ENERGÍA\n\n \n\nCon fundamento en las facultades que les\nconfieres los artículos 140, incisos 3) y 18) y 146 de la Constitución\nPolítica, artículo 37 de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre\nde 1995.\n\n \n\nConsiderando:\n\n \n\n1º-De conformidad con el Convenio para la\nConservación de Biodiversidad y Protección de Áreas Silvestres Prioritarias en\nAmérica Central, cuyo objetivo es conservar al máximo posible la diversidad biológica,\nterrestre y costero marina de la Región Centroamericana, y su conservación in\nsitu de ecosistemas y hábitats naturales con el compromiso de todos los Estados\nde tomar las medidas posibles para la conservación.\n\n2º-Con la ratificación del Convenio de\nDiversidad Biológica en 1994, nuestro país adquiere el compromiso de establecer\nun sistema de áreas protegidas donde se haya que tomar medidas especiales para\nconservar la diversidad biológica, como la administración de recursos\nbiológicos importantes, ya sea dentro o fuera de las áreas silvestres\nprotegidas, para garantizar su conservación, la protección de ecosistemas y\nhábitat naturales, con lo cual se permita promover el desarrollo ambientalmente\nadecuado y sostenible en zonas adyacentes a áreas protegidas, con miras a aumentar\nla protección de esas zonas y promover la recuperación de especies amenazadas.\n\n3º-El Parque Marino Las Baulas de Guanacaste fue\ncreado primeramente mediante Decreto Ejecutivo N° 20518-MIRENEM del día 5 de\njunio de 1991, publicado el 9 de julio de 1991, y posteriormente por Ley N°\n7524 del 16 de agosto de 1995.\n\n4º-Por Ley N° 7906, publicada el 24 de setiembre\nde 1999, nuestro país aprueba la Convención Interamericana para la Protección y\nConservación de las Tortugas Marinas, suscrita el 31 de enero de 1997, ésta establece\ncomo compromiso de los Estados signatarios, el de establecer restricciones a\nlas actividades humanas que puedan afectar a las tortugas marinas, sobre todo\ndurante los periodos de reproducción, incubación y migración así como la restauración\ndel hábitat y de los lugares de desove de las tortugas, mediante la utilización\nde esas zonas como áreas silvestres protegidas.\n\n5º-La tortuga Baula (Dermochelys coriacea)\nactualmente se encuentra en peligro de extinción, y su principal amenaza la constituye\ntanto la pesca comercial como el desarrollo de actividades no compatibles con\nla conservación. El Parque Marino Las Baulas de Guanacaste, posee las playas\nmás importantes de anidación de esta especie en el Océano Pacífico.\n\n6º-De conformidad con el Oficio\nSINAC-DS-OFAU-O-004-2005, de fecha 17 de enero de 2005, el inmueble descrito en\nel plano catastrado G-919333-2004, propiedad de la sociedad Sea Sounds S. A.,\ncédula jurídica número 3-101-367558 se encuentra dentro de los límites del\nParque Nacional Marino Las Baulas.\n\n7º-Que el artículo 37 de la Ley Orgánica del\nAmbiente Nº 7554 del 4 de octubre de 1995, establece la obligación para el\nEstado de pagar las tierras que se incluyan dentro de los límites de los\nParques Nacionales, facultando al Poder Ejecutivo a través del Ministerio del\nAmbiente y Energía para realizar la expropiación de las mismas según lo\nestablecido por la Ley de Expropiaciones Nº 7495 del 3 de mayo de 1995.\n\n8º-Con el fin de reducir el impacto directo\nsobre los sitios de desove de la tortuga Baula, se hace necesario que el Poder\nEjecutivo proceda a emitir el acto de resolución correspondiente, con el objeto\nde declarar de interés público, la expropiación del inmueble matrícula de folio\nreal N° 5137393-000, propiedad de Sea Sounds S. Las Baulas de Guanacaste Marine Park possesses the most important nesting beaches for this species in the Pacific Ocean.\n\n6º-In accordance with Official Communication SINAC-DS-OFAU-O-004-2005, dated January 17, 2005, the property described in cadastral map G-919333-2004, owned by the corporation Sea Sounds S. A., legal identification number 3-101-367558, is located within the boundaries of Las Baulas Marine National Park.\n\n7º-That article 37 of the Organic Law of the Environment Nº 7554 of October 4, 1995, establishes the obligation for the State to pay for lands that are included within the boundaries of National Parks, empowering the Executive Branch through the Ministry of Environment and Energy to carry out the expropriation (expropiación) thereof according to the provisions of the Expropriations Law Nº 7495 of May 3, 1995.\n\n8º-In order to reduce the direct impact on the nesting sites of the Baula turtle, it is necessary for the Executive Branch to issue the corresponding resolution act, with the purpose of declaring of public interest the expropriation (expropiación) of the property real folio registration N° 5137393-000, owned by Sea Sounds S. A., legal identification number 3-101-367558, property located in Playa Grande, district 8 Cabo Velas, canton 3 Santa Cruz of the province of Guanacaste, map number G-919333-2004, area 1,018.20 m with the following boundaries: north, Night Air S. A.; south, inalienable zone of 50 meters in favor of the State; east, El Pelícano Marino S. A.; and west, Night Air S. A.\n\n9º-Given that the property described in the second \"Considering\" clause is located within the boundaries of Las Baulas de Guanacaste Marine National Park, it is necessary that, for the purpose of protecting the nesting sites of the Baula turtle, the Executive Branch proceed to declare of public interest the acquisition of said lot. Therefore:\n\n \n\nDECREES:\n\n \n\nArticle 1º-The acquisition of the property inscribed in the National Registry at real folio registration N° 5137393-000 is hereby declared of public interest, owned by Sea Sounds S. A., legal identification number 3-101-367558, property located in district 8 Cabo Velas, canton 3 Santa Cruz of the province of Guanacaste, map number G-919333-2004, area 1018.20 m with the following boundaries: north, Night Air S. A.; south, inalienable zone of 50 meters in favor of the State; east, El Pelícano Marino S. A., and west, Night Air S.
