artículos 140, incisos 3), 8), 18) y 20) y 146 de la Constitución\nPolítica, los artículos 25, 27.1, 28.2b de la Ley Nº 6227 del 2 de mayo de 1978, Ley\nGeneral de la Administración Pública y la Ley Nº 6289 de 4 de diciembre de 1978, Ley de\nSemillas.\n\n                                                                               \nConsiderando:\n\n    1º—Que es un deber\nineludible del Estado velar por la salud de la población, evitando o reprimiendo aquellos\nactos u omisiones de particulares que impliquen un riesgo para la salud humana como bien\njurídico de importancia suprema para el desarrollo social y económico del país.\n\n    2º—Que la Oficina\nNacional de Semillas, Institución adscrita al Ministerio de Agricultura y Ganadería,\ntiene a cargo la promoción, protección, mejoramiento, control y uso de semillas de\ncalidad superior para lo que establecerá las normas y mecanismos necesarios para su\ncirculación y comercio.\n\n    3º—Que la Oficina\nNacional de Semillas debe registrar todas las importaciones y exportaciones de semillas y\nestablecer controles para comercializarlas, observando los criterios de protección de la\nsalud y vida de personas y animales, la preservación de los vegetales y la prevención de\nprácticas que puedan inducir a error.\n\n    4º—Que toda la\nsemilla que se reproduzca en el país indistintamente de su lugar de origen puede ser\nafectada por factores externos patógenos y físicos, que afectan directamente y privan al\nagricultor y consumidor, del legítimo derecho de adquirir productos capaces de satisfacer\nsus expectativas de producción rentable y de consumo.\n\n    5º—Que toda\nregulación de actividades económicas en el mercado interno para producto nacional e\nimportado exige el mínimo necesario para proteger la salud humana, vegetal o animal, el\nambiente y el cumplimiento de los estándares mínimos de calidad.\n\n    6º—Que tanto la\nsemilla que se comercializa como la que se introduce para otros fines está expuesta a los\nriesgos de contaminación, debiendo ejercerse por tanto los controles necesarios.
