  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 32224\n\n                        Imposición de servidumbre de acueducto por el término de diez años, sobre el\ninmueble inscrito en el Registro de la Propiedad bajo el Sistema de Folio Real  No. 016126-00\n\nTexto Completo acta: 7C080\nNº 32224\n\nNº 32224\n\nEL\nPRESIDENTE DE LA REPÚBLICA\n\nY EL\nMINISTRO DE GOBERNACIÓN Y POLICÍA,\n\nY SEGURIDA\nPÚBLICA\n\n            Con fundamento en el Artículo N° 146\nde la Constitución Política, los Artículos 99 y siguientes de la Ley de Aguas\nNº 276 del 27 de agosto de 1942 y sus reformas, el Artículo N° 383 siguientes y\nconcordantes del Código Civil.\n\nConsiderando:\n\n            1º-Que mediante la Resolución Nº\nR-153-AGUAS-MINAE-2000, de las doce horas del seis de abril del año dos mil, el\nDepartamento de Aguas del Ministerio del Ambiente y Energía, otorgó a partir de\nesa fecha al Señor Carlos Manuel Pérez Ramírez, cédula de identidad Nº\n4-114-744, concesión de aprovechamiento de aguas por un plazo de diez años,\npara uso doméstico, abrevadero y porqueriza, durante todo el año, las\nveinticuatro horas del día, en cantidad de 0,40 litros por segundo, efectuando\nla captación de una naciente ubicada en la finca del partido de Guanacaste,\nmatrícula número 016126-000, con los linderos y cabida que indica el registro\nla cual es propiedad del señor Iok Io Chan Wong conocido como: Andrés Sánchez\nWong, cédula de identidad Nº 8-044-515, y conduciéndola por tubería subterránea\nhasta el sitio de aprovechamiento. \n\n            2º-Que el día 22 de abril del 2003,\nel señor Carlos Manuel Pérez Ramírez, cédula de identidad Nº 4-114-744, en su\ncalidad de propietario del fundo servido, la cual le pertenece al partido de\nGuanacaste, Folio Real Nº 095866-001 y 002, presentó solicitud de imposición de\nservidumbre de acueducto ante este Despacho, siguiendo recomendación hecha por MINAE\ny en apego a lo establecido en la Ley de Aguas Nº 276 del 27 de agosto de 1942\ny sus reformas.\n\n            3º-Que previo procedimiento\nadministrativo y mediante Resolución Nº 0142-2004-ALG, de las catorce horas,\ntreinta y cinco minutos del veintiséis de enero del dos mil tres, la Dirección\nde Asesoría Jurídica de este Ministerio, pone en conocimiento de las partes el\ninforme rendido por los peritos valuadores del Departamento de Valoraciones del\nMinisterio de Hacienda, la Ingeniera Lorena López Alfaro, sobre el monto de\nindemnización correspondiente al propietario del fundo sirviente, el cual asciende\na la suma de ¢409.177,10 (cuatrocientos nueve mil ciento setenta y siete\ncolones con diez céntimos).\n\n            4º-Que de conformidad con los\nestudios realizados por este Ministerio y la concesión de aprovechamiento de\naguas otorgada mediante Resolución Nº R-153-AGUAS-MINAE-2000, de las doce horas\ndel seis de abril del año dos mil, los Artículos 99 y siguientes de la Ley de\nAguas Nº 276 del 27 de agosto de 1942 y sus reformas y el Artículo N° 383 del\nCódigo Civil, procede decretar la constitución de la correspondiente\nservidumbre de acueducto.\n\nDECRETAN:\n\n            Artículo 1º-Imponer servidumbre de\nacueducto por el término de diez años, según los términos de la concesión,\nsobre el inmueble inscrito en el Registro de la Propiedad partido de Guanacaste\nFolio Real Nº 016126-00, que es terreno para la agricultura, pasto y montaña,\nubicado en la provincia de Guanacaste, cantón ocho Tilarán, distrito siete\nArenal.  Linderos: norte, Freddy Pérez\nElizondo; sur: calle pública y Turística SU S. A.; este, Fernando Murillo\nEsquivel y Turística SU S. A., y oeste, Freddy Pérez Elizondo, Agropecuaria Río\nBlanco y Turística SU S. A. A.; east, Fernando Murillo Esquivel and Turística SU S. A.; and west, Freddy\nPérez Elizondo, Agropecuaria Río Blanco, and Turística SU S. A. It measures one\nmillion three hundred fifty-five thousand three hundred sixty-five meters and\nthirty square decimeters, which belongs to Mr. Iok Io Chan Wong, known as:\nAndrés Sánchez Wong, identity card No. 8-044-515, in favor of the property of\nthe Guanacaste district, registration Folio Real No. 095866-001 and 002, whose\nnature is pasture land situated in district 07 Arenal, canton 08 Tilarán, of\nthe province of Guanacaste, with boundaries and area as indicated in the\nregistry and whose owner is Mr. Carlos Manuel Pérez Ramírez, identity card No.\n4-114-744.\n\nArticle 2º-Description of the\neasement (servidumbre): It will be located in a north-to-south direction, with\na length of seven hundred twenty-eight meters, and a width of two meters, for\nan extension of 1,437.24 square meters.\n\nArticle 3º-The compensation is set\nat the sum of ¢409,177.10 (four hundred nine thousand one hundred seventy-seven\ncolones and ten céntimos), which must be paid immediately by Mr. Carlos Manuel\nPérez Ramírez or by his attorney-in-fact, Licenciado Oscar Alberto Pérez\nMurillo.\n\nArticle 4º-This Executive Decree becomes\neffective upon its publication.\n\nGiven at the Presidency of the\nRepublic.-San José, at ten thirty on the eighth day of November of two\nthousand four."
