la\nLey Forestal N° 7575, publicada en La Gaceta N° 72 alcance 21 del 16 de\nabril de 1996, así como con los artículos 82, 84 y 87 de la Ley de Conservación\nde la Vida Silvestre Nº 7317 y los artículos 80 y 81 del Reglamento a la Ley N°\n26435-MINAE, así como con el artículo 32 de la Ley Orgánica del Ambiente N° 7554.\n\n \n\nConsiderando:\n\n \n\n1º-Que es interés del gobierno fortalecer las\nestructuras administrativas en el campo de los recursos naturales, a fin de\ncontar con políticas definidas que garanticen el uso racional de dichos\nrecursos.\n\n2º-Que en el sitio llamado Montaña Azul de Vara\nBlanca, Distrito catorce, Sarapiquí, cantón primero, Alajuela de la provincia\nde Alajuela, se encuentra el inmueble inscrito en el Registro Público al Folio\nReal Nº 212995-000, del Partido de Alajuela, con un área de 25 hectáreas 2 911,67\nmetros cuadrados, según Plano Catastrado Nº H-481150-98, que es propiedad de la\nempresa Jardines de La Catarata Sociedad Anónima, cédula jurídica N°\n3-101-143149, y se pretende conformar como Refugio de Vida Silvestre Privado.\n\n3º-Que el área antes descrita, se encuentra a 1\n500 metros sobre el nivel del mar, enclavada en el poblado Montaña Azul y por\nende constituye un núcleo muy importante para la conservación de la vida\nsilvestre, dentro de la categoría de manejo de Refugio Nacional de Vida\nSilvestre Categoría Privado, localizada claramente en las faldas del Parque\nNacional Volcán Poas, el cual es uno de los destinos turísticos más importantes\ndel país.  Dicha área la conforma un\nbosque nuboso muy frondoso y una abundante avifauna. Se llega al sitio por medio\nde una carretera pavimentada, de dos carriles desde San José por Alajuela y\ndesde Heredia, ambas se juntan en el sitio denominado Vara Blanca.\n\n4º-Que dicha propiedad es de vital importancia\nen cuanto a nacientes de agua, áreas de recarga y acuíferos de los manantiales.\nPor la topografía se dan saltos en muchos casos con importante altura. El\ndrenaje mayor del sitio es el río La Paz, el cual está constituido por la\nconjunción de los ríos La Paz Grande, La Paz Pequeño, Santiaguito y la Quebrada\nCedro, se da la presencia de saltos con cataratas, la de más fácil acceso se le\nconoce como catarata de La Paz, la cual se encuentra a la orilla del camino y\nconstituye el principal atractivo turístico del sector. Se observa la presencia\nde pequeñas quebradas temporales y surcos que solo se activan cuando llueve. La\nescorrentía es alta debido a la precipitación existente por más de ocho meses\nal año y lo pronunciado de las pendientes en algunos sectores.\n\n5º-Que el área en cuestión, constituye un núcleo\nmuy importante para la conservación de la vida silvestre dentro de la categoría\nde manejo de refugio privado silvestre. Que por continuar desapareciendo de\nnuestro medio y por ende de nuestro planeta los bosques y las especies de vida silvestre,\nésta categoría de manejo permite conservarlas y manejarlas dentro de un\ndesarrollo sostenible sirviendo a la vez como regulador ambiental, mediante la\nimplementación de un Plan de manejo.\n\n6º-Que en el documento técnico presentado y\nefectuado en la zona, se demuestra que es un área silvestre protegida para la\nprotección de la biodiversidad y que sirve para brindar oportunidades a la\ninvestigación científica, la recreación y la educación; siendo objetivos\nprimordiales de este refugio, conservar y proteger el bosque natural primario y\nsecundario, así como la perpetuación y protección de especies con poblaciones amenazadas\ny reducidas de flora y fauna.\n\n7º-Que el manejo racional integrado de los\nrecursos naturales, contribuye a satisfacer las necesidades regionales para la\ninvestigación, recreación, educación ambiental, ecoturismo, así como el\naprovechamiento de los recursos naturales renovables explotados racionalmente,\nde ahí que tiene varios convenios con diferentes ONG's, así como instituciones estatales.\n\n8º-Que la propietaria de dicho inmueble, accede\nvoluntariamente a incorporarse a este régimen de protección de la vida\nsilvestre, comprometiéndose a no desarrollar ninguna actividad que ponga en peligro\nla fragilidad de los diferentes ecosistemas existentes en la zona. Said area consists of a very lush cloud forest and abundant birdlife. The site is reached by\na paved, two-lane road from San José via Alajuela and\nfrom Heredia, both of which meet at the place called Vara Blanca.\n\n4º-That said property is of vital importance\nregarding springs (nacientes), recharge areas, and aquifers of the water sources.\nDue to the topography, waterfalls occur, in many cases with significant height. The\nmajor drainage of the site is the La Paz River, which is formed by the\nconjunction of the La Paz Grande, La Paz Pequeño, and Santiaguito Rivers and the Quebrada\nCedro; there is the presence of waterfalls and cataracts, the most easily accessible one is\nknown as the La Paz Waterfall, which is located at the edge of the road and\nconstitutes the main tourist attraction of the sector. The presence\nof small temporary streams and furrows that are only activated when it rains is observed. Runoff\nis high due to the existing precipitation for more than eight months\na year and the steepness of the slopes in some sectors.\n\n5º-That the area in question constitutes a\nvery important core for wildlife conservation within the management\ncategory of private wildlife refuge. That because forests and wildlife species continue to disappear from\nour environment and therefore from our planet,\nthis management category allows them to be conserved and managed within\nsustainable development, also serving as an environmental regulator, through\nthe implementation of a Management Plan.\n\n6º-That in the technical document presented and\ncarried out in the zone, it is demonstrated that it is a protected wild area for\nthe protection of biodiversity and that it serves to provide opportunities for\nscientific research, recreation, and education; being the primary\nobjectives of this refuge, to conserve and protect the primary and secondary natural\nforest, as well as the perpetuation and protection of species with threatened\nand reduced populations of flora and fauna.\n\n7º-That the rational integrated management of\nnatural resources contributes to satisfying regional needs for\nresearch, recreation, environmental education, ecotourism, as well as the\nuse of rationally exploited renewable natural resources,\nhence it has several agreements with different NGOs, as well as state institutions.\n\n8º-That the owner of said property voluntarily\nagrees to submit to this wildlife protection regime, committing not to develop any activity that endangers\nthe fragility of the different ecosystems existing in the zone. Therefore:\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1-Declare \"Jardines de la Catarata Private Category National Wildlife Refuge\", an area of two hundred\nfifty thousand one hundred ninety-nine square meters and six square decimeters\n(25 hectares 2,911.67 square meters), corresponding to the entirety of the\nproperty registered in the Public Registry under Folio Real Nº 212995-000, of\nthe Alajuela Registry Section, with an area of 25 hectares 2,911.67 square meters,\naccording to cadastral map (plano catastrado) Nº H-481150-98, located on the Poás 1:50,000\ncartographic sheet, which is owned by the company Jardines de La Catarata Sociedad\nAnónima, legal ID number N° 3-101-143149.\n\nArticle 2-The owner of said property undertakes\nnot to develop any activity that compromises the existence of the\nflora and fauna without the respective permission of MINAE.
