físicas:\n\n \n\n·        \nFormula de solicitud debidamente\nllena y firmada (F.S.L.).\n\n·        \nPresentar cedula de identidad\nvigente en original y aportar fotocopia por ambos lados o cedula de residencia\nvigente, y aportar fotocopia completa.\n\n·        \nAportar una certificación del\nRegistro Nacional de Buques, que demuestre que la embarcación esta inscrita a\nsu nombre, con un máximo legal.\n\n·        \nPresentar cedula de identidad,\nvigente en original y aportar fotocopia por ambos lados o cedula de residencia\nvigente y aportar fotocopia completa, del representante legal.\n\n·        \nPresentar original de la cedula jurídica\nvigente y aportar fotocopia por ambos lados.\n\n·        \nAportar una certificación registral\no notarial de la empresa en original, con no mas de un mes de haber sido\nexpedida y que contenga como mínimo los siguientes elementos:\n\n·        \nCitas de inscripción en el Registro\nPublico Nacional.\n\n·        \nNumero de cedula de persona jurídica.\n\n·        \nPersonería jurídica.\n\n·        \nObjeto y Plazo Social.\n\n·        \nDistribución de la Acciones.\n\n·        \nAportar una certificación del\nRegistro Nacional de Buques, que demuestre que la embarcación esta inscrita a\nnombre de la empresa solicitante, con un máximo de un mes calendario de haber\nsido expedida.\n\n·        \nPresentar certificado de\nnavegabilidad vigente en original y aportar fotocopia.\n\n·        \nFotografía de la embarcación por\nambos lados, donde se aprecie el nombre, numero de matricula y bandera.\n\n·        \nLa empresa propietaria de la embarcación\nsolicitante debe estar al dia con sus obligaciones obrero patronales.\n\n·        \nCancelación del canon respectivo.\n\nArticulo\n2°-Requisitos para renovar una licencia\nde pesca comercial.\n\n \n\n \n\nA.\nPersonas físicas:\n\n \n\n·        \nFormula de solicitud debidamente\nllena y firmada (F.S.L.).\n\n·        \nPresentar cedula de identidad o de\nresidencia, vigentes.\n\n·        \nAportar una certificación del\nRegistro Nacional de Buques, que demuestre que la embarcación esta inscrita a\nsu nombre, con un máximo de un mes calendario de haber sido expedida.\n\n·        \nPresentar certificado de\nnavegabilidad vigente.\n\n·        \nPresentar carne de pesca comercial\nvigente, en el caso de Pescadores artesanales en pequeña escala.\n\n·        \nEstar al día con las obligaciones\nobrero patronales.\n\n·        \nCancelación del canon respectivo.\n\n \n\nB.\nPersonas jurídicas:\n\n \n\n·        \nFormula de solicitud debidamente\nllena y firmada (F.S.L.) por el representante legal.\n\n·        \nPresentar cedula de identidad o\ncedula de residencia del representante legal, vigentes.\n\n·        \nAportar certificación registral o\nnotarial de la empresa en original, con no mas de un mes de haber sido expedida\ny que contenga como mínimo los siguientes elementos:\n\n \n\n1.       Citas\nde Inscripción en el Registro Publico Nacional.\n\n2.       Numero\nde cedula de persona jurídica.\n\n3.       Personería\njurídica.\n\n4.       Objeto\ny plazo social.\n\n5.       Distribución\nde las acciones.\n\n \n\n \n\n§        \nAportar una certificación del\nRegistro Nacional de Buques que demuestre que la embarcación esta inscrita a\nnombre de la empresa solicitante, con un máximo de un mes calendario de haber\nsido expedida.                                                  Presentar\ncertificado de navegabilidad vigente.  Presentar\ncarne de pesca comercial vigente del representante legal. \n\n§        \nLa empresa propietaria de la embarcación\nsolicitante debe estar al día con sus obligaciones obrero patronales.\n\n§        \nCancelación del canon respectivo.\n\nArtículo 2.Bis Del plazo para la\nrenovación de la licencia de pesca comercial\n\n    Los\npermisionarios de licencia de pesca comercial contarán con un plazo de dos\nmeses calendario a partir del vencimiento de la licencia de pesca, para\nrealizar las gestiones o solicitudes de trámites de prórrogas de renovación de\nla licencia de pesca comercial en forma legal ante las Oficinas y autoridades\ndel INCOPESCA.\n\n(La adición practicada de este numeral por acuerdo AJDIP/151-2011 de 6 de mayo del 2011,\nposteriormente fue dejada sin efecto por acuerdo AJDIP/395 del 31 de octubre de 2014. Se advierte\nque dicha derogación no se ha aplicado a este numeral, debido a que el ente emisor no indica\nexpresamente que como consecuencia, debe volver esta norma a su estado anterior a dicha adición).\n\n       Artículo 3º—Requisitos para el otorgamiento de\nLicencia a embarcaciones dedicadas a pesca deportiva y pesca turística marina o\ncontinental así como para la observación de especies acuáticas por \"PRIMERA\nVEZ\":\n\n    a) Propietario de embarcación nacional:\n\n    a.1. Personas físicas:\n\n- Fórmula de\nsolicitud debidamente llena y firmada por el propietario, apoderado o capitán. Cuando se\ntrate del capitán o apoderado, presentar documento legal que lo acredite como tal.\n\n- Presentar\noriginal y copia de alguno de los siguientes documentos, según corresponda:\n\n        - Cédula de identidad vigente.\n\n        - Cédula de residencia vigente.\n\n        - Pasaporte vigente.\n\n-\nCertificación original de que la embarcación está inscrita ante el Registro Nacional de\nBuques.\n\n- Presentar\noriginal y copia del certificado de navegabilidad vigente.\n\n- En el caso de\nembarcaciones dedicadas a la pesca turística, presentar original y copia de la\ndeclaratoria turística emitida por\n            el Instituto\nCostarricense de Turismo (ICT).\n\n- Presentar\ncarné de pesca vigentes respetivos del propietario o el capitán y de los tripulantes.\n\n- En el caso de\nembarcaciones dedicadas a la pesca turística y la observación de especies acuáticas,\ndeberá presentarse documento original idóneo emitido por la CCSS, en el que se demuestre\nestar inscritos y al día con sus obligaciones.\n\n- Cancelación\nde la tarifa respectiva\n\n \n\n    a.2. Personas jurídicas:\n\n- Fórmula de\nsolicitud debidamente llena y firmada por el representante legal o capitán. Cuando se\ntrate de capitán presentar documento legal que lo acredite.\n\n- Presentar\noriginal y copia de alguno de los siguientes documentos, del (la) representante legal o\ndel capitán según corresponda:\n\n        - Cédula de identidad.\n\n        - Cédula de residencia vigente.\n\n        - Pasaporte vigente.\n\n- Presentar\noriginal y copia de cédula de persona jurídica vigente.\n\n- Entregar\noriginal de certificación registral o notarial de personería jurídica de la empresa,\ncon no más de un mes de haber sido expedida.\n\n-\nCertificación original de que la embarcación está inscrita ante el Registro Nacional de\nBuques.\n\n- Presentar\noriginal y copia del certificado de navegabilidad vigente.\n\n- En el caso de\nembarcaciones dedicadas a la pesca turística, presentar original y copia de la\ndeclaratoria turística emitida por el Instituto Costarricense de Turismo (ICT).\n\n- Presentar\ncarné de pesca vigentes respectivos del propietario o el capitán y de los tripulantes.\n\n- En el caso de\nembarcaciones dedicadas a la pesca turística y la observación de especies acuáticas,\ndeberá presentarse documento original idóneo emitido por la CCSS, en el que se demuestre\nestar inscritos y al día con sus obligaciones.\n\n- Cancelación\nde la tarifa respectiva.\n\n \n\n    b. Propietario de embarcación extranjera (únicamente para pesca\ndeportiva).\n\n    b.1. Personas físicas:\n\n- Fórmula de\nsolicitud debidamente llena y firmada por el representante legal o capitán. Cuando se\ntrate del capitán, presentar documento legal que lo acredite como tal.\n\n- Presentar\noriginal de alguno de los siguientes documentos, del (la) propietario(a) o del capitán\nsegún corresponda:\n\n        - Cédula de identidad.\n\n        - Cédula de residencia vigente.\n\n        - Pasaporte vigente.\n\n        - Carné de turista extendido por el I.C.T.,\nvigente.\n\n- Presentar\noriginal y copia del certificado de importación temporal emitido por el Servicio Nacional\nde Aduanas del Ministerio de Hacienda.\n\n- Presentar\noriginal y copia del permiso de permanencia de la embarcación en aguas nacionales emitido\npor el Ministerio de Obras Públicas y Transportes.\n\n- Presentar\ncarné de pesca vigentes respectivos del propietario o el capitán y de los tripulantes.\n\n- Cancelación\nde la tarifa respectiva.\n\n \n\n    b. 2. Personas jurídicas (nacional o extranjera):\n\n- Fórmula de\nsolicitud debidamente llena y firmada por el representante legal o capitán. Cuando se\ntrate del capitán, presentar documento legal que lo acredite como tal.\n\n- Presentar\noriginal de alguno de los siguientes documentos, del (la) representante legal o del\ncapitán según corresponda:\n\n        - Cédula de identidad.\n\n        - Cédula de residencia vigente.\n\n        - Pasaporte vigente.\n\n        - Carné de turista extendido por el I.C.T.,\nvigente.\n\n- Presentar\noriginal y copia de cédula de persona jurídica vigente.\n\n- Entregar\noriginal de certificación registral o notarial de personería jurídica de la empresa,\ncon no más de un mes de haber sido expedida (únicamente para empresas costarricenses).\n\n- Presentar\noriginal y copia del certificado de importación temporal emitido por el Servicio Nacional\nde Aduanas del Ministerio de Hacienda.\n\n-Presentar\noriginal y copia del permiso de permanencia de la embarcación en aguas nacionales emitido\npor el Ministerio de Obras Públicas y Transportes.\n\n- Presentar\ncarné de pesca vigentes respectivos del propietario o el capitán y de los tripulantes.\n\n- Cancelación\nde la tarifa respectiva.\n\n   (Así reformado por el\nartículo 1° del Acuerdo AJDIP 430 del 31 de agosto de 2005).  \n\n     Artículo 4º—Requisitos\npara renovación de Licencia a embarcaciones dedicadas a pesca deportiva y pesca\nturística marina o continental así como para la observación de especies acuáticas.\n\n    a) Propietario de\nembarcación nacional.\n\n    a.1. Personas físicas:\n\n- Fórmula de solicitud debidamente llena y\nfirmada por el representante legal o capitán. Cuando se trate del capitán, presentar\ndocumento legal que lo acredite como tal. ? Presentar original de alguno de los siguientes\ndocumentos, según corresponda:\n\n        - Cédula de identidad vigente.\n\n        - Cédula de residencia vigente.\n\n        - Pasaporte vigente.\n\n- Certificación original de que la\nembarcación está inscrita ante el Registro Nacional de Buques.\n\n- Presentar original y copia del\ncertificado de navegabilidad vigente.\n\n- En el caso de embarcaciones dedicadas a\nla pesca turística, presentar original de la declaratoria turística emitida por el\nInstituto Costarricense de Turismo (ICT).\n\n- Presentar carné de pesca vigentes\nrespectivos del propietario o el capitán y de los tripulantes.\n\n- En el caso de embarcaciones dedicadas a\nla pesca turística y la observación de especies acuáticas; deberán estar al día con\nlas obligaciones en la CCSS.\n\n- Cancelación de la tarifa respectiva.\n\n    a.2. Personas Jurídicas\n\n- Fórmula de solicitud debidamente llena y\nfirmada por el representante legal o capitán. Para vendedor auxiliar de huevos de\ntortuga:\n\n \n\n·        \nAportar fotocopia del permiso de comercialización\nvigente de la Asociación de Desarrollo Integral de Ostional.\n\n·        \nPresentar original de la cedula de\nidentidad o cedula de residencia, vigentes.\n\n·        \nPresentar carne de venta de huevos\nde tortuga Lora.\n\n·        \nAportar 1 fotografía reciente, tamaño\npasaporte.\n\n·        \nCancelación del canon respectivo.\n\nArticulo\n20.-Requisitos para autorizar la sustitución\nde embarcaciones o motores:\n\n \n\n \n\nA.\nSustitución por adquisición:\n\n \n\n·         Formula de solicitud debidamente llena y firmada por el permisionario o el representante\nlegal en personas jurídicas, donde se indique las características de la embarcación a sustituir o\nla  potencia del motor a sustituir.\n\n·        \nPresentar cedula de identidad o\ncedula de residencia vigentes.\n\n·        \nNota donde especifique las razones\npor las que requiere la sustitución y el destine que dará a la embarcación a\nsustituir. idóneo en caso de\nmortual notarial.\n\n·        \nCancelación del canon respectivo.\n\n \n\nB.\nPersonas jurídicas.\n\n \n\n·        \nFormula de solicitud debidamente\nllena y firmada por el permisionario o el representante legal de la empresa\npropietaria de la embarcación, donde se indique la justificación para solicitar\nel traspaso.\n\n·        \nPresentar cedula de identidad o\ncedula de residencia vigentes del solicitante.\n\n·        \nAportar opción de compra-venta de la\nembarcación con un máximo de 3 meses de haber sido emitida.\n\n·        \nPresentar cedula jurídica por ambos\nlados, vigente en original y aportar fotocopia de la persona interesada en\nadquirir la licencia con su embarcación.\n\n·        \nAportar certificación registral o\nnotarial en original que incluya numero de cedula jurídica, personería jurídica,\nplazo social, objeto social, división del capital de la persona interesada en\nadquirir la licencia con su embarcación.\n\n·        \nCancelación del canon respectivo.\n\nArticulo\n23.-Requisitos para recomendar la exportación\ne importación de productos pesqueros:            \n\n      \n\n·        \nAportar solicitud indicando el tipo\nde producto a exportar o importar, su origen y destino, cantidades, etc.,\ndebidamente llena, y firmada por el interesado.\n\n·        \nPresentar cedula de identidad o\ncedula de residencia vigentes del interesado en personas físicas o del\nrepresentante legal en personas jurídicas vigentes.\n\n·        \nPresentar permiso de comercialización\ne industrialización extendido por el INCOPESCA.\n\n·        \nContrato de maquila de una planta\ndebidamente autorizada por el INCOPESCA.\n\n·        \nAportar factura de exportación o importación\ndel producto.\n\n·        \nCancelación del canon respectivo.\n\nArticulo\n24.-Requisitos para recomendar la importación\nde insumos pesqueros y acuícola:\n\n \n\n \n\n·        \nAportar solicitud indicando el\ninsumo a importar, su cantidad y origen, uso y periodo en que lo utilizara,\netc., debidamente firmada por el For small-scale artisanal vessels exceeding 8 meters in length and a 3-mile range, it must state that the applicant accepts that INCOPESCA may authorise, ex officio, fishing zones different from those appearing on the license, such that fishing in the coastal zone will be impossible.\n\n· Provide a purchase-sale option agreement for the vessel.\n\n· Payment of the respective fee.\n\nB. Engine substitution:\n\n· Present the applicant's current identity card or residency card.\n\n· Certificate from the Property Registry stating the new engine is registered.\n\n· Payment of the respective fee.\n\nArticle 21.- Requirements to authorize vessel inactivity:\n\n· Duly completed application form signed by the permit holder or the legal representative for legal entities, indicating the justification for requesting inactivity and the period for which it is requested, which must be greater than 2 months and up to one year.\n\n· Present a current identity card or residency card.\n\n· Payment of the respective fee.\n\nArticle 22.- Requirements to authorize the transfer of commercial fishing licenses with their vessels:\n\nA. Natural persons:\n\n· Duly completed application form signed by the permit holder, indicating the justification for requesting the transfer.\n\n· Present the applicant's current identity card or residency card.\n\n· Provide a purchase-sale option agreement no more than 3 months old.\n\n· For a donation, present a notarised donation document.\n\n· Present the current identity card or residency card of the person interested in acquiring the license with its vessel, and provide a photocopy of both sides or the complete card.\n\n· In cases of transfer by inheritance, present a final judgment or a suitable notarial document in case of notarial probate.\n\n· Payment of the respective fee.\n\nB. Legal entities.\n\n· Duly completed application form signed by the permit holder or the legal representative of the company that owns the vessel, indicating the justification for requesting the transfer.\n\n· Present the applicant's current identity card or residency card.\n\n· Provide a purchase-sale option agreement for the vessel no more than 3 months old.\n\n· Present the original, current legal entity ID card on both sides and provide a photocopy of the person interested in acquiring the license with its vessel.\n\n· Provide an original registry or notarial certification that includes the legal entity ID number, legal status, corporate duration, corporate purpose, capital division of the person interested in acquiring the license with its vessel.\n\n· Payment of the respective fee.\n\nArticle 23.- Requirements to recommend the export and import of fishery products:\n\n· Provide a duly completed application signed by the interested party indicating the type of product to be exported or imported, its origin and destination, quantities, etc.\n\n· Present a current identity card or residency card of the interested party for natural persons or of the legal representative for legal entities.\n\n· Present the marketing and industrialisation permit issued by INCOPESCA.\n\n· Processing contract from a plant duly authorised by INCOPESCA.\n\n· Provide the export or import invoice for the product.\n\n· Payment of the respective fee.\n\nArticle 24.- Requirements to recommend the importation of fishery and aquaculture inputs:\n\n· Provide an application signed by the interested party indicating the input to be imported, its quantity and origin, use and period in which it will be used, etc.\n\n· Present a current identity card or residency card of the interested party for natural persons or of the legal representative for legal entities.\n\n· Provide the duly completed Ministry of Finance form for these purposes.\n\n· Provide the commercial invoice for the input to be imported.\n\n· Provide the BL (Bill of Lading).\n\n· Payment of the respective fee.\n\nArticle 25.- Requirements to authorize the unloading of fishery products:\n\n· Submit an application indicating the product's provenance, the species with their respective volumes, time, date, and place where the unloading will take place. This application must be signed by the vessel owner or their duly authorised representative.\n\n· Present the applicant's current identity card or residency card.\n\n· Payment of the respective fee.\n\nArticle 26.—Requirements to obtain a tuna fishing license for vessels with a current annual registration:\n\nA- First license of the year:\n\n· Payment of the fee corresponding to the Annual Registration of the vessel, equivalent to $20 per net registered ton. This may be done starting in December of the year prior to the one for which the tuna fishing license is sought, in which case the fee shall be $10 per net registered ton.\n\n· Request for the fishing license by the Customs Agency or the legal representative of the vessel.\n\n· Certification of ownership of the vessel.\n\n· Authorisation authenticated by a lawyer from the owner or the legal representative of the Company owning the vessel, authorising the Customs Agency or natural person to carry out the fishing permit procedures for the vessel subject to the license.\n\n· Original current identity card and provide a photocopy of both sides, or current residency card and provide a complete photocopy, of the authorised person.\n\n· Provide a certificate from the Comisión Interamericana del Atún Tropical stating that the vessel is enrolled in the dolphin-safe tuna monitoring program.\n\n· Provide a note from the ship's captain committing to respect the country's legislation and to respect everything concerning the protection of dolphins emanating from the Comisión Interamericana del Atún Tropical.\n\n· Provide the ship captain's report on dolphin mortality from the previous trip.\n\n· Certification of the vessel's tonnage measurement (arqueo) from the Dirección General de Transporte Marítimo of the Ministerio de Obras Públicas y Transportes stipulating the net registered tonnage, no more than 3 months old.\n\n· Payment of the deposit in any Bank of the National Banking System for $54 per net registered tonnage.\n\n· Payment of the respective fee.\n\nB.
