Puntarenas y en las comunidades del Golfo de Nicoya, Guanacaste,\nen los periodos que van del 1º de junio al 31 de julio y del 1º al 31 de octubre\ndel año 2005.\n\n4º-Que el acuerdo citado impide a los pescadores\nque utilizan \"trasmallo\", desempeñar su actividad remunerada y por ende\npercibir ingresos por este concepto, afectando la satisfacción de sus\nnecesidades básicas.\n\n5º-Que la Ley de Creación del Instituto Mixto de\nAyuda Social N° 4760 del 4 de mayo de 1971, establece en su artículo 2° la finalidad\nde resolver el problema de la pobreza extrema en el país y en su artículo 4°\ninciso e) establece dentro de sus fines \"atender las necesidades de los grupos\nsociales o de las personas que deban ser provistas de medios de subsistencia\ncuando carezcan de ellos\".\n\n6º-Que el artículo 4° del Reglamento para la\nPrestación de Servicios y el Otorgamiento de Beneficios del Instituto Mixto de\nAyuda Social, publicado en La Gaceta N° 102 del 29 de mayo del 2000,\ndefine el concepto de pobreza como: \"Fenómeno o situación compleja de índole coyuntural\no estructural multifacético y heterogéneo, que afecta a las personas y que se\ncaracteriza por sus precarias condiciones de vivienda y sanitarias, bajos\nniveles educacionales, inserción inestable en el sistema productivo,\ncondiciones de riesgo social, con poca o ninguna incorporación en mecanismos de\nparticipación social, recursos insuficientes para satisfacer necesidades básicas\n(nutricionales, salud, educación y vivienda) y en algunos casos ausencia o\ninsuficiencia de destrezas, aptitudes, herramientas y oportunidades para\ngenerar y acumular ingresos\".\n\n7º-Que en el artículo 21 inciso h) del citado\nReglamento, se señala en cuanto a los sujetos de los servicios institucionales,\nlo siguiente: \"En casos de excepción debidamente documentados y con el\ncorrespondiente informe técnico social autorizados por quien ejerza la Gerencia\nRegional respectiva, se podrá otorgar beneficios a personas o familias que\npresenten una situación de pobreza coyuntural no necesariamente registrada como\ntal en el SIPO, o que mediante algún decreto o ley especí.ca, se considere\nbeneficiarios de la acción institucional\".\n\n8º-Que no se cuenta con un fondo compensatorio\npara brindar un subsidio económico a los pescadores afectados por la veda y\nesta circunstancia provoca una situación de pobreza coyuntural, por la carencia\nde ingresos de los pescadores en época de veda.\n\n9º-Que el artículo 36 de la Ley Nº 8436,\ndispone: \"...El Poder Ejecutivo podrá autorizar el destino de fondos del\nPresupuesto Nacional a favor de INCOPESCA para la realización de los estudios\nsobre vedas, y a favor del Instituto Mixto de Ayuda Social (IMAS), con el\npropósito de desarrollar programas de asistencia socioeconómica diseñados especialmente\ncon tal propósito, a favor de los pescadores que se vean afectados en los\nperíodos de veda, siempre que se compruebe que no tienen otras fuentes de\ningresos y se encuentran en condición de pobreza. Estos programas implicarán\nnecesariamente servicios de trabajo comunal por parte de los beneficiarios,\nconforme al reglamento correspondiente o para la realización de estudios sobre\nla materia\".\n\n \n\nDECRETAN:\n\n \n\nArtículo 1°-Declárase en situación de pobreza\ncoyuntural la condición de los pescadores y sus ayudantes debidamente\nacreditados por el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) con\nlicencia de pesca vigente, afectados por la veda establecida para el presente\naño, mediante acuerdo N° JDIP-274-2005 de la Junta Directiva de INCOPESCA; y\nque carezcan de otros ingresos complementarios. La entrega\ndel beneficio correspondiente al primer periodo de veda se hará efectiva a más tardar\nen el mes de agosto del año dos mil cinco, conformando el primer evento o\ntracto; y en el mes de octubre del mismo año se hará la entrega del subsidio\nrelativo al segundo periodo de veda, que conformará el segundo evento o tracto.\n\nArtículo 4°-Los subsidios serán tramitados por\nlas Gerencias Regionales del IMAS de las zonas de Puntarenas y Guanacaste. Los profesionales\ndel IMAS estarán facultados para solicitar a los potenciales beneficiarios los\nrequisitos establecidos en el artículo 2° del presente decreto y no requerirán\nque los mismos se encuentren registrados en el Sistema de Información de la\nPoblación Objetivo (SIPO). REPUBLIC\n\nAND THE MINISTER OF LABOR AND SOCIAL SECURITY\n\n \n\nExercising the powers conferred by articles 140, subsections 3), 8), and 18) of the Political Constitution and 25, 26, and 27 of the General Law of Public Administration.\n\n \n\nConsidering:\n\n \n\n1º—That in accordance with the provisions of article 2, subsections e), f), and g) of the Organic Law of the Ministry of Labor and Social Security, No. 1860 of April 21, 1955, and its amendments, it is the function of said Ministry to ensure that national policy in the field of social welfare has adequate regulation guaranteeing effective assistance to Costa Ricans, their families, and the community.\n\n2º—That in accordance with Law No. 8436, published in the Official Gazette La Gaceta No. 78 of April 25, 2005, it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) to protect and conserve hydrobiological resources, in order to guarantee living marine resources for future generations, promoting a sustainable exploitation of resources through the establishment of closed season periods and areas, for which agreement No. AJDIP / 274-2005, published in the Official Gazette La Gaceta of May 26, 2005, is issued.\n\n3º—That in the cited agreement and based on article 34 of Law 8436, INCOPESCA prohibits artisanal fishers in the province of Puntarenas and in the communities of the Gulf of Nicoya, Guanacaste, from carrying out fishing operations during the periods from June 1 to July 31 and from October 1 to 31 of the year 2005.\n\n4º—That the cited agreement prevents fishers who use \"trasmallo\" from performing their remunerated activity and therefore from earning income from this source, affecting the satisfaction of their basic needs.\n\n5º—That the Law Creating the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social) No. 4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country, and in its article 4, subsection e), establishes among its purposes \"to attend to the needs of social groups or persons who must be provided with means of subsistence when they lack them.\"\n\n6º—That article 4 of the Regulation for the Provision of Services and the Granting of Benefits of the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social), published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: \"A complex phenomenon or situation of a temporary or structural nature, multifaceted and heterogeneous, which affects people and is characterized by their precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to satisfy basic needs (nutritional, health, education, and housing), and in some cases absence or insufficiency of skills, aptitudes, tools, and opportunities to generate and accumulate income.\"\n\n7º—That in article 21, subsection h) of the cited Regulation, the following is indicated regarding the subjects of institutional services: \"In duly documented exceptional cases and with the corresponding technical social report authorized by the respective Regional Management, benefits may be granted to persons or families presenting a situation of temporary poverty (pobreza coyuntural) not necessarily registered as such in the SIPO (Information System of the Target Population), or who, through a specific decree or law, are considered beneficiaries of institutional action.\"\n\n8º—That there is no compensatory fund to provide an economic subsidy to fishers affected by the closed season (veda), and this circumstance causes a situation of temporary poverty (pobreza coyuntural), due to the lack of income of fishers during the closed season (veda).\n\n9º—That article 36 of Law No. 8436 provides: \"...The Executive Branch may authorize the allocation of funds from the National Budget in favor of INCOPESCA for conducting studies on closed seasons, and in favor of the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social, IMAS), for the purpose of developing socioeconomic assistance programs specially designed for this purpose, in favor of fishers who are affected during closed season periods, provided it is proven that they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services by the beneficiaries, in accordance with the corresponding regulation or for conducting studies on the matter.\"\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1.—The condition of fishers and their assistants, duly accredited by the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) with a valid fishing license, affected by the closed season (veda) established for the current year through agreement No. JDIP-274-2005 of the INCOPESCA Board of Directors, and who lack other complementary income, is hereby declared to be in a situation of temporary poverty (pobreza coyuntural). Consequently, the Joint Institute of Social Aid (Instituto Mixto de Ayuda Social) is authorized to grant economic benefits in the form of subsidies to these persons, in compliance with the conditions established in this decree.\n\nArticle 2.—The beneficiaries of the IMAS action shall be considered to be the fishers and their assistants who are duly accredited as such before INCOPESCA and hold a valid fishing license. IMAS shall attend to these persons based on a duly reasoned resolution approved by the Regional Manager determining compliance with the requirements established in this decree, in conformity with the refined list that INCOPESCA must present to it, which shall contain the following requirements:\n\n \n\na) Full name of the beneficiary.\n\nb) Identification card number.\n\nc) Exact address of the beneficiaries.\n\nd) Photocopy of the valid fishing license issued by INCOPESCA.\n\nArticle 3.—IMAS shall grant a subsidy to the beneficiaries who comply with the conditions stipulated in the previous article, issued in two events or installments as follows: in the first closed season period, the amount to be subsidized shall be eighty-five thousand colones (¢85,000.00 colones) per beneficiary, and for the second closed season period, the amount to be subsidized shall be forty thousand colones (¢40,000.00 colones). The delivery of the benefit corresponding to the first closed season period shall be made effective no later than the month of August of the year two thousand five, constituting the first event or installment; and in the month of October of the same year, the delivery of the subsidy related to the second closed season period shall be made, which shall constitute the second event or installment.\n\nArticle 4.—The subsidies shall be processed by the IMAS Regional Managements of the Puntarenas and Guanacaste zones. IMAS professionals shall be empowered to request from potential beneficiaries the requirements established in article 2 of this decree and shall not require that they be registered in the Information System of the Target Population (SIPO). To make effective the delivery of the economic amount corresponding to the second closed season period, IMAS may request INCOPESCA and/or the beneficiaries to verify and update the information provided based on this decree.\n\nArticle 5.—It is the responsibility of INCOPESCA to supervise and control the community work that the beneficiaries shall perform during the closed season (veda) period, and to inform IMAS of the name of those persons who fail to comply with this condition, as well as those who execute actions that contravene the closed season (veda) declaration or who have complementary income within their family group.
