  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 32372\n\n                        Declara Estado de Emergencia Fitosanitaria por Daños en plantaciones de\nBanano y Plátano en las Regiones Huetar Atlántica y Huetar Norte, causadas por Hongos y Bacterias\n\nTexto Completo acta: E3EC7\nDECRETOS\n\nDECRETOS\n\nNº 32372-MAG\n\n  (Este decreto fue derogado por el artículo 7° del decreto ejecutivo N°\n    36827 del 4 de octubre del 2011) \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nEn ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8), 18) y 20) y 146,\nde la Constitución Política, los artículos 25, 27.1, 28.2b de la Ley Nº 6227 del 2 de mayo de 1978,\nLey General de la Administración Pública y la Ley Nº 7664 del 8 de abril de 1997, Ley de Protección\nFitosanitaria.\n\nConsiderando:\n\n1º-Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así\ncomo garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en\nriesgo o causar daños a la producción agrícola.\n\n2º-Que corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del\nEstado velar por la protección fitosanitaria de los cultivos en nuestro país, disponiendo, una vez\ncomprobada la existencia de una plaga o enfermedad, las medidas técnicas y de control que eviten la\n\npropagación de éstas.\n\n3º-Que las recientes inundaciones en las Regiones Huetar Atlántica y Huetar Norte, entre otros, han\nafectado sensiblemente los cultivos de banano y plátano, los cuales constituyen una de las\nprincipales fuentes generadoras de divisas y de empleo en nuestro país.\n\n4º-Que además de los daños físicos a las plantaciones, también se han incrementado enfermedades como\nla Sigatoka Negra (Mychospaerrella fijiensis) y el Moko (Ralstonia solanacearum), las cuales son\nlimitantes para la producción y exportación de estos materiales.\n\n5º-Que es necesario brindar el apoyo oficial a los productores, tanto para la aplicación de medidas\ncorrectivas de protección fitosanitaria, como para que las plantaciones sigan produciendo y\ngenerando empleos, evitando con ello la desocupación en nuestro país.\n\n6º-Que el Poder Ejecutivo, previa recomendación del Servicio Fitosanitario del Estado, podrá\ndecretar estado de Emergencia Fitosanitaria, cuando existan plagas o enfermedades de importancia,\nque constituyan o representen una amenaza para la economía nacional. Por tanto;\n\nDECRETAN:\n\nEstado de Emergencia Fitosanitaria por Daños en plantaciones de Banano y Plátano en las Regiones\n\nHuetar Atlántica y Huetar Norte, causadas por Hongos y Bacterias\n\nArtículo 1º-Se declara Estado de Emergencia Fitosanitaria Nacional, por las plagas Sigatoka Negra\n(Mychospaerrella fijiensis) y Moko (Ralstonia solanacearum ).\n\nArtículo 2º-Todo productor u ocupantes de predios a cualquier título está obligado a denunciar la\npresencia de la plaga ante el Servicio Fitosanitario del Estado.\n\nArtículo 3º-Los propietarios u ocupantes de áreas donde se detecte la plaga deberán colaborar con\nlos funcionarios del Servicio Fitosanitario del Estado o quien él designe, para la aplicación de las\nmedidas de control recomendadas oficialmente.\n\nArtículo 4º-Para la ejecución de las labores de control de la plaga, el Servicio Fitosanitario del\nEstado dispondrá de los Fondos de Emergencia que contempla el artículo 66 de la Ley de Protección\nFitosanitaria, realizando la liquidación correspondiente a posteriori, conforme a los procedimientos\nadministrativos que regulan la materia.\n\nArtículo 5º-Las instituciones públicas o privadas, autónomas o semiautónomas, quedan facultadas para\nrealizar donaciones y aportes económicos dentro del marco legal de referencia que rige cada una de\nellas, así como prestar todo tipo de colaboración al Servicio Fitosanitario del Estado, para atender\nesta emergencia fitosanitaria.\n\nArtículo 6º-El Estado de emergencia fitosanitaria se mantendrá hasta tanto sean controladas las\nplagas mencionadas y se haya normalizado el manejo en las plantaciones.\n\nArtículo 7º-El Servicio Fitosanitario del Estado se encargará de disponer y ejecutar las medidas\ntécnicas necesarias para el control de la Sigatoka Negra y el Moko.\n\nArtículo 8º-Rige a partir de su publicación.\n\nDado en la Presidencia de la República.-San José, a los veintidós días del mes abril del dos mil\ncinco.",

Therefore;\n\nTHEY DECREE:\n\nState of Phytosanitary Emergency for Damage to Banana and Plantain Plantations in the Huetar\nAtlántica and Huetar Norte Regions, Caused by Fungi and Bacteria\n\nArticle 1º-A National State of Phytosanitary Emergency is declared, for the pests Black Sigatoka\n(Mychospaerrella fijiensis) and Moko (Ralstonia solanacearum).\n\nArticle 2º-Every producer or occupant of properties under any title is obligated to report the\npresence of the pest to the State Phytosanitary Service.\n\nArticle 3º-The owners or occupants of areas where the pest is detected must collaborate with\nthe officials of the State Phytosanitary Service or whomever it designates, for the application of the\nofficially recommended control measures.\n\nArticle 4º-For the execution of the pest control tasks, the State Phytosanitary Service\nwill make use of the Emergency Funds provided for in Article 66 of the Plant Protection Law,\ncarrying out the corresponding settlement a posteriori, in accordance with the administrative procedures that regulate the matter.\n\nArticle 5º-Public or private, autonomous or semi-autonomous institutions are empowered to\nmake donations and economic contributions within the legal framework of reference that governs each of\nthem, as well as to provide all types of collaboration to the State Phytosanitary Service, to address\nthis phytosanitary emergency.\n\nArticle 6º-The state of phytosanitary emergency shall be maintained until the aforementioned\npests are controlled and management in the plantations has been normalized.\n\nArticle 7º-The State Phytosanitary Service shall be responsible for ordering and executing the\nnecessary technical measures for the control of Black Sigatoka and Moko.\n\nArticle 8º-It shall be effective as of its publication.\n\nDone at the Presidency of the Republic.-San José, on the twenty-second day of the month of April of two thousand\nfive."
