  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 32396\n\n                        Declara de interés público la adquisición del inmueble inscrito en el\nRegistro Público al Folio Real matrícula  N° 5137392-000, para la consolidación del Parque Nacional\nMarino Las Baulas de Guanacaste\n\nTexto Completo acta: 8FEFF\nN° 32396\n\nN°\n32396\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\n \n\nCon fundamento en las facultades que les\nconfieres los artículos 140, incisos 3) y 18) y 146 de la Constitución\nPolítica, artículo 37 de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre\nde 1995.\n\n \n\nConsiderando:\n\n \n\n1º-De conformidad con el Convenio para la\nConservación de Biodiversidad y Protección de Áreas Silvestres Prioritarias en\nAmérica Central, cuyo objetivo es conservar al máximo posible la diversidad biológica,\nterrestre y costero marina de la Región Centroamericana, y su conservación in\nsitu de ecosistemas y hábitats naturales con el compromiso de todos los Estados\nde tomar las medidas posibles para la conservación.\n\n2º-Con la ratificación del Convenio de\nDiversidad Biológica en 1994, nuestro país adquiere el compromiso de establecer\nun sistema de áreas protegidas donde se haya que tomar medidas especiales para\nconservar la diversidad biológica, como la administración de recursos\nbiológicos importantes, ya sea dentro o fuera de las áreas silvestres\nprotegidas, para garantizar su conservación, la protección de ecosistemas y\nhábitat naturales, con lo cual se permita promover el desarrollo ambientalmente\nadecuado y sostenible en zonas adyacentes a áreas protegidas, con miras a aumentar\nla protección de esas zonas y promover la recuperación de especies amenazadas.\n\n3º-El Parque Marino Las Baulas de Guanacaste fue\ncreado primeramente mediante Decreto Ejecutivo N° 20518-MIRENEM del día 5 de\njunio de 1991, publicado el 9 de julio de 1991, y posteriormente por Ley N°\n7524 del 16 de agosto de 1995.\n\n4º-Por Ley N° 7906, publicada el 24 de setiembre\nde 1999, nuestro país aprueba la Convención Interamericana para la Protección y\nConservación de las Tortugas Marinas, suscrita el 31 de enero de 1997, ésta\nestablece como compromiso de los Estados signatarios, el de establecer\nrestricciones a las actividades humanas que puedan afectar a las tortugas\nmarinas, sobre todo durante los periodos de reproducción, incubación y\nmigración así como la restauración del hábitat y de los lugares de desove de\nlas tortugas, mediante la utilización de esas zonas como áreas silvestres\nprotegidas.\n\n5º-La tortuga Baula (Dermochelys coriacea)\nactualmente se encuentra en peligro de extinción, y su principal amenaza la constituye\ntanto la pesca comercial como el desarrollo de actividades no compatibles con\nla conservación. El Parque Marino Las Baulas de Guanacaste, posee las playas\nmás importantes de anidación de esta especie en el Océano Pacífico.\n\n6º-De conformidad con el Oficio\nSINAC-DS-OFAU-O-004-2005, de fecha 17 de enero de 2005, el inmueble descrito en\nel Plano Catastrado G-919331-2004, propiedad de la sociedad Night Air S. A.,\ncédula jurídica número 3-101-366817, se encuentra dentro de los límites del\nParque Nacional Marino Las Baulas.\n\n7º-Que el artículo 37 de la Ley Orgánica del\nAmbiente Nº 7554 del 4 de octubre de 1995, establece la obligación para el\nEstado de pagar las tierras que se incluyan dentro de los límites de los\nParques Nacionales, facultando al Poder Ejecutivo a través del Ministerio del\nAmbiente y Energía para realizar la expropiación de las mismas según lo\nestablecido por la Ley de Expropiaciones Nº 7495 del 3 de mayo de 1995.\n\n8º-Con el fin de reducir el impacto directo\nsobre los sitios de desove de la tortuga Baula, se hace necesario que el Poder\nEjecutivo proceda a emitir el acto de resolución correspondiente, con el objeto\nde declarar de interés público, la expropiación del inmueble matrícula de folio\nreal N° 5137392-000, propiedad de Night Air S.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 32396\n\n                        Declares of public interest the acquisition of the property registered in the\nPublic Registry under Folio Real registration number 5137392-000, for the consolidation of the Las Baulas de Guanacaste National Marine Park\n\nComplete Text record: 8FEFF\nNo. 32396\n\nNo.\n32396\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\n \n\nBased on the powers conferred upon them by articles 140, subsections 3) and 18), and 146 of the Political Constitution, and article 37 of the Organic Law of the Environment No. 7554 of October 4, 1995.\n\n \n\nConsidering:\n\n \n\n1º-In accordance with the Convention for the Conservation of Biodiversity and Protection of Priority Wilderness Areas in Central America, whose objective is to conserve to the maximum extent possible the biological diversity, terrestrial and coastal-marine, of the Central American Region, and its in situ conservation of ecosystems and natural habitats, with the commitment of all States to take all possible measures for conservation.\n\n2º-With the ratification of the Convention on Biological Diversity in 1994, our country assumed the commitment to establish a system of protected areas where special measures must be taken to conserve biological diversity, such as the management of important biological resources, whether within or outside protected wilderness areas, to guarantee their conservation and the protection of natural ecosystems and habitats, thereby promoting environmentally sound and sustainable development in zones adjacent to protected areas, with a view to increasing the protection of those zones and promoting the recovery of threatened species.\n\n3º-The Las Baulas de Guanacaste Marine Park was first created by Executive Decree No. 20518-MIRENEM of June 5, 1991, published on July 9, 1991, and subsequently by Law No. 7524 of August 16, 1995.\n\n4º-By Law No. 7906, published on September 24, 1999, our country approved the Inter-American Convention for the Protection and Conservation of Sea Turtles, signed on January 31, 1997; this convention establishes as a commitment of the signatory States the establishment of restrictions on human activities that may affect sea turtles, especially during periods of reproduction, incubation, and migration, as well as the restoration of the habitat and nesting sites of the turtles, through the use of such zones as protected wilderness areas.\n\n5º-The Baula turtle (Leatherback sea turtle, *Dermochelys coriacea*) is currently in danger of extinction, and its principal threat is constituted by both commercial fishing and the development of activities incompatible with conservation. The Las Baulas de Guanacaste National Marine Park possesses the most important nesting beaches for this species in the Pacific Ocean.\n\n6º-In accordance with Official Communication SINAC-DS-OFAU-O-004-2005, dated January 17, 2005, the property described in Cadastral Plan G-919331-2004, owned by the corporation Night Air S. A., legal identification number 3-101-366817, is located within the boundaries of the Las Baulas National Marine Park.\n\n7º-That article 37 of the Organic Law of the Environment No. 7554 of October 4, 1995, establishes the obligation for the State to pay for lands included within the boundaries of National Parks, empowering the Executive Branch, through the Ministry of Environment and Energy, to carry out the expropriation (expropiación) of the same in accordance with the provisions of the Expropriations Law No. 7495 of May 3, 1995.\n\n8º-In order to reduce the direct impact on the nesting sites of the Baula turtle, it is necessary for the Executive Branch to issue the corresponding resolution act, for the purpose of declaring of public interest the expropriation of the property under Folio Real registration number 5137392-000, owned by Night Air S.
