  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 32417\n\n                        Modifica al Fondo de Parques Nacionales el gasto presupuestario máximo\nfijado para el año 2005\n\nTexto Completo acta: 9046C\nDECRETOS\n\nDECRETOS\n\nNº 32417-H\n\nLA PRIMERA VICEPRESIDENTA\n\nEN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA\n\nY EL MINISTRO DE HACIENDA\n\nCon fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la\nConstitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley\nNº 6227, Ley General de la Administración Pública del 2 de mayo de 1978; Ley Nº 8131, Ley de la\nAdministración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y su\nReglamento, Decreto Ejecutivo Nº 30058-H-MP-PLAN de 19 de diciembre del 2001; Ley Nº 6084, Ley del\nServicio de Parques Nacionales de 24 de agosto de 1977; Ley Nº 7554, Ley Orgánica del Ambiente del 4\nde octubre de 1995; Ley Nº 7788, Ley de Biodiversidad de 30 de abril de 1998; y Decreto Ejecutivo Nº\n31708-H del 16 de marzo del 2004.\n\nConsiderando:\n\n1º-Que la Ley Orgánica del Ambiente Nº 7554, publicada en La Gaceta Nº 215 del 13 de noviembre de\n1995, establece que el Ministerio del Ambiente y Energía (MINAE) es el ente rector en materia\nambiental, por lo que debe velar por la protección, conservación y aprovechamiento de los recursos\nnaturales como condición indispensable para el desarrollo económico sostenible.\n\n2º-Que el Fondo de Parques Nacionales, creado mediante Ley Nº 6084, Ley del Servicio de Parques\nNacionales, publicada en La Gaceta Nº 169 del 7 de setiembre de 1977, forma parte del Sistema\nNacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad,\npublicada en La Gaceta Nº 101 del 27 de mayo de 1998, sistema mediante el cual se lleva a cabo la\nprotección, conservación, control y fomento de estas áreas protegidas debido a su riqueza en\nespecies de vida silvestre y bosque forestal.\n\n3º-Que el Fondo de Parques Nacionales requiere incorporar recursos adicionales para cubrir gastos de\noperación en las siguientes partidas: Servicios Personales; Servicios no Personales; Materiales y\nSuministros; Maquinaria y Equipo; Construcciones, Adiciones y Mejoras; y Transferencias Corrientes.\n\n4º-Que mediante el Decreto Ejecutivo Nº 31708-H y sus reformas, publicado en La Gaceta Nº 62 del 29\nmarzo del 2004, la Autoridad Presupuestaria formuló las Directrices Generales de Política\nPresupuestaria para el 2005, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por\nel Poder Ejecutivo, estableciendo en el artículo 1º del citado decreto, el gasto presupuestario\nmáximo para el año 2005, de las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.\n\n5º-Que mediante oficio STAP-0420-04 del 12 de abril del 2004, se comunicó al Fondo de Parques\nNacionales el gasto presupuestario máximo fijado para el año 2005.\n\n6º-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el\nFondo de Parques Nacionales para el año 2005.   "body_en_text": "across the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 32417\n\n                        Modifies the maximum budgetary expenditure for the National Parks Fund\nset for the year 2005\n\nComplete Text of record: 9046C\nDECREES\n\nDECREES\n\nNo. 32417-H\n\nTHE FIRST VICE PRESIDENT\n\nEXERCISING THE PRESIDENCY OF THE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the powers conferred by articles 140, subsections 3) and 18) and 146 of the\nPolitical Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of Law\nNo. 6227, General Public Administration Law of 2 May 1978; Law No. 8131, Law on\nFinancial Administration of the Republic and Public Budgets of 18 September 2001 and its\nRegulations, Executive Decree No. 30058-H-MP-PLAN of 19 December 2001; Law No. 6084, Law of the\nNational Parks Service of 24 August 1977; Law No. 7554, Organic Environmental Law of 4\nOctober 1995; Law No. 7788, Biodiversity Law of 30 April 1998; and Executive Decree No.\n31708-H of 16 March 2004.\n\nConsidering:\n\n1st—That Organic Environmental Law No. 7554, published in La Gaceta No. 215 of 13 November\n1995, establishes that the Ministry of Environment and Energy (MINAE) is the governing body in environmental\nmatters and must therefore ensure the protection, conservation, and use of natural\nresources as an indispensable condition for sustainable economic development.\n\n2nd—That the National Parks Fund, created by Law No. 6084, Law of the National Parks\nService, published in La Gaceta No. 169 of 7 September 1977, is part of the National\nSystem of Conservation Areas, as established in Law No. 7788, Biodiversity Law,\npublished in La Gaceta No. 101 of 27 May 1998, a system through which the\nprotection, conservation, control, and promotion of these protected areas is carried out due to their richness in\nwildlife species and forest cover (bosque forestal).\n\n3rd—That the National Parks Fund requires the incorporation of additional resources to cover operating\nexpenses in the following budget lines: Personal Services; Non-Personal Services; Materials and\nSupplies; Machinery and Equipment; Constructions, Additions and Improvements; and Current Transfers.\n\n4th—That through Executive Decree No. 31708-H and its amendments, published in La Gaceta No. 62 of 29\nMarch 2004, the Budgetary Authority issued the General Budgetary Policy\nGuidelines for 2005, which were made known to the Government Council and approved by\nthe Executive Branch, establishing in article 1 of the cited decree the maximum budgetary\nexpenditure for the year 2005 for entities covered by the scope of said Collegiate Body.\n\n5th—That through official communication STAP-0420-04 of 12 April 2004, the National Parks\nFund was notified of the maximum budgetary expenditure set for the year 2005.\n\n6th—That in light of the foregoing, it is therefore necessary to modify the maximum budgetary expenditure set for the\nNational Parks Fund for the year 2005. Therefore:\n\nDECREE:\n\nArticle 1—The maximum budgetary expenditure set for the National Parks Fund for the\nyear 2005, established under article 1 of Executive Decree No. 31708-H and its amendments,\npublished in La Gaceta No. 62 of 29 March 2004, is hereby modified such that it may not exceed the sum\nof ¢3,782.2 million.\n\nArticle 2—It shall be effective upon its publication. Issued at the\nPresidency of the Republic.\n\n \n\n—San José, on the thirteenth day of the month\nof May of two thousand five."
