sigue:\n\n \n\nREGLAMENTO DE OPERACIÓN PARA\n\nEL MUELLE DE PUERTO QUEPOS\n\n \n\nCAPÍTULO I\n\nDisposiciones generales\n\n \n\nArtículo 1º-Este articulado instaura los\npreceptos generales bajo los cuales estarán sometidos los clientes, los\nfuncionarios trabajadores y empleados tanto de INCOP como los particulares\nsegún el Reglamento General de Servicios Portuarios de INCOP en sus Artículos 1\ny 2 y Decreto Ejecutivo Nº 22161-MOPT en\nLa Gaceta Nº 95 del miércoles 19 de mayo de 1993. Además, conforme lo\nestablece la Ley\nde la República Nº 1721 de\ndiciembre de 1953, reformada por Ley Nº 4964 de marzo\nde 1972, en la cual nos aclara que es competencia del Instituto Costarricense\nde Puertos del Pacífico (INCOP) las funciones de Autoridad Portuaria del\nLitoral Pacífico de Costa Rica.\n\nArtículo 2º-Para lo que atañe a este conjunto de\nnormas se definen los siguientes conceptos:\n\n \n\na) I.N.C.O.P.: Instituto Costarricense de\nPuertos del Pacífico.\n\nb) Instalaciones: Toda obra de\ninfraestructura del puerto destinada a brindar cualquier atención y facilidad a\nlos buques y a la carga.\n\nc) Buque: Cualquier embarcación destinada\na la navegación marítima que se utiliza para el transporte de carga y/o\npasajeros, de cabotaje o turismo.\n\nd) T.R.B.: Tonelada de Registro Bruto del\nbuque, es la capacidad total del barco expresada en toneladas de 100 pies\ncúbicos.\n\ne) Muelle: Parte de la infraestructura\ndel Puerto, destinada para la estadía del buque a efecto de facilitar sus\noperaciones de carga y descarga.\n\nf) Cliente: Toda persona natural o\njurídica que solicita y pague por un servicio y acatando las normas\nestablecidas por el INCOP.\n\ng) Insumos: Cada uno de los factores que\nintervienen en la producción de bienes o servicios.\n\nh) Código PBIP: Código para la protección\nde buques e instalaciones portuarias.\n\nArtículo 3º-Este Reglamento funcionará como\nApéndice del Reglamento General de Servicios Portuarios de INCOP, según su\nArtículo 2.\n\nLa administración de la Terminal de Puerto\nQuepos tomará las previsiones necesarias para contar con los requerimientos de\nseguridad en el muelle, que le permitan implementar el código PBIP. Las\ncondiciones que se determinen formarán parte integral de este Reglamento.\n\nArtículo 4º-El horario de funcionamiento de los\nservicios prestados en el Muelle será definido por la Administración según la\nconveniencia y necesidades, siempre y cuando se respeten las normas internas\nque el INCOP ha establecido.\n\nArtículo 5º-La Administración del Muelle de\nPuerto Quepos podrá reservarse el derecho de no prestar o suspender los servicios\na aquellos clientes que no se encuentren a derecho en sus obligaciones o que\nincumplan las disposiciones de este Reglamento.\n\nArtículo 6º-Todo daño a las instalaciones y\nequipos propiedad de INCOP o bajo su administración, causados por terceros, será\nindemnizado por el responsable en el costo real del daño.\n\nArtículo 7º-No se permitirá a los clientes o\nparticulares dejar basuras o desperdicios dentro de las instalaciones del\nMuelle. Estos deben ser retirados una vez concluida la operación por cuenta del\ncliente.\n\nArtículo 8º-Todo reclamo que se relacione con la\nprestación de servicios o su cobro, debe dirigirse a la Contraloría de\nServicios o a la Gerencia General.\n\nArtículo 9º-A los trabajadores del INCOP les\nserá prohibida la compra de productos en las naves. El incumplimiento acarreará\nla sanción disciplinaria y legal correspondiente.\n\nArtículo 10.-Los guardas (servicio de\nvigilancia) de INCOP destacados en el muelle, seguirán las normas y roles\nestablecidos por la Administración del Muelle de Puerto Quepos.\n\nArtículo 11.-No podrá ninguna nave utilizar la\npantalla de atraque sin la debida autorización de la Administración del muelle.\n\nArtículo 12.-La Administración del Muelle de\nQuepos se reserva el derecho de designar el orden de atraque de las naves o\nlimitar su permanencia en el muelle, cuando esto se requiera por razón de orden\noperativo.\n\nArtículo 13.-Ninguna nave será atracada,\ndesatracada o cambiada de atracadero sin la autorización de la Administración\ndel Muelle de Puerto Quepos.\n\nArtículo 14.-Las naves serán atendidas siguiendo\nel orden de arribo, siempre y cuando no se expongan las instalaciones del\nmuelle o a los clientes y funcionarios destacados en él.\n\nArtículo 15.-Perderá el derecho de atraque toda\nnave que no vaya a trabajar inmediatamente después de su arribo al muelle, así\ncomo las que estando fondeadas y les corresponda el atraque, no lo efectúen.\n\nArtículo 16.-Toda nave que ponga en peligro o\ndañe las instalaciones del muelle no será atracada.\n\nArtículo 17.-El capitán o el responsable de cada\nnave cuidará que su embarcación se encuentre lista para desatracar o cambiar de\nsitio, cuando a juicio de la Administración del muelle sea necesario hacerlo.\n\nArtículo 18.-Terminadas las operaciones, toda\nnave deberá abandonar el puesto de atraque de inmediato.\n\nArtículo 19.-En caso de naves que no reúnan las\ncondiciones que exige la Administración del muelle para la seguridad de las\ninstalaciones del mismo o su personal, podrán suspenderse las operaciones o no\ndar inicio a las mismas hasta que las anomalías sean corregidas o se pronuncie al\nrespecto el encargado del muelle.\n\nArtículo 20.-En caso de incendio o algún otro\naccidente de peligro inminente abordo, la nave debe ser desatracada\ninmediatamente.\n\nArtículo 21.-La Administración del muelle puede\nordenar la suspensión de labores y el desatraque de una nave cuando considere\nque la forma y condiciones de trabajo perjudican las labores en el Muelle de Puerto\nQuepos, la atención de otras naves o dañen de alguna manera las instalaciones\ndel muelle.\n\nArtículo 22.-El embarque o desembarque de\npasajeros de embarcaciones de placer y turísticas, se hará por cuenta y riesgo\nde los encargados de dicha actividad.\n\nCAPÍTULO II\n\nDe la descripción de los servicios\n\n \n\nArtículo 23.-Todo servicio que se brinde en las\ninstalaciones del Muelle de Puerto Quepos estará sujeto a las regulaciones y\nlas disposiciones tarifarías.\n\nArtículo 24.-La estructura tarifaría comprenderá\nlos siguientes servicios:\n\n \n\na) Estadía: Corresponde a la ocupación\nque hace la nave del muelle mientras se encuentra atracada.\n\n \n\nUnidad de tarificación: Metro eslora-día o\nfracción.\n\nDescripción de servicios:\n\n \n\n1) Embarcaciones de pesca deportiva.\n\n2) Embarcaciones de pesca artesanal.\n\n3) Yates y embarcaciones de placer.\n\n \n\nb) Muellaje: Consiste en la utilización\nque hace la carga de las instalaciones del muelle en tránsito de o hacia la\nnave. Unidad de tarificación: Tonelada métrica o fracción.\n\nc) Ingreso de vehículos a las instalaciones\ndel muelle (peaje): Todo vehículo que ingrese a las instalaciones del muelle\ndeberá pagar por el uso de las mismas.\n\n \n\nUnidad de tarificación: Movimiento.\n\n \n\nd) Embarque y desembarque de pasajeros:\nLos pasajeros que desembarquen o aborden embarcaciones de placer y turísticas deberán\npagar por el uso de las instalaciones.\n\n \n\nUnidad de tarificación: Por persona.\n\n \n\ne) Fondeo de embarcaciones en zona protegida:\nUnidad de tarificación: T.R.B.\n\nf) Cualquier otro servicio ofrecido\nprincipalmente a embarcaciones mayores, se regirá por el Reglamento General de\nServicios Portuarios de INCOP y sus disposiciones tarifarías.\n\n \n\nTodo servicio que se brinde a futuro en esta\nterminal, y que sea debidamente aprobado por la ARESEP, formará parte integral\nde este Reglamento.\n\nCAPÍTULO III\n\nDel ingreso y permanencia de\npersonas y vehículos\n\na las instalaciones del Muelle de\nPuerto Quepos\n\n \n\nArtículo 25.-El control de ingresos, salida y\npermanencia de personas y vehículos dentro de las instalaciones del muelle se\nregirá por lo que indique este articulado y en caso de circunstancias no\ncubiertas regirán además las disposiciones legales y reglamentarias que el\nINCOP tiene establecidas.\n\nArtículo 26.-Únicamente se permitirá el ingreso\ny permanencia dentro de las instalaciones del muelle a las siguientes personas:\n\n \n\na) Funcionarios o empleados del INCOP\ndebidamente identificados.\n\nb) Empleados de las naves o personas que por\nrazón de trabajo deban permanecer dentro de las instalaciones siempre y cuando\nestén debidamente identificados con su pase.\n\nArtículo 27.-Los conductores de vehículos dentro\nde las instalaciones del muelle deben:\n\n \n\na) Transitar por las vías señaladas para tal fin.\n\nb) Respetar el límite de velocidad que se\nindique.\n\nc) Estacionarse en los lugares indicados para\ntal efecto.\n\nd) Detener el motor mientras se realiza la carga\no descarga.\n\ne) No efectuar reparaciones y en caso de averías\ndeberán ser retirados de las instalaciones del muelle de inmediato.\n\nArtículo 28.-Todo conductor, cliente y cualquier\notra persona debe abstenerse de actos imprudentes o peligrosos dentro de las\ninstalaciones del Muelle que puedan originar accidentes o exponer la salud de\nlas personas.\n\nArtículo 29.-Es prohibido el ingreso de\nvehículos salvo los siguientes casos:\n\n \n\na) Todos los vehículos propiedad del INCOP o\nbajo su administración.\n\nb) Vehículos particulares autorizados por la Presidencia\nEjecutiva, Gerencia General del INCOP o la Administración del muelle.\n\nc) Todo vehículo que haya pagado su peaje.\n\nArtículo 30.-El ingreso de las personas se\nefectuará por la entrada principal donde está la casetilla y la inspección; en\neste lugar se identificarán con la unidad de vigilancia.\n\nArtículo 31.-Todas las personas que ingresen,\ncon excepción de los funcionarios o empleados de la Institución destacados en\nel Muelle de Quepos, deberán anotar los motivos de sus visitas al muelle y firmar\nel libro de registro indicando la hora de entrada y posteriormente la salida.\n\nArtículo 32.-Toda persona vinculada al quehacer\ndentro del muelle deberá preverse de un pase para poder ingresar a las\ninstalaciones del mismo.\n\n \n\nExisten dos pases: a) Temporales\n\n     b) Para visitantes.\n\nArtículo 33.-Los pases temporales serán\notorgados a trabajadores ocasionales y a los empleados de los usuarios que\ndeban realizar constantemente labores dentro de las instalaciones del muelle.\nAdemás los pases indicarán su vigencia.\n\nArtículo 34.-Las personas que ingresen en\ncalidad de visitantes recibirán un pase de visitante en las Oficinas\nAdministrativas, además de cumplir con lo estipulado en el Artículo 31.\n\nLos tripulantes portarán pase temporal dentro de\nlas Instalaciones del muelle y la Administración llevará el control\ncorrespondiente.\n\nArtículo 35.-Todos los pases, con excepción de\nlos visitantes, deberán llevar una fotografía reciente del propietario. Los\npases de visitantes llevarán un número de registro.\n\nArtículo 36.-Toda persona al ingresar a las\ninstalaciones del muelle deberá exhibir en lugar visible el pase (tarjeta),\nademás deberá respetar y observar las disposiciones contenidas en este\ncapítulo.\n\nArtículo 37.-Cuando una persona haya perdido su\ntarjeta, deberá informarlo a la Administración del muelle, la cual le dará\ntrámite para que se le extienda una nueva tarjeta previo pago de una suma igual\nal doble del costo original.\n\nArtículo 38.-La Administración del Muelle de\nPuerto Quepos llevará el control y registro de los pases otorgados.\n\nArtículo 39.-El pase otorgado a una persona, no\nautoriza el ingreso de su vehículo particular, el cual estará bajo otra\nregulación.\n\nArtículo 40.-La Administración del Muelle de\nPuerto Quepos podrá negar el permiso de ingreso a las personas que no cumplan\nlas disposiciones de este capítulo.\n\nCAPÍTULO IV\n\nDel suministro de insumos\n\n \n\nArtículo 41.-Todos aquellos suministros de\ninsumos que se brinden a las embarcaciones que utilicen las instalaciones del\nmuelle de Quepos, deberán ser amparadas al Reglamento para las Personas físicas\ny Jurídicas que brindan servicios o suministros a Buques que arriban a los\nPuertos administrados por INCOP y consecuentemente objeto de la aplicación del canon\nque requiere el artículo Nº 5 del citado Reglamento.\n\nArtículo 42.-La Administración del Muelle de\nPuerto Quepos definirá los horarios y modo de operar en la venta de insumos,\nsiempre y cuando no interfiera con las normas de este Reglamento o las de la Institución.\n\nCAPÍTULO V\n\nDel uso y manejo de las máquinas\n\n \n\nArtículo 43.-Toda maquinaria que se utilice en\nlas instalaciones del muelle estará bajo la estricta supervisión de la\nAdministración.\n\nArtículo 44.-Es prohibido para cualquier\ntrabajador manejar u operar equipos sin autorización de la Administración del\nmuelle, así como abrir o cerrar válvulas, interruptores de electricidad, gas,\nvapor, aire, etc., y si está autorizado para ello, deberá cerciorarse que su\nacción no ponga en peligro a otras personas.\n\nArtículo 45.-Es prohibido para cualquier\ntrabajador el uso de camisetas abiertas y otros objetos como cadenas, pulseras\no cualquier tipo de prendas personales y ropa que puedan ser arrolladas por\nmáquinas en movimiento (grúas, montacargas, etc.) o enganchadas por los\naparatos de manipulación de cargas.\n\nArtículo 46.-El servicio de cualquier máquina\npara la manipulación de carga estará regulada por una estructura tarifaría en\nla cual se establece el rubro a cobrar.\n\nCAPÍTULO VI\n\nDe la facturación y el cobro de los\nservicios\n\n \n\nArtículo 47.-Todo cliente, cualquiera que sea su\nclase, que necesite los servicios que se brindan en el muelle o en alguna forma\nutiliza las instalaciones o facilidades que se dan, tendrá que solicitarlos por\nescrito y con antelación, según criterio de la Administración del Muelle.\n\nDicha solicitud deberá indicar claramente, la\nidentificación del servicio que solicita, bajo un formato de presentación el\ncual contendrá entre otras cosas nombre del solicitante, cédula de identidad;\ndescripción de los servicios a solicitar y datos de la embarcación.\n\nLa solicitud será firmada por el cliente o su\nrepresentante, previamente acreditado como tal ante la Administración del\nMuelle de Quepos, para lo cual ésta llevará un registro de firmas de las\npersonas facultadas por el usuario para contraer las responsabilidades que\nimplica la prestación del servicio.\n\nArtículo 48.-El interesado, al presentar la\nsolicitud de servicios, lo hará ante la Administración del muelle, la cual\ntendrá que autorizar, canalizar y agilizar los trámites correspondientes.\n\nArtículo 49.-Además de la solicitud del\nservicio, el usuario tendrá que depositar el valor estimado de los servicios\nque se requiere.\n\nArtículo 50.-El funcionario designado para el\ncobro de los servicios tendrá que entregar a la persona designada por la\nAdministración, la suma recaudada diariamente con su debida justificación\n(documentos, comprobantes), ésta hará un depósito diario en los Bancos del\nSistema Bancario Nacional en la cuenta de INCOP.\n\nEl encargado de efectuar el depósito del banco\nreportará todos los días hábiles al Departamento de Contabilidad de la\nInstitución el informe de ingresos (informe diario de movimiento).\n\nArtículo 51.-El valor del depósito se le\ncomunicará a la Sección de Facturación del Departamento de Contabilidad al\nmomento de recibir la solicitud.\n\nEl importe del depósito debe ser pagado en\ndinero efectivo o cheques certificados siempre y cuando la Gerencia General del\nINCOP autorice a la Administración del muelle a la recepción de cheques contra\nBancos del Sistema Nacional, siempre que se trate de clientes habituales.\n\nArtículo 52.-Una vez prestado el servicio, los\ncargos respectivos se presentarán en una factura al efecto. Se efectuará una\nliquidación sobre la base del depósito previamente efectuada.\n\nArtículo 53.-En caso que el cobro de los\nservicios prestados sobrepase el depósito, el cliente debe cancelar\ninmediatamente la diferencia que corresponda; de no hacerlo la Administración\ndel muelle podrá suspender o cancelar los servicios en el futuro.\n\nEn caso de que el saldo de la liquidación sea\nacreedor, su importe le será acreditado para aplicarse a próximos servicios.\n\nCAPÍTULO VII\n\nDisposiciones finales\n\n \n\nArtículo 54.-En caso de duda sobre la\ninterpretación de este Reglamento, corresponderá a la Junta Directiva del INCOP\ninterpretar correctamente las disposiciones contenidas.\n\nArtículo 55.-Para cualquier nave que no cumpla\nlas disposiciones estipuladas en este Reglamento, la Administración del muelle\nnegará el permiso para atracar en dicho muelle.\n\nArtículo 56.-Las disposiciones contempladas deben\nser estrictamente acatadas por todos los trabajadores del INCOP y los\nparticulares que hagan uso de las instalaciones del muelle o que por razones de\nvisita o trabajo transiten o permanezcan dentro de ellas.\n\nArtículo 57.-Los trabajadores del INCOP que no\nacaten las normas de este articulado, se les sancionará como lo dispone el\nReglamento Autónomo de Servicios de la Institución y la respectiva legislación.\n\nEn lo que corresponde a los clientes de las\ninstalaciones del muelle que incumplan las disposiciones aquí establecidas\nrecibirán las siguientes sanciones:\n\n \n\na) Con una advertencia escrita, si no es\nreincidente, ésta en casos menores.\n\nb) Con la suspensión de la prestación del\nservicio o del pase de ingreso a las instalaciones del muelle por 15 días la\nprimera vez.\n\nc) Con la anulación total de la prestación de\nlos servicios o del pase o permiso de entrada a las instalaciones del muelle.\n\nArtículo 58.-Cualquier servicio o normativa que\nescape a este Articulado será cubierto por el Reglamento General de Servicios\nPortuarios de INCOP.\n\n \n\nRige a partir de su publicación en el Diario Oficial\nLa Gaceta.", "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Regulation 3296\n\nOperating Regulations for the Quepos Port Pier\n\nFull Text record: C2DFA\nCOSTA RICAN INSTITUTE OF PACIFIC PORTS\n\n(This\nregulation was repealed by Article 66 of the Operating Regulations\nfor the Quepos Port Pier,\napproved in Session\nNo. 3488 of April 29, 2008.)\n\n \n\nCOSTA RICAN INSTITUTE OF PACIFIC\nPORTS\n\n \n\nThat\nthe Board of Directors of\nthis Institution, through Agreement No. 2 taken in\nSession No. 3296 held on June 9 of the current year,\nagreed to approve the Regulations for\nthe Operation of the Quepos Port\nPier, which shall read as follows:\n\n \n\nOPERATING REGULATIONS FOR\n\nTHE QUEPOS PORT PIER\n\n \n\nCHAPTER I\n\nGeneral Provisions\n\n \n\nArticle 1.—This set of articles establishes the\ngeneral precepts under which clients,\nofficials, workers, and employees of both INCOP and private parties shall be subject,\nin accordance with the General Regulations for Port Services of INCOP in its Articles 1\nand 2 and Executive Decree No. 22161-MOPT in\nLa Gaceta No. 95 of Wednesday, May 19, 1993. Furthermore, as established\nby Law of the Republic No. 1721 of\nDecember 1953, amended by Law No. 4964 of March\n1972, which clarifies that the Costa Rican Institute\nof Pacific Ports (INCOP) is responsible for the functions of Port Authority of the\nPacific Coast of Costa Rica.\n\nArticle 2.—For the purposes of this set of\nrules, the following concepts are defined:\n\n \n\na) I.N.C.O.P.: Costa Rican Institute of\nPacific Ports.\n\nb) Facilities: Any port infrastructure\nwork intended to provide any service and facility\nto vessels and cargo.\n\nc) Vessel: Any craft intended\nfor maritime navigation used for the transport of cargo and/or\npassengers, cabotage, or tourism.\n\nd) G.R.T.: Gross Registered Tonnage of the\nvessel, it is the total capacity of the ship expressed in tons of 100 cubic\nfeet.\n\ne) Pier: Part of the infrastructure\nof the Port, intended for the stay of the vessel in order to facilitate its\nloading and unloading operations.\n\nf) Client: Any natural or\nlegal person who requests and pays for a service and complies with the rules\nestablished by INCOP.\n\ng) Supplies: Each of the factors that\nintervene in the production of goods or services.\n\nh) ISPS Code: Code for the protection\nof ships and port facilities.\n\nArticle 3.—This Regulation shall function as an\nAppendix to the General Regulations for Port Services of INCOP, according to its\nArticle 2.\n\nThe administration of the Quepos Port Terminal\nwill take the necessary measures to meet the security requirements at the pier,\nallowing it to implement the ISPS Code. The\nconditions that are determined shall form an integral part of this Regulation.\n\nArticle 4.—The operating hours of the services\nprovided at the Pier shall be defined by the Administration according to\nconvenience and needs, provided that the internal rules\nthat INCOP has established are respected.\n\nArticle 5.—The Administration of the Quepos Port\nPier may reserve the right not to provide or to suspend services\nto those clients who are not current in their obligations or who\nbreach the provisions of this Regulation.\n\nArticle 6.—Any damage to the facilities and\nequipment owned by INCOP or under its administration, caused by third parties, shall be\ncompensated by the responsible party at the actual cost of the damage.\n\nArticle 7.—Clients or private parties will not be allowed to leave\ngarbage or waste within the Pier facilities.\nThese must be removed once the operation is completed at the\nclient's expense.\n\nArticle 8.—Any claim related to the\nprovision of services or their collection must be addressed to the Services Comptroller's Office\nor to the General Management.\n\nArticle 9.—INCOP workers shall be\nprohibited from purchasing products on ships. Non-compliance shall result in\nthe corresponding disciplinary and legal sanction.\n\nArticle 10.—The security guards (surveillance service)\nof INCOP stationed at the pier shall follow the rules and roles\nestablished by the Administration of the Quepos Port Pier.\n\nArticle 11.—No vessel may use the\nberthing fender without the proper authorization from the Pier Administration.\n\nArticle 12.—The Administration of the Quepos\nPier reserves the right to designate the order of berthing of vessels or\nto limit their stay at the pier, when this is required for reasons of operational\norder.\n\nArticle 13.—No vessel shall be berthed,\nunberthed, or moved from its berth without the authorization of the Administration\nof the Quepos Port Pier.\n\nArticle 14.—Vessels shall be attended to following\nthe order of arrival, provided that the pier facilities\nor the clients and officials stationed there are not exposed to danger.\n\nArticle 15.—Any vessel that is not going to work immediately\nafter its arrival at the pier shall lose its berthing right, as\nwell as those that, being anchored and whose turn for berthing is due, do not carry it out.\n\nArticle 16.—Any vessel that endangers or\ndamages the pier facilities shall not be berthed.\n\nArticle 17.—The captain or the person responsible for each\nvessel shall ensure that their craft is ready to unberth or change\nlocation, when, in the opinion of the Pier Administration, it is necessary to do so.\n\nArticle 18.—Once operations are completed, every\nvessel must leave the berth immediately.\n\nArticle 19.—In the case of vessels that do not meet\nthe conditions required by the Pier Administration for the safety of its facilities\nor its personnel, operations may be suspended or\nnot initiated until the anomalies are corrected or the person in charge of the pier\npronounces on the matter.\n\nArticle 20.—In the event of a fire or some other\naccident posing imminent danger onboard, the vessel must be unberthed\nimmediately.\n\nArticle 21.—The Pier Administration may\norder the suspension of work and the unberthing of a vessel when it considers\nthat the manner and conditions of work are detrimental to the operations at the Quepos Port\nPier, the service to other vessels, or in any way damage the pier\nfacilities.\n\nArticle 22.—The boarding or disembarkation of\npassengers from pleasure and tourist vessels shall be at the own risk\nof those in charge of said activity.\n\nCHAPTER II\n\nOn the Description of Services\n\n \n\nArticle 23.—Every service provided at the\nfacilities of the Quepos Port Pier shall be subject to the regulations and\ntariff provisions.\n\nArticle 24.—The tariff structure shall comprise\nthe following services:\n\n \n\na) Berthing (Estadía): Corresponds to the occupation\nof the pier made by the vessel while it is berthed.\n\n \n\nBilling unit: Meter of length overall-day or\nfraction.\n\nDescription of services:\n\n \n\n1) Sport fishing vessels.\n\n2) Artisanal fishing vessels.\n\n3) Yachts and pleasure vessels.\n\n \n\nb) Wharfage (Muellaje): Consists of the use\nof the pier facilities by cargo in transit from or to the\nvessel. Billing unit: Metric ton or fraction.\n\nc) Entry of vehicles to the pier\nfacilities (toll): Every vehicle entering the pier facilities\nmust pay for their use.\n\n \n\nBilling unit: Movement.\n\n \n\nd) Boarding and disembarkation of passengers:\nPassengers disembarking from or boarding pleasure and tourist vessels must\npay for the use of the facilities.\n\n \n\nBilling unit: Per person.\n\n \n\ne) Anchoring of vessels in the protected zone:\nBilling unit: G.R.T.\n\nf) Any other service offered\nmainly to larger vessels shall be governed by the General Regulations for\nPort Services of INCOP and its tariff provisions.\n\n \n\nAny service provided in the future at this\nterminal, and that is duly approved by ARESEP, shall form an integral part\nof this Regulation.\n\nCHAPTER III\n\nOn the Entry and Stay of\nPersons and Vehicles\nat the Facilities of the Quepos Port\nPier\n\n \n\nArticle 25.—The control of entry, exit, and\nstay of persons and vehicles within the pier facilities shall\nbe governed by the provisions of this set of articles, and in the case of circumstances not\ncovered, the legal and regulatory provisions that\nINCOP has established shall also govern.\n\nArticle 26.—Entry and stay within the\npier facilities shall only be permitted to the following persons:\n\n \n\na) Duly identified officials or employees of INCOP.\n\nb) Vessel employees or persons who for\nwork reasons must remain within the facilities, provided\nthey are duly identified with their pass.\n\nArticle 27.—Drivers of vehicles within\nthe pier facilities must:\n\n \n\na) Transi along the routes designated for that purpose.\n\nb) Respect the indicated speed limit.\n\nc) Park in the areas designated for\nthat purpose.\n\nd) Turn off the engine while loading or\nunloading is taking place.\n\ne) Not carry out repairs, and in the event of breakdowns,\nthey must be removed from the pier facilities immediately.\n\nArticle 28.—Every driver, client, and any\nother person must refrain from reckless or dangerous acts within the\nPier facilities that could cause accidents or endanger the health of\npersons.\n\nArticle 29.—The entry of vehicles is\nprohibited except in the following cases:\n\n \n\na) All vehicles owned by INCOP or\nunder its administration.\n\nb) Private vehicles authorized by the Executive\nPresidency, General Management of INCOP, or the Pier Administration.\n\nc) Every vehicle that has paid its toll.\n\nArticle 30.—The entry of persons shall be done\nthrough the main entrance where the guardhouse and inspection point are located; at\nthis location, they shall identify themselves to the surveillance unit.\n\nArticle 31.—All persons who enter,\nwith the exception of the Institution's officials or employees stationed at\nthe Quepos Pier, must record the reasons for their visits to the pier and sign\nthe logbook indicating the time of entry and subsequently the time of exit.\n\nArticle 32.—Every person involved in the activities\nwithin the pier must provide themselves with a pass in order to enter the\nfacilities thereof.\n\n \n\nThere are two types of passes: a) Temporary\n\n b) For visitors.\n\nArticle 33.—Temporary passes shall be\ngranted to occasional workers and to the employees of users who\nmust constantly perform work within the pier facilities.\nFurthermore, the passes shall indicate their validity.\n\nArticle 34.—Persons entering as\nvisitors shall receive a visitor's pass at the Administrative\nOffices, in addition to complying with the provisions of Article 31.\n\nCrew members shall carry a temporary pass within\nthe Pier facilities, and the Administration shall keep the corresponding\ncontrol.\n\nArticle 35.—All passes, with the exception of\nthose for visitors, must bear a recent photograph of the holder. The\nvisitor passes shall bear a registration number.\n\nArticle 36.—Every person upon entering the\npier facilities must display the pass (badge) in a visible place,\nand must also respect and observe the provisions contained in this\nchapter.\n\nArticle 37.—When a person has lost their\nbadge, they must inform the Pier Administration, which shall process\nthe issuance of a new badge upon prior payment of a sum equal\nto twice the original cost.\n\nArticle 38.—The Administration of the Quepos Port\nPier shall keep the control and record of the passes granted.\n\nArticle 39.—The pass granted to a person does\nnot authorize the entry of their private vehicle, which shall be under another\nregulation.\n\nArticle 40.—The Administration of the Quepos Port\nPier may deny entry permission to persons who do not comply\nwith the provisions of this chapter.\n\nCHAPTER IV\n\nOn the Supply of Provisions\n\n \n\nArticle 41.—All supplies of provisions\nprovided to vessels that use the facilities of the\nQuepos pier must be covered by the Regulation for Natural\nand Legal Persons that Provide Services or Provisions to Vessels Arriving at\nPorts Administered by INCOP and consequently be subject to the application of the fee\nrequired by Article No. 5 of the cited Regulation.\n\nArticle 42.—The Administration of the Quepos Port\nPier shall define the schedules and mode of operation for the sale of supplies,\nprovided it does not interfere with the rules of this Regulation or those of the Institution.\n\nCHAPTER V\n\nOn the Use and Handling of Machinery\n\n \n\nArticle 43.—All machinery used in\nthe pier facilities shall be under the strict supervision of the\nAdministration.\n\nArticle 44.—It is prohibited for any\nworker to handle or operate equipment without authorization from the Pier\nAdministration, as well as to open or close valves, switches for electricity, gas,\nsteam, air, etc., and if authorized to do so, they must ensure that their\naction does not endanger other persons.\n\nArticle 45.—It is prohibited for any\nworker to use open shirts and other objects such as chains, bracelets,\nor any type of personal item and clothing that could be caught by\nmoving machinery (cranes, forklifts, etc.) or snagged by\nload handling equipment.\n\nArticle 46.—The service of any machine\nfor load handling shall be regulated by a tariff structure\nwhich establishes the item to be charged.\n\nCHAPTER VI\n\nOn the Billing and Collection of\nServices\n\n \n\nArticle 47.—Every client, regardless of their\ntype, who needs the services provided at the pier or in any way\nuses the facilities or amenities given, must request them in\nwriting and in advance, according to the criteria of the Pier Administration.\n\nSuch request must clearly indicate the\nidentification of the service requested, using a submission format\nwhich shall contain, among other things, the name of the applicant, identity card;\ndescription of the services requested, and data of the vessel.\n\nThe request shall be signed by the client or their\nrepresentative, previously accredited as such before the Administration of the\nQuepos Port Pier, for which the latter shall keep a signature record of the\npersons authorized by the user to assume the responsibilities\nentailed by the provision of the service.\n\nArticle 48.—The interested party, upon submitting the\nservice request, shall do so to the Pier Administration, which\nmust authorize, channel, and expedite the corresponding procedures.\n\nArticle 49.—In addition to the service\nrequest, the user must deposit the estimated value of the services\nrequired.\n\nArticle 50.—The official designated for the\ncollection of services must deliver to the person designated by the\nAdministration the sum collected daily with its proper justification\n(documents, vouchers); the latter shall make a daily deposit in the Banks of the\nNational Banking System to the INCOP account.\n\nThe person in charge of making the bank deposit\nshall report to the Accounting Department of the\nInstitution on every business day the income report (daily movement report).\n\nArticle 51.—The value of the deposit shall be\ncommunicated to the Billing Section of the Accounting Department upon\nreceipt of the request.\n\nThe deposit amount must be paid in\ncash or certified checks, provided that the General Management of\nINCOP authorizes the Pier Administration to receive checks drawn on\nBanks of the National System, as long as these are habitual clients.\n\nArticle 52.—Once the service has been provided, the\nrespective charges shall be presented on an invoice for this purpose. A\nsettlement shall be made based on the deposit previously made.\n\nArticle 53.—In the event that the charge for the\nservices provided exceeds the deposit, the client must immediately pay\nthe corresponding difference; failing to do so, the Pier\nAdministration may suspend or cancel services in the future.\n\nIn the event that the balance of the settlement is a\ncredit, the amount shall be credited for application to future services.\n\nCHAPTER VII\n\nFinal Provisions\n\n \n\nArticle 54.—In case of doubt regarding the\ninterpretation of this Regulation, it shall be the responsibility of the Board of Directors of INCOP\nto correctly interpret the provisions contained herein.\n\nArticle 55.—For any vessel that does not comply\nwith the provisions stipulated in this Regulation, the Pier Administration shall\ndeny the permit to berth at said pier.\n\nArticle 56.—The provisions set forth must\nbe strictly complied with by all INCOP workers and\nprivate parties who make use of the pier facilities or who, for reasons of\nvisit or work, transi or remain within them.\n\nArticle 57.—INCOP workers who do not\ncomply with the rules of this set of articles shall be sanctioned as provided by the\nAutonomous Service Regulations of the Institution and the respective legislation.\n\nAs regards clients of the\npier facilities who breach the provisions established herein,\nthey shall receive the following sanctions:\n\n \n\na) A written warning, if not a\nrepeat offender, this being for minor cases.\n\nb) Suspension of the provision of the\nservice or of the entry pass to the pier facilities for 15 days the\nfirst time.\n\nc) Total cancellation of the provision of\nservices or of the pass or entry permit to the pier facilities.\n\nArticle 58.—Any service or regulation that is\nnot covered by this set of articles shall be covered by the General Regulations for Port\nServices of INCOP.\n\n \n\nShall become effective upon its publication in the Official Gazette\nLa Gaceta." }
