MINISTRO DEL AMBIENTE Y ENERGÍA\n\n \n\nEn uso de las facultades que les confieren los\nincisos 3 y 18 del artículo 146 de la Constitución Política; los artículos 1º,\n2º, 4º, 6º, 34 y 35 de la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de\n1995; la Ley Forestal Nº 7575 del 13 de febrero de 1996; Ley del Servicio de\nParques Nacionales Nº 6084 del 24 de agosto de 1977 y la Ley de Conservación de\nVida Silvestre Nº 7317 del 30 de octubre de 1992 y sus respectivos reglamentos;\ny\n\n \n\nConsiderando:\n\n \n\n1º-Que es deber del Estado procurar, dotar y\nrealizar las acciones necesarias para garantizar a los y las costarricenses un\nambiente sano y ecológicamente equilibrado, debiendo defender y preservar el\nbienestar de todos los y las habitantes de la Nación, lo que requiere entre\notras cosas la protección del medio ambiente.\n\n2º-Que el Estado debe fomentar la participación\nactiva y organizada de los y las habitantes de la República, en las acciones\ntendientes a proteger y mejorar de manera sostenible el ambiente.\n\n3º-Los servicios voluntarios representan para el\nSistema Nacional de Áreas de Conservación una fuente importante e indispensable\nde apoyo para fortalecer la conservación de los recursos existentes en las\náreas silvestres protegidas.\n\n4º-Que las acciones que se desarrollan por medio\ndel voluntariado requieren de una adecuada organización y estrecha coordinación\ncon diferentes instancias, instituciones u organizaciones, nacionales o internacionales,\nasociaciones comunales e individuos. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nReglamento de las Acciones de\nVoluntariado en las\n\nÀreas Silvestres Protegidas bajo\nAdministración del\n\nSistema Nacional de Àreas de\nConservación, Dirección\n\nSuperior del Ministerio del Ambiente\ny Energía\n\n \n\nCAPÍTULO I\n\nDe la organización institucional\npara atender las acciones de\n\nvoluntariado en las áreas silvestres\nprotegidas\n\n \n\nArtículo 1º-Para la ejecución de las acciones de\nvoluntariado en las áreas silvestres protegidas se establecen los siguientes\nniveles de coordinación y organización institucional:\n\n \n\na) La Dirección Superior del Sistema Nacional de\nÁreas de Conservación, será quien dicte las directrices a aplicar en materia de\nvoluntariado en las áreas silvestres protegidas, además de asegurar la efectiva\naplicación de este reglamento.\n\nb) La Dirección de las Áreas de Conservación se\nencargará de implementar las directrices emanadas de la Dirección Superior del SINAC,\nmediante una coordinación estrecha con los administradores (as) y aquellos\nfuncionarios (as) responsables de cada una de las áreas silvestres protegidas a\nsu cargo.\n\nc) Los Administradores (as) de las áreas\nsilvestres protegidas o aquellos funcionarios (as) a cargo, tendrán la\nresponsabilidad de aplicar y observar este reglamento y las directrices\ndictadas por la Dirección Superior del SINAC y la Dirección del Área de\nConservación respectiva.\n\nArtículo 2º-La Dirección Superior del SINAC,\npara dar cumplimiento efectivo al proceso de voluntariado desarrollará las\nsiguientes funciones:\n\n \n\na) Emitir los lineamientos nacionales en materia\nde voluntariado en las áreas silvestres protegidas.\n\nb) Establecer el enlace permanente con las\norganizaciones e instituciones nacionales e internacionales dedicadas al\nvoluntariado en las áreas silvestres protegidas.\n\nc) Establecer los mecanismos de seguimiento y\nevaluación de las acciones de voluntariado realizadas en las Áreas Silvestres Protegidas.\n\nd) Mantener actualizado el registro de todas las\norganizaciones e instituciones dedicadas al voluntariado en las áreas\nsilvestres protegidas.\n\ne) Gestionar recursos financieros para la\noperación de los planes de voluntariado de las áreas silvestres protegidas.\n\nArtículo 3º-La Dirección de las Áreas de\nConservación del SINAC, en cumplimiento de este reglamento tendrá las\nsiguientes funciones:\n\n \n\na) Coordinar permanentemente con las\norganizaciones e instituciones regionales y locales que realizan acciones de\nvoluntariado en las áreas silvestres protegidas.\n\nb) Velar por la aplicación de los mecanismos de\nseguimiento y evaluación definidos a nivel nacional y establecer las medidas de\ncontrol que fueran necesarias para el buen curso de las acciones de voluntariado\nen las áreas silvestres protegidas.\n\nc) Mantener actualizados los registros de las\norganizaciones e instituciones regionales y locales que realizan acciones de voluntariado\nen las áreas silvestres protegidas.\n\nd) Gestionar recursos financieros para la\noperación de los planes de voluntariado de las áreas silvestres protegidas\nubicadas en el Área de Conservación correspondiente.\n\nArtículo 4º-Son funciones de los Administradores\n(as) y responsables de las áreas silvestres protegidas las siguientes:\n\n \n\na) Formular, ejecutar y evaluar los planes de\nvoluntariado de las áreas silvestres protegidas a su cargo.\n\nb) Coordinar permanentemente con las\norganizaciones, grupos comunitarios locales e individuos que realicen acciones\nde voluntariado en las áreas silvestres protegidas a su cargo.\n\nc) Procurar que los voluntarios (as) cuenten con\ntodas las condiciones necesarias para su permanencia y óptimo desempeño en las\náreas silvestres protegidas a su cargo, incluyendo lo relacionado con su\nalojamiento, alimentación, equipo, transporte, identificación e instrucciones\nde trabajo.\n\nd) Brindar la inducción necesaria para los\nvoluntarios (as) que se reciben en las Áreas Silvestres Protegidas a su cargo y\nsupervisar el desempeño de los mismos.\n\ne) Mantener actualizados los registros de\nvoluntarios (as) de las áreas silvestres protegidas a su cargo.\n\nf) Elaborar los informes anuales de las acciones\nrealizadas por los voluntarios (as) en las áreas silvestres protegidas a su\ncargo y presentarlos a las Direcciones de las Áreas de Conservación correspondientes\ny las organizaciones referidas en el artículo 9º.\n\ng) Comunicar a la Dirección del Área de\nConservación y Dirección Superior del SINAC los nombres de los voluntarios (as)\nque han sido expulsados de las áreas silvestres protegidas a su cargo, de conformidad\ncon lo establecido en el artículo 19 de este Reglamento, para su divulgación a nivel nacional.\n\nCAPÍTULO II\n\nDe las categorías de voluntarios\n(as), sus derechos,\n\ndeberes y prohibiciones\n\n \n\nArtículo 5º-Los voluntarios (as) serán personas\nde probada solvencia moral y de reconocida honradez, disciplina y compromiso\ncon la causa conservacionista y ambientalista y con los principios del desarrollo\nsostenible. Prestarán sus servicios ad-honorem, motivados por el interés y la\nsatisfacción de coadyuvar en la conservación de los recursos existentes en las\náreas silvestres protegidas.\n\nLos voluntarios (as) que brinden sus servicios\nen las áreas silvestres protegidas podrán pertenecer a alguna de las siguientes\ncategorías:\n\n \n\na) Voluntarios (as) de organizaciones e\ninstituciones, internacionales, nacionales y regionales, que organizan y\nejecutan acciones de voluntariado en las áreas silvestres protegidas bajo la\nadministración del SINAC.\n\nb) Miembros de organizaciones o grupos\ncomunitarios locales, que realizan acciones de voluntariado en las áreas\nsilvestres protegidas.\n\nc) Particulares que realizan acciones de\nvoluntariado en las áreas silvestres protegidas, de manera individual.\n\n \n\nPodrán ser voluntarios todos los ciudadanos y\nciudadanas costarricenses y extranjeros residentes, así como las personas\nextranjeras no residentes que cumplan con todos los requisitos que las leyes\ncostarricenses exigen para poder ingresar legalmente al país. Los voluntarios\n(as) deberán ser personas mayores de edad, de conformidad con la legislación costarricense.\nEn caso de ser menores de edad, pero con edad igual o superior a los 15 años,\ndeberán contar con la autorización escrita de los padres o tutores.\n\nArtículo 6º-Son facultades y derechos de los\nvoluntarios (as), durante su permanencia en las áreas silvestres protegidas,\nlos siguientes:\n\n \n\na) Recibir inducción y asesoría sobre sus\nderechos, deberes, responsabilidades, prohibiciones y sobre las funciones en\nque se desempeñarán de acuerdo al plan de trabajo, así como información general\nsobre el área silvestre protegida respectiva.\n\nb) Solicitar apoyo y colaboración a los\nfuncionarios (as) públicos que laboran en el área silvestre protegida para\npoder desempeñar eficazmente sus funciones.\n\nc) Recibir la identificación que corresponde, al\ningresar a las áreas silvestres protegidas.\n\nd) Contar con todas las condiciones necesarias\npara su permanencia y óptimo desempeño en las áreas silvestres protegidas,\nincluyendo lo relacionado con su alojamiento, alimentación, equipo, transporte\ne instrucciones de trabajo.\n\ne) Recibir un trato cortés, amable y respetuoso\npor parte de los funcionarios (as) públicos, otros voluntarios (as) y\nparticulares, durante su permanencia en el área silvestre protegida.\n\nArtículo 7º-Son deberes y obligaciones de los\nvoluntarios (as), durante su permanencia en las áreas silvestres protegidas,\nlos siguientes:\n\n \n\na) Cumplir con las disposiciones jurídicas\nvigentes, así como con las directrices que al efecto dicte el Sistema Nacional\nde Áreas de Conservación.\n\nb) Colaborar con los funcionarios (as) públicos\ncompetentes en las labores que se les asignen, con base en el plan de trabajo\ndefinido por las partes.\n\nc) Acatar las instrucciones que gire el\nAdministrador (a) o el funcionario (a) a cargo del área silvestre protegida\ncorrespondiente, siempre y cuando se ajusten al ordenamiento jurídico, a este\nreglamento y al plan de trabajo.\n\nd) Presentar informes periódicos de las labores\nefectuadas, en aquellos casos que así lo requieran.\n\ne) Notificar al respectivo administrador (a) del\nárea silvestre protegida de cualquier irregularidad cometida por funcionarios\n(as) públicos, otros voluntarios (as), o particulares dentro de dicha área.\n\nf) Mantener durante su estadía en el área\nsilvestre protegida, una actitud permanente de seriedad, prudencia y atención,\nasí como de cortesía y amabilidad con otros voluntarios, con los funcionarios\n(as) y el público en general.\n\ng) En caso de requerirse, deberán brindar\ntestimonio .el ante la autoridad competente de todo cuanto hubieren visto,\nescuchado y actuado durante el tiempo que permanecieron en el área silvestre protegida.\n\nh) Cumplir fielmente las disposiciones de este\nReglamento y las normas conexas que disponga el ordenamiento jurídico.\n\ni) Portar en forma visible y permanentemente la\ndebida identificación cuando se encuentren prestando servicio en el área\nsilvestre protegida.\n\nj) Responder por cualquier daño, pérdida o\nextravío que ocasionen a las instalaciones, equipo y otros bienes del Estado\ndurante su permanencia en las áreas silvestres protegidas, de conformidad con lo\nque establezca la normativa aplicable. En caso de reposición se contará de\nprevio con un avalúo emitido por la oficina de Patrimonio del MINAE.\n\nArtículo 8°-Queda prohibido a los voluntarios\n(as), durante su permanencia en las áreas silvestres protegidas, lo siguiente:\n\n \n\na) Actuar en contra de la normativa vigente, de\nlas directrices que dicte el Sistema Nacional de Áreas de Conservación y del\npresente reglamento.\n\nb) Asumir funciones de autoridad de policía u\notras que estén reservadas en forma exclusiva para los funcionarios (as)\npúblicos, de conformidad con la normativa aplicable.\n\nc) Hacer uso de instalaciones, equipo y otros bienes\ndel Estado sin contar con la debida autorización del Administrador (a) o del responsable\ndel área silvestre protegida respectiva.\n\nCAPÍTULO III\n\nDe las organizaciones\n\n \n\nArtículo 9°-Toda organización o institución\ninternacional, nacional, regional o local sin fines de lucro que pretenda\nrealizar acciones, actividades o proyectos relacionados con voluntariado en las\náreas silvestres protegidas bajo la administración del Estado, deberá realizar\nun convenio con el SINAC donde se estipule los objetivos de la entidad y las\nobligaciones y las responsabilidades de las partes, de conformidad con los\nartículos 2º, inciso b), 3º, inciso a) y 4º, inciso b), de este reglamento.\n\nArtículo 10.-Todas las organizaciones o\ninstituciones referidas en el artículo 9º, deberán cumplir con las siguientes\nobligaciones:\n\n \n\na) Contar con una póliza de seguros que cubra\ncualquier accidente que pudieran sufrir los voluntarios.\n\nb) En caso de que los voluntarios (as) sean\nmenores de edad, y cuenten con el requisito establecido en el artículo 5º,\npárrafo final, deberán ser acompañados por la persona responsable del grupo, la\ncual deberá velar por el cumplimiento de lo expuesto en este reglamento, como\nde la seguridad de los menores.\n\nc) Cubrir los costos de alimentación y\ntransporte de voluntarios en caso de que se requiera, así como cualquier otro\ncosto que surja conforme a circunstancias no previstas.\n\nd) Mantener un registro interno actualizado de\ntodos sus voluntarios (as).\n\ne) Comunicar a las autoridades del SINAC que\ncompeta, la exclusión de cualquier persona del registro interno de voluntarios\n(as).\n\nf) Capacitar a los voluntarios (as) sobre los\nobjetivos y la naturaleza de las labores que desempeñarán en las áreas\nsilvestres protegidas, así como en lo relativo a sus derechos, deberes y prohibiciones,\nde acuerdo con lo establecido en este reglamento.\n\ng) Acatar las disposiciones vigentes que rigen\nlas áreas silvestres protegidas en materia jurídica y administrativa, así como\ncualquier otra directriz que dicten en esta materia las autoridades\nrespectivas.\n\nh) Elaborar conjuntamente con la autoridad que\ncompeta, un plan de trabajo para el período de permanencia de los voluntarios\n(as) en las áreas silvestres protegidas. Este plan debe ser elaborado\npreviamente al ingreso de los voluntarios (as) al área.\n\nArtículo 11.-Se prohíbe a las organizaciones e\ninstituciones descritas en el artículo 9º de este reglamento, el uso de los\nnombres y logotipos institucionales del MINAE, del SINAC o de sus Áreas de\nConservación, sin la debida autorización por escrito.\n\nArtículo 12.-Los funcionarios (as) del SINAC\ndeberán velar por el cumplimiento de los derechos y facultades de los\nvoluntarios (as) durante su permanencia en las áreas silvestres protegidas,\nsegún lo que establece el artículo 6º de este reglamento.\n\nArtículo 13.-Será responsabilidad de los\ndirectores (as) de las Áreas de Conservación garantizar que todas las áreas\nsilvestres protegidas donde se reciben voluntarios (as), cuenten con un plan de\nvoluntariado debidamente aprobado por el Comité Técnico del Área de\nConservación respectiva.\n\nCAPÍTULO IV\n\nDe los voluntarios (as) particulares\n\n \n\nArtículo 14.-Toda persona física que pretenda\nrealizar acciones, actividades o proyectos relacionados con voluntariado en las\náreas silvestres protegidas bajo la administración del Estado, deberá\nformalizar los objetivos del servicio de voluntariado y las responsabilidades\nde cada una de las partes, mediante la boleta de registro de voluntarios (as)\nante la instancia correspondiente del SINAC.\n\nArtículo 15.-Los derechos, facultades,\nobligaciones, deberes y prohibiciones para los voluntarios (as) particulares\nserán los mismos que se estipulan en los artículos 6º, 7º y 8º del presente\nReglamento.\n\nArtículo 16.-Todos los voluntarios (as)\nparticulares deberán cumplir con las siguientes obligaciones:\n\n \n\na) Contar con una póliza de seguros que cubra\ncualquier accidente que pudieran sufrir.\n\nb) En caso de ser menores de edad deberán contar\ncon autorización escrita de sus padres o tutores.\n\nc) En caso de que se requiera, deberán cubrir\nlos costos de alimentación y transporte, u otros que surjan conforme a las\ncircunstancias no previstas.\n\nCAPÍTULO V\n\nDe las faltas y sanciones\n\n \n\nArtículo 17.-Los voluntarios (as) serán\nresponsables por todos sus actos, respondiendo tanto civil como penalmente por\nsus acciones. articles 1, 2, 4, 6, 34 and 35 of the Organic Environmental Law Nº 7554 of October 4, 1995; the Forestry Law (Ley Forestal) Nº 7575 of February 13, 1996; the National Parks Service Law Nº 6084 of August 24, 1977 and the Wildlife Conservation Law Nº 7317 of October 30, 1992 and their respective regulations; and\n\n \n\nConsidering:\n\n \n\n1st-That it is the duty of the State to seek, provide, and carry out the necessary actions to guarantee Costa Ricans a healthy and ecologically balanced environment, and it must defend and preserve the well-being of all the inhabitants of the Nation, which requires, among other things, the protection of the environment.\n\n2nd-That the State must encourage the active and organized participation of the inhabitants of the Republic in actions aimed at protecting and sustainably improving the environment.\n\n3rd-Voluntary services represent an important and indispensable source of support for the National System of Conservation Areas to strengthen the conservation of the resources existing in protected wild areas.\n\n4th-That the actions developed through volunteering require adequate organization and close coordination with different bodies, institutions or organizations, whether national or international, community associations, and individuals. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nRegulation of Volunteer Actions in\n\nProtected Wild Areas under the Administration of\n\nthe National System of Conservation Areas, Superior\n\nDirectorate of the Ministry of Environment and Energy\n\n \n\nCHAPTER I\n\nInstitutional organization for addressing volunteer\n\nactions in protected wild areas\n\n \n\nArticle 1-For the execution of volunteer actions in protected wild areas, the following levels of coordination and institutional organization are established:\n\n \n\na) The Superior Directorate of the National System of Conservation Areas shall issue the guidelines to be applied regarding volunteering in protected wild areas, in addition to ensuring the effective application of this regulation.\n\nb) The Directorate of the Conservation Areas shall be responsible for implementing the guidelines issued by the Superior Directorate of SINAC, through close coordination with the administrators and those officials responsible for each of the protected wild areas under its charge.\n\nc) The Administrators of the protected wild areas or those officials in charge shall have the responsibility of applying and observing this regulation and the guidelines dictated by the Superior Directorate of SINAC and the respective Conservation Area Directorate.\n\nArticle 2-The Superior Directorate of SINAC, in order to effectively comply with the volunteering process, shall develop the following functions:\n\n \n\na) Issue national guidelines regarding volunteering in protected wild areas.\n\nb) Establish a permanent liaison with national and international organizations and institutions dedicated to volunteering in protected wild areas.\n\nc) Establish the mechanisms for monitoring and evaluating the volunteer actions carried out in the Protected Wild Areas.\n\nd) Keep the registry of all organizations and institutions dedicated to volunteering in protected wild areas updated.\n\ne) Manage financial resources for the operation of the volunteer plans of the protected wild areas.\n\nArticle 3-The Directorate of the Conservation Areas of SINAC, in compliance with this regulation, shall have the following functions:\n\n \n\na) Coordinate permanently with the regional and local organizations and institutions that carry out volunteer actions in protected wild areas.\n\nb) Ensure the application of the monitoring and evaluation mechanisms defined at the national level and establish any control measures necessary for the smooth course of volunteer actions in the protected wild areas.\n\nc) Keep the registries of the regional and local organizations and institutions that carry out volunteer actions in protected wild areas updated.\n\nd) Manage financial resources for the operation of the volunteer plans of the protected wild areas located in the corresponding Conservation Area.\n\nArticle 4-The functions of the Administrators and managers of the protected wild areas are the following:\n\n \n\na) Formulate, execute, and evaluate the volunteer plans of the protected wild areas under their charge.\n\nb) Coordinate permanently with organizations, local community groups, and individuals who carry out volunteer actions in the protected wild areas under their charge.\n\nc) Ensure that the volunteers have all the necessary conditions for their stay and optimal performance in the protected wild areas under their charge, including matters related to their lodging, food, equipment, transportation, identification, and work instructions.\n\nd) Provide the necessary induction for the volunteers received in the Protected Wild Areas under their charge and supervise their performance.\n\ne) Keep the registries of volunteers of the protected wild areas under their charge updated.\n\nf) Prepare the annual reports of the actions carried out by the volunteers in the protected wild areas under their charge and present them to the corresponding Conservation Area Directorates and the organizations referred to in article 9.\n\ng) Communicate the names of the volunteers who have been expelled from the protected wild areas under their charge to the Conservation Area Directorate and the Superior Directorate of SINAC, in accordance with the provisions of article 19 of this Regulation, for dissemination at the national level.\n\nCHAPTER II\n\nCategories of volunteers, their rights,\n\nduties, and prohibitions\n\n \n\nArticle 5-The volunteers shall be persons of proven moral standing and recognized honesty, discipline, and commitment to the conservationist and environmentalist cause and to the principles of sustainable development. They shall render their services ad-honorem, motivated by the interest and satisfaction of assisting in the conservation of the resources existing in protected wild areas.\n\nThe volunteers who provide their services in protected wild areas may belong to one of the following categories:\n\n \n\na) Volunteers from organizations and institutions, international, national, and regional, that organize and execute volunteer actions in protected wild areas under the administration of SINAC.\n\nb) Members of local community organizations or groups that carry out volunteer actions in protected wild areas.\n\nc) Individuals who carry out volunteer actions in protected wild areas on an individual basis.\n\n \n\nAll Costa Rican citizens and resident foreigners, as well as non-resident foreigners who comply with all the requirements demanded by Costa Rican laws to enter the country legally, may be volunteers. Volunteers must be of legal age, in accordance with Costa Rican legislation. If they are minors, but aged 15 or older, they must have written authorization from their parents or guardians.\n\nArticle 6-The powers and rights of the volunteers, during their stay in protected wild areas, are the following:\n\n \n\na) Receive induction and guidance regarding their rights, duties, responsibilities, prohibitions, and the functions they will perform according to the work plan, as well as general information about the respective protected wild area.\n\nb) Request support and collaboration from the public officials working in the protected wild area in order to perform their functions effectively.\n\nc) Receive the corresponding identification upon entering the protected wild areas.\n\nd) Have all the necessary conditions for their stay and optimal performance in the protected wild areas, including matters related to their lodging, food, equipment, transportation, and work instructions.\n\ne) Receive courteous, kind, and respectful treatment from public officials, other volunteers, and private individuals during their stay in the protected wild area.\n\nArticle 7-The duties and obligations of the volunteers, during their stay in protected wild areas, are the following:\n\n \n\na) Comply with the legal provisions in force, as well as with the guidelines issued for this purpose by the National System of Conservation Areas.\n\nb) Collaborate with the competent public officials in the tasks assigned to them, based on the work plan defined by the parties.\n\nc) Abide by the instructions issued by the Administrator or the official in charge of the corresponding protected wild area, provided they conform to the legal system, this regulation, and the work plan.\n\nd) Present periodic reports on the tasks carried out, in those cases where required.\n\ne) Notify the respective administrator of the protected wild area of any irregularity committed by public officials, other volunteers, or private individuals within said area.\n\nf) Maintain, during their stay in the protected wild area, a permanent attitude of seriousness, prudence, and attention, as well as courtesy and kindness towards other volunteers, officials, and the general public.\n\ng) If required, they must provide true testimony before the competent authority of everything they saw, heard, and acted upon during the time they remained in the protected wild area.\n\nh) Faithfully comply with the provisions of this Regulation and the related rules provided by the legal system.\n\ni) Wear the proper identification visibly and at all times when providing service in the protected wild area.\n\nj) Be liable for any damage, loss, or misplacement they cause to the facilities, equipment, and other State property during their stay in the protected wild areas, in accordance with the provisions of the applicable regulations. In case of replacement, an appraisal issued by the MINAE Heritage office shall be obtained beforehand.\n\nArticle 8-Volunteers are prohibited, during their stay in protected wild areas, from the following:\n\n \n\na) Acting against the regulations in force, the guidelines issued by the National System of Conservation Areas, and this regulation.\n\nb) Assuming police authority functions or others that are exclusively reserved for public officials, in accordance with the applicable regulations.\n\nc) Making use of facilities, equipment, and other State property without the proper authorization of the Administrator or the manager of the respective protected wild area.\n\nCHAPTER III\n\nOrganizations\n\n \n\nArticle 9-Any international, national, regional, or local non-profit organization or institution intending to carry out actions, activities, or projects related to volunteering in protected wild areas under State administration must enter into an agreement with SINAC stipulating the entity's objectives and the obligations and responsibilities of the parties, in accordance with articles 2, subsection b), 3, subsection a), and 4, subsection b), of this regulation.\n\nArticle 10-All organizations or institutions referred to in article 9 must comply with the following obligations:\n\n \n\na) Have an insurance policy covering any accident that the volunteers might suffer.\n\nb) If the volunteers are minors and meet the requirement established in article 5, final paragraph, they must be accompanied by the person responsible for the group, who must ensure compliance with the provisions of this regulation, as well as the safety of the minors.\n\nc) Cover the costs of food and transportation for volunteers if required, as well as any other costs arising from unforeseen circumstances.\n\nd) Keep an updated internal registry of all their volunteers.\n\ne) Notify the competent SINAC authorities of the exclusion of any person from the internal registry of volunteers.\n\nf) Train the volunteers on the objectives and nature of the work they will perform in the protected wild areas, as well as regarding their rights, duties, and prohibitions, in accordance with the provisions of this regulation.\n\ng) Abide by the regulations in force governing protected wild areas in legal and administrative matters, as well as any other guidelines issued in this matter by the respective authorities.\n\nh) Elaborate, jointly with the competent authority, a work plan for the period of the volunteers' stay in the protected wild areas. This plan must be prepared prior to the volunteers' entry into the area.\n\nArticle 11-The organizations and institutions described in article 9 of this regulation are prohibited from using the institutional names and logos of MINAE, SINAC, or its Conservation Areas, without proper written authorization.\n\nArticle 12-The officials of SINAC must ensure compliance with the rights and powers of the volunteers during their stay in protected wild areas, as established in article 6 of this regulation.\n\nArticle 13-It shall be the responsibility of the directors of the Conservation Areas to guarantee that all protected wild areas where volunteers are received have a volunteer plan duly approved by the Technical Committee of the respective Conservation Area.\n\nCHAPTER IV\n\nIndividual volunteers\n\n \n\nArticle 14-Any individual who intends to carry out actions, activities, or projects related to volunteering in protected wild areas under State administration must formalize the objectives of the volunteer service and the responsibilities of each party, through the volunteer registration form before the corresponding body of SINAC.\n\nArticle 15-The rights, powers, obligations, duties, and prohibitions for individual volunteers shall be the same as stipulated in articles 6, 7, and 8 of this Regulation.\n\nArticle 16-All individual volunteers must comply with the following obligations:\n\n \n\na) Have an insurance policy covering any accident they might suffer.\n\nb) If they are minors, they must have written authorization from their parents or guardians.\n\nc) If required, they must cover the costs of food and transportation, or other costs arising from unforeseen circumstances.\n\nCHAPTER V\n\nFaults and sanctions\n\n \n\nArticle 17-The volunteers shall be responsible for all their acts, being both civilly and criminally liable for their actions. In the case of minors, the parents or guardians shall be the legal persons responsible for their actions before the State or third parties.\n\nArticle 18-The following are faults meriting a sanction for the volunteer:\n\n \n\na) Failure to comply with the tasks assigned in the work plan and with the duties, obligations, and prohibitions established in this regulation.\n\nb) Violating the applicable regulatory provisions during the time they remain in the protected wild area.\n\nc) Receiving gifts, rewards, favors, or payments of any kind during the time they remain in service in a protected wild area.\n\nd) Acting under the influence of alcohol or any illegal drug while performing their duties in the protected wild area.\n\ne) Physically, verbally, or psychologically assaulting any person.\n\nf) Illegally retaining, or failing to report to the administration of the corresponding protected wild area, articles or objects belonging to visitors, other volunteers, officials, or third parties, which have been lost or forgotten.\n\ng) Making use of facilities, equipment, and other State property without the proper authorization of the Administrator or the official in charge of the respective protected wild area.\n\nArticle 19-If the volunteers incur any of the faults described in article 18, the Administrators of the protected wild areas or the responsible officials may proceed to expel them as an immediate measure, in addition to requesting that the responsible organization or institution apply the corresponding disciplinary measures, without prejudice to what may proceed in accordance with criminal and civil channels.\n\nArticle 20-To apply the sanction described in article 19, the SINAC authorities must take into consideration the circumstances in which the events occurred, possible repetitions of previous faults, and the type of fault committed, as well as the principles of prudence, proportionality, rationality, and reasonableness.\n\nCHAPTER VI\n\nFinancing\n\n \n\nArticle 21-For the financing of the volunteer plans of the protected wild areas, the organizations and institutions described in article 9 of this regulation may formulate and present financing proposals before the appropriate entities, in coordination with SINAC.\n\nArticle 22-Repeal Executive Decree Nº 30988-MINAE of August 30, 2002, published in La Gaceta number thirty-six dated February 20, 2003.\n\nArticle 23-This comes into effect upon publication.\n\nTransitory 1-The organizations and institutions that are currently carrying out actions, activities, or projects related to volunteering in protected wild areas under State administration shall have a period of three months, from the publication of this Decree, to adjust to the provisions of this Regulation.\n\n \n\nGiven at the Presidency of the Republic.-San José, on the first day of the month of March of two thousand five." }
