artículo 28, inciso 2) de la Ley General de la Administración Pública;\nartículo 24, inciso e) la Ley de Creación del Servicio Nacional de\nGuardacostas, Nº 8000, publicada en La Gaceta Nº 99 del 24 de mayo del\n2000; y Decreto Ejecutivo Nº 90-SC del 13 de diciembre de 1965, publicado en La\nGaceta Nº 286 del 17 de diciembre de 1965.\n\nConsiderando:\n\n            1º-Que la Ley de Creación del\nServicio Nacional de Guardacostas, Nº 8000, establece en su artículo 24, inciso\ne), el pago de zonaje para el Director de la Academia del Servicio, según los\nparámetros que maneja el Servicio Civil para los funcionarios del Gobierno\nCentral; sin embargo, en el Decreto Ejecutivo Nº 29144-MSP que reglamenta dicha\nLey, no se establecen los lineamientos específicos para regular dicho pago. \n\n            2º-Que el Decreto Ejecutivo Nº 90-SC\ndel 13 de diciembre de 1965, publicado en La Gaceta Nº 286 del 17 de\ndiciembre de 1965, constituye el marco jurídico general que regula el pago de\nzonaje a los servidores de la Administración Central.\n\n            3º-Que la Academia del Servicio se\nencuentra ubicada en el cantón sétimo de la provincia de Puntarenas, Golfito,\npudiendo eventualmente ser traslada a cualquier otra parte del territorio\nnacional, por lo que se hace necesario el traslado o nombramiento del Director\nAcadémico en el lugar en que ésta se encuentre para poder cumplir a cabalidad\ncon sus funciones. \n\n            4º-Que como el costo de vida, la\nfacilidad de servicios, el clima, la salubridad, los medios y riesgos de\ntransporte, las posibilidades de educación y atención médica, para el servidor\ny sus familiares, al igual que otros factores que inciden en la vida diaria son\ndiferentes en cada localidad del país, el pago por concepto de zonaje debe ser\nfijado tomando en consideración cada uno de los aspectos citados anteriormente. \n\n            5º-Que por las consideraciones\nexpuestas, se hace necesario introducir una reforma al inciso a) del numeral\n12, Sección VI: \"De la Academia del Servicio\" del Decreto Ejecutivo Nº\n29144-MSP, regulando los aspectos específicos que deberá contemplar la\nAdministración para el pago del zonaje al Director Académico. Por tanto:\n\nDECRETAN:\n\n            Reforma al inciso a) del numeral 12\ndel Decreto Ejecutivo Nº 29144 del:\n\nReglamento\na la Ley\n\ndel Servicio Nacional de\nGuardacostas\n\n            Artículo 1º-Refórmese el inciso a)\ndel numeral 12 del Decreto Ejecutivo Nº 29144, de \"Reglamento a la Ley de\nCreación del Servicio Nacional de Guardacostas\", para que en adelante se lea:\n\n\"a)\nDirector Académico. Es el responsable de la administración de los recursos y\ndel personal docente y administrativo de la Academia del Servicio, además de\nplanificar, coordinar y dirigir el Programa Curricular de la Academia del\nServicio en coordinación con la Dirección de Guardacostas, velará por el\ncorrecto funcionamiento de las unidades encargadas de la instrucción en la\ncapacitación técnica-policial náutica, procurando en todo momento la excelencia\nen la preparación profesional del personal a capacitar. Para el cumplimiento de\nlo anterior, el Director deberá residir en la misma zona en donde se ubica la\nAcademia de Servicio.\n\nPara\nlos efectos del reconocimiento por zonaje establecido en el artículo 24, inciso\ne) de la Ley Nº 8000, se deberán observar las siguientes reglas:\n\ni)   El pago de zonaje será porcentual, tomando en\nconsideración medios y riesgos de transporte, clima, salubridad del cantón o\nlugar, acceso a servicios básicos, costo local de vida según los índices del\nInstituto Nacional de Estadísticas y Censos, posibilidades de educación y\natención médica para el servidor y su familia, de manera que el ciento por\nciento corresponderá a la suma máxima que la Contraloría General de la\nRepública fije para el pago de zonaje a los servidores públicos.\n\nNo procederá el pago del zonaje cuando el domicilio legal del Director Académico esté en el mismo\nlugar o circunscripción cantonal de la Academia del Servicio.  Para la determinación de la suma a\npagar por concepto de zonaje, deberán tomarse en cuenta los beneficios de alojamiento y alimentación\nque reciba el servidor por parte del Ministerio, y que signifiquen una disminución en sus gastos de\nsubsistencia.\n\nii)  La Dirección de Recursos Humanos hará el\nestudio respectivo para determinar si procede o no el pago del zonaje de\nacuerdo con las consideraciones señaladas en el artículo anterior. En caso de\nser procedente, emitirá una resolución que servirá para dar curso a la acción\nde personal respectiva, en la cual deberá indicarse el monto que por concepto\nde zonaje se reconozca al servidor, así como su domicilio legal y el lugar\ndonde se encuentre ubicada la Academia.  En\ncada acción de personal del servidor se consignará el monto por el concepto\nantes dicho.\n\nEn\ncaso de no proceder el pago, procederá a comunicarlo mediante resolución\nfundada, al Director de la Academia, con copia al Director del Servicio.\n\niii)  El cálculo porcentual que será reconocido por\nconcepto de zonaje se fijará de acuerdo a la división territorial establecida para\nla Fuerza Pública, según la tabla contenida en el aparte vi) del presente\ninciso. La Dirección de Recursos Humanos ajustará de oficio dichos porcentajes,\nde conformidad con los máximos y mínimos que establezca la Contraloría General\nde la República, según lo dispuesto en el artículo 3º del Reglamento para el\nPago de Zonaje a los Servidores de la Administración Pública, y empezará a\nregir cuando exista el contenido presupuestario respectivo.\n\niv)  Se mantendrá el pago del zonaje cuando el\nDirector de la Academia se encuentre, hasta por el término de un mes, en alguna\nde las siguientes condiciones:\n\na)  Incapacidad.\n\nb)  Vacaciones.\n\nc)  Por estar en capacitación o disfrutando de una\nbeca.\n\nd)  Por permiso con goce de salario.\n\ne)  Por traslado para cumplir funciones propias de\nsu cargo a una zona en la que no se paga zonaje.\n\nv)   Cuando el servidor se vea obligado a\npermanecer por un periodo superior a un mes fuera de su lugar habitual de\ntrabajo por razones de capacitación u otro motivo, se le suspenderá el pago del\nincentivo hasta que se reincorpore nuevamente a sus funciones en dicho lugar,\nprevia comunicación formal a la Dirección de Recursos Humanos.\n\nLa\nsuspensión empezará a regir una vez que haya transcurrido un mes después de su\ndesplazo a otra zona.\n\nvi)  Los porcentajes que se reconocerán para efecto\nde zonaje de conformidad con lo establecido en el inciso iii) del presente Reglamento,\nson los siguientes:\n\n| 75% | 30% | 45% | 50% |\n| --- | --- | --- | --- |\n| Región 5 | Región 6 | Región 9 | Región 10 |\n| Cuajiniquil | Quepos | Limón | Golfito |\n| | Puntarenas | Barra del Colorado | Sixaola |\n\n \n\nvii) Cuando el servidor sea trasladado de una zona\ncon derecho a zonaje a otra con el mismo derecho, por un lapso mayor de un mes,\nse procederá al pago correspondiente realizando el ajuste de acuerdo con la\ntabla de zonas del artículo anterior.\n\nviii)\nLa Dirección de Recursos Humanos será la encargada de realizar el estudio\ncorrespondiente para el pago del incentivo que aquí se regula, y de ejecutar y\nvelar por el fiel cumplimiento de estas disposiciones, quedando obligado el Director\nAcadémico a observar y acatar los procedimientos que a tal efecto dictare.\n\nix) Para el pago del incentivo, el Director\nAcadémico deberá solicitar al Departamento de Recursos Humanos su reconocimiento\no modificación, adjuntando certificación de su domicilio legal, firmada y\nsellada por la autoridad competente de su circunscripción territorial, así como\ndeclaración jurada firmada por él y por el Director del Servicio Nacional de\nGuardacostas, haciendo constar el lugar en donde presta o prestará sus\nservicios.  El beneficio empezará a regir\nel primer día del mes siguiente a su solicitud, siempre y cuando la misma sea\nprocedente.  El Director del Servicio\nNacional de Guardacostas será el responsable de tramitar ante la Dirección de\nRecursos Humanos la solicitud debidamente fundamentada de supresión del\nbeneficio, acompañando una certificación del domicilio legal del servidor.\n\nx)  El zonaje dejará de pagarse cuando el servidor\ncese de trabajar en el puesto en que fue nombrado con disfrute de dicho\nbeneficio o cuando se modifiquen las circunstancias que motivaron ese pago\nadicional.\n\nLa\nsupresión de dicho beneficio se realizará, previa audiencia al servidor,\nmediante resolución fundada de la Dirección de Recursos Humanos, la cual será\ncomunicada al servidor con treinta días de anticipación a la fecha en que se\nhará efectiva.  Contra dicha resolución\ncabe los recursos de revocatoria y apelación en los términos y condiciones\ncontemplados en la Ley General de la Administración Pública.\n\nEn\nningún caso podrá alegarse derecho adquirido sobre el zonaje, en virtud de que\neste no constituye una prestación invariable.\n\nxi) En lo no regulado en el presente inciso, se\nestará a lo dispuesto en el Decreto Ejecutivo Nº 90-SC del 13 de diciembre de\n1965, publicado en La Gaceta Nº 286 del 17 de diciembre de 1965).\n\n       Artículo 2º-Rige a partir de su\npublicación.\n\n            Dado en la Presidencia de la\nRepública.-San José, a los seis días del mes de julio del dos mil cuatro.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Norm 32234\n\n Reform to the Regulation to the Law of the National Coast Guard Service\n\nFull Text record: 7C39B\nNº 32234\n\nNº 32234\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF PUBLIC SECURITY\n\n            In exercise of the powers conferred\nupon them by Article 140, subsections 3), 8) and 18) and 146) of the Political\nConstitution; Article 28, subsection 2) of the General Law of Public\nAdministration; Article 24, subsection e) of the Law Creating the National Coast\nGuard Service, Nº 8000, published in La Gaceta Nº 99 of May 24,\n2000; and Executive Decree Nº 90-SC of December 13, 1965, published in La\nGaceta Nº 286 of December 17, 1965.\n\nConsidering:\n\n            1º-That the Law Creating the National\nCoast Guard Service, Nº 8000, establishes in its Article 24, subsection e),\nthe payment of zonaje for the Director of the Service Academy, according to the\nparameters managed by the Civil Service for Central Government officials;\nhowever, Executive Decree Nº 29144-MSP, which regulates said Law, does not\nestablish specific guidelines to regulate such payment.\n\n            2º-That Executive Decree Nº 90-SC of\nDecember 13, 1965, published in La Gaceta Nº 286 of December 17, 1965,\nconstitutes the general legal framework that regulates the payment of zonaje\nto the servants of the Central Administration.\n\n            3º-That the Service Academy is located\nin the seventh canton of the province of Puntarenas, Golfito, and could\neventually be moved to any other part of the national territory; therefore, it\nis necessary for the Academic Director to be transferred or appointed to the\nplace where it is located in order to fully perform their duties.\n\n            4º-That since the cost of living, the\navailability of services, the climate, the salubrity, the means and risks of\ntransportation, the possibilities for education and medical care for the\nservant and their family members, as well as other factors that affect daily\nlife, are different in each locality of the country, the payment for zonaje\nmust be determined by taking into consideration each of the aspects cited above.\n\n            5º-That due to the considerations\nexpressed, it is necessary to introduce a reform to subsection a) of numeral 12,\nSection VI: \"Of the Service Academy\" of Executive Decree Nº 29144-MSP,\nregulating the specific aspects that the Administration must consider for the\npayment of zonaje to the Academic Director. Therefore:\n\nTHEY DECREE:\n\n            Reform to subsection a) of numeral 12\nof Executive Decree Nº 29144 of:\n\nRegulation\nto the Law\n\nof the National Coast Guard\nService\n\n            Article 1º-Let subsection a) of\nnumeral 12 of Executive Decree Nº 29144, of \"Regulation to the Law\nCreating the National Coast Guard Service\", be reformed so that it shall\nhereafter read:\n\n\"a)\nAcademic Director. Is the person responsible for the administration of the\nresources and the teaching and administrative staff of the Service Academy, in\naddition to planning, coordinating, and directing the Curricular Program of the\nService Academy in coordination with the Coast Guard Directorate; will oversee\nthe correct functioning of the units in charge of instruction in nautical\ntechnical-police training, striving at all times for excellence in the\nprofessional preparation of the personnel to be trained. To fulfill the\nforegoing, the Director must reside in the same zone where the Service Academy\nis located.\n\nFor\nthe purposes of the recognition for zonaje established in Article 24,\nsubsection e) of Law Nº 8000, the following rules must be observed:\n\ni)   The payment of zonaje shall be a percentage,\ntaking into consideration means and risks of transportation, climate, salubrity\nof the canton or place, access to basic services, local cost of living\naccording to the indices of the National Institute of Statistics and Censuses,\npossibilities for education and medical care for the servant and their family,\nsuch that one hundred percent shall correspond to the maximum sum that the\nComptroller General of the Republic sets for the payment of zonaje to public\nservants.\n\nThe payment of zonaje shall not proceed when the legal domicile of the Academic Director is in the same\nplace or cantonal jurisdiction as the Service Academy. In determining the sum to\nbe paid for zonaje, account must be taken of the lodging and food benefits\nreceived by the servant from the Ministry, which signify a decrease in their\nsubsistence expenses.\n\nii)  The Human Resources Directorate shall conduct\nthe respective study to determine whether or not the payment of zonaje is\napplicable in accordance with the considerations indicated in the preceding\narticle. If it is applicable, it shall issue a resolution that will serve to\nprocess the respective personnel action, in which the amount recognized to the\nservant for zonaje must be indicated, as well as their legal domicile and the\nplace where the Academy is located. Each personnel action of the servant shall\nrecord the amount for the aforementioned concept.\n\nIf\nthe payment is not applicable, it shall proceed to communicate this by a\nreasoned resolution to the Director of the Academy, with a copy to the Director\nof the Service.\n\niii)  The percentage calculation that will be\nrecognized for zonaje shall be set according to the territorial division\nestablished for the Public Force, in accordance with the table contained in\nsection vi) of this subsection. The Human Resources Directorate shall adjust\nthese percentages ex officio, in accordance with the maximums and minimums\nestablished by the Comptroller General of the Republic, as stipulated in Article\n3º of the Regulation for the Payment of Zonaje to Public Administration\nServants, and it shall enter into force once the respective budgetary\nallocation exists.\n\niv)  The payment of zonaje shall be maintained when\nthe Director of the Academy is, for a term of up to one month, in any of the\nfollowing conditions:\n\na)  Disability.\n\nb)  Vacation.\n\nc)  While undergoing training or enjoying a\nscholarship.\n\nd)  On leave with pay.\n\ne)  By transfer to perform duties inherent to their\nposition in a zone where zonaje is not paid.\n\nv)   When the servant is obliged to remain for a\nperiod exceeding one month outside their habitual place of work for reasons of\ntraining or another motive, the payment of the incentive shall be suspended\nuntil they rejoin their duties in said place, upon prior formal notification to\nthe Human Resources Directorate.\n\nThe\nsuspension shall enter into force once one month has passed after their move to\nanother zone.\n\nvi)  The percentages that shall be recognized for\nzonaje purposes in accordance with the provisions of subsection iii) of this\nRegulation are the following:\n\n| 75% | 30% | 45% | 50% |\n| --- | --- | --- | --- |\n| Region 5 | Region 6 | Region 9 | Region 10 |\n| Cuajiniquil | Quepos | Limón | Golfito |\n| | Puntarenas | Barra del Colorado | Sixaola |\n\n \n\nvii) When the servant is transferred from a zone with\nentitlement to zonaje to another with the same entitlement, for a period\nexceeding one month, the corresponding payment shall be made, adjusting it in\naccordance with the zone table in the preceding article.\n\nviii)\nThe Human Resources Directorate shall be responsible for conducting the\ncorresponding study for the payment of the incentive regulated herein, and for\nexecuting and ensuring the faithful compliance with these provisions, with the\nAcademic Director being obliged to observe and abide by the procedures dictated\nfor such purposes.\n\nix) For the payment of the incentive, the Academic\nDirector must request its recognition or modification from the Human Resources\nDepartment, attaching a certification of their legal domicile, signed and\nsealed by the competent authority of their territorial circumscription, as well\nas a sworn declaration signed by them and by the Director of the National Coast\nGuard Service, attesting to the place where they provide or will provide their\nservices. The benefit shall enter into force on the first day of the month\nfollowing their request, provided that the same is applicable. The Director of\nthe National Coast Guard Service shall be responsible for processing before the\nHuman Resources Directorate the duly substantiated request for the suppression\nof the benefit, accompanied by a certification of the servant's legal domicile.\n\nx)  The zonaje shall cease to be paid when the\nservant ceases to work in the position for which they were appointed with the\nenjoyment of said benefit or when the circumstances that motivated that\nadditional payment change.\n\nThe\nsuppression of said benefit shall be carried out, after a hearing is granted to\nthe servant, by a reasoned resolution from the Human Resources Directorate,\nwhich shall be communicated to the servant thirty days in advance of the date\nit will take effect. Against such resolution, the remedies of revocation and\nappeal are admissible under the terms and conditions stipulated in the General\nLaw of Public Administration.\n\nIn\nno case may an acquired right to zonaje be alleged, as it does not constitute\nan invariable benefit.\n\nxi) In matters not regulated in this subsection, the\nprovisions of Executive Decree Nº 90-SC of December 13, 1965, published in La\nGaceta Nº 286 of December 17, 1965) shall apply.\n\n       Article 2º-Shall take effect as of its\npublication.\n\n            Enacted at the Presidency of the\nRepublic.-San José, on the sixth day of July, two thousand four." }
