regulaciones\ntécnicas del uso correcto del dispositivo excluidor de tortugas (DEPT), por\nparte de la flota camaronera de arrastre de orilla (AJDIP/151 del 30 de abril\nde 2009))\n\n \n\nConsiderando:\n\n \n\n1º-Que\na través de la\n Convención Interamericana para\nla Protección y Conservación\nde las Tortugas Marinas, se han dictado medidas para promover la protección,\nconservación y recuperación, así como la prohibición de la captura, retención y\nmuerte incidental de tortugas marinas.\n\n2º-Que\nde conformidad con la sección 609 de\nla Ley Pública de los Estados Unidos de Norteamérica\n101-162 decretada en el año 1989, el camarón capturado con tecnología de pesca\ncomercial que pudiera afectar negativamente a ciertas especies de tortugas\nmarinas, podría no ser importado hacia ese país a menos que el Departamento de\nEstado certifique que el Gobierno del país de origen de ese producto, ha\nimplementado un programa que promueva el uso de ciertos equipos que permitan el\nescape de las tortugas.\n\n3º-Que\nel Servicio Nacional de Pesca Marítima (NMFS) de los Estados Unidos de\nNorteamérica, ha propuesto nuevas regulaciones que conllevan cambios\nsignificativos y sustanciales en el diseño de los Dispositivos Excluidores de\nTortugas Marinas (DET's).\n\n4º-Que\nel principal método para reflejar tasas incidentales comparables de tortugas\nmarinas, es el desarrollo de un régimen que requiere del uso de los DET's, de\ntal forma que se consideran efectivos cuando se logra excluir hasta el 97% de\nlas tortugas encontradas en el proceso de arrastre de la red.\n\n5º-Que\nmediante el Acuerdo Nº AJDIP/002-2004\nla Junta Directiva\nacordó apoyar el proyecto conjunto entre PRETOMA, UNIPESCA, CPP el INCOPESCA\ndenominado \"Entrenamiento de pescadores costarricenses para mejorar la\naceptación del Dispositivo Excluidor de Tortugas DET y promover la\nimplementación de prácticas que mitigan el impacto de la pesquería de camarón\npor arrastre sobre las poblaciones de tortugas marinas\".\n\n6º-Que\nde conformidad con los resultados obtenidos en los arrastres realizados entre\nlos meses de agosto del 2004 y febrero del 2005, en diferentes embarcaciones\ncamaroneras de orilla, se pudo determinar que los Dispositivos Excluidores de\nTortugas con las nuevas regulaciones recomendadas por el Servicio Nacional de\nPesca Marítima (NMFS) de los Estados Unidos de Norteamérica, no perjudican\nsignificativamente las capturas de camarón y otros productos y mejoran la\nevacuación de la basura.\n\n7º-Que\ncorresponde al INCOPESCA garantizar el uso adecuado del DET's por parte de la\nflota camaronera de arrastre de orilla. Por lo tanto:\n\nSE ACUERDA:\n\nArtículo 1º-En aquellos casos en que los marcos de los DET's\ny las barras detectoras se construyan con tubo de\naluminio, éste deberá tener un diámetro mínimo exterior de 1,5 pulgadas y un\nmínimo de ¾ pulgadas de grosor.\n\nArtículo 2º-Las dimensiones mínimas de la parrilla de los DET's cuando éstos hayan sido construidos\nde tubo de aluminio, deberán tener 39,0 pulgadas de alto por 48 ¾ pulgadas de ancho.\n\nArtículo 3º-En aquellos casos en que los marcos de los DET's y las barras detectoras se construyan\ncon varilla de aluminio sólida, ésta deberá tener un diámetro mínimo exterior de ¾ de pulgadas.\n\nArtículo 4º-Las dimensiones mínimas de la parrilla de los DET's cuando éstos hayan sido construidos\nde varilla de aluminio sólido, deberán tener 34 ½ pulgadas de alto por 42,0 pulgadas de ancho.\n\nArtículo 5º-Si los marcos de los DET's y las barras detectoras son construidos con las\ncaracterísticas de los materiales que se indican en los artículos 1º y 2º del presente acuerdo, el\nespacio entre las barras detectoras y el marco de la parrilla no deberá de exceder las 6 pulgadas.\n\nArtículo 6º-Si los marcos de los DET's y las barras detectoras son construidos con materiales\ndiferentes a los que se indican en los artículos 1º y 2º del presente acuerdo, el espacio entre las\nbarras detectoras y el marco de la parrilla no deberá de exceder las 4 pulgadas.\n\nArtículo 7º-El ángulo de los DET's debe quedar entre los 30 grados y los 55 grados.\n\nArtículo 8º-Requisitos de la salida de escape de los DET's:\n\nA. Debe tener una medida de 71 pulgadas en línea recta con la malla estirada.\n\nB. Debe fijarse a los lados hasta un máximo de 6 pulgadas, medidas desde la parte posterior de la\nparrilla hacia el bolso.\n\nC. Therefore:\n\nIT IS AGREED:\n\nArticle 1º-In those cases where the TED frames and the deflector bars are constructed of aluminum tubing, it must have a minimum outside diameter of 1.5 inches and a minimum thickness of ¾ inch.\n\nArticle 2º-The minimum dimensions of the TED grid when constructed of aluminum tubing must be 39.0 inches high by 48 ¾ inches wide.\n\nArticle 3º-In those cases where the TED frames and the deflector bars are constructed of solid aluminum rod, it must have a minimum outside diameter of ¾ inch.\n\nArticle 4º-The minimum dimensions of the TED grid when constructed of solid aluminum rod must be 34 ½ inches high by 42.0 inches wide.\n\nArticle 5º-If the TED frames and deflector bars are constructed with the material characteristics indicated in articles 1º and 2º of this agreement, the space between the deflector bars and the grid frame must not exceed 6 inches.\n\nArticle 6º-If the TED frames and deflector bars are constructed with materials different from those indicated in articles 1º and 2º of this agreement, the space between the deflector bars and the grid frame must not exceed 4 inches.\n\nArticle 7º-The angle of the TEDs must be between 30 degrees and 55 degrees.\n\nArticle 8º-Requirements for the escape exit of the TEDs:\n\nA. It must have a measurement of 71 inches in a straight line with the stretched mesh.\n\nB. It must be attached to the sides up to a maximum of 6 inches, measured from the rear part of the grid toward the codend.\n\nC.
