted to persons or families presenting a situation of circumstantial poverty (pobreza coyuntural), not necessarily registered as such in the SIPO, or who, through a specific decree or law, are considered beneficiaries of institutional action.\"\n\n8º—That there is no compensatory fund to provide an economic subsidy to fishers affected by the closed season, and this circumstance causes a situation of circumstantial poverty (pobreza coyuntural), due to the fishers' lack of income during the closed season.\n\n9º—That in response to Decree No. 31904-MP-MTSS, published in La Gaceta No. 151 of Wednesday, August 4, 2004, the Joint Institute for Social Assistance (IMAS) granted a subsidy to the families of affected fishers who are in said situation, for the sum of seventy-five thousand colones for the period of July and August 2004, an amount that must be supplemented with an additional benefit of a single amount of forty thousand colones to each family, as support for their socioeconomic situation, in light of the second period extending from October 16 to November 15, 2004. Therefore,\n\n \n\nDECREE:\n\n \n\nArticle 1—The condition of fishers affected by the closed season agreed by INCOPESCA, who lack other complementary income, is hereby declared to be in a situation of circumstantial poverty (pobreza coyuntural).\n\nIMAS shall grant an additional subsidy of forty thousand colones on a one-time basis, which shall become effective as of the first half of December 2004, to each of the families of the fishers benefited under Decree No. 31904-MP-MTSS.\n\nArticle 2—The new subsidies shall be processed by the Regional Managements of IMAS in the zones of Puntarenas and Guanacaste, with resources from FODESAF.\n\nArticle 3—IMAS officials may request complementary information or condition the new benefit upon the beneficiary, solely in those cases where some form of evidence shows that the beneficiary does possess complementary income within their family unit.\n\nArticle 4—It shall take effect upon publication.\n\n \n\nGiven at the Presidency of the Republic.—San José, on the first day of November, two thousand four." }
