artículo 140, incisos 3) y\n18) y 146 de la Constitución Política, y el artículo 28 de la Ley General de la\nAdministración Pública Nº 6227.\n\nConsiderando:\n\n    1º—Que el Ministro\ndel Ambiente y Energía, es el rector del Estado encargado del Sector Recursos Naturales,\nEnergía y Minas, y por tanto, de emitir las políticas ambientales, regulaciones y\nadministración de todo lo relativo al ambiente, las áreas silvestres protegidas,\ncorredores biológicos, conservación y manejo de la vida silvestre, biodiversidad,\nrecursos marinos en áreas silvestres protegidas, entre otros.\n\n    2º—Que la\nAsociación Marviva Costa Rica fue constituida legalmente bajo las leyes de Costa Rica y\nse encuentra inscrita en el Registro Público, Sección de Asociaciones bajo el expediente\nnúmero quince mil ochenta y ocho, cédula jurídica número tres-cero cero dos-tres\ncuatro uno uno uno cinco.\n\n    3º—Que la\nAsociación Marviva Costa Rica es una asociación costarricense, cuyos fines son, entre\notros: a) Promover y reforzar la protección de las áreas marinas, costeras y en tierra\nfirme de Costa Rica, y en particular sus áreas protegidas. b) Coadyuvar con las\nautoridades gubernamentales competentes, en la aplicación efectiva de las leyes y las\nmedidas de protección ambiental. c) Facilitar los recursos necesarios para colaborar con\nlas autoridades públicas en el aseguramiento de una protección medioambiental\ntransparente, disciplinada y eficiente. d) Realizar las acciones necesarias para crear\nconciencia en la opinión pública sobre la importancia y los riesgos a que están\nsometidas las áreas marinas, costeras y tierra firme del país. e) Colaborar con las\nautoridades públicas en el aseguramiento de una protección medioambiental transparente,\ndisciplinada y eficiente. f) Fomentar la participación e involucramiento activo de las\ncomunidades locales en la protección medioambiental marino-costera ligada al desarrollo\nsostenible. g) Promover la formación profesional de los guardaparques y guardacostas para\nque puedan cumplir sus funciones con eficacia y determinación, dando apoyo a las\nautoridades gubernamentales en este aspecto y contribuyendo con la asesoría y\nfacilitación de recursos para lograrlo. h) Dar a conocer, internacionalmente, los valores\necológicos de las áreas protegidas y la importancia de su tutela medioambiental. i)\nIdentificar y facilitar los recursos humanos y equipos científicos necesarios para apoyar\nel trabajo de protección que realicen las autoridades gubernamentales o el sector privado\nen las zonas protegidas. j) Prestar ayuda en caso de catástrofes medioambientales que\nproduzcan tanto daños a los humanos como al medio ambiente.\n\n       4º—Que el Ministerio del Ambiente y Energía,\nel Ministerio de Seguridad Pública y la Asociación Marviva Costa Rica han firmado un\nConvenio de Cooperación, el cual fue aprobado el 12 de agosto del 2004 por la\nContraloría General de la República para la protección de los recursos marinos costeros\nmediante el refuerzo y complementación de los recursos humanos y equipos de ambos\nministerios, en el cual la Asociación Marviva Costa Rica aportará, entre otros, tres\nembarcaciones, una de las cuales se destinará a los patrullajes en el Parque Nacional\nIsla del Coco, tripulaciones contratadas y remuneradas, equipamiento de las embarcaciones\ny de las tripulaciones, costo de operación, mantenimiento y reparación de las\nembarcaciones, seguros de las embarcaciones y de la tripulación, recursos humanos y\ntécnicos para la creación de la Unidad Central de Apoyo para aspectos logísticos,\ncientíficos, técnicos y de comunicación con sede en la ciudad de Golfito.\n\n    |5º—Que en\nadición a las anteriores acciones, la Asociación Marviva Costa Rica colabora con el\nMinisterio del Ambiente y Energía con Programas de capacitación legal ambiental,\npatrullajes en áreas marinas protegidas, incluyendo el Parque Nacional Marino Las Baulas\nen Guanacaste, así como el Parque Nacional Marino Isla del Coco y logística de\nabastecimiento para patrullajes en el Corredor Marino de Conservación del Pací.co Este\nTropical especialmente en el tramo Isla del Cocos-Coiba.\n\n    6º—Que las labores\nque ha desplegado el Ministerio del Ambiente y Energía con el apoyo de la Asociación\nMarviva In accordance with Article 140, subsections 3) and\n18) and 146 of the Political Constitution, and Article 28 of the General Law of Public\nAdministration Nº 6227.\n\nWhereas:\n\n    1º—That the Rican association, whose purposes are, among\nothers: a) To promote and reinforce the protection of marine, coastal, and mainland\nareas of Costa Rica, and in particular its protected areas. b) To assist the\ncompetent government authorities in the effective application of environmental protection laws and measures. c) To facilitate the necessary resources to collaborate with\npublic authorities in ensuring transparent, disciplined, and efficient environmental protection. d) To carry out the necessary actions to create\nawareness in public opinion about the importance of, and the risks to which, the country's marine, coastal, and mainland areas are subjected. e) To collaborate with\npublic authorities in ensuring transparent, disciplined, and efficient environmental protection. f) To promote the participation and active involvement of\nlocal communities in marine-coastal environmental protection linked to sustainable development. g) To promote the professional training of park rangers and coast guards so that\nthey can perform their duties effectively and with determination, supporting\ngovernment authorities in this aspect and contributing with advisory services and the\nfacilitation of resources to achieve it. h) To publicize, internationally, the ecological\nvalues of protected areas and the importance of their environmental stewardship. i) To\nidentify and facilitate the human resources and scientific equipment necessary to support\nthe protection work carried out by government authorities or the private sector\nin protected areas. j) To provide aid in the event of environmental catastrophes that\nproduce both human and environmental damage.\n\n       4º—That the Ministry of the Environment and Energy,\nthe Ministry of Public Security, and the Asociación Marviva Costa Rica have signed a\nCooperation Agreement, which was approved on August 12, 2004, by the\nComptroller General of the Republic for the protection of coastal marine resources\nthrough the reinforcement and supplementation of the human resources and equipment of both\nministries, in which the Asociación Marviva Costa Rica will contribute, among other things, three\nvessels, one of which will be used for patrols in the Parque Nacional Isla del Coco, hired and paid crews, equipment for the vessels\nand crews, operating, maintenance, and repair costs for the\nvessels, insurance for the vessels and crew, and human and\ntechnical resources for the creation of the Central Support Unit for logistical,\nscientific, technical, and communication aspects based in the city of Golfito.\n\n    5º—That in\naddition to the previous actions, the Asociación Marviva Costa Rica collaborates with the\nMinistry of the Environment and Energy on environmental legal training programs,\npatrols in protected marine areas, including the Parque Nacional Marino Las Baulas\nin Guanacaste, as well as the Parque Nacional Marino Isla del Coco and supply\nlogistics for patrols in the Eastern Tropical Pacific Marine Conservation Corridor,\nespecially in the Isla del Coco-Coiba section.\n\n    6º—That the work\ndeployed by the Ministry of the Environment and Energy with the support of the Asociación\nMarviva Costa Rica is of great value and importance for the conservation of the country's natural resources, due to the facilities that this association has offered the government\nin order to collaborate in the conservation of our protected areas and to supply some\nneeds of the State.\n\n    7º—That it is\nadvisable to declare of public interest the actions deployed by the Asociación\nMarviva Costa Rica in support of government institutions and the environmental welfare\nof the country.
