de permisos de sustitución temporal\nde embarcaciones a embarcaciones de la flota pesquera nacional con fines\ncomerciales\").\n\nA.J.D.I.P./109.-Puntarenas, a los cuatro días del mes de\nmarzo del 2005.\n\nConsiderando:\n\n1º-Que de conformidad con las disposiciones establecidas\nen la Ley Nº\n7384 del 16 de marzo de 1994, publicada en el Diario Oficial\nLa Gaceta Nº 62 del 29 de\nmarzo de 1994, el INCOPESCA tiene competencia y facultad legal para normar lo\nconcerniente al aprovechamiento, explotación y comercialización de los recursos\npesqueros, el otorgamiento de los permisos de pesca, construcción de\nembarcaciones, permisos de inactividad.\n\n2º-Que al amparo de esa potestad legal se adoptaron\ndiversos acuerdos que regulan el otorgamiento de permisos de inactividad, como\npolítica para garantizar una adecuada y racional explotación de los recursos\npesqueros y un óptimo rendimiento de las actividades pesqueras.\n\n3º-Que a efecto de lograr una mayor y mejor aplicación y\ncomprensión de las disposiciones legales existentes en materia de\ninactividades, se ha estimado oportuno y conveniente integrarlas en una única\ndisposición legal. Por tanto:\n\nRegulaciones generales\npara el otorgamiento de permisos de inactividad a embarcaciones de la flota\npesquera nacional con fines comerciales\n\nArtículo 1º-La administración del Instituto, por medio\ndel Jefe del Departamento de Protección y Registro, los Directores Regionales,\nlos Jefes de Oficinas Regionales y Jefes de Oficinas Auxiliares, podrá\nautorizar en casos excepcionales, la sustitución temporal de embarcaciones\ndedicadas a la pesca con fines comerciales, siempre y cuando se compruebe ante\ndichas instancias que efectivamente la embarcación no se encuentra en\ncondiciones aptas para realizar la actividad de pesca.
