  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 518\n\n                        Reforma Reglamento para la Regulación y Control del Uso Eficiente del\nCombustible a Precio Preferencial, destinado a la Flota Pesquera no Deportiva\n\nTexto Completo acta: 7AD2D\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\n \n\nAJDIP/518.-Puntarenas,\na los diecinueve días del mes de noviembre del año dos mil cuatro.\n\nConsiderando:\n\n \n\n1º-Que de\nconformidad con lo establecido en la Ley de Creación del INCOPESCA, Ley Nº\n7384, publicada en el Diario Oficial La Gaceta Nº 62 del 29 de marzo de\n1994, el INCOPESCA está facultado para normar y manejar los subsidios que el\nestado asigne al sector pesquero y de acuicultura, así mismo, es responsable y\nencargado de la administración y el control del uso eficiente del combustible,\ndestinado a la actividad pesquera no deportiva.\n\n2º-Que en\natención a las atribuciones y competencias asignadas y señaladas anteriormente,\nel Instituto a través de su Junta Directiva adoptó el Reglamento para la\nRegulación y Control del Uso Eficiente del Combustible a Precio Preferencial,\ndestinado a la Flota Pesquera no Deportiva, el cual fue debidamente publicado\nen el Diario Oficial La Gaceta Nº 199, Alcance 75 del 16 de octubre del\n2002. \n\n3º-Que según\nmanifestaciones realizadas por parte del sector pesquero existe cierto vacío en\nla aplicación del Reglamento de Combustible a precio Preferencial para la Flota\nPesquera no Deportiva, específicamente en el artículo 19, en cuanto al plazo\notorgado al administrado a efecto de cumplir con los requerimientos y\ncondiciones inmersos en dicho artículo. \n\n4º-Que en\naras de prevenir dudas razonables en cuanto a la interpretación y aplicación de\ndicho artículo y con el fin de evitar un posible perjuicio al beneficiario del\ncombustible a precio preferencial, esta Junta Directiva considera conveniente\nmodificar el artículo 19 del Reglamento citado.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 518\n\n                        Amendment to the Regulation for the Regulation and Control of the Efficient Use of\nPreferential-Price Fuel, destined for the Non-Sport Fishing Fleet\n\nFull Text of act: 7AD2D\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\nAJDIP/518.-Puntarenas,\non the nineteenth day of the month of November of the year two thousand four.\n\nConsidering:\n\n1º-That in\naccordance with the provisions of the Law Creating INCOPESCA, Law No.\n7384, published in the Official Gazette La Gaceta No. 62 of March 29,\n1994, INCOPESCA is empowered to regulate and manage the subsidies that the\nstate allocates to the fishing and aquaculture sector, likewise, it is responsible\nand in charge of the administration and control of the efficient use of fuel,\ndestined for non-sport fishing activity.\n\n2º-That in\nattention to the attributions and competencies assigned and indicated above,\nthe Institute, through its Board of Directors, adopted the Regulation for the\nRegulation and Control of the Efficient Use of Preferential-Price Fuel,\ndestined for the Non-Sport Fishing Fleet, which was duly published\nin the Official Gazette La Gaceta No. 199, Supplement 75 of October 16,\n2002.\n\n3º-That according\nto statements made by the fishing sector, there is a certain gap in\nthe application of the Preferential-Price Fuel Regulation for the Non-Sport\nFishing Fleet, specifically in Article 19, regarding the period\ngranted to the administered party in order to comply with the requirements and\nconditions implicit in said article.\n\n4º-That in\norder to prevent reasonable doubts regarding the interpretation and application of\nsaid article and to avoid possible harm to the beneficiary of\npreferential-price fuel, this Board of Directors considers it convenient\nto modify Article 19 of the cited Regulation. Therefore,\n\nIT IS AGREED:\n\nArticle\n1º-Article 19 of the Regulation for the Regulation and Control of the\nEfficient Use of Preferential-Price Fuel, destined for the Non-Sport Fishing\nFleet, is hereby amended, so that henceforth it reads as follows:\n\n\"Article\n19º-When the beneficiary is unable to purchase the fuel,\nthey must submit, within the first 10 business days counted from the\ndate of arrival of the last fishing trip at the base port of operation, the\nwritten justification and the 'preferential fuel' application with the\ncomplete and correct documentation; the SCAC will record the submission thereof,\nfor purposes of issuing the Fuel Purchase Order within a period of no\nmore than 120 calendar days. Once said period has expired without the\napplication having been made effective by the beneficiary, it shall expire by operation of law.\"\n\nArticle\n2º-Shall be effective as of its publication."
