  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 32164\n\n                        Modifica límite de gasto presupuestario para el Proyecto de Desarrollo\nAgricola de la Peninsula de Nicoya, establecido en Directrices de política presupuestaria del 2005\n\nTexto Completo acta: 7ADB3\nNº 32164\n\nNº 32164\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE HACIENDA\n\nCon fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la\nConstitución Política; los artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2) acápite b) de la\nLey Nº 6227 o Ley General de la Administración Pública del 2 de mayo de 1978, la Ley Nº 8131 o Ley\nde la Administración Financiera de la República y Presupuestos Públicos del 18 de setiembre del\n2001, y su Reglamento, la Ley Nº 7659 del 28 de febrero de 1997 y el Decreto Ejecutivo Nº 31708-H\ndel 16 de marzo del 2004.\n\nConsiderando:\n\n1º-Que mediante la Ley Nº 7659, publicada en La Gaceta Nº 66 del 7 de abril de 1997, se aprobó un\ncontrato de préstamo entre la República de Costa Rica y el Fondo Internacional de Desarrollo\nAgrícola (FIDA) para financiar el Proyecto de Desarrollo Agrícola de la Península de Nicoya\n(PRODAPEN).\n\n2º-Que en cumplimiento de las condiciones de dicho contrato de préstamo, el PRODAPEN tiene a cargo\nel financiamiento y asesoría técnica a productores de la zona, así como la ejecución de varios\nproyectos de infraestructura para el desarrollo de la península de Nicoya, por un plazo de 6 años.\n\n3º-Que al cierre técnico de este proyecto quedaría un remanente del préstamo, razón por la que el\nMinisterio de Hacienda y el de Agricultura y Ganadería, negociaron con el Fondo Internacional de\nDesarrollo Agrícola la utilización de dicho remanente en la ejecución de un Plan Piloto de\nCompetitividad Rural que sería impulsado por el MEIC en la zona de influencia del proyecto.\n\n4º-Que el cierre técnico de este proyecto está dispuesto para junio 2005, razón por la cual se hace\nnecesario contar con la autorización de gasto a fin de lograr la ejecución de los recursos a inicios\ndel año 2005.  5º-Que mediante Decreto Ejecutivo Nº 31708-H, publicado en La Gaceta Nº 62 del 29 de\nmarzo del 2004, la Autoridad Presupuestaria formuló las Directrices Generales de Política\nPresupuestaria para el 2005, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por\nel Presidente de la República, estableciendo en el artículo 1° del citado Decreto, el límite de\ngasto presupuestario del presente año, para las entidades cubiertas por el ámbito del mencionado\nÓrgano Colegiado.  6º-Que mediante oficio STAP-CIRCULAR STAP-0435-04 del 14 de abril del 2004, se\ncomunicó a PRODAPEN el límite de gasto fijado para el año 2005.\n\n7º-A efectos de solicitar el desembolso total de los fondos contratados, la Entidad solicitó\nmediante oficio Nº 010-04 del 29 de noviembre, 2004, la ampliación del límite de gasto total\npresupuestario para el año 2005.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 32164\n\n                        Modifies the budgetary expenditure limit for the Agricultural Development\nProject of the Nicoya Peninsula, established in the 2005 Budgetary Policy Directives\n\nComplete Text of record: 7ADB3\nNº 32164\n\nNº 32164\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the powers conferred upon them by Articles 140, subsections 3) and 18) and 146 of the\nPolitical Constitution; Articles 25, subsection 1), 27, subsection 1) and 28, subsection 2) item b) of\nLaw No. 6227 or the General Law of Public Administration of May 2, 1978, Law No. 8131 or the Law\nof the Financial Administration of the Republic and Public Budgets of September 18,\n2001, and its Regulations, Law No. 7659 of February 28, 1997 and Executive Decree No. 31708-H\nof March 16, 2004.\n\nConsidering:\n\n1st-That through Law No. 7659, published in La Gaceta No. 66 of April 7, 1997, a\nloan agreement was approved between the Republic of Costa Rica and the International Fund for Agricultural\nDevelopment (IFAD) to finance the Agricultural Development Project of the Nicoya Peninsula\n(PRODAPEN).\n\n2nd-That in compliance with the conditions of said loan agreement, PRODAPEN is responsible for\nthe financing and technical advisory services to producers in the area, as well as the execution of several\ninfrastructure projects for the development of the Nicoya Peninsula, for a term of 6 years.\n\n3rd-That upon the technical closure of this project, a loan remainder would remain, which is why the\nMinistry of Finance and the Ministry of Agriculture and Livestock negotiated with the International Fund for\nAgricultural Development the use of said remainder in the execution of a Pilot Plan for\nRural Competitiveness that would be promoted by the MEIC in the project's area of influence.\n\n4th-That the technical closure of this project is scheduled for June 2005, which is why it\nis necessary to have the expenditure authorization in order to achieve the execution of the resources at the beginning\nof the year 2005.  5th-That through Executive Decree No. 31708-H, published in La Gaceta No. 62 of March 29,\n2004, the Budgetary Authority formulated the General Budgetary Policy\nDirectives for 2005, which were reviewed by the Governing Council and approved by\nthe President of the Republic, establishing in Article 1 of said Decree the\nbudgetary expenditure limit for the present year, for the entities covered under the scope of the aforementioned\nCollegiate Body.  6th-That through official communication STAP-CIRCULAR STAP-0435-04 of April 14, 2004, the\nexpenditure limit set for the year 2005 was communicated to PRODAPEN.\n\n7th-In order to request the total disbursement of the contracted funds, the Entity requested,\nthrough official communication No. 010-04 of November 29, 2004, the expansion of the total\nbudgetary expenditure limit for the year 2005.
