Por tanto:\n\nSE ACUERDA:\n\nArtículo 1º-De la pesca por parte\nde la Flota Semi-Industrial camaronera de arrastre.\nSe prohíbe a la Flota Semi-Industrial camaronera de\narrastre faenar del 1º de junio al 31 de julio y entre el 1º al 31 de octubre\nde 2005, en el área comprendida entre una línea recta imaginaria que va desde\nPunta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el\nFaro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de esa\nlínea, aguas adentro hasta la desembocadura del Río Tempisque.\n\nArtículo 2º-La Flota Semi-Industrial\ncamaronera de arrastre no podrá realizar su actividad en ninguna época del año\nen la zona comprendida entre una línea recta imaginaria que va desde el Muelle\nde Cruceros de Puntarenas (84º 49´ 51'' W, 9º 58´ 26'' N) hasta el Faro de las\nIslas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de esta línea aguas\nadentro hasta la desembocadura del Río Tempisque.\n\nArtículo 3º-De la pesca por parte de la Flota Artesanal en Pequeña Escala.\n\n \n\nA.         Pesca con redes agalleras o\ntrasmallos: durante el período comprendido entre el 1º de junio y el 31 de\njulio y del 1º al 31 de octubre de 2005, se prohíbe la utilización de redes\nagalleras o trasmallos de cualquier luz de malla, en el área comprendida entre una\nlínea recta imaginaria que va desde Punta Torres, conocida como Peñón (84° 43'\n52'' W, 09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49'\n35'' W, 09º 49' 14'' N) y de esa línea, aguas adentro hasta la desembocadura\ndel Río Tempisque.\n\n \n\nB.         Pesca con cuerdas de mano:\ndurante el período comprendido entre el 1º de junio y el 31 de julio y del 1º\nal 31 de octubre del 2005, todo aquel permisionario con Licencia de Pesca\nComercial vigente e independientemente del tipo de pesca y las artes de pesca\nautorizada en la misma, podrá utilizar cuerda de mano con anzuelo Nº 6, en el\nárea comprendida entre una línea recta imaginaria que va desde Punta Torres,\nconocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas\nNegritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de esa línea aguas adentro\nhasta la desembocadura del Río Tempisque.\n\n \n\nC.         Pesca con línea planera en la zona\nprotegida por la veda: durante el período comprendido entre el 1º de junio\ny el 31 de julio y del 1º al 31 de octubre del 2005, todo aquel permisionario\ncon Licencia de Pesca Comercial vigente para pesca con línea en la zona interna\ndel Golfo de Nicoya, podrá utilizar una línea planera por embarcación, con un\nmáximo de 500 metros de largo y también un máximo de 300 anzuelos Nº 6, en el\nárea comprendida en el triángulo formado por una línea recta imaginaria que va\ndesde el Muelle de Cruceros de Puntarenas (84º 49' 51'' W, 09º 58' 26''N) a\nPunta Gigante de Paquera (84º 55' 00'' W, 09º 52' 30'' N) y de ahí otra línea\nrecta imaginaria hasta el Faro de la Isla Negritos Afuera (84º 49' 35'' W, 09º\n49' 14'' N) y de ahí otra línea recta imaginaria hasta el Muelle de Cruceros de\nPuntarenas (84º 49' 51'' W, 09º 58' 26''N).\n\n \n\nD.         Pesca con línea planera en la zona\naguas afuera del Golfo de Nicoya: durante el período comprendido entre\nel 1º de junio y el 31 de julio y del 1º al 31 de octubre del 2005, todo aquel\npermisionario con Licencia de Pesca Comercial vigente para pesca con línea en la\nzona externa Golfo de Nicoya, podrá utilizar una línea planera por embarcación,\ncon un máximo de 5000 metros de largo y 2000 anzuelos del tipo circular,\nsolamente en el área comprendida entre una línea recta imaginaria que va desde\nPunta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53'31'' N) hasta el Faro\nde la Isla Negritos Afuera (84º 49' 35'' '57, 09º 49' 14'' N) y de esa línea\naguas hacia afuera del Golfo de Nicoya.\n\nArtículo 4º-De la pesca para carnada.\n\n \n\nA.         Pesca con chinchorro de barrer playa:\ndurante el período comprendido entre el 1º de junio y el 31 de julio y del 1º\nal 31 de octubre de 2005, se permitirá la captura de carnada con chinchorro de\nbarrer en playa. Dicha red deberá tener una luz de malla de ¾ de pulgada, una\nlongitud máxima de 20 metros, una altura máxima de 2 metros y no deberá de\ntener bolsa. Corresponderá al INCOPESCA el otorgamiento de permisos provisionales\npara este efecto durante la veda, de conformidad con los requerimientos de\ncarnada en cada una de las comunidades pesqueras.\n\n \n\nB.         Pesca con red bolichera: durante\nel período comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de\noctubre de 2005, se permitirá la captura de carnada con red bolichera. Dicha\nred deberá tener una luz de malla de ¾ de pulgada, una longitud máxima de 40\nmetros, una altura máxima de 8 metros respectivamente, con o sin bolsa.\nCorresponderá al INCOPESCA el otorgamiento de permisos colectivos provisionales\npara este efecto durante la veda, de conformidad con los requerimientos de\ncarnada y la cantidad de pescadores con Licencia de Pesca Comercial vigente.\n\nArtículo 5º-De la pesca de sardina por parte de la Flota Semi-Industrial sardinera\ncon red de cerco. Durante el período comprendido entre el 1º de junio y el\n31 de julio, se permitirá la pesca de la sardina con red de cerco, durante 3\ndías por semana, en la zona comprendida entre una línea recta imaginaria que va\ndesde Punta Torres, conocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta\nel Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de ahí\naguas adentro hasta la línea recta imaginaria que va hasta el Muelle de\nCruceros en la Ciudad de Puntarenas (84º 49'51'' W, 09º 58' 26'' N).\n\n \n\nLos propietarios de las\nembarcaciones sardineras con red de cerco, se pondrán de acuerdo y presentarán\nante el Departamento de Protección y Registro del INCOPESCA, antes del 30 de\nabril, un cronograma que comprenda los 3 días por semana que pescarán durante\nesta veda. \n\n \n\nDurante los 4 días restantes de la\nsemana de esta veda, esta flota podrá pescar aguas afuera de la línea recta\nimaginaria comprendida desde Punta Torres, conocida como Peñón (84° 43' 52'' W,\n09° 53' 31'' N) hasta el Faro de las Islas Negritos Afuera (84º 49' 35'' W, 09º\n49' 14'' N). \n\n \n\nDurante el período comprendido entre\nel 1º al 31 de octubre, se prohíbe la pesca de la sardina con red de cerco, en\nla zona comprendida entre una línea recta imaginaria que va desde Punta Torres,\nconocida como Peñón (84° 43' 52'' W, 09° 53' 31'' N) hasta el Faro de las Islas\nNegritos Afuera (84º 49' 35'' W, 09º 49' 14'' N) y de ahí aguas adentro hasta\nla línea recta imaginaria que va hasta el Muelle de Cruceros en la Ciudad de Puntarenas\n(84º 49' 51'' W, 09º 58' 26'' N).\n\nArtículo 6º-De la pesca de la jaiva con nasas. Durante el período comprendido\nentre el 1º de junio y el 31 de julio y del 1º al 31 de octubre de 2005, se\npermitirá la pesca del cangrejo jaiva con nasas, únicamente a todo aquel\npermisionario con Licencia de Pesca Comercial vigente para este tipo de pesca y\nen la zona que tenga permiso.\n\nArtículo 7º-De las sanciones. A los pescadores que se les encuentre realizando labores de pesca en\nzonas y con artes de pesca no permitidos, se les iniciará los procedimientos administrativos o\nlegales correspondientes.  De forma inmediata se le suspenderá el subsidio económico otorgado y el\nbeneficio del combustible a precio preferencial, para lo cual tendrán que reintegrar el dinero o el\ndiferencial otorgado para tal fin.\n\nArtículo 8º-Deróguese cualquier\nacuerdo o disposición anterior que se le oponga.\n\nArtículo 9º-Vigencia. Therefore:\n\nIT IS AGREED:\n\nArticle 1.—Of fishing by\nthe Semi-Industrial shrimp trawler Fleet.\nThe Semi-Industrial shrimp trawler\nFleet is prohibited from operating from June 1st to July 31st and between October 1st and 31st\nof 2005, in the area between an imaginary straight line running from\nPunta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the\nLighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from that\nline, inshore to the mouth of the Río Tempisque.\n\nArticle 2.—The Semi-Industrial\nshrimp trawler Fleet may not carry out its activity at any time of the year\nin the area between an imaginary straight line running from the\nPuntarenas Cruise Ship Dock (84º 49´ 51'' W, 9º 58´ 26'' N) to the Lighthouse of the\nIslas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from this line\ninshore to the mouth of the Río Tempisque.\n\nArticle 3.—Of fishing by the Small-Scale Artisanal Fleet.\n\n \n\nA.         Fishing with gillnets or\ntrammel nets: during the period between June 1st and July\n31st and from October 1st to 31st, 2005, the use of\ngillnets or trammel nets of any mesh size is prohibited in the area between a\nstraight imaginary line running from Punta Torres, known as Peñón (84° 43'\n52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49'\n35'' W, 09º 49' 14'' N), and from that line, inshore to the mouth\nof the Río Tempisque.\n\n \n\nB.         Fishing with handlines:\nduring the period between June 1st and July 31st and from the 1st\nto the 31st of October, 2005, any permit holder with a valid Commercial Fishing License, regardless of the type of fishing and the fishing gear\nauthorized therein, may use a handline with a No. 6 hook, in the\narea between an imaginary straight line running from Punta Torres,\nknown as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas\nNegritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from that line inshore\nto the mouth of the Río Tempisque.\n\n \n\nC.         Fishing with flatline in the area\nprotected by the closed season: during the period between June 1st\nand July 31st and from October 1st to 31st, 2005, any permit holder\nwith a valid Commercial Fishing License for line fishing in the inner zone\nof the Golfo de Nicoya may use one flatline per vessel, with a\nmaximum length of 500 meters and also a maximum of 300 No. 6 hooks, in the\narea comprised within the triangle formed by an imaginary straight line running from\nthe Puntarenas Cruise Ship Dock (84º 49' 51'' W, 09º 58' 26''N) to\nPunta Gigante in Paquera (84º 55' 00'' W, 09º 52' 30'' N), and from there another\nimaginary straight line to the Lighthouse of Isla Negritos Afuera (84º 49' 35'' W, 09º\n49' 14'' N), and from there another imaginary straight line to the Puntarenas Cruise Ship Dock\n(84º 49' 51'' W, 09º 58' 26''N).\n\n \n\nD.         Fishing with flatline in the\noffshore area of the Golfo de Nicoya: during the period between\nJune 1st and July 31st and from October 1st to 31st, 2005, any permit holder\nwith a valid Commercial Fishing License for line fishing in the outer zone\nof the Golfo de Nicoya may use one flatline per vessel,\nwith a maximum length of 5000 meters and 2000 circular hooks,\nonly in the area between an imaginary straight line running from\nPunta Torres, known as Peñón (84° 43' 52'' W, 09° 53'31'' N), to the Lighthouse\nof Isla Negritos Afuera (84º 49' 35'' '57, 09º 49' 14'' N), and from that line\noffshore of the Golfo de Nicoya.\n\nArticle 4.—Of fishing for bait.\n\n \n\nA.         Fishing with beach seine net:\nduring the period between June 1st and July 31st and from the 1st\nto the 31st of October, 2005, the capture of bait with beach seine\nnet will be permitted. Said net must have a mesh size of ¾ of an inch, a\nmaximum length of 20 meters, a maximum height of 2 meters, and must not\nhave a bag. INCOPESCA shall be responsible for granting provisional permits\nfor this purpose during the closed season, in accordance with the requirements for\nbait in each of the fishing communities.\n\n \n\nB.         Fishing with lampara net: during\nthe period between June 1st and July 31st and from the 1st to the 31st of\nOctober, 2005, the capture of bait with lampara net will be permitted. Said\nnet must have a mesh size of ¾ of an inch, a maximum length of 40\nmeters, a maximum height of 8 meters respectively, with or without a bag.\nINCOPESCA shall be responsible for granting provisional collective permits\nfor this purpose during the closed season, in accordance with the requirements for\nbait and the number of fishers with a valid Commercial Fishing License.\n\nArticle 5.—Of sardine fishing by the Semi-Industrial sardine Fleet\nwith purse seine net. During the period between June 1st and July\n31st, sardine fishing with purse seine net will be permitted for 3\ndays per week, in the area between an imaginary straight line running from\nPunta Torres, known as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to\nthe Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from there\ninshore to the imaginary straight line running to the Cruise Ship Dock in the City of Puntarenas (84º 49'51'' W, 09º 58' 26'' N).\n\n \n\nThe owners of the\nsardine vessels with purse seine nets shall agree upon and submit\nto the Department of Protection and Registration of INCOPESCA, before April\n30th, a schedule comprising the 3 days per week they will fish during\nthis closed season. \n\n \n\nDuring the remaining 4 days of the\nweek of this closed season, this fleet may fish offshore of the imaginary straight\nline comprising from Punta Torres, known as Peñón (84° 43' 52'' W,\n09° 53' 31'' N), to the Lighthouse of the Islas Negritos Afuera (84º 49' 35'' W, 09º\n49' 14'' N). \n\n \n\nDuring the period between\nOctober 1st and 31st, sardine fishing with purse seine net is prohibited in\nthe area between an imaginary straight line running from Punta Torres,\nknown as Peñón (84° 43' 52'' W, 09° 53' 31'' N), to the Lighthouse of the Islas\nNegritos Afuera (84º 49' 35'' W, 09º 49' 14'' N), and from there inshore to\nthe imaginary straight line running to the Cruise Ship Dock in the City of Puntarenas\n(84º 49' 51'' W, 09º 58' 26'' N).\n\nArticle 6.—Of fishing for jaiba crab with traps. During the period between\nJune 1st and July 31st and from October 1st to 31st, 2005,\nfishing for jaiba crab with traps will be permitted, only to any\npermit holder with a valid Commercial Fishing License for this type of fishing and\nin the zone for which they have a permit.\n\nArticle 7.—Of sanctions. Fishers found carrying out fishing activities in\nzones and with fishing gear not permitted will have the corresponding administrative or\nlegal procedures initiated against them. The economic subsidy granted and the\nbenefit of fuel at a preferential price will be immediately suspended for them, for which purpose they must reimburse the money or the\ndifferential granted for that end.\n\nArticle 8.—Repeal any\nprevious agreement or provision that contradicts this one.\n\nArticle 9.—Effective Date. It shall be in force as of June 1st, 2005."
